Abstract

This research aims to find out and analyze Fatwa of the Indonesian Ulema Council number 23 in 2021 regarding the law on implementing swab tests while fasting to detect the presence of Covid-19 during the month of Ramadan. The problems that the author raises in this research are: First, what is the description of the swab test procedure. Second, what is the Fatwa of the Indonesian Ulema Council regarding the law regarding swab tests when fasting to detect Covid-19. This type of research is library research, with a qualitative descriptive method and using a normative juridical approach and a conceptual approach. The research results found were as follows; First, the swab test is part of the PCR (Polymerase Chain Reaction) test which is used to get a diagnosis of whether someone is infected with the Covid-19 virus or not and is one of the tests that is considered to have the most accurate results. The swab test is carried out by inserting a device in the form of Dacron/rayon into the throat through a person's mouth (oropharynx) and nose (nasopharynx). Second, Fatwa of the Indonesian Ulema Council number 23 in 2021 stipulates that swab tests may be carried out and do not break the fast, in this case it is one of the health protocols during the Covid-19 pandemic in order to break the chain of transmission of Covid-19, including during the month of Ramadan and Muslims who are fasting are allowed to take a Swab test to detect Covid-19.

Abstract

This research was conducted with the aim of understanding the validity of wills based on age standardization from the perspective of the Compilation of Islamic Law and Islamic Law. Including to determine differences in the validity of wills based on age standards from the perspective of the Compilation of Islamic Law and Islamic Law. The type of research used is descriptive qualitative using normative literature and juridical study methods. As for the research results; Firstly, minor children who are not yet mature are allowed to make a will and their will is valid provided that the minor child must be of sound mind. In fact, the will of a small child has no legal basis from the Koran, except for the hadith narrated by Umar bin Khattab ra. that the will of a small child is permissible and is the word of a friend. Second, in the Compilation of Islamic Law it is very clear that a person who will make a will must be at least 21 years old, if the person doing it is not of age, in the Compilation of Islamic Law the will is invalid. Third, there is a difference between the Compilation of Islamic Law and Islamic Law, namely in determining the maturity and legal skills of the will. According to the Compilation of Islamic Law, a person who can make a will is a person who is truly an adult and has the ability to accept perfect laws. From what is seen in society, the age of 19 years is the standard for adulthood and the age of 21 years is the standard for making a will. As for Islamic law, the limits for people who make a will are based on being of age and being of sound mind.

Abstract

This research aims to know and understand the Existence of Hijab as an Effort to Protect Muslim Women from the Maqāṣid al-Syarī'ah Perspective. The purpose of this study is also to find out how the urgency of the hijab is in Islamic law and how the existence of the hijab provides protection for Muslim women, and to find out how the elements of maqāṣid al-syarī'ah in the hijab of Muslim women. The method used in this study to get answers to the problems above is using library research with a qualitative descriptive type of research, using normative and philosophical approaches. The results of the study found that the hijab has an important role in Islam. Some of the urgency of the hijab, namely the hijab as a form of obedience to Allah swt. and His Messenger, the hijab can reduce various kinds of slander, and more importantly the hijab makes women more respectable and protected. Hijab protects women by covering their nakedness and curves and the beauty they have so that they do not cause slander and do not invite lust or dirty thoughts for those who look at them. The hijab order was revealed by Allah swt. certainly has benefit both in this world and in the hereafter. By wearing the hijab, the religion, soul, intellect, property and lineage of a Muslim woman will be maintained.

Abstract

This research aims to find out and understand the legal concept of using haram objects in treatment from the perspective of sectarian scholars. This research is a descriptive qualitative research based on literature (Library research) which is based on relevant texts as an analytical tool, using normative and comparative approach methods. The research results first discuss the emergency limitations of the fuqaha perspective. Furthermore, the results of the study found that: 1) Ulama agrees on the prohibition of seeking treatment with haram objects under normal circumstances without any element of emergency. It's just that they have different opinions in emergencies, some of which absolutely prohibit it, consisting of the majority of Hanafiyah, Malikiyah, Syafi'iyah and Hanabilah scholars. Some Hanafiyah scholars allow it with conditions; 2) The opinion chosen in this matter is permissible with conditions, namely that there is an element of emergency and a recommendation from a trusted Muslim doctor, where it is confirmed that the drug can treat the disease and there is no halal drug that can replace it.

Abstract

This research aims to determine the role of the Al-Qur'an and its influence in shaping Arabic language and literature. The Al-Qur'an has very high miracles, both at the level of content and the language it uses. The height of the language of the Qur'an can be seen in the aspects of phoneme selection, word selection, sentence selection and the effects they cause. This research uses qualitative research which focuses more on aspects of in-depth understanding, using library research methods. The research results found that: The influence of the Al-Qur'an in shaping Arabic language and literature is very large and profound. The language of the Koran is considered the pinnacle of beauty and excellence in the structure of the Arabic language and has made a significant contribution to the development of Arabic literature. The strength and beauty of the language of the Koran has become an inspiration and model for Arabic speakers in developing literary skills and their language, such as the beauty of the language, use of vocabulary and terms, rhetorical style, influence on Arabic poetry, as well as the role of the Al-Qur'an in providing inspiration and guidance for Arab writers and poets in creating literary works.

Abstract

This study aims to determine the legal implications of divorce due to the influence of magic on marital status and how to prove it. The research method used is library research by collecting and analyzing data from various literature. The phenomenon of divorce due to the influence of magic is explained in the Quran, hadiths, and opinions of scholars. The results show that if a husband divorces his wife while under the influence of magic which causes him to lose consciousness and sanity, then the divorce is invalid. However, if the magic only prevents him from doing something else, and he is aware when issuing the divorce, then the divorce is legal. To prove whether a husband's sanity is impaired due to magic, the husband must provide evidence that he has symptoms of being affected by magic which causes him to lose sanity. If the wife suspects her husband divorced her while insane due to magic, the burden of proof is on the wife to prove the husband has symptoms of magic which causes him to lose sanity and divorce her unconsciously. In conclusion, a divorce due to uncontrolled magical influence is invalid, while one done consciously is legal. The burden of proof lies with the husband or wife, depending on who claims insanity due to magic.

Abstract

Major depression is one of the serious psychological problems and can affect a person's quality of life significantly and can hinder individuals from carrying out worship optimally. This study aims to analyze the concept of rukhsah and its implications for people with major depression in the perspective of religious jurisprudence. This research is library research using normative and philosophical approach methods. The results showed that in the perspective of religious jurisprudence, people with major depression get rukhsah to carry out worship according to their conditions. In addition, this study also found several examples of rukhsah in worship such as the loss of worship obligations, replacing worship with lighter ones and getting help from others in carrying out worship. This research makes an important contribution in understanding the concept of rukhsah in religious jurisprudence for people with major depression. These findings can be used as a guideline for people with major depression and religious practitioners in facing challenges in carrying out worship. It is hoped that this research can increase public understanding and awareness and provide practical solutions in fulfilling worship obligations for people with major depression.

Abstract

Many classical and contemporary scholars use al-Maṣlaḥah al-mursalah as a source or method of adopting Islamic law on issues that have not been explained in detail in the texts, whether in the Al-Qur'an or hadith. The aim of the research is to find out the views of Imam al -Syāfi'ī regarding the position of al-maṣlaḥah al- mursalah as a source of law and his opinion about al-maṣlaḥah al-murlah as a source of law in the book al-Risālah. The formulation of the problem raised is; First, what is Imam al-Syāfi'ī's view regarding the position of al-maṣlaḥah al-mursalah as a source of law. Second, what is Imam al-Syāfi'ī's opinion in the book al-Risālah regarding al-maṣlaḥah al-mursalah as a source of law. Researchers use qualitative research with library research methods which focus on the study of manuscripts and texts, using normative and conceptual approach methods. The results can be concluded as follows; Firstly, Iman al-Syāfi'ī does not reject al-maṣlaḥah al-mursalah absolutely, but he considers that the use of this method must be based on several conditions. This opinion is strengthened by the opinion of the scholars of the Second Syāfi'ī school, the results of the researcher's analysis of al-maṣlaḥah al-mursalah as a source of law in the book al-Risālah, that Imam al-Syāfi'ī does not mention the rejection or permissibility of blaspheming with methods or sources the. It is hoped that the implications of this research will be a reference for a mujtahid when he wants to establish a law using the al-maṣlaḥah al-murlah method.

Abstract

This research aims to find out the nature of schizophrenia and the view of Islamic jurisprudence towards people with schizophrenia asmukallaf. The problems that the author raises in this research are: first, what is the nature of schizophrenia; secondly, what is the view of Islamic jurisprudence towards people with schizophrenia asmukallaf. This research uses a qualitative descriptive (non-statistical) type of research, which focuses on the study of manuscripts and texts, using normative and sociological approach methods. The research results found were as follows: first, schizophrenia can cause varying symptoms in each individual, but the core symptoms include delusions, hallucinations, thought disorders and abnormal behavior. Schizophrenia can also cause impairment in an individual's academic, occupational and daily functioning. The factors that cause this disorder consist of genetic, environmental and psychological factors. Second, in the view of Islamic Jurisprudence, people with schizophrenia who have lost their minds are not punished as mukallaf or not burdened with taklif. It is not obligatory to perform prayers and fast. Except for those who still have awareness of their minds, they are obliged to perform prayers and fast. If you are unable to fast, you must replace your fast or pay fidyah. To review the extent of understanding of people with schizophrenia, a diagnosis is needed from professional mental health personnel, both doctors and psychologists. Maliyah obligations such as zakat still apply to guardians of relatives who must pay zakat. Because zakat obligations are related to obligations on assets, not bodies.

Abstract

The study aims to understand the tradition of appasa’bi during the month of Ramadan in Kampung Kacidu, Bantaeng district, from the perspective of Islamic law. This tradition is carried out before, during, and after Ramadan to welcome and be grateful for the holy month. Research uses field research methods with historical, sociological, and normative approaches. Data collection was done through interviews and observations. The results show a long-standing tradition of keeping an eye on the Islamic sharia. People are urged to be careful of religious prohibitions. From the perspective of Islamic law, this tradition is permitted as long as it does not conflict with the Shariah and serves good purposes. Traditional processions include worship, dodol-making, study, and joint prayer. In conclusion, the appasa'bi tradition is an ancestral heritage that remains preserved by promoting Islamic values. Recommendation, the need for socialization relates religious aspects in tradition to the younger generation.
