Abstract

This study investigates the practice of “pernikahan naik” (elopement marriage) in Persada Tongra Village, Terangun District, Gayo Lues Regency, Aceh Province, from the perspectives of Islamic law and customary law. “Pernikahan naik” refers to a traditional form of marriage where a man takes the woman he loves to the home of a religious figure (tengku imem) to be married, often without the consent or knowledge of the woman’s parents. This practice is commonly driven by factors such as lack of parental approval, expensive dowries, family disputes, or premarital pregnancy. Although it appears to violate social and legal norms, in the Gayo community, it has become institutionalized through customary procedures and religious involvement. Using a descriptive qualitative approach, data were collected through observation, interviews, and documentation involving pesantren alumni couples, customary leaders, and religious figures. Data analysis involved reduction, presentation, and conclusion drawing. The findings reveal that pernikahan naik follows several stages: mutual agreement between the couple, elopement to the religious leader’s residence, and the solemnization of the marriage witnessed by community figures. From the standpoint of Islamic law, such marriages are considered valid as long as they fulfill the essential elements (rukun) and conditions (syarat) of nikah. However, from the customary law perspective, this practice is seen as a violation and may incur sanctions, such as a fine of a goat. In the context of Islamic jurisprudence, although pernikahan naik may be normatively accepted, it can be classified as urf fasid (corrupt custom) because it neglects the obligation to honor the bride’s guardian (wali). Therefore, the study recommends the need for comprehensive legal socialization that integrates Islamic law, statutory regulations, and customary values, to mitigate such practices while preserving local wisdom. This research contributes to a broader understanding of how social dynamics, religious values, and customary systems shape the formation of harmonious families within pesantren and indigenous communities.

Abstract

Marriage dispensation is a legal mechanism that allows for exceptions to the minimum age of marriage under certain conditions. This study examines the granting of marriage dispensations at the Jombang Religious Court and their relationship with early marriage and divorce patterns. A juridical-empirical method was applied, including analysis of court administrative data, interviews with judges, and literature review. The findings indicate that, although the number of dispensation requests has declined, the predominant reason remains pregnancy outside of marriage, alongside economic, educational, and cultural factors. Granting these dispensations has significant implications, including increased vulnerability of young couples to school dropout, reproductive health issues, and economic burdens on families. From a legal perspective, the findings highlight a gap between the objectives of Law No. 16/2019 and its implementation in practice. These results provide important insights for policymakers, legal practitioners, and social institutions aiming to reduce child marriage and its adverse consequences.

Abstract

The dynamics of talaq divorce decisions in the Banyuwangi Religious Court reflect a transformation in religious justice practice that moves from a formalistic approach to a more humanist and contextual substantive justice paradigm. This study aims to analyze how judges consider legal, moral, and social aspects in imposing talaq divorce decisions and assess the extent to which substantive justice is realized in the practice of religious justice. The method used is a descriptive-critical qualitative approach with data collection techniques through in-depth interviews with judges and litigants, court observations, and analysis of decision documents. The results of the study show that judges at the Banyuwangi Religious Court have tried to balance juridical and religious moral considerations, although there are still inconsistencies in the determination of alimony and the implementation of mediation. In conclusion, the dynamics of talaq divorce decisions reflect a transformation towards a more humanistic, transparent, and benefit-oriented judicial paradigm. The implication is that it is necessary to strengthen the capacity of judges in the perspective of gender justice, the application of maqasid al-shari'ah, and the establishment of contextual legal considerations guidelines so that talaq divorce decisions are more fair, consistent, and responsive to the social needs of the community

Abstract

Seiring berkembangnya waktu praktik arisan tidak hanya berfungsi sebagai media sosial tetapi juga sebagai instrumen ekonomi yang membantu kebutuhan finansial anggota. Penelitian ini bertujuan untuk memahami bagaimana masyarakat di Desa Pakisan Kecamatan Tlogosari Kabupaten Bondowoso melakukan praktik pengalihan hak giliran arisan dengan cara memberikan ongkos, serta menganalisis praktik tersebut dari perspektif Hukum Ekonomi Syariah. Penelitian ini menggunakan pendekatan kualitatif dengan jenis penelitian studi kasus. Data diperoleh melalui pengamatan langsung, wawancara mendalam dengan ketua dan anggota arisan, serta pengumpulan dokumen terkait. Hasil penelitian menunjukkan bahwa pengalihan hak giliran arisan dilakukan melalui fokus kepada akad jual beli. Dalam praktiknya, terjadi negosiasi antara pihak yang ingin mengalihkan hak dengan pihak yang menerima. Proses ini diawali dengan kesepakatan, kemudian pemberian imbalan dilakukan secara sukarela. Besarnya imbalan biasanya merupakan bagian dari uang arisan, bergantung pada nilai nominal dan kebutuhan kedua belah pihak. Dari perspektif Hukum Ekonomi Syariah, akad jual beli dinilai paling sesuai karena memenuhi syarat dan rukunnya, yaitu adanya penjual, pembeli, objek yang diperjualbelikan, serta ijab dan qabul. Dengan demikian, praktik pengalihan hak giliran arisan dapat dibenarkan secara syariah selama dilaksanakan berdasarkan prinsip sukarela, adanya kesepakatan, serta tidak bertentangan dengan ajaran Islam.

Abstract

The enforcement of electoral laws is a critical element in safeguarding the integrity and legitimacy of democracy in Indonesia. The Election Supervisory Agency (Bawaslu), as the oversight body, plays a central role in ensuring elections are conducted honestly, fairly, and with dignity. However, Bawaslu’s limited authority, confined to issuing recommendations without investigative powers, results in low effectiveness in electoral law enforcement. Coordination through the Integrated Law Enforcement Center (Gakkumdu) is often hindered by bureaucratic complexities, differing interpretations of authority, and tight deadlines, causing many violation cases to stall before reaching the investigation stage. This article examines Bawaslu’s structural weaknesses from juridical perspectives, national case studies, and international comparisons with electoral law enforcement systems in the Philippines, Brazil, and South Africa. The analysis demonstrates that granting Bawaslu limited investigative authority can strengthen electoral justice, expedite legal processes, and enhance public trust in democracy. Institutional reforms integrating oversight, inquiry, and investigative functions are proposed as a solution to achieve effective, independent, and integrity-driven electoral law enforcement, in line with the principles of the rule of law and social justice. Abstract

This study examines the management of professional zakat (zakat profesi) in urban Muslim families in Situbondo, East Java, amid the rise of the gig economy. The research aims to analyze zakat calculation mechanisms, integration with family maintenance obligations (nafakah), impacts on household economic resilience, and propose a family-based redistribution model. Employing a qualitative approach with in-depth interviews and participatory observation of 15 urban families—primarily gig workers such as online motorcycle taxi drivers and freelancers—the study reveals that 80% calculate zakat at 2.5% of net monthly income per MUI Fatwa No. 3/2003, while 60% distribute it directly to eligible relatives to strengthen kinship ties. Nafakah is prioritized by 66.7% of respondents, with 60% viewing zakat as a long-term support strategy. Digital platforms enhance compliance (r = 0.930 correlation with literacy), and integrated management boosts financial resilience in 70% of households. The proposed three-stage model—post-nafakah calculation, hybrid institutional-direct distribution, and maqasid-based evaluation—offers a sharia-compliant, fintech-enabled framework adaptable to income volatility. Findings underscore the need for enhanced syariah literacy, digital infrastructure, and collaborative policies to optimize zakat’s role in urban family welfare.

Abstract

An unofficial marriage is a marriage that fulfills all the pillars and requirements stipulated by Islamic law (fiqh) but is not officially registered with the authorized authorities as stipulated in applicable laws and regulations. Such a marriage is valid only according to religion, but does not align with the Prophet's Hadith, which instructs those marrying to announce their marriage at a wedding reception (feast/tasyakuran). An unofficial marriage is usually performed in the presence of a religious leader (ustad) or community leader as the registrar, or is conducted solely based on customary law. Although the marriage is considered valid under religious law, because it is not legally valid, an unofficial marriage, or an unofficial marriage, has no legal force. Therefore, an unofficial marriage is inherently detrimental and can have negative consequences for those who enter into it, especially for wives and women in general, including for children born from the unofficial marriage.

Abstract

Penelitian ini bertujuan untuk menganalisis mekanisme akad mudharabah yang diterapkan di Koperasi Peternakan Syariah (KTTS) Mitra Subur Desa Karanganyar, Tegal Ampel, serta menilai kesesuaiannya dengan prinsip hukum ekonomi syariah. Metode yang digunakan adalah penelitian lapangan dengan pendekatan kualitatif melalui observasi, wawancara, dan dokumentasi. Hasil penelitian menunjukkan bahwa akad mudharabah di KTTS Mitra Subur dijalankan melalui kontrak tertulis, pendampingan usaha, penyerahan modal berupa hewan ternak, serta pembagian keuntungan sebesar 60% untuk koperasi dan 40% untuk peternak. Meskipun mayoritas ulama tidak membolehkan modal berbentuk barang, praktik di KTTS Mitra Subur yang menimbang bobot awal ternak dapat dianggap sebagai upaya menegaskan nilai modal. Dari perspektif hukum ekonomi syariah, mekanisme tersebut pada dasarnya telah memenuhi rukun dan syarat sah mudharabah, meskipun masih ditemukan kendala berupa rendahnya pemahaman anggota dan risiko kerugian akibat kelalaian pengelola. Temuan ini menegaskan pentingnya peningkatan edukasi dan pengawasan untuk memperkuat implementasi akad mudharabah dalam koperasi syariah guna mendukung kesejahteraan ekonomi masyarakat.

Abstract

This study examines the practice of price discounts in sale and purchase transactions from the perspective of Islamic law within the framework of fiqh muamalah. Discounts are widely applied as a promotional strategy in modern trade to attract consumers by offering price reductions. However, in practice, discounts may raise normative issues, particularly when accompanied by price manipulation, lack of transparency, and misleading promotional practices. This research employs a qualitative library-based approach (library research), utilizing primary sources such as the Qur’an, Sunnah, and classical fiqh muamalah literature, as well as secondary sources including scholarly journals and relevant academic studies. Data analysis is conducted using the Miles and Huberman model through the stages of data reduction, data display, and conclusion drawing. The findings indicate that discounts are fundamentally permissible in Islam when conducted under the contract of al-muwadla’ah and implemented with fairness, transparency, and compliance with the essential pillars and conditions of Islamic sales contracts. Nevertheless, discount practices become inconsistent with Sharia principles when they involve elements of tadlis (deception in price information), gharar (uncertainty regarding the object or quality of goods), or najasy (manipulative promotion creating false market perceptions). Therefore, discounts in commercial transactions are considered valid only when free from fraudulent practices, ensuring mutual consent, honesty, and the achievement of maslahah (public benefit). This study highlights the importance of applying Islamic ethical principles in contemporary marketing practices to preserve justice and integrity in economic transactions..

Abstract

This study examines the granting of custody rights (hadhanah) of a child whohas not yet reached the age of mumayyiz to the father based on a decision ofthe Kraksaan Religious Court, which in principle differs from the generalprovisions of Islamic law and the Compilation of Islamic Law (KHI) thatprioritize the mother as the primary caregiver. The background of this researcharises from the reality of divorce that produces legal consequences concerningchild custody, where the best interest of the child must become the primaryconsideration in determining guardianship rights. This research aims toanalyze the legal considerations used by judges in granting custody to thefather and to assess their conformity with Islamic law perspectives andapplicable legal regulations. The study employs a qualitative field researchmethod, utilizing primary data obtained from field findings and secondarydata from literature, classical fiqh texts, and related legal sources.The findings indicate that although normatively a child who has not yetreached mumayyiz age is entitled to maternal custody, such rights may beforfeited if the mother fails to meet the qualifications of a proper guardian(hadhin), such as abandoning the child, failing to appear in court proceedings,or being unable to ensure the child’s physical and psychological welfare. Inthe case examined, the judge granted custody to the father after consideringtrial facts demonstrating that the mother had left the child and did not showresponsibility for caregiving. This decision was grounded in the MarriageLaw, the KHI, and the opinions of Islamic jurists emphasizing that the child’swelfare and best interest constitute the primary principle in custodydetermination.In conclusion, the judicial decision granting custody to the father does notcontradict Islamic law insofar as it is based on the child’s welfare and themother’s unfitness as a caregiver. This study underscores that the protectionand well-being of the child must remain the central orientation in resolvingcustody disputes, beyond general normative assumptions.Keywords:
