Abstract

Election criminal acts are closely related when entering the current political year, general election crimes are all criminal acts related to the holding of general elections both regulated in and outside the electoral law. This study aims to determine the investigation as well as the obstacles in investigating election criminal acts using official cars in Purworejo Regency. This research uses normative research with descriptive research methods. The approach used is the statute approach and case approach. This research was conducted at Purworejo District Police, Purworejo Regency KPU, and Purworejo Regency Bawaslu. The type of data used is primary and secondary data. Primary data sources from interviews and observations, secondary data sources from primary legal materials and secondary legal materials. The data analysis technique used is qualitative descriptive analysis. The results of research on election crime cases deliberately violated the prohibition of the implementation of the election campaign by using government facilities in the form of official cars by the suspect Endang Tavip Handayani, SH binti Suparno based on Purworejo District Court Decree No: 31  Pid.Sus.  2019  PN Pwr, impose a sentence on the Defendant for 1 (one) month and a fine of  ten million rupiah provided that if the fine is not paid, it is replaced with imprisonment for 15  days with a trial period of 3 (three months. Based on the decision of the Central Java High Court No: 134  Pid.Sus  2019  PT SMG sentenced the defendant to imprisonment for 1  month and a fine of Rp five million rupiah with the provisions if the fine Unpaid is replaced by imprisonment for 15  days. KPU Decision No: 1040  HK.03.1Kpt  3306  Kab  V  2019 states removing the candidate from the permanent candidate list.

Abstract

Abstract In this thesis the author takes the title Function of Information Management and Documentation Officials (PPID) in providing Public Information Services in the Special Region of Yogyakarta. This study discusses how the main PPID is in providing information services in the Special Region of Yogyakarta based on the provisions of the applicable legislation. By using normative research methods and approaches to legislation and conceptual and qualitative data processing, it is concluded that the main PPID in the Department of Communications and Information Technology DIY has implemented Law Number 14 of 2008 concerning Public Information Disclosure. However, there are several factors that influence PPID in carrying out its function in realizing public information services in DIY including Juridical factors, Structural factors, Apparatus factors / Service Officers. Some of these factors are also obstacles faced by PPID in implementing Law No. 14 of 2008 concerning Openness of Public Information, namely, the low commitment of the leadership of public agencies, limited Personnel / Human Resources (HR) who specifically handle the provision and management of public information. information services in several OPDs within the DIY Regional Government, including an understanding of the duties and functions of some OPDs regarding the provision of a Public Information List and a list of excluded information and related to inadequate budgets

Abstract

Terorisme selalu menjadi ancaman yang menakutkan bagi semua orang, baik pemerintah maupun masyarakat. Pemerintah mengeluarkan Undang-Undang nomor 5 Tahun 2018 dan menugaskan Densus 88 Antiteror Polri untuk menanggulangi dan memberantas tindak pidana terorisme. Densus 88 Antiteror dalam penanganan pencegahan cenderung menggunakan kebijakan non penal yang bertujuan untuk mengubah paham radikal yang dianut oleh teroris dan keluarganya agar tidak kembali melakukan tindak pidana terorisme. Penelitian ini menggunakan jenis penelitian normatif yang diperkuat dengan rangkaian wawancara terstruktur yang telah ditentukan terlebih dahulu dengan pertanyaan dan narasumber sesuai dengan aspek dan masalah yang diteliti.Pengumpulan data dilakukan dengan cara wawancara dengan narasumber di Mabes Polri dan studi pustaka. Data yang diperoleh dianalisis dengan metode deskriptif analitis.Dari hasil analisis data dapat disimpulkan bahwa: (a) Peran Densus 88 Anti Teror dalam Kebijakan Non Penal Sebagai Upaya Pencegahan Tindak Pidana Terorisme di Wilayah Hukum Polda DIY adalah untuk melakukan deradikalisasi dan pelepasan (breaking network) dengan kelompok atau jaringan dengan tujuan agar tidak terjerat kembali ke dalam lingkaran terorisme menunjukkan hasil yang signifikan namun masih ada yang mengingatkan dalam pemahaman radikalnya. (b) Resistensi kebijakan non penal dari Densus 88 Antiteror untuk pencegahan tindak pidana terorisme di wilayah hukum Polda DIY kedepannya adalah semakin banyaknya target untuk tindakan pencegahan terorisme, narapidana juga tidak diharuskan untuk mengikuti tahap deradikalisasi, tahap deradikalisasi hanya wajib jika narapidana yang akan mengajukan pembebasan bersyarat, dan semakin pesatnya kemajuan teknologi dalam penyebaran radikalisme

Abstract

Tindak pidana penjara yang diberikan kepada pelaku narkotika dengan tidak membedakan, apakah diberikan kepada pengedar narkoba atau pecandu narkoba dapat menyebabkan munculnya sel-sel gelap narkotika baru. Belakangan ini banyak bermunculan zat psikoaktif baru yang berpotensi disalahgunakan dan membahayakan kesehatan masyarakat yang telah masuk dalam golongan narkotika.Di sisi lain, tim penilai terpadu berpedoman pada Surat Edaran Mahkamah Agung No. 04 Tahun 2010 sehingga menimbulkan perbedaan pendapat di antara tim hukum dalam menganalisis rekomendasi. Tim Penilai Terpadu diposisikan sebagai asesor yang bertugas memberikan rekomendasi kepada hakim mengenai tingkat ketergantungan narkotika dan keterlibatan tersangka dalam tindak pidana narkotika. Jadi, melalui rekomendasi Tim Penilai Terpadu, tindakan terhadap penyalahgunaan narkotika dapat diklasifikasikan dan disesuaikan. Namun, akhir dari keputusan hukum tetap di tangan hakim yang memimpin kasus tersebut.Masalah dan tujuan penelitian ini untuk menganalisis secara jelas rekomendasi Tim Penilai Terpadu dapat menjadi bagian dari putusan hakim bagi korban penyalahguna narkotika Untuk menganalisis hambatan dan konsep ideal dalam proses penanganan narkotika melalui Tim Penilai Terpadu.Berdasarkan hasil penelitian dan pembahasan, penerapan asesmen terpadu menghasilkan rekomendasi mengenai rencana penempatan ke dalam instalasi rehabilitasi yang sekaligus menjadi dokumen persidangan untuk memperkuat dasar pertimbangan hakim dalam memutus perkara. Kendala yang terjadi umumnya karena faktor penegak hukum yang masih memiliki persepsi yang berbeda dalam menentukan penerapan penilaian penyalahguna narkotika dan faktor sarana dan prasarana di masing-masing BNNP masih terbatas

Abstract

The Development of information technology influences social changes that are significant and take place so fast. Currently information technology in addition to contributing to the advancement of human civilization is also at once a means that can lead to unlawful acts. Currently information technology in addition to contributing to the advancement of human civilization is also at once a means that can lead to unlawful acts. Under these conditions vulnerable violations of defamation and defamatioan through social media, as people often misuse their freedom of expression. This research is conducted by using the normative juridical approach is the approach done based on the main legal material by studying the theories, concepts, legal principles and legislation related to this research. This approach is also known as the literature approach, by studying books, legislation and other documents relating to this research.The regulation on defation trough social media in act number 19 of 2016 concerning amendment to law number 11 year 2008 concerning information and electronic transactions is contained in article 27 paragraph  and article 45 paragraph  and paragraph . In article paragraph regulaties the prohibited act which is categorized in the offense of defamation or defamation while in article 45 regulates the criminal provisions. Law number 19 year 2016 on amandement to law number 11 year 2008 on information and electronic transactions does not stipulate restriction on opinion trough social media that may cteate muliple interpretations. Judging from the type of punishment is possible for the existence of alternative types of criminal other than imprisonment, namely social work crime and criminal supervision. Both types of crime are considered more effective and provide prospects of coaching so that the purpose of criminal punishment in the form of community protection and protection of onvicts can be achieved.Keywords : Yuridical Review, criminal defamation, social media

Abstract

The province of Papua, which is geographically located on the eastern Indonesia, is the largest province with abundant natural resources. But in reality various policies in centralized governance and development have not fully fulfilled the sense of justice, have not fully enabled the achievement of people welfare, have not fully supported the realization of law enforcement, and have not fully demonstrated respect for human rights in Papua Province, especially the Papuan people. These conditions caused disparities in almost all sectors of life, especially in education, health, economics, culture and social politics, so the Government tried to overcome these problems by providing policies with Special Autonomy in Papua Province. In 2001 the Government legalized the Law No. 21 of 2001, On Special Autonomy for the Papua Province in order to ensure equal distribution of public welfare.Purpose of this study is to find out the implementation of the special autonomy law in the Papua Province in realizing the welfare of the Papuan people. Also to know the obstacle factors faced in the implementation of the special autonomy law in Papua Province. And to find out what solutions are carried out by the Regional Government of the Province of Papua to overcome the problems in the implementation of the special autonomy law.The methods that used in this study are by determine the subject and object of the study, the characteristic of the study, types and sources of data, data collection techniques, and data analysis methods.The results of this study are based on conclusions, namely: 1The implementation of the special autonomy law in the Papua Province has been carried out in accordance with the direction of the Central Government. However, in realizing social welfare for the Papuan people, they still need the struggle and hard work of all elements of people and the local Government in Papua Province; 2 Obstacle factors that came up due to inconsistencies of the Central Government and the Papua Local Government have not been able to apply Special Autonomy maximally; and 3 what the Central Government has to do is to seriously implement this law consistently, avoiding policies that can result in collision of interpretation with the Special Autonomy law. So that the suggestions are 1the Central Government is expected to not carry out policies that collide with special Autonomy laws; 2 The Local Government needs to do two things, namely the realignment of the regional government management system, and the improvement of managerial capacity for regional government officials; and 3 There needs to be a separation between the special autonomy law of Papua Province and West Papua Province.

Abstract

The existence of an online motorcycle taxi that uses the telephone to work is a form of violation of Law Number 22 Year 2009 Regarding Traffic and Road Transportation. Drivers must be careful when using the phone while driving, because when driving while using a telephone, the driver can be punished by the police, and could endanger other drivers. This research is a normative legal research that is a library research using a normative juridical approach, besides using supporting data that is conducting interviews with SatlantasSleman Police as a resource and conducting interviews with online motorcycle taxi drivers as respondents of this study. After an analysis of all of them, it can be concluded that the online motorcycle taxi drivers who put the phone on the motorcycle are considered to violate traffic, because of obvious reasons the driver uses the phone, namely to work or look for orders. Interpretation of Law Number 22 Year 2009 Regarding Traffic and Road Transportation in article 106 states that motorists are prohibited from using the telephone while driving. Although according to the Sleman Yogyakarta Police, they stated that they did not violate traffic because there were no clear rules forbidding placing the telephone in a vehicle.

Abstract

Optimalisasi Pendapatan Asli Daerah merupakan aspek penting dalam pelaksanaan pembangunan di daerah karena semenjak berlakunya otonomi daerah, pemerintah daerah tidak lagi tergantung pada pemerintah pusat dalam melaksanakan pembangunan. PAD yang semakin besar tentunya akan memberikan kesempatan yang luas bagi daerah untuk melaksanakan pembangunan guna meningkatkan kesejahteraan masyarakat. Penelitian ini bertujuan untuk 1 mengetahui faktor yang menjadi pertimbangan dalam menentukan pilihan bentuk hukum BUMD di Kota Magelang 2 Mengetahui upaya yang dilakukan BUMD dalam memberikan kontribusi dalam meningkatkan Pendapatan Asli Daerah di Kota Magelang 3 Mengetahui kendala bagi Pemerintah Kota Magelang dalam menjalankan usaha melalui BUMD. Penelitian ini merupakan penelitian normatif yuridis dengan metode pendekatan yang digunakan dalam penelitian ini adalah pendekatan undang-undang. Data yang diperlukan terdiri dari data primer dan data sekunder. Metode analisis yang dilakukan dengan analisis kualitatif yaitu suatu metode analisis yang dilakukan dengan memberikan gambaran yang lebih jelas mengenai masalah yang diteliti. Berdasarkan hasil penelitian, maka kesimpulan dari penelitian ini adalah sebagai berikut 1 faktor-faktor yang menjadi pertimbangan dalam menentukan pilihan bentuk hukum BUMD di Kota Magelang yaitu  a Faktor kepemilikan modal usaha perusahaan daerah hanya di miliki oleh Pemerintah Daerah Kota Magelang b Faktor batas wewenang dan tanggung jawab pemilik, dimana dengan dimensi tanggung jawab perusahaan daerah untuk mendapatkan keuntungan dan sekaligus pelayanan sosial guna membantu pembangunan di daerah, maka kebijakan-kebijakan yang menyangkut masyarakat, berada di kewenangan Kepala Daerah Kota Magelang 2 Upaya-upaya yang dilakukan agar BUMD Kota Magelang dapat memberikan kontribusi dalam meningkatkan pendapatan asli daerah yaitu a Meningkatkan pendapatan dengan cara mengadakan perubahan dan inovasi di perusahaan daerah b Mengelola perusahaan secara efektif dan efisien, dimana biaya-biaya yang masih dpaat ditunda, maka kebijakan yang ditempuh dengan cara mengalokasi dananya pada hal-hal yang lebih prioritas 3 Yang menjadi kendala bagi Pemerintah Daerah Kota Magelang dalam menjalankan usaha.

Abstract

The purpose of this study is to find out how the mechanism of the investigation process by the police against people with mental disorders who commit crimes. Because it takes maximum effort and cooperation between various parties in handling people with mental disorders who commit crimes, so that the right decision can be made to provide action against the perpetrators. The results of this study indicate that the process of investigation by the police against people with mental disorders who have committed crimes often experiences many obstacles and obstacles so that the legal certainty is unclear.

Abstract

This research aims to determine the quality of public services in the health by conducting a case study of health services at Palue Health Center, analyzing constraints that hinder optimization of health services and offering solutions as an effort to resolve these problems so that health services in Palue Health Center can be optimal.The research is descriptive and empirical research, the approach method used is empirical juridical approach. The research is located in Palue Health Center, Palue District, Sikka Regency, East Nusa Tenggara Province. Primary data collection by observation and interview techniques, secondary by library research. The research result were analyzed by qualitative methods and presented descriptively. Public services in the health sector at Palue Health Center have not been optimal. This is based on 5 five basic health service requirements and 5 five public service indicators Parasuraman et al. and 4 four indicators of the fulfillment of the right to health. Constraints that cause health services are not optimal, among others, facilities and infrastructure that are inadequate, incomplete and damaged, lack of workforce, competency in human resources and community participation in appreciating services held by Palue Health Center and government policies that hamper improvement service quality. Efforts to optimize health service including improving and completing advice and infrastructure, to increase the competency of health and non-health workers in accordance with The Minimum Standard of Health Service in The District City and government policies that accommodate the fullfilment of the rights of Palue Health Center and remote and very remote areas based on applicable laws and regulations.
