Abstract

The National Police of the Republic of Indonesia is given a very broad authority in carrying out its duties as the main task of the National Police, among others Harkamtibmas, Protecting, Mengayami, Serving the community and Law Enforcement, in which it is also given another authority that is discretionary police an authority to perform actions based on the conscience of police members on duty and supported by the rules that exist in police institutions. The issue that will be discussed is whether the concept of Restorative Justice in accordance with the Circular letter of the Police Chief Number SE/2/II/2021 on Ethical Cultural Awareness to Realize a Clean Digital Space of Indonesia, Healthy, and Productive can be applied in accordance with the Law of the Republic of Indonesia No. 19 of 2016 Amendments to Law No. 11 of 2008 on Information and Electronic Transactions and Criminal Defamation regulated in the Criminal Code as an alternative to suppress cybercrime, but also must be able to as a deterrent effect in order to provide protection for the human rights of others.

Abstract

Human rights are basic rights or basic rights that humans are born with as a gift from God Almighty. These human rights form the basis of other rights and obligations. As is known, in addition to human rights, there are human rights that in our social life should receive attention first in their implementation. We must fulfill our obligations first, then demand rights.In an individualistic society, there is a tendency for excessive prosecution of the implementation of these human rights, even though the implementation of human rights cannot be demanded absolute implementation because the prosecution of the absolute implementation of human rights means violating the same human rights of other people. For example, print and television news reporters often use argumentation in finding or interviewing artists who have personal problems, these reporters dig and interview artists down to the most personal issues in the artist's life, and if the artist refuses or is angry, the answer is the journalist is carrying out his journalistic duties and they demand that their human rights be fulfilled or obeyed so that the artist must tell his problem.Here it can be seen that on the journalist's side, he demands that his human rights be fulfilled, on the other hand, it can be seen that the artist's human rights are trampled on by the journalists, which means that the artist's human rights are being violated by the journalists. The question is: Where is the legality of human rights and moral rationalism?

Abstract

Abstract

The act of counterfeiting excise stamps is not too much of a concern in the community because, in general, people are more interested in big problems or big cases such as crime, terrorism, corruption, and so on. As in the United States, it has offered, delivered, sold, or made available for sale excisable goods that are not packaged for retailers, are not attached with excise stamps, or are not affixed with other excise payment signs in the form of 273,162 cigarettes, as referred to in Article 54 of the Law. Law No.39 of 2007 concerning amendments to Law No.11 of 1995 concerning Excise For his actions, the defendant was sentenced to prison and a fine of twice the excise value. The research method in this paper uses normative and empirical legal research, which is one type of legal research, namely by examining library materials or secondary data of a legal nature. At trial, the panel of judges did not find anything that could absolve the defendant of criminal liability, either as a justification or an excuse, so the defendant must be held accountable for his actions. Because the defendant is capable of being responsible, he must be found guilty and sentenced.

Abstract

Pemerintah mempunyai kewajiban untuk menyelenggarakan pelayanan publik yang baik kepada masyarakat. UUD 1945 alinea empat mengamanatkan tentang aspek pelayanan pokok aparatur terhadap masyarakat. Hal tersebut juga diatur dalam UU No. 25 Tahun 2009 tentang Pelayanan Publik yang menjamin hak masyarakat atas pelayanan publik yang baik. Hanya saja, hal ini tidak sesuai dengan yang terjadi. Pada faktanya, masih banyak pelayanan publik yang buruk hingga praktik mal administrasi yang pada akhirnya merugikan masyarakat. Pemerintah berkewajiban menangani penyelenggaraan pelayanan publik yang tidak sesuai dengan aturan yang berlaku. Bentuk penanganan dan pengawasan pemerintah dalam hal ini adalah mendirikan lembaga negara yang independen yang bertugas mengawasi jalannya penyelenggaraan pelayanan publik. Dalam rangka mengawasi kinerja pelayanan publik di daerah saat ini, didirikan lembaga Ombudsman Daerah. Penelitian ini bertujuan untuk mengetahui peran Ombudsman Republik Indonesia Perwakilan Daerah Istimewa Yogyakarta dalam pengawasan penyelenggaraan pelayanan publik.Penelitian ini merupakan penelitian hukum normatif yang dianalisis menggunakan analisis kualitatif. Teknik pengumpulan data menggunakan teknik wawancara, observasi dan studi dokumentasi. Hasil penelitian menunjukkan Ombudsman Republik Indonesia menurut fungsi kelembagaan merupakan lembaga penunjang dalam ranah kekuasaan legislatif dan yudikatif. Ia berperan sebagai lembaga pengawas sekaligus merupakan wadah yang menjembatani antara masyarakat dan pemerintah atas tindakan penyimpangan administrasi yang dilakukan oleh pejabat penyelenggaraan pelayanan publik. Pelaksanaan wewenang pengawasan Ombudsman Republik Indonesia Perwakilan Daerah Istimewa Yogyakarta dalam pelayanan publik ada faktor pendukung dan penghambat, yang menjadi faktor pendukung yaitu meningkatnya pemahaman masyarakat, terutama generasi mudah, semakin mudahnya melaporkan dan dukungan dari lembaga pengawas lain. Faktor penghambat yaitu terbatasnya anggaran, sumber daya manusia, serta infrastruktur.

Abstract

The primary purpose of this research is to examine and find out the causes of the concept of urgency compelling in the formation of Peraturan Pemerintah Pengganti Undang-Undang (Perppu) Number 1 of 2022 to replace Law Number 7 of 2017 concerning general elections in Papua. The approach method used is normative juridical. This approach is intended to be a type of descriptive research concerning laws. Furthermore, the specification of this research is descriptive-analytical. Methods of data collection using library research that tests the document materials and library materials used in this study. The data were analyzed qualitatively normative, namely conducting research by interpreting and constructing statements contained in statutory regulations.This research discusses the formation of government regulation in lieu of law for changes to law Number 7 of 2017 concerning general elections in Papua, considering that extraordinary policies and steps are needed to anticipate the impact of the formation of four new provinces namely South Papua, Central Papua, Papua Mountains, and Southwest Papua. It is intended that the 2024 Election will continue according to schedule and stages so as to create domestic political stability.

Abstract

This study aims to analyze the establishment of a special general election Judiciary and to analyze if the special Judiciary can take over the constitutional court’s authority in handling the electoral disputes without going through changes to Article 24-C of the 1945 Constitution especially paragraph 1. The approach applied in order to answer the problems and objectives of this research was a normative juridical approach. This study employed several approaches to legal issues including the Statutory Approach, the Conceptual Approach, and the Historical Approach. The results of this study explain that although it has been mandated in Article 157 paragraph (1-2) of Law No. 10 of 2016 on a special general election Judiciary. However, the constitutional court’s authority is still well-maintained until the 2024 general elections or amendments to Article 24-C to such an extent that it concerns electoral disputes. The constitutional authority cannot be transferred immediately to the Special Courts according to Articles 156 and 157 of Law No. 10 of 2016 because there is no amendment to Article 24-C. Therefore, the constitutional court’s authority is still well-maintained until the special court is regulated by a special law.

Abstract

Islamic law has always been defined as a law that is religious and sacred, which replaces a durable law. Among the interesting questions about the adaptation of Islamic law with social developments that often occur at the base of questions concerning human beings before the sharia text. The consideration is: can Islamic law be developed by human  reason or Islamic law is only taken eternally determined by God with what Islamic legal principles can be changed by social change? What developments in Islamic law can affect social change?In the course of its history, Islamic law is a dynamic and creative force, this can be seen from the instructions of the Prophet Muhammad to his friends in dealing with the sociological reality of the people at that time. But after the Prophet Muhammad died, new problems began to emerge. At the time of the ijtihad friends began to be promoted so that various interpretations emerged, the legal practice fatwa that was exemplified by the Messenger of Allah, was considered not only as a legal decision of a judge in a court of law, but also as a guide in solving problems.Society with a variety of dynamics that exist requires social change, and every social change generally requires a change in the value system and law, To oversee Islamic law remains dynamic, responsive and has a high adaptability to the demands of change, is to revive and revive the spirit berijtihad among Muslims. In this position ijtihad is an inner dynamic for the birth of change to oversee the ideals of the universality of Islam as a system of teachings that shalihun li kulli times eat. Muslims are fully aware that the source of normative-textual law is very limited in number, while new cases in the field of law are unlimited.From this explanation, it can be concluded that: firstly, Islamic law can be developed through the power of human reason, because the verse itself contains qaṭ’ī and ẓannī. Second, the tool that can be used by humans in developing Islamic law is ijtihad by using a ratio that is equipped with scientific methodological tools so that the results obtained can be justified scientifically.

Abstract

Indonesia is a unitary state or negara kesatuan. One of the characteristics of a unitary state is the concentration of all forms of policy on the central government. In other words, the central government has very broad authority in regulating policies in the regions. On the other hand, policies that tend to be more centralized can cause injustice to diversity in the regions, especially for Indonesia, which is geographically an archipelagic country that has very diverse customs and cultures, so the needs in each region are very complex.Therefore, this paper offers a system of residual asymmetric decentralization that can be applied in Indonesia by rigidly dividing the authority of the central and regional governments. Such a division of authority is an urgent matter so that there is no longer any authority overlap between the central and regional governments. Besides that, the distribution of authority in this way can also further emphasize the characteristics of decentralization within the framework of the Unitary State of the Republic of Indonesia.
