Abstract

Criminal acts can encourage other people to commit crimes, because many parties involved in criminal acts such as receiving, buying or accommodating goods from the crime of theft. The problem in research is what is the factor that causes the perpetrators to commit criminal acts of rubber gum extraction at PT. Perkebunan Nusantara VII Unit Kedaton, Sabah Balau village, Tanjung Bintang Subdistrict, South Lampung Regency, how to apply criminal sanctions against perpetrators of criminal acts of rubber latex in PT. Perkebunan Nusantara VII Unit Kedaton, Sabah Balau village, Tanjung Bintang Subdistrict, South Lampung Regency, based on Decision Number 313 / Pid.B / 2018 / Pn.Kla and How is the crime prevention effort for perpetrators of criminal acts of rubber latex in PT. Perkebunan Nusantara VII Unit Kedaton, Sabah Balau village, Tanjung Bintang District, South Lampung Regency. The judge should give criminal sanctions to the defendant to consider juridical factors as stipulated in the law. It is expected that the related law Enforcement officers will be more professional in carrying out their duties in upholding the law against perpetrators of fraud in office, and the public has legal awareness to report immediately if there is a similar crime.

Abstract

The international community has succeeded in compiling a law of the sea to regulate all forms of use of the sea as well as the benefits of the natural resources contained therein as outlined in the form of an agreement between States as known as United Nations Convention on the Law of the Sea 1982. The sea is divided into several parts / zones, namely the territorial sea, internal waters, contiguous zones, archipelagic waters, the exclusive economic zone and the high seas. The exclusive economic zone is an area beyond and adjacent to the territorial sea, subject to the specific legal regime established in this Part, under which the rights and jurisdiction of the coastal State and the rights and freedoms of other States are governed by the relevant provisions of this Convention. In the exclusive economic zone, coastal countries have sovereign rights for exploration and exploitation purposes, conservation and management of natural resources, both living and non-living, from the waters above the seabed and from the seabed and the land below and with respect to other activities for the purposes of exploration and economic exploitation of the zone, such as energy production from water, currents and wind; jurisdiction as defined in the relevant provisions of this Convention with respect to the creation and use of artificial islands, installations and structures, marine scientific research and the protection and preservation of the marine environment. Abstract

ABSTRACT Breastmilk, which is called as Exclusive Breastmilk is given to baby since the day baby is born until 6 (six) months without adding and / or replacing with other foods or beverages. Governments are responsible for setting policy in order to guarantee the right of infants and children to get the exclusive breastmilk. Regulatory Policy Regions in Lampung Province related to exclusive breastfeeding is still less effective. Coverage of babies who get exclusive breastfeeding in Lampung Province in 2015 is amounted to 57.70%, which is still below the figure from the expected target as 80%. The Government policy on provision of special breastfeeding facilities in the workplace and public facilities for its implementation has not been fully implemented in accordance with the provisions prevailing laws and regulations. Particularly in the Province of Lampung, based on the observation of researchers, there is an office providing nursery room, but the standard is not good enough and also the facilities in it are not yet eligible. In line with that, the nursery room which exist in public places like terminal, shopping center, tourist attractions, hotels still do not provide specific facilities for breastfeeding activity. The law enforcement against the disfunction of working places and public places which do not provide nursery room like private sector, government offices, regional government as well is still going on. As the conclusion, the lack of opportunity given by the respective institutions still reflect that breastfeeding mothers still have no proper opportunity to deliver their rights in using the facilities. It also could be said that the regulation has not been running the way it should be regarding the existing regulations.

Abstract

Bandar Lampung Government Regulation Number 13 year 2013 about the Formation of Organization and Working Procedure of Government task force unit in Bandar Lampung regulates tasks and functions of Government task force unit in Bandar Lampung. Government task force unit has important roles in maintaining public security and orderliness and to enforce regional law products. According to that job descriptions, Government task force unitconducts disciplining actions upon any violation of public safety and orderliness as well as upon any regional law product.The research problem was the function of Government task force unit in disciplining small vendors and inhibiting factors for Government task force unit in disciplining small vendors.This research used normative and empirical jurisdiction and criminology approaches with primary and secondary data collected from literary study and from the field respectively. The researchersconcluded that the Bandar Lampung Regional Regulation was not yet optimal because Government task force unit had conducted its tasks to help the Major in safety and orderliness by enforcing the Regional Regulations but there were many stret vendors did not understand this Regional Regulation, yet they finally did this government policy with particular compensations.

Abstract

This research examines the urgency of Village Regulations as a basis To realizedisaster resilient villages based on the understanding that villages as community disaster resilents, this research will identify village regulations as potential legal instruments governing disaster risk management. The research methods used are normative and empirical research, while data collection required will be carried out through studies. document. The results show that village regulations are a legal instrument needed to implement disaster resilient communities, village regulations serve as the basis for strengthening disaster resilient villages and serve as guidelines in communities at village level resilient to disasters, village regulations are also the key to overcoming community vulnerability to disasters Basically, the risk is managed through strengthening coordination and increasing the capacity of village government officials. This research was conducted in South Lampung Regency in a village that was affected by the 2018 tsunami disaster. The contribution of this research is to encourage the village government as the leading government organizing entity to build disaster awareness through village regulations as a legal instrument to form a disaster management-based framework.

Abstract

In the current practice in Indonesia, the government places licensing as a form of obligation that must be fulfilled by business actors to be able to carry out business activities legally (license approach). The complicated problem of doing business in Indonesia is caused by so many regulations (over-regulated) in the licensing sector whose substance is not harmonious, overlaps, and even contradicts one another. Such regulations create a long and complicated licensing system that results in the investment climate in Indonesia becoming ineffective, inefficient, and not providing legal certainty. The working mechanism of business services in Indonesia is considered to take a long time, is not transparent, is not informative, has limited service facilities and infrastructure so that which requires high costs. The urgency of licensing redesign is motivated by the weak investment competitiveness and growth of the private sector in Indonesia. The big agenda of building a productive investment-based economy is threatened to run aground or move slowly if all the blockages in the administrative and policy spheres are not carried out by reconstruction. Policy improvements to simplify business licensing, which are carried out in a relatively short time, uncomplicated procedures, and low costs for establishing, operating, and developing businesses are expected conditions. By implementing risk-based regulations as a reference for determining the type of business licensing accompanied by the implementation of inspections for effective control, will simplify the business licensing mechanism and will ultimately provide economic, social, and environmental benefits.

Abstract

The main focus of this research is the factors that cause criminal acts, participate in marketing timber from illegal logging and the application of environmental criminal law to the perpetrators of criminal acts and participate in marketing timber from illegal logging. The research method used in this research is juridical normative and empirical. Based on the research results, it was found that the causes of illegal logging in Cikolak Teluk Pandan Village, Pesawaran District, included internal factors including educational factors, personal factors, biological pathogenic factors and pneumonia. External factors include environmental factors, lack of protection, lack of community empowerment, global development factors and economic factors. Enforcement of environmental criminal law against perpetrators of criminal acts by participating in marketing timber from illegal logging, namely imprisonment for 1 (one) year and a fine of Rp. 500,000,000.00 (five hundred million rupiah) provided that if the fine is not paid, it will be replaced by imprisonment for 2 (two) months.

Abstract

Tindakan mengedarkan benih lobster keluar wilayah Negara Republik Indonesia masuk dalam kategori penyelundupan. Permasalahan dalam penelitian ini adalah Apakah faktor terjadinya tindak pidana mengedarkan hasil pengelolaan benih lobster ke luar wilayah Republik Indonesia berdasarkan putusan Nomor 731/Pid.B/LH/2019/PN.Tjk, Bagaimana pertanggungjawaban terhadap tindak pidana mengedarkan hasil pengelolaan benih lobster ke luar wilayah Republik Indonesia berdasarkan putusan Nomor 731/Pid.B/LH/2019/PN.Tjk. Metode Penelitian yang digunakan adalah,pendekatan Yuridis Normatif dan pendekatan Empiris. Prosedur pengumpulan data terdiri dari studi kepustakaan (Library Research) dan studi lapangan (Field Research). Sedangkan pengolahan data dilakukan dengan metode editing, sistematisasi, dan klasifikasi data. Analisis yang digunakan adalah kualitatif. Berdasarkan hasil penelitian faktor terjadinya tindak pidana mengedarkan hasil pengelolaan benih lobster didasari pada faktor internal pelaku tidak mengetahui larangan mengedarkan benih lobster dan faktor eksternal didasari atas ekonomi. Kemudian pertanggungjawaban terhadap pelaku tindak pidana mengedarkan hasil pengelolaan pelaku divonis berdasarkan Pasal 88 juncto Pasal 16 ayat (1) Undang-Undang Nomor 31 tahun 2004 sebagaimana yang telah diubah dengan Undang-Undang Nomor 45 tahun 2009 tentang Perikanan dengan pidana penjara selama 10 (sepuluh) bulan dan hukuman denda sebesar Rp.25.000.000,- (Dua puluh lima juta rupiah). Saran dalam penelitian ini adalah, Pemerintah harus menyediakan lapangan pekerjaan untuk menggantikan sumber mata pencaharian masyarakat. Kemudian direkomendasikan kepada penegak hukum untuk melakukan upaya prefentif atau pencegahan.

Abstract

The act of destruction of goods in this case is a motorcycle is one form of lawlessness, which is regulated in Article 406 paragraph (1) of the Criminal Code. The problem is how criminal accountability for the perpetrators of motorcycle destruction and how the judge's consideration in the enforcement of the verdict against the perpetrator of the motorcycle destruction crime. Data collection is based on literature studies and field studies, while data processing is done by editing methods, classification and systematization of data, then analyzed using qualitative analysis. The results of the study showed that criminal liability against the perpetrators of motorcycle destruction crimes has been proven legitimately and convinced guilty of committing criminal acts of destruction and criminally convicted defendants therefore with a prison sentence of 1 (one) year each and the basis of the judge's consideration in the enforcement of the verdict against the perpetrator of the crime of bicycle destruction, among others, evidence,  Witness statements, expert testimony, indictments and demands of the Public Prosecutor, elements that meet in the Prosecutor's Indictment, as well as incriminating and mitigating matters in the accused

Abstract

Abstrak Penghibahan termasuk perjanjian dengan sukarela, ditujukan pada hanya adanya prestasi dari satu pihak saja, sedang pihak yang lainnya tidak perlu memberikan kontraprestasi sebagai balasannya. Penelitian ini bertujuan untuk menganalisis dan memberikan pemahaman tentang prosedur hibah agar mempunyai kekuatan hukum, serta memberikan pemahaman mengenai perbandingan terhadap hibah yang dilakukan dibawah tangan dan hibah yang dilakukan secara resmi di hadapan notaris. Berdasarkan hasil penelitian dan pembahasan, maka dapat peneliti simpulkan bahwa dalam contoh perkara pembatalan hibah putusan Nomor 0457/Pdt.G/2020/PA.Tnk, gugatan Penggugat terhadap para Tergugat yang merupakan anak-anak kandung Penggugat tidak lah tepat. Perbuatan hukum Tergugat menerima hibah dari penggugat adalah tidak sah karena pada saat menerima hibah masih di bawah umur dan belum cakap untuk melaksanakan perbuatan hukum yang berkaitan dengan gugatan Penggugat (Pembatalan Hibah) sehingga tidak memenuhi syarat formal sebuah gugatan. Perbuatan hukum antara tergugat dengan penggugat batal demi hukum karena tidak memenuhi syarat peraturan perundang-undangan yang berlaku yaitu Pasal 1685 dan Pasal 1688 KUHPerdata. Maka gugatan Penggugat tidak dapat diterima (Niet Ontvankelijke). Kata kunci : Perbuatan Hukum, Hibah, Pembatalan Hibah. Abstract Grants which include voluntary agreements, are aimed at only the achievements of one party, while the other party does not need to provide contra-achievements in return.  This study aims to analyze and provide an understanding of the grant procedure so that it has legal force, as well as offer the concept of the comparison between grants made under the hands and grants made officially before a notary.  Based on the results of the research and discussion, the researcher can conclude that in the example of the case of cancellation of the decision grant No. 0457/Pdt.G/2020/PA.Tnk, the Plaintiff's lawsuit against the Defendants who are the Plaintiff's biological children is not appropriate.  The Defendant's legal action in receiving a grant from the plaintiff was invalid because when he received the grant he was still underage and was not capable yet of carrying out legal actions related to the Plaintiff's lawsuit (Grant Cancellation) thus he did not meet the formal requirements of a lawsuit.  The legal action between the defendant and the plaintiff is null and void because it does not eligible of the applicable laws and regulations, specifically Article 1685 and Article 1688 of the Civil Code. Hence, the Plaintiff's claim cannot be accepted (Niet Ontvankelijke).  Keywords: Legal Acts, Grants, Cancellation of Grants
