Jurnal Restorasi Hukum (P-ISSN 2502-1370; E-ISSN 2987-7571) is a scholarly journal published by the Center for Legal Studies and Consultation (PSKH) of the Faculty of Sharia and Law at UIN Sunan Kalijaga Yogyakarta. It has been published in print since 2015 and start published online since volume 5, issue 1, 2022. Jurnal Restorasi Hukum includes various scientific articles on the study of Sharia (Islamic law) and positive law, both conceptual-doctrinal and empirical studies. Articles are published through a process that involves article selection, double-blind peer review, and editing. Jurnal Restorasi Hukum is published twice a year, in January-June and July-December. The editorial board invites academics, practitioners, and researchers in the field of Sharia and law to contribute and develop their thoughts and research findings to be published in Jurnal Restorasi Hukum. Jurnal Restorasi Hukum is an open access peer-reviewed journal which aims to offer a national academic platform for legal sciences and Sharia. It includes research articles, both normative-doctrinal and empirical/field. Abstract

The House of Representatives is one of the state institutions that exercises legislative power as a representative of the people. However, in reality, the parliament has not been able to carry out its legislative function optimally because there is no guaranteed space for representative public participation. That way, one media is needed to be used to streamline the existence of community space in the middle of the parliament function. Based on that axiom, the author conducted this study to analyze the problem of public participation in the legislative process by the Parliament in terms of good governance principles. The research method used is normative juridical with a statutory approach and concept approach. Based on the results of the study, it shows that the resulting Law has not fully covered the interests of the community as a whole. This is because public participation in order to realize the principle of openness in the formation of laws has not been fulfilled optimally in the process. Thus, the use of Online Petitions accommodated by the parliament is considered as an initial initiative to improve the principle of openness in the implementation of Good Governance in the realm of government   Dewan Perwakilan Rakyat (DPR) merupakan salah satu lembaga negara yang menjalankan kekuasaan legislatif sebagai representasi rakyat. Namun, pada realitanya DPR belum dapat melaksanakan fungsi legislasi secara optimal karena tidak terjaminnya ruang partisipasi masyarakat yang representatif. Dengan begitu, dibutuhkan satu media yang digunakan untuk mengefektian keberadaan ruang masyarakat ditengah fungsi DPR. Berdasarkan aksioma itulah Penulis melakukan penelitian ini untuk menganalisa permasalahan partisipasi masyarakat terhadap proses legislasi oleh DPR ditinjau prinsip good governance. Adapun metode penelitian yang digunakan adalah yuridis normatif dengan pendekatan perundang-undangan (statute approach) dan pendekatan konsep (conceptual approach). Berdasarkan hasil penelitian menunjukkan menunjukkan bahwa Undang-Undang (UU) yang dihasilkan belum sepenuhnya mencakup kepentingan masyarakat secara menyeluruh. Hal ini dikarenakan partisipasi masyarakat dalam rangka mewujudkan prinsip keterbukaan dalam pembentukan UU belum terpenuhi secara maksimal dalam prosesnya. Maka, Pemanfaatan Petisi Online yang diakomodasi oleh DPR dianggap sebagai inisiatif awal untuk meningkatkan prinsip keterbukaan dalam implementasi Good Governance di ranah pemerintahan.

Abstract

Indonesia's abundant natural resources, particularly minerals and coal, prompted this study. Article 33(3) of the 1945 Constitution explicitly states that natural resources should benefit the people. However, illegal mining persists, profiting only a select few. Therefore, implementing the Leniency Program in Indonesia is crucial to fostering ecological citizenship. This legal research employs a normative juridical approach, incorporating conceptual and legislative perspectives. The findings indicate ongoing law enforcement issues in the mining sector, involving mining mafias. Consequently, the Leniency Program could serve as a novel strategy to eradicate mining mafias. Penelitian ini dilatarbelakangi oleh kekayaan sumber daya alam Indonesia, khususnya mineral dan batu bara. Sebagaimana yang diamanatkan dalam Pasal 33 Ayat 3 UUD 1945, sumber daya alam harus dimanfaatkan untuk sebesar-besarnya kemakmuran rakyat. Namun pada kenyataannya, praktik pertambangan ilegal masih marak terjadi dan hanya menguntungkan segelintir pihak. Oleh karena itu, penerapan Program Leniency menjadi penting untuk dikaji dalam rangka penegakan keadilan ekologi di Indonesia. Penelitian ini menggunakan metode penelitian hukum yuridis normatif dengan pendekatan konseptual dan perundang-undangan. Hasil penelitian menunjukkan masih adanya permasalahan penegakan hukum di sektor pertambangan, yang melibatkan mafia pertambangan. Dengan demikian, Program Leniency dapat menjadi strategi baru untuk memberantas mafia tambang.

Abstract

Transparency and public participation in the formation of regulations in Indonesia are needed to improve the quality and legitimacy of policies. Although the principle of openness has been regulated in Law No. 13 of 2022, its application is still not optimal. The phenomenon of social movements, such as in the polemics over the revision of the Pilkada Law, shows the public's desire to be involved in the legislative process. This research proposes a social contract-based E-Legislation model through a normative juridical method, with a regulatory approach and comparative studies. This model integrates technology with E- Rulemaking and E-Petition features to enable public involvement from the planning stage to the passing of laws. Comparative studies with the UK and Australia are used to adapt the concept of Citizen Charter. The results of this research are expected to provide recommendations to increase public trust and support the achievement of the Sustainable Development Goals in the aspects of justice and strong institutions. Transparansi dan partisipasi publik dalam pembentukan peraturan di Indonesia diperlukan untuk meningkatkan kualitas serta legitimasi kebijakan. Walaupun asas keterbukaan sudah diatur dalam UU No. 13 Tahun 2022, penerapannya masih belum optimal. Fenomena social movement, seperti dalam polemik revisi UU Pilkada, menunjukkan keinginan masyarakat untuk terlibat dalam proses legislasi. Penelitian ini mengusulkan model E-Legislasi berbasis kontrak sosial melalui metode yuridis normatif, dengan pendekatan peraturan dan studi perbandingan. Model ini mengintegrasikan teknologi dengan fitur E-Rulemaking dan E-Petition untuk memungkinkan keterlibatan publik sejak tahap perencanaan hingga pengesahan undang-undang. Studi perbandingan dengan Inggris dan Australia digunakan untuk mengadaptasi konsep Citizen Charter. Hasil penelitian ini diharapkan memberikan rekomendasi untuk meningkatkan kepercayaan publik dan mendukung.

Abstract

Indonesia is a country that adheres to the principle of democracy, which is manifested through the implementation of general election as a means to elect members of the House Of Representatives (DPR), Regional Representatives (DPRD), Regional Heads, and Deputy Regional Heads directly, universally, freely, and confedentially, in accordance with the article 22E of the 1945 Constitution of the Republic of Indonesia (UUD NRI 1945). However, in practice, weakness have been identified, such as a lack of oversight over the flow of campaign funds, which opens the door to potential vote-buyinh practice. The purpose of this scientific paper is to examine the existing condition of the campaign fund distribution mechanism in Indonesia and the application of blockchain-based smart contract in the campaign fund distribution system. This research employs a doctrinal legal research method. The result show that the current campaign fund distribution has not been optimally implemented, as evidence by data on widespread vote-buyinh in previous election periods. The recomendation from this scientific paper is to integrate the concept of bloackchain-based smart contract into the campaign fund distribution system to achieve transparancy and accountinility in campaign fund management.  Indonesia merupakan negara yang menganut asas demokrasi yang diwujudkan dalam pelaksanaan pemilihan umum sebagai sarana untuk memilih DPR, DPD, Presiden, Wakil Presiden, DPRD, Kepala Daerah, dan Wakil Kepala Daerah secara langsung, umum, bebas, dan rahasia selaras dengan Pasal 22E UUD NRI 1945. Namun, dalam prosesnya ditemukan kelemahan berupa kurangnya pengawasan terhadap alur dana kampanye sehingga membuka peluang terjadinya praktik politik uang. Penulisan karya tulis ilmiah ini bertujuan untuk mengetahui kondisi exsisting mekanisme penyaluran dana kampanye di Indonesia dan penerapan smart contract berbasis blockchain pada sistem penyaluran dana kampanye. Dalam penelitian ini menggunakan metode penelitian hukum doktrinal. Hasil penelitian menunjukkan bahwa penyaluran dana kampanye saat ini belum dilaksanakan secara optimal dibuktikan dengan data temuan politik uang yang marak terjadi pada periode pemilu sebelumnya. Adapun rekomendasi dari karya tulis ilmiah ini adalah mengintegrasikan konsep smart contract berbasis blockchain dalam sistem penyaluran dana kampanye dalam rangka mencapai transparansi dan akuntabilitas pengelolaan dana kampanye.

Abstract

State administrators' wealth reports (LHKPN) play an important role in realizing transparency and accountability of the Indonesian government. In reality, the implementation of LHKPN has not been optimal. Therefore, it is urgent to restructure the LHKPN in order to realize a modern democracy. This scientific paper is juridical-normative research using statutory, comparative and conceptual approaches. The data used in this paper is secondary data. The results of this paper shows that; (i) LHKPN is one of the pillars of transparency because part of public monitoring tool, but faces problems in the juridical, technical, and institutional fields; (ii) the successful implementation of the automatic assessment system (AAS) in South Africa, Australia, and France has become a comparison with real solutions for optimizing ASS in Indonesia; and (iii) the ideal construction for implementing ASS which will be regulated in Government Regulations and implemented through the Directorate Agency for LHKPN auditing in Indonesia. Laporan harta kekayaan penyelenggara negara (LHKPN) berperan penting dalam mewujudkan transparansi dan akuntabilitas pemerintah Indonesia. Kualitas unsur tersebut berimplikasi pada indeks demokrasi modern Indonesia. Kenyataannya, penerapan LHKPN di status quo belum maksimal. Oleh karena itu, diperlukan restrukturisasi LHKPN yang mampu mewujudkan demokrasi modern yang berkeadilan. Karya tulis ilmiah ini merupakan penelitian yuridis-normatif dengan menggunakan pendekatan perundang-undangan, perbandingan, dan konseptual. Data yang digunakan dalam tulisan ini adalah data sekunder. Hasil dari tulisan ini menunjukkan bahwa; (i) LHKPN merupakan salah satu tonggak transparansi karena menjadi alat pengawas masyarakat, tetapi menghadapi permasalahan dalam bidang yuridis, teknis, dan kelembagaan; (ii) keberhasilan penerapan automatic assessment system (AAS) di Afrika Selatan, Australia, dan Prancis telah menjadi perbandingan dengan solusi nyata optimalisasi ASS di Indonesia; dan (iii) diperoleh konstruksi ideal penerapan ASS yang akan diatur dalam regulasi berbentuk Peraturan Pemerintah dan dijalankan melalui lembaga Direktorat PP LHKPN selaku penanggung jawab pemeriksa LHKPN di Indonesia.

Abstract

This study aims to analyze the phenomenon of early marriage and marriage postponement trends in Indonesia from the perspectives of maqashid sharia and social aspects, with a focus on social implications and the impact on public policy. Early marriage is often promoted as a moral solution to avoid zina, while marriage postponement is more commonly chosen by the younger generation who prioritize education, career, and financial stability. However, both phenomena pose challenges related to the mental, economic, and social readiness of the individuals involved, which can potentially affect the well-being of families and society. This research adopts a normative-sociological approach with Max Weber’s theory of social action to understand the motivations behind the decisions to marry early or postpone marriage. Data was obtained through semi-structured interviews with young couples and young people who chose to delay marriage. The results of the study show that, although there are good intentions behind the promotion of early marriage, marriages carried out without adequate readiness can lead to social and economic problems, and contradict maqashid sharia, which emphasizes the importance of stability and well-being in marriage. On the other hand, postponing marriage provides advantages in terms of financial and psychological readiness, but also brings negative impacts, such as a decline in birth rates and changes in social structure. The limitations of this study lie in its narrow geographical scope and its focus on the perspectives of Islamic law and sociology. Penelitian ini mengkaji fenomena ajakan menikah muda dan tren penundaan perkawinan di Indonesia dengan menganalisis perspektif sosial, budaya, dan hukum Islam. Nikah muda sering kali dipromosikan sebagai solusi masalah moral dan jalur untuk membangun keluarga harmonis, didorong oleh narasi media sosial dan dorongan agama. Sebaliknya, penundaan perkawinan semakin umum terjadi pada generasi muda yang memprioritaskan pendidikan, karier, dan stabilitas finansial. Penelitian ini menggunakan pendekatan Normatif-Sosiologis teori Tindakan sosial Max Webber dan pendekatan Maqasid Syariah dengan metode kajian pustaka dan wawancara semi-terstruktur untuk menganalisis motivasi mendasar dan dampak sosial dari kedua tren ini. Hasil penelitian menunjukkan implikasi signifikan terhadap kesejahteraan individu, struktur keluarga, dan kebijakan publik, dengan menekankan pentingnya kesiapan dan keseimbangan dalam pengambilan keputusan pernikahan. Studi ini juga menyoroti relevansi maqashid syariah dalam menjembatani fenomena ini, serta memberikan rekomendasi praktis melalui pendidikan, kebijakan, dan pemberdayaan komunitas.

Abstract

The amendment of the Constitution does not only change the authority and position of the MPR in the constitutional system but also has an impact on its legal products. The placement of MPR Decree in the hierarchy of laws and regulations raises norm conflicts that lead to legal uncertainty, this research aims to examine how the ideal position of MPR Decree in the hierarchy of laws and regulations. This research uses normative juridical method with conceptual approach and statute approach. The results of the study found that there are several norm conflicts due to the inclusion of TAP MPR in the hierarchy, namely the issue of content material, the role of the consideration, the status of validity and constitutional testing which causes legal uncertaint. The author offers two alternative recommendation to the legislators. First, it is necessary to reassess to determine which provisions are still relevant to be maintained, so that a definite number is agreed upon. Then the content material is moved into the law. So that all MPR Decrees can still be used in the form of laws. Then revise the hierarchy of laws and regulations. Secondly, the lawmakers can just leave the MPR Decrees that are still recognised as MPR Decrees, with the legal status of laws and regulations. Whatever the lawmakers' choice, the MPR Decree must be removed from the hierarchy. Amandemen Undang Undang Dasar  tidak hanya mengubah wewenang dan kedudukan MPR dalam sistem ketatanegaraan namun juga berimbas pada produk hukum nya. Penempatan TAP MPR dalam hierarki peraturan perundang undangan menimbulkan konflik norma yang berujung pada ketidakpastian hukum, penelitian ini bertujuan untuk mengkaji bagaimana idealnya kedudukan TAP MPR dalam hirrarki  peraturan perundang undangan. Penelitian ini menggunakan  metode yuridis normatif dengan pendekatan konseptual. Pengumpulan data yang digunakan dalam penelitian ini menggunakan kajian literatur . hasil penelitian menemukan terdapat beberapa konflik norma karena masuknya TAP MPR dalam hierarki yaitu masalah materi muatan, peran konsideran, status keberlakuan dan pengujian konstitusional yang menimbulkan ketidakpastian hukum sehingga TAP MPR harus dikeluarkan dari hierarki melalui revisi UU no.12/2011
