Abstract

The Covid-19 pandemic has had a significant impact on various sectors, such as the tourism sector, which is characterized by, among other things, a decrease in the number of visitors and the closure of tourist attractions. During the Covid-19 Pandemic, the Government has made various efforts to reduce the spread of the virus, one of which is by establishing and implementing various tourism policies. The implementation of tourism policies during the pandemic has in fact also resulted in innovation in various tourist destinations except the Surabaya Zoo by creating educational virtual tour packages. The method used in this research is a descriptive qualitative approach, with data collection techniques using interviews, observation and searching for laws, references, articles, journals and websites. The research results show that government policies during the Covid-19 pandemic include regulations making laws and regulations related to tourism activities which are targeted at tourists and tourism business actors. Responding to the tourism policy made by the government during the pandemic, the Surabaya Zoo is one of the tourist destinations that can take advantage of the pandemic situation by creating alternative tourism in the form of educational virtual tour packages. This tour package is intended for tourists who want to get to know animal life online, especially during the Covid-19 pandemic.

Abstract

The general election system in Indonesia adheres to a one-man-one-vote system, where everyone has one vote, regardless of educational background and social status. From the point of view of Indonesia's current education which is still not evenly distributed, as well as the social gaps that are still far away, causing the distribution of information and technology to be uneven, this causes uneven political maturity, in addition to Indonesia's geographical conditions adding challenges to the realization of justice in terms of education and Therefore, it is necessary to try the electoral college electoral system, reforms in the general election must also be in accordance with the improvement in the supervision of political parties which seem undemocratic in their implementation.

Abstract

Online gambling is one of the forms of digital crime that is increasingly prevalent in Indonesia, including in the city of Manado. This study aims to analyse the effectiveness of law enforcement against online gambling crimes and identify factors that are challenging in the enforcement process. The research method used is an empirical approach with data collection techniques through interviews, observations, and documentation studies. The results of the study show that although law enforcement officials have made various efforts to eradicate online gambling, challenges such as regulatory limitations, evolving modus operandi, and limited technological resources are still major obstacles. In addition, the low legal awareness of the community also contributes to the high number of online gambling cases. To increase the effectiveness of law enforcement, a comprehensive strategy is needed that includes regulatory updates, capacity building in the field of digital technology, and education campaigns for the public. With a more synergistic approach between the government, law enforcement officials, and internet service providers, it is hoped that online gambling in Manado City can be minimised.

Abstract

Penelitian ini bertujuan untuk menganalisis pengaturan tindak pidana manipulasi data kependudukan dalam hukum pidana Indonesia serta perlindungan hukum bagi pemilik data pribadi. Pendekatan yang digunakan adalah normatif dengan menganalisis peraturan perundang-undangan yang relevan, termasuk Undang-Undang Administrasi Kependudukan, Undang-Undang Perlindungan Data Pribadi, Undang-Undang Informasi dan Transaksi Elektronik, serta Peraturan Menteri Komunikasi dan Informatika RI Nomor 20 Tahun 2016. Hasil penelitian menunjukkan bahwa manipulasi data kependudukan meliputi beberapa jenis tindak pidana, seperti perubahan data oleh pelaku yang memberi perintah, penyebarluasan data tanpa izin, pencetakan dan pendistribusian dokumen kependudukan ilegal, serta perbuatan melawan hukum terkait pengolahan dan penyebaran data secara online. Perlindungan hukum terhadap pemilik data dilakukan melalui langkah preventif berupa penerbitan peraturan dan langkah represif berupa sanksi pidana. Pelaku tindak pidana tersebut dapat dijatuhi hukuman pidana penjara dan denda sesuai ketentuan yang diatur dalam Undang-Undang Administrasi Kependudukan. Penelitian ini diharapkan memberikan wawasan mengenai pentingnya perlindungan data kependudukan dan pengawasan terhadap manipulasi data.Kata kunci: manipulasi data kependudukan, perlindungan data pribadi, hukum pidana.

Abstract

This study analyzes criminal law policies for employers in the National Health Insurance (NHI) Program under Law No. 24 of 2011. Articles 54 and 55 regulate criminal sanctions but do not clearly classify violations as crimes or offenses, nor sufficiently incorporate the element of unlawfulness. Article 55 also adopts an alternative sentencing system, allowing imprisonment to be replaced with fines. Sanctions target employers who fail to register employees or remit contributions. The study concludes that law enforcement requires improved regulatory formulation, oversight, and synergy between BPJS, law enforcement agencies, and society.

Abstract

Indonesia is one of the largest countries that sends its citizens to work abroad. However, many of them experience injustice in their rights and experience inappropriate treatment. This research has two problem formulations, namely how to review the juridical protection of Indonesian workers in Malaysia based on the law. No. 18 of 2017 concerning the protection of Indonesian migrant workers, and how BP2MI is trying to reduce the illegal sending of Indonesian workers based on Law Number 18 of 2017 concerning the protection of Indonesian migrant workers. The purpose of this research is to find out how the juridical review of legal protection for Indonesian workers in Malaysia is based on the law. No. 18 of 2017 concerning the protection of Indonesian migrant workers, and to find out how BP2MI is trying to reduce the illegal sending of Indonesian workers based on Law Number 18 of 2017 concerning the protection of Indonesian migrant workers. This research uses a type of empirical normative research. The data collection techniques used were literature study, field study and interviews. From the results of this research, it can be concluded that the role of the Indonesian migrant worker protection agency (BP2MI) is in seeking protection for Indonesian migrant workers.

Abstract

This study examines public information disclosure by local governments from a criminal law perspective, focusing on weaknesses in the formulation of criminal offenses and the effectiveness of law enforcement. Based on the lex specialis derogat lex generalis principle, Law No. 14 of 2008 on Public Information Disclosure (UU PID) as a special regulation has not specifically formulated criminal offenses, particularly regarding the criminal liability of public bodies or corporations. Existing criminal sanctions, such as a maximum prison sentence of one year or fines, are deemed insufficient to provide an optimal deterrent effect. The dispute resolution mechanism through the Information Commission is procedurally effective but faces implementation challenges. The process begins with mediation and proceeds to adjudication if mediation fails. However, low legal understanding among public bodies, weak sanction enforcement, and inadequate oversight of decision implementation remain significant obstacles.This study recommends strengthening regulations through clearer formulation of criminal offenses, establishing criminal liability for public bodies, and enhancing the effectiveness of sanctions. Additionally, it is necessary to improve the capacity of law enforcement officers and public bodies in understanding and implementing the UU PID. Thus, public information disclosure in local governments can be carried out more effectively, accountably, and transparently.

Abstract

This study examines the criminal law aspects of business activities required to have an Environmental Impact Analysis (EI) based on Law No. 32 of 2009 on Environmental Protection and Management and Government Regulation No. 27 of 2012 on Environmental Permits. EI is mandatory for activities with significant environmental impacts, aiming to identify environmental risks, accommodate public aspirations, and ensure proper impact management. Criminal sanctions are applied as a last resort (ultimum remedium) when administrative sanctions are ineffective. These sanctions aim to educate business actors, protect public interests, and prevent similar violations. The principle of legality is upheld, requiring actions to be based on existing laws and proven wrongdoing. However, the enforcement of environmental criminal law faces challenges, including a lack of understanding among law enforcers about the essence of environmental crimes. This study that strengthening regulations, enhancing law enforcers' capacity, and consistently applying criminal sanctions are necessary to support the successful enforcement of environmental law. These measures are crucial to preserving the environment and ensuring compliance with EI obligations by business actors.

Abstract

This research aims to analyze the effectiveness of the implementation of the Decree of the Minister of Law and Human Rights M.HH-01.HN.03.03 of 2021 concerning the amount of legal aid fees for litigation and non-litigation for impoverished communities. Employing a socio-legal (yuridis empiris) approach, this study examines the prevailing legal provisions while also investigating actual legal events in society, with field research conducted in Gorontalo Province. The objective is to determine the extent to which this policy is effective in providing legal assistance to impoverished communities. The research findings indicate that although the Ministerial Decree has provided a crucial legal basis for the provision of legal aid, its implementation has not yet reached an optimal level from a technical execution perspective. Various obstacles were encountered in the field, including a mismatch between the stipulated fee amounts and the actual operational needs of legal aid provider organizations. This potentially hinders the quality and scope of services that can be provided to impoverished communities. To enhance the effectiveness of this policy, this research proposes several optimization strategies. These strategies include the necessity of periodically revising the amount of legal aid fees, taking into account factors such as inflation rates and the complexity of the cases handled. Furthermore, strengthening the capacity of legal aid institutions is essential, which can be achieved through continuous training for advocates and paralegals, the utilization of information technology to improve administrative and reporting efficiency, and the strengthening of collaborative networks among related institutions. A comparative study with other regions, such as DKI Jakarta, suggests that the adoption of administrative innovations and the utilization of digital technology have significant potential in increasing the efficiency and expanding the reach of legal aid services. Therefore, this research recommends several concrete steps: (1) Conducting periodic revisions of the legal aid fee amounts, considering economic conditions and the characteristics of the cases. (2) Encouraging local governments to allocate supporting budgets in the Regional Revenue and Expenditure Budget (APBD) to support the sustainability of legal aid programs at the local level. (3) Enhancing the institutional capacity of Legal Aid Organizations (OBH) through continuous training programs, the utilization of technology in operations, and the strengthening of collaboration with various relevant parties. With the comprehensive implementation of these optimization strategies, it is expected that legal aid programs can reach impoverished communities more effectively and contribute to the realization of the principle of social justice in Indonesia.

Abstract

The enactment of the Law No. 6 of 2023 has brought significant changes to the management of Fly Ash and Bottom Ash (FABA), including the reclassification of FABA as non-hazardous and non-toxic waste (non-B3 waste) and the extension of the storage period in the Ash Disposal Area from 365 days to 3 years. This study aims to analyze the impact of Law No. 6 of 2023 on the management of Fly Ash and Bottom Ash at the Amurang Coal-Fired Power Plant (PLTU Amurang). Using a normative legal research method, the findings provide comprehensive insights into the effects of implementing Law No. 6 of 2023 on FABA waste management. These findings are expected to contribute to the development of more effective and sustainable environmental policies, as well as offer practical recommendations for power plant operators to improve environmentally friendly and economically valuable waste management practices.
