Abstract

Illegal fishing refers to fishing activities that are conducted in violation of the laws and regulations in force in Indonesia. The Talaud Islands Regency, known for its significant marine resource potential, frequently encounters serious challenges related to illegal fishing practices. The prevalence of fisheries-related crimes, particularly illegal fishing in the waters surrounding Talaud, raises important concerns regarding the effectiveness of law enforcement in the region. Law enforcement in the fisheries sector plays a vital and strategic role in supporting the controlled and sustainable development of fisheries, in accordance with the principles of responsible resource management. Therefore, this study aims to examine the legal framework governing police authority in the enforcement of laws against illegal fishing, as well as the practical implementation of criminal law enforcement against illegal fishing in the territorial waters of the Talaud Islands Regency. Using a normative legal research method, this study finds that the authority of the police in addressing illegal fishing is regulated through the Indonesian National Police Law and the Fisheries Law, along with several special mandates provided by statutory regulations and inter-agency coordination mechanisms. However, in practice, the enforcement of criminal law against illegal fishing in Talaud’s territorial waters—despite being conducted through inter-institutional cooperation—still faces numerous challenges that hinder its overall effectiveness.

Abstract

This study aims to analyze the urgency of criminal reform against perpetrators of narcotics crimes, especially users, with a focus on the Gorontalo Province area. In practice, the criminal justice system in this area still tends to impose prison sentences on narcotics users, although Law Number 35 of 2009 on Narcotics opens up space for a rehabilitation approach. This study uses an empirical juridical method with a qualitative approach, involving interviews with law enforcement officials, rehabilitation officers, and observations at correctional institutions and BNNP Gorontalo. The results of the study show that the implementation of rehabilitation is still limited due to weak coordination between agencies, limited resources, and the non-optimal implementation of integrated assessments. As a result, many users are overcriminalized and lose the opportunity to recover socially and medically. This study emphasizes the need for criminal policy reform through a more humanistic, public health-based, and rehabilitative-oriented approach, not just punishment

Abstract

Intellectual Property Rights (IPR) play a crucial role in both regional and international trade. Indonesia has ratified the Uruguay Round Agreement through Law No. 7 of 1994, which includes provisions on the protection of copyright as one of the key aspects of IPR. This study uses a normative legal research method, employing statutory and conceptual approaches to analyze the copyright status of AI-generated works under Indonesian law. The results show that Indonesian copyright protection requires works to have originality, be expressed in a tangible form, and be the product of human creativity. Since AI lacks consciousness and intentionality, its creations do not meet the subjective requirement of authorship. However, these works often satisfy the objective criteria of copyrightable works. Comparative legal analysis with systems in the European Union and the United Kingdom highlights differing views—while the EU requires human intellectual input for copyright protection, UK law allows computer-generated works to be protected under certain conditions. In the long term, legal reform is necessary to accommodate AI-generated works, ensuring legal certainty and fairness in the digital age. A suitable regulatory framework must be developed to adapt the concept of "author" and recognize the evolving role of AI in creative processes, while still upholding the fundamental principles of copyright law.

Abstract

This study aims to examine and analyze the role of Legal Aid Organizations (OBH) in providing legal aid services to the poor in Gorontalo Province, as well as identifying the obstacles faced in its implementation. The background of this study is based on the principle of a state of law that guarantees the right to protection and access to justice for every citizen without discrimination, as regulated in Law Number 16 of 2011 concerning Legal Aid. This study uses an empirical legal method, with data collection techniques through observation, interviews, and documentation of OBHs active in the Gorontalo Province. The results of the study show that the role of OBHs is very significant in providing litigation and non-litigation legal assistance, as well as legal counseling to the poor. During the period 2022 to 2024, the number of cases handled and the budget absorbed showed a high increase and effectiveness, with a budget absorption rate of above 99%. However, there are several obstacles that hinder the effectiveness of services, such as budget limitations, lack of professional human resources, low legal literacy of the community, geographical constraints, administrative bureaucracy, and minimal support from local governments. Therefore, synergy is needed between the government, OBHs, and the community in strengthening an inclusive and equitable legal aid system.

Abstract

One of the principles that deserves serious attention in environmental law enforcement is the "polluter pays principle," which means that any business actor whose activities cause environmental pollution and/or damage is obligated to bear the full cost of its restoration. However, many courts in Indonesia have yet to apply this principle firmly in various cases. Therefore, this research aims to comprehensively explain the regulation of the polluter pays principle in Indonesian legislation and its implementation in environmental cases. Using a normative legal research method, the author finds that the polluter pays principle is explicitly regulated in various environmental laws in Indonesia, particularly in Law No. 32 of 2009. For corporations, the implementation of this principle includes legal responsibility for environmental damage, the internalization of environmental costs into production processes, and the provision of guarantee funds. However, its enforcement remains weak, as illustrated by the case of mangrove destruction in the Bunaken National Park, where the imposed fine was too low and not accompanied by a restoration obligation, thus failing to provide a sufficient deterrent effect.

Abstract

Perkembangan Generative artificial intelligence (AI) telah menimbulkan persoalan hukum baru terkait status perlindungan hak cipta atas karya yang dihasilkannya. Sistem hukum Indonesia belum memberikan kepastian hukum mengenai posisi karya AI, karena peraturan yang berlaku masih mengasumsikan manusia sebagai satu-satunya subjek hukum hak cipta. Rumusan masalah dalam penelitian ini diarahkan untuk menjawab pertanyaan mengenai apakah karya yang dihasilkan oleh sistem Generative AI dapat dikualifikasikan sebagai ciptaan yang dilindungi oleh hak cipta menurut peraturan perundang-undangan di Indonesia, serta bagaimana posisi hukum pengguna (user) terhadap karya tersebut, khususnya dalam kaitannya dengan klaim kepemilikan dan hak pemanfaatan karya hasil teknologi Generative AI. Penelitian ini menggunakan metode yuridis normatif dengan pendekatan studi kepustakaan. Hasil analisis menunjukkan bahwa karya yang sepenuhnya dihasilkan AI belum memenuhi syarat perlindungan hak cipta, kecuali terdapat kontribusi kreatif manusia. Oleh karena itu, diperlukan reformasi regulasi untuk memberikan kepastian hukum yang adaptif terhadap perkembangan teknologi.

Abstract

The eradication of corruption requires a special legal approach involving key law enforcement agencies such as the Police, the Prosecutor’s Office, and the Corruption Eradication Commission (KPK). However, overlapping investigative authorities among these institutions cause conflicts and hinder the effectiveness of corruption eradication efforts. By using normative legal approach, this research indicate the need for clear clarification and strict limitation of investigative powers, as well as a strong coordination mechanism, to ensure effective and synergistic law enforcement. The professionalism and independence of the Police are key factors in carrying out investigative duties but require clear regulatory support and oversight. Institutional reform, capacity building of human resources, and regulatory harmonization are crucial to establishing a criminal justice system that is fair, transparent, and free from corruption, thereby restoring public trust and advancing the nation.

Abstract

Within the framework of a constitutional state, the judiciary holds a pivotal role in upholding the rule of law and ensuring justice through an independent and impartial judicial process. Among the various types of court rulings, the verdict of release from all legal charges (onslag van alle rechtsvervolging) is one that frequently provokes legal and public debate. This study investigates such a verdict in an illegal mining case that occurred in Ratatotok Dua Village, North Minahasa Regency, North Sulawesi, involving three defendants and adjudicated by the Tondano District Court. Despite the court establishing that the defendants' actions were proven, the panel of judges concluded that those actions did not constitute a criminal offense under the applicable laws, thereby issuing a release verdict. The objective of this research is to critically examine the legal grounds and judicial reasoning behind the issuance of the release verdict, as well as its broader implications for the enforcement of mining laws in Indonesia.

Abstract

This study aims to evaluate the implementation of the principle of legal certainty in the land certification process carried out by the Land Office of Buol Regency. The principle of legal certainty is a fundamental concept in a rule-of-law state that guarantees land rights in a fair, equitable, and transparent manner. The method used is normative legal research with statutory and conceptual approaches. Data were obtained through a literature review of laws and regulations as well as relevant legal literature. The research findings indicate that although the regulations regarding land certification are already available in a complete and clear form, their implementation at the local level still encounters various obstacles. These include inconsistencies in procedural application, lack of legal understanding among the public, weak protection for vulnerable groups, and the suboptimal state of land administration systems. Therefore, a comprehensive reform of land policies, capacity-building for government apparatus, and a participatory approach that ensures service inclusiveness are urgently needed. This evaluation is expected to contribute to the development of a more just land certification system that upholds legal certainty for all citizens.

Abstract

The development of digital technology has driven the increasing use of cryptocurrency in cybercrime in Indonesia. Cryptocurrencies such as Bitcoin and Ethereum offer anonymity and ease of global transfers without a central authority, making them attractive to cybercriminals. Unfortunately, regulations in Indonesia remain weak due to the absence of a strong legal framework, making it difficult to identify and track misuse. Law enforcement and the general public also lack understanding of how cryptocurrency works. This article uses a normative method by examining existing regulations and highlights the need for stricter rules and inter-agency cooperation to prevent the misuse of cryptocurrency in cybercrime.
