Abstract

The process for selecting Constitutional Court judges involves three branches of government: the House of Representatives (legislative), the President (executive), and the Supreme Court (judicial). This arrangement is intended to ensure integrity, independence, and proper oversight. Normatively, neither the House of Representatives, the President, nor the Supreme Court has the authority to dismiss a Constitutional Court judge they have proposed. However, on September 29, 2022, the House of Representatives removed Judge Aswanto from the Constitutional Court, citing his frequent annulment of legislation enacted by the House of Representatives as the reason. This study aims to analyze the dismissal of Constitutional Court judges by the proposing institution. It employs a normative legal research method, utilizing legislative, case, and conceptual approaches. The findings indicate that Judge Aswanto's dismissal was inconsistent with Article 23, paragraph (4) of the Constitutional Court Law, which stipulates that "The dismissal of a Constitutional Judge may be made based on a Presidential Decree upon the request of the Chairperson of the Constitutional Court." This article clearly shows that the dismissal of Judge Aswanto by the proposing institution, namely the House of Representatives, constitutes a violation of the law and breaches the rule of law principle. Moreover, Judge Aswanto's dismissal has legal consequences, including representing an intervention by the proposing institution the House of Representatives  into the Constitutional Court, which undermines the independence and impartiality of the Court.

Abstract

The Constitutional Court in a country has a very important role for the implementation of the constitution in a country, so the recruitment process is ensured to be carried out transparently, participatively, objectively and accountably. The principles of the constitutional judge recruitment mechanism have not been implemented properly, because the law does not clearly regulate the parameters of the selection mechanism. Talking about the recruitment process for Constitutional Court judges. Germany which is considered an independent country in carrying out the recruitment process for constitutional judges. This study aims to explain the comparison and legal consequences of the recruitment process for Constitutional Court judges in Indonesia and Germany. In Indonesia, the nomination process for Constitutional Court judges is carried out by President, the House of Representatives (DPR), and the Supreme Court (MA). While in Germany it is proposed by the Bundestag and Bundesrat. Each proposing institution creates a mechanism for selecting Constitutional Court judges and integrates it with a reliable and professional merit system. Germany in an effort to accelerate and increase the efficiency of the recruitment process for Constitutional Court judges can consider several things, including determining the consensus deadline.

Abstract

This study aims to reveal the Authority of the Legislative Function of the Executive in the formation of the National Capital Law. After the Amendment to the 1945 Constitution, it resulted in changes in the design of the Indonesian state administration, one of which was the change in the function of state institutions. Regarding the formation of laws, the amendment to Article 5 Paragraph (1) and Article 20 of the 1945 Constitution has presented its own dynamics in the legislative function. The research method used is normative juridical which discusses doctrine or legal principles to create new arguments, theories or concepts to solve problems, with a statutory, comparative and conceptual approach that uses library materials as the main legal material to analyze the legislative function of the executive in the formation of the National Capital Law. The results of this study indicate that after the amendment to the 1945 Constitution, the institutions that can submit draft laws are not only the DPR and the President but the DPD can also submit draft laws. The formation of the National Capital Law was formed by the Executive (President). The legal consequences of the ratification of the National Capital Law gave birth to a law and changed a legal situation. The birth of the law is proven by the existence of a derivative form of the National Capital Law.

Abstract

The fulfillment of civil registration rights for people with mental disorders (ODGJ) in Kalirejo Village, Talun Subdistrict, Pekalongan Regency, is an important issue that requires serious attention. Based on Law Number 23 of 2006 concerning Civil Registration, every Indonesian citizen has the right to obtain civil documents such as an Identity Card (KTP) and Family Card (KK). However, in practice, many individuals with mental disorders in Kalirejo Village lack these essential documents, preventing them from accessing social and healthcare services that are their rightful entitlements. This study aims to analyze the factors contributing to the non-fulfillment of civil registration rights for ODGJ, as well as the implications arising from this situation. The research employs a qualitative approach with an empirical juridical method. Primary data were collected through interviews with village officials, families of ODGJ, and direct observations in Kalirejo Village, while secondary data included legal documents and literature related to the fulfillment of civil registration rights. The findings reveal that the main barriers to the fulfillment of these rights are the low level of legal awareness among the community and the limited proactive efforts by village authorities. The implications of this situation include restricted access for ODGJ to healthcare and social assistance services to which they are entitled, worsening their health conditions and increasing social marginalization within the community.

Abstract

This study aims to analyze the fulfillment of the right to education for students with disabilities in higher education institutions in Pekalongan. The primary issue addressed is the low accessibility of higher education for students with disabilities, which contradicts the principles of human rights: universality, interdependence, non-discrimination, and state responsibility. This research employs an empirical juridical method with a qualitative approach, combining primary data from interviews with policymakers and students and secondary data from legal documents and related literature. The findings indicate that most higher education institutions in Pekalongan have not fully ensured the right to education for students with disabilities. Existing services and facilities remain ad hoc, lacking structured regulations or inclusive standards. Three key findings include the absence of specific inclusive policies, the lack of integrated data on students with disabilities, and the unavailability of Disability Service Units. The legal implications of this inadequacy involve violations of human rights and state obligations, as mandated by Law No. 8 of 2016 concerning Persons with Disabilities. This study recommends the development of inclusive regulations and strategic measures to establish a more inclusive and sustainable educational environment, ensuring the fulfillment of the right to education for all, including persons with disabilities.

Abstract

This research aims to explore the ratio decidendi in the Constitutional Court Decision Number 47/PUU-XXI/2023 and analyze the application of constitutional values contained in the decision. This research uses a normative method with statutory, conceptual, and case approaches. This approach aims to understand the legal basis on which the Constitutional Court's decision is based and its implications for the protection of constitutional rights. The results showed that the Constitutional Court rejected the petition for norm testing in Article 509 letter a of the latest Criminal Code. The rejection was based on the provision that the new Criminal Code will be enacted after three years since its enactment, so the petition was considered premature. In its decision, the Court emphasized the importance of the principle of legal certainty and the protection of advocates' rights from unconstitutional criminal threats. However, the petition could not be accepted due to the lack of concrete harm experienced by the petitioner. This finding underscores that the Constitutional Court continues to prioritize basic constitutional principles in its decision-making, even though the petition did not proceed to material examination. Thus, this research makes an important contribution in understanding how constitutional values are applied in the Constitutional Court's decisions, particularly in relation to the review of criminal law norms. The implications of this research are expected to be a reference in the development of the study of constitutional law and the protection of human rights in Indonesia.

Abstract

Service standards are benchmarks used as a basis for service delivery and as a reference for assessing service quality in realizing services that are swift, easy, affordable, quality and measurable. Article 3 paragraph (5) of the Regulation of the Minister of Health of the Republic of Indonesia Number 43 of 2019 concerning Public Health, states that community health centers provide health services that are accessible and affordable to all people in their working areas. Article 2 of Pekalongan Regency Regional Regulation Number 12 of 2019 concerning Health Services states that this regulation guarantees that the public will receive health services with quality health facilities and services, to create good quality health, health services must have Standard Operating Procedures (SOP). The case that occurred lies in one of the SOPs available at the Tirto Community Health Center services, namely the SOP for Initial Klimis Assessment. An initial clinical assessment is an activity carried out by a patient with a doctor/paramedic to collect the patient's complete condition, including anamnesis, physical examination and supporting examinations as well as a review of the patient's questions. The difference in the quality of service received by BPJS Health patients is not as complete as that received by non-BPJS patients who receive better and more complete quality of service. In this research the author focuses on 3 general principles of good government. namely the principle of good service, the principle of justice and the principle of non-discrimination. This research is empirical juridical research which uses a statutory approach, case approach and conceptual approach, with data collected from primary and secondary legal materials.

Abstract

The implementation of smoke-free areas is an effort to protect and guarantee the right of everyone to breathe clean air without cigarette smoke. Pekalongan City Regional Regulation Number 19 of 2012 concerning smoke-free areas regulates areas or rooms that are prohibited for smoking activities. The type of research used is empirical juridical with a qualitative approach, with a maqasid sharia perspective. The results of the study indicate that the implementation of smoke-free areas based on Pekalongan City Regional Regulation Number 19 of 2012 concerning smoke-free areas is running well but not yet optimal. The implementation of this KTR regulation is in accordance with Islamic teachings, namely the importance of maintaining health and avoiding all its harms, this is included in the maqasid sharia. That maintaining the soul in it there is a spirit as a mandate from Allah SWT which is a control of all human beings physically and mentally. This is the reason for how important it is to keep the soul healthy, pure, and functioning properly. At this level it is included in hifz-nafs (protection of the soul).

Abstract

Pendidikan politik masyarakat merupakan salah satu peran yang harus dilaksanakan oleh partai politik sebagaimana tertuang dalam Undang-undang nomor 2 tahun 2011 tentang Partai Politik. Permasalahannya adalah bagaimana pelaksanaan pendidikan politik masyarakat oleh partai politik di Kabupaten Batang apakah sudah sesuai dengan ketentuan dalam pasal 34 ayat (3b) Undang-undang nomor 2 tahun 2011 tentang Partai Politik. Jenis penelitian ini adalah penelitian lapangan, pengumpulan data dengan teknik observasi, wawancara, dan dokumentasi. Pendekatan penelitian ini adalah pendekatan kualitatif. Teknik analisis data yang digunakan dalam penelitian ini yaitu metode analisis data kualitatif dan selanjutnya peneliti menggunakan logika berfikir induktif dalam penarikan kesimpulan. Hasil penelitian menunjukan: pertama, bahwa partai politik di Kabupaten Batang telah melaksanakan peranya dalam pendidikan politik masyarakat di kabupaten Batang. Dalam prakteknya pendidikan politik ini mengambil bentuk kagiatan yaitu berupa silaturahmi masyarakat, seminar, konsolidasi, sekolah kader partai, dan reses yang diselingi dengan pendidikan politik. Kedua, Partai Politik di Kabupaten Batang telah mengimplementasikan pasal 34 ayat (3b) Undang-undang nomor 2 tahun 2011, namun dalam pelaksanaanya belum secara kualitatif bisa mewujudkan tujuan yang termuat dalam Undang-Undang sehingga pendidikan politik masyarakat kurang dirasakan masyarakat luas dan kurang membawa dampak hasil bagi peningkatan kesadaran politik masyarakat terutama peningkatan partisipasi aktif masyarakata dalam pemilihan umum maupun pilkada

Abstract

Pelayanan perizinan menggunakan sistem manual dikhawatirkan dapat membuat data yang tersimpan pada perangkat komputer menjadi lebih beresiko atau hilang, dan juga membuat masyarakat harus datang ke kantor untuk mengetahui persyaratan apa saja yang harus dibawa ketika akan mengajukan permohonan, menghabiskan biaya yang cukup besar, dan waktu penyelesaian yang kurang jelas. Sehingga Dinas Penanaman Modal dan Pelayanan Terpadu Satu Pintu (DPMPTSP) Kota Pekalongan pada bulan Desember 2017 meluncurkan sebuah sistem perizinan berbasis online yaitu Sistem Perizinan Online, Ringkas dan Ekonomis (SAKPORE) agar masyarakat Kota Pekalongan dapat mengurus perizinan usahanya secara online. Melihat permasalah tersebut tujuan penelitian ini adalah untuk mengetahui kemudahan pelayanan perizinan dengan menggunakan sistem SAKPORE. Metode analisis data yang penulis lakukan yaitu menggunakan teknik analisis data yang dikemukakan oleh Miles dan Huberman mencakup reduksi data, penyajian data, dan menarik kesimpulan. Hasil penelitian penulis, kemudahan pemohan dalam menggurus perizinan secara online dengan menggunakan sistem SAKPORE di Dinas Penanaman Modal dan Pelayanan Terpadu Satu Pintu (DPMPTSP) Kota Pekalongan dapat meringkas prosedur pelayanan, waktu penyelesaian pelayanan, dan biaya penyelesaian pelayanan.
