Abstract

Pemenuhan hak politik penyandang disabilitas mental di kabupaten batang mendapat  perhatian  serius karena mereka menghadapi tantangan dalam menjalankan hak-hak politiknya. Termasuk hak untuk memilih, terlibat dalam proses pembuatan keputusan politik dan partisipasi secara aktif dalam kehidupan demokratis. Tujuan dari penulisan skripsi ini adalah untuk mengetahui bagaimana pemenuhan hak konstitusional penyandang disabilitas dalam pemilihan umum di Kabupaten Batang dan untuk mengetahui mengapa pemenuhan hak konstitusional penyandang disabilitas mental dalam pemilihan umum di Kabupaten Batang belum terpenuhi. Penelitian ini merupakan penelitian yuridis empiris dengan menggunakan pendekatan kualitatif serta menggunakan bahan hukum primer berupa data yang diambil langsung dari lapangan dan data sekunder dari dokumen hukum yang relevan. Adapun hasil dari penelitian ini adalah  Dalam pelaksanaan pemenuhan hak konstitusional penyandang disabilitas mental dalam pemilihan umum di Kabupaten Batang masih banyak terjadi kendala dalam pelaksanaannya baik dari peraturan yang mengatur, aparat penegak hukum, sarana prasarana maupun masyarakat maka dari itu masih banyak yang harus dievaluasi dan perbaiki agar pemenuhan hak politik penyandang disabilitas mental dapat berjalan dengan baik dan lancar.

Abstract

Tata kelola pemerintahan desa yang berkualitas menentukan keberhasilan pembangunan nasional. Oleh karena itu, desa diberikan otonomi untuk mengelola pemerintahan sendiri. Namun, penerapan otonomi desa rentan menimbulkan konflik karena lemahnya kontrol pemerintah pusat sehingga banyak pelanggaran yang dilakukan oleh pemerintah desa terutama terkait dengan tata kelola pembangunan desa. Penelitian ini menganalisis penerapan prinsip good governance dan akibat hukum tidak dilaksanakannya prinsip good governance dalam tata kelola pembangunan desa di Desa Depok Kecamatan Siwalan Kabupaten Pekalongan. Jenis penelitian yang digunakan dalam penelitian ini adalah penelitian non doktrinal dengan pendekatan kualitatif. Hasil penelitian menunjukkan bahwa Pemerintah Desa Depok belum melaksanakan prinsip transparansi dalam tata kelola pembangunan desa secara maksimal, karena Pemerintah Desa tidak terbuka terkait laporan pertanggungjawaban realisasi APB Desa kepada masyarakat. Adapun akibat hukum apabila prinsip good governance tidak dilaksanakan adalah adanya sanksi administratif berupa teguran lisan dan/atau teguran tertulis. Apabila sanksi administratif tidak dilaksanakan, maka dilakukan pemberhentian sementara dan dapat dilanjutkan dengan pemberhentian dari jabatannya sebagai Kepala Desa.

Abstract

In the 2024 elections, the role of Islamic boarding schools will be very central, how could it not be that even before the campaign began, various elements of political parties as election participants flocked to various Islamic boarding schools in Indonesia in the hope of getting full support from scholars, Kyai and even santri and making Islamic boarding schools one of the bases for political battles ahead of elections which could potentially lead to polarization. The purpose of this research is to analyze political polarization in pesantren during the general election period and the impact it has. This research is normative juridical type with statutory, conceptual and historical approaches. The results showed that political polarization in the pesantren environment during the general election campaign period showed that pesantren had an important role in Indonesia's political process. However, this polarization also brings negative impacts in the form of internal fragmentation, political exploitation, and a decrease in the quality of democracy. Therefore, it is important to maintain the integrity and main function of pesantren as educational and moral institutions, and prioritize the principle of tolerance to maintain the integrity of political dynamics.

Abstract

The increase in cases of personal data breaches in Indonesia in recent years has become a very serious problem. So a personal data protection institution is needed to guarantee the protection of personal data. The existence of an independent personal data protection agency is an important aspect in carrying out personal data protection and is key in ensuring independence in the monitoring, auditing and prosecution processes. This is very crucial because regulations regarding personal data security apply to all public institutions, including executive, legislative and judicial. This research uses a normative juridical research type with a statutory approach, a comparative approach and a conceptual approach. The research results show that the personal data protection law that regulates this institution shows that there is executive involvement in the formation of the institution, thereby reducing its independence. As a result, this institution is at risk of being influenced by political interests and unable to carry out its duties accountably, effectively and efficiently.

Abstract

This research delves into the legal implications of Constitutional Court Decision No. 91/PUU- XVIII/2020, focusing on its impact on the inconsistency of Law Number 11 of 2020 and the resulting legal effects. Employing a juridical normative approach, the study examines legal concepts, principles, and regulations. The findings reveal that the Constitutional Court's conditional declaration of unconstitutionality for Law Number 11 of 2020 stems from discrepancies in its formation concerning clarity of purpose, formulation, and transparency, as stipulated by Law Number 12 of 2011 on the Formation of Legislation. The legal effects of Decision No. 91/PUU-XVIII/2020 on Law Number 11 of 2020 within Indonesia's legal system are significant. During the two-year rectification period, it retains legal status and is recorded in the Official Gazette. If no rectification occurs within two years, Law Number 11 of 2020 becomes permanently unconstitutional, and the prior laws it amended or replaced are reinstated. In conclusion, several recommendations are made: The Constitutional Court should issue clear, unambiguous verdicts for legal certainty. The public and academia should monitor government and legislative activities to uphold constitutional principles. This research sheds light on the legal implications of Constitutional Court Decision No. 91/PUU-XVIII/2020 and provides valuable guidance for Indonesia's legal and legislative stakeholders. The problem of political rights owned by former convicts arose after the enactment of PKPU No. 10 of 2023 and PKPU No. 11 of 2023 which determined that former convicts who would run for legislative candidates did not need to pass a five-year interval if they had received an additional sentence in the form of revocation of political rights. Whereas the Constitutional Court Decision No. 87/PUU-XX/2022 and Constitutional Court Decision No. 12/PUU-XXI/2023 determine that ex-convicts must pass a five-year interval, without any additional conditions. This study aims to determine the regulation of the political rights of former corruption convicts in legislative elections and to review analyze the perspective of the principles of musawa and justice on the regulation of former corruption convicts to become legislative candidates. This research uses normative legal research methods. the data used in this research uses secondary data literature legal materials. The data collected in this study were collected through documentation techniques. Based on the results of the research, it can be stated that the regulation of the political rights of former prisoners to become legislative candidates has experienced the dynamics of regulatory changes through the Election Law, Constitutional Court Decisions, Supreme Court Decisions and KPU Regulations. Supreme Court Decision No. 28 P / HUM / 2023, Constitutional Court Decision No. 87 / PUU-XX / 2022 and Constitutional Court Decision No. 12 / PUU-XXI / 2023 are in accordance with the principle of musawa in general because they have equalized the political rights of ex-corruption convicts just like other citizens.

Abstract

This study aims to examine the legal protection of children's rights exploited as beggars in Pekalongan Regency. The background of this research is the increasing phenomenon of child exploitation as beggars, which contradicts the children's rights stipulated in the constitution and laws. This research uses empirical juridical methods with legislative, conceptual, and qualitative approaches. Data were collected through observation, interviews, and documentation with informants from the Social Service as well as beggars and their children. The research results show that the legal protection efforts carried out by the Pekalongan Regency Government are still limited to handling and there are no specific basic regulations regarding the protection of children exploited as beggars. The existing policies only cover enforcement, rehabilitation, guidance, and social assistance, but have not provided strict legal protection against child exploitation. Moreover, the implementation of social assistance is often ineffective due to the lack of proper utilization by parents. This research contributes to a deeper understanding of the condition of legal protection for children exploited as beggars and provides recommendations for developing more specific and stringent regional regulations. The proposed recommendations include drafting regional regulations governing legal protection for exploited children, as well as increasing awareness and education for the community about the importance of children's rights and efforts to prevent child exploitation. This study also emphasizes the need for coordination between various government and non-governmental agencies to ensure effective and sustainable legal protection for children in Pekalongan Regency.

Abstract

The implementation of elections as an embodiment of democracy is closely related to territorial structures at national, provincial, and autonomous district levels. The Supreme Court has the authority to resolve election administration violations, including decisions that cancel the participation of candidate pairs in regional head elections. The dispute over the election of the Boalemo Regent and Deputy Regent brought to the Supreme Court for judicial review raises questions about the Supreme Court's authority under Article 154 paragraph (10), which states that the final legal remedy is cassation. This research is normative juridical research using legislative, conceptual, and case approaches, with data collected from primary, secondary, and tertiary legal materials. Analysis is conducted after data is inventoried and systematized. The results show that Article 153 paragraph (10) of Law Number 10 of 2016 states that the Supreme Court's decisions are final and cannot be subject to judicial review. The decision of the Boalemo Regency Election Commission, which established a new candidate pair after the cassation decision, violates the principle of legal certainty. The Cassation Panel stated that the candidate pair eligible to participate in the 2017 Boalemo Regent and Deputy Regent Election was Rum Pagau and Lahmudin Hambali, according to the Decree of the Boalemo Regency Election Commission.

Abstract

The waste problem is a complex environmental problem. In reality, not many leaders are able to commit to solving the waste problem. The waste crisis in Banyumas Regency which peaked in 2018, also made Achmad Husein, as Regent of Banyumas at that time, directly involved in handling the problem, even using his personal funds. This research analyzes Achmad Husein's leadership character, which has good governance principles, as well as the economic impact of the waste management initiated by him. The research was carried out using a qualitative approach with data collection techniques in the form of content analysis, using the content of kasisolusi’s podcast. Research findings show that Achmad Husein's leadership character reflects the principles of good governance in the form of participation, transparency, accountability, effectiveness and efficiency, responsiveness and equity. Achmad Husein's use of personal funds indicates his commitment and integrity in solving urgent problems. This dedication has produced results that have had a significant economic impact on the welfare of society. Apart from that, the success of the SUMPAH BERUANG (Enchant Trash Turns Money) program, has made Banyumas becoming a representative for Smart Green ASEAN Cities. The excellent solution to the waste problem in Banyumas has become a sustainable waste management system. It is hoped that the results of this research provides motivation for all communities to recommit in taking responsibility for mandated work and distance themselves from corrupt behavior in overcoming various problems, especially threatening environmental problems.

Abstract

This research discusses the legal interpretation contained in the Constitutional Court decision Number 29,51,55/PUU-XXI/2023 concerning the age limit for presidential candidates and vice presidential candidates who will run for office in the 2024 general election, who must be at least 40 (forty) Years or have/are currently holding positions elected through general elections including regional head elections in presidential and vice presidential elections. Based on the provisions of article 169 letter (q) of Law Number 7 of 2017 concerning general elections, these provisions are contrary to the 1945 Constitution of the Republic of Indonesia and could cause the loss of citizens' constitutional rights. This research aims to explain the legal interpretation by Constitutional Court judges in the Constitutional Court Decision Number 29,51,55/PUU-XXI/2023 which uses a type of normative juridical research that uses library materials as the main data to analyze cases and analyzes using analytical methods. prescriptive by describing the structure of decisions using logic and legal reasoning, and carried out using interpretation techniques. The results of this research show that the legal interpretation carried out by judges in deciding the Constitutional Court Decision Number 29,51,55/PUU-XXI/2023 uses a futuristic interpretation. Anticipatory in nature, namely an explanation of a law that does not yet have legal force. Thus, to anticipate the loss of constitutional rights, the Constitutional Court should grant the petition of the applicants who will nominate themselves as presidential candidates and vice presidential candidates in the 2024 general election. The legal consequences of using futuristic interpretation methods have the impact of creating potential conflicts of interest and their impact on the general election process.
