Abstract

Singer is a customary sanction contained in marriage problems among the Dayak Bakumpai indigenous people in North Barito Regency, Central Kalimantan in the form of traditional Dayak ceremonial equipment, slaughtering animals, gold, and agricultural products. This article wants to find out how far the effectiveness of the sanctions or singer fines is in tackling the occurrence of violations of marriage law in the Bakumpai Dayak community in North Barito Regency. Through qualitative research, it was concluded that Singer effectively maintains a family’s integrity. In addition, in general, Singer also plays a role in maintaining social balance, including marriage, adultery, ethics and morals, beliefs and beliefs, social responsibility, agreements, responsibility for the natural environment, adoption of siblings, property, accusations, theft, fights, and murder

Abstract

Indonesia is a democratic country with a unitary state system and uses a republic form. This has been stated in Indonesia's main constitution, namely the 1945 Constitution. As a consequence of using the above system, Indonesia has several regions under it which have their own autonomy. One of the autonomy that exists in Indonesia is the special status attached to the province of Yogyakarta. The privileges of Yogyakarta have long been legitimized by related laws, namely Law Number 2 of 1948. Apart from that, the privileges of Yogyakarta have also been strengthened by institutionalizing the form of the Sultanate and standardizing the highest regulations for the area; paugeran, into national regulations, namely Law No. 13 of 2012. So this research focuses on the extent to which paugeran is accommodated by Law no. 13 of 2012, specifically on the aspect of female leaders. This research is an analytic normative research using two theoretical approaches, namely stipulative theory and genealogical theory. It was found that Law no. 13 of 2012 was unable to fully accommodate the paugeran owned by the Sultanate of Yogyakarta. This is evidenced by the existence of several nomenclatures that are not in line with paugeran. In fact, paugeran is the spirit and spirit of the formation of Law no. 13 of 2012

Abstract

Salah satu bentuk transaksi yang baru dalam praktik jual beli adalah penerapan sistem pembulatan nominal uang kembalian berbelanja. Fenomena praktik pembulatan nominal kembalian ini pun semakin luas terjadi di masyarakat. Akan tetapi, praktik pembulatan yang dilakukan di beberapa toko ataupun swalayan tidak semuanya menerapkan syarat-syarat dari hukum pembulatan harga tersebut, sehingga hal ini dapat menyebabkan ketidakjelasan hukum bagi pelakunya dan kemungkinan pembeli tidak menyetujuinya. Adapun permasalahan dalam penelitian ini adalah bagaiamana implementasi pembulatan nominal uang kembalian di Toserba Fajar Luragung, bagaimana pandangan Hukum Islam terhadap implementasi pembulatan nominal uang kembalian di Toserba Fajar Luragung. Tujuan dari penelitian ini adalah untuk mengetahui implementasi pembulatan nominal uang kembalian di Toserba Fajar Luragung dan bagaimana pandangan Hukum Islam terhadap implementasi pembulatan nominal uang kembalian di Toserba Fajar Luragung. Jenis penelitian yang digunakan dalam penelitian ini adalah penelitian lapangan (field research) dengan pendekatan deskriptif kualitatif. Sumber data dalam penelitian ini yaitu data primer dan data skunder, yaitu data-data resmi yang dikumpulkan langsung oleh peneliti baik dari narasumber di lapangan ataupun dari buku, jurnal, serta litelatur lain yang berkaitan dengan tema pembahasan dan diperlukan untuk penelitian dalam meneliti permasalahan kajian. Adapun hasil dari penelitian ini adalah implementasi pembulatan nominal uang kembalian yang dilakukan oleh Fajar luragung dibolehkan karena pada praktiknya sudah sesuai dengan ketentuan yang berlaku yaitu terpenuhinya rukun dan syarat dalam jual beli mu’athaah, sejalan dengan dalil Al Qur’an surat An Nisa ayat 29, dan transaksi ini merupakan ‘urf di masyarakat

Abstract

The Bajapuik tradition describes the ongoing process of patriarchal ideological hegemony in social relations, in which the interests of the male community as a superior class are hidden, and the social rights of women as members of society are suppressed. This is a portrait of the process of gender discrimination. In the case of the bajapuik tradition, no matter how high the achievements of women and no matter The bajapuik tradition describes the ongoing process of patriarchal ideological hegemony in social relations, in which hidden the interests of the male community as a superior class, there is a suppression of women's social rights as members of society. This article wants to know how the struggle between customary tradition and Islamic law occurred in the Bajapuik tradition in Pariangan. Through qualitative research, it was concluded that   the debate between adat and sharia in Minangkabau, adat always emerged as the main winner, especially in terms of bajapuik marriage. Sharia principles that emphasize women's rights are often left behind by customary domination. In the name of respect for custom, the bajapuik tradition increasingly provides greater benefits to the male side.how high the intellectual quality of women still cannot elevate their social status to equal with men

Abstract

Nahdlatul Ulama (NU) is an organization that combines traditionalism and accommodationism with the concept of "Aswaja" as its main way of thinking. NU uses three methods (qawliy, ilhaqiy, and manhajiy) in answering legal problems. On the other hand, Muhammadiyah is an organization that emphasizes tajdid (renewal) and ijtihad in the understanding of Islam, using the methods of ijtihad bayaniy, ijtihad qiyasiy, and ijtihad al-istislahiy.  This research uses literature methods and legal approaches with primary data sources in the form of fatwas of NU, Muhammadiyyah, and banking laws, as well as secondary sources in the form of books, journals, and documents related to the research theme. This article concludes that there are different methods of determining the law on bank interest, NU uses the ilhaqi method, while Muhammadiyah uses qiyas. These differences give birth to the dynamics of legal determination due to differences in methodology. The decision of NU  and  Muhammadiyah despite various polarizations (points of similarity and difference) in the process of determining bank interest law. Thesefatwas, directly or indirectly, through the MUI ultimately have implications for Law No. 7 of 1992 concerning Banking

Abstract

This research aims to describe the gratification practices accepted by public officials within the framework of an Islamic legal perspective. The research method used is a literature review study, where various literature sources such as academic journals, books, articles and related papers are studied comprehensively. The results of this research show, among other things. First, Islamic law has a firm view on the practice of gratification accepted by public officials. This practice is considered to violate the principles of justice, transparency and accountability which are the basis of Islamic teachings. Second, in the view of Islamic law, accepting gratuities by public officials can be considered a form of bribery or rasywah which damages the morality and integrity of individuals and society as a whole. Third, Islamic scholars and scholars throughout history have voiced their rejection of the practice of gratification in the context of government or public officials

Abstract

Marriages with adhal guardians still often occur in society, even though for prospective brides marriage guardians are a requirement for a valid marriage. However, in reality, in society there are still frequent marriage guardians who refuse or are reluctant to marry off their daughters for various reasons that are not acceptable according to Islamic law and the applicable laws and regulations. This research is a qualitative descriptive study aimed at getting an overview of the problems regarding marriage to an adhal guardian and the role of the KUA in resolving marriages with an adhal guardian in the Sukoharjo Regency area. Data collection techniques in this study used direct surveys, interviews and documentation studies. The data analysis technique used in this study uses interactive descriptive analysis. The results of this study drew the conclusion that the problem of the adhal guardian occurred at the KUA in the Sukoharjo Regency where from the incident of the adhal guardian's marriage where the bride-to-be who did not get the blessing or marriage guardian refused to become a marriage guardian for various reasons that were not legally acceptable,   the steps taken taken by the prospective bride and groom is by submitting a guardian judge to the Sukoharjo District Religious Court, so that the local KUA has the right to carry out the marriage and become the guardian judge for the prospective bride and groom in each sub-district. The role of the Head of KUA in the Sukoharjo Regency area in solving the problem of wali adhal basically is that the Office of Religious Affairs (KUA) only has the authority to carry out tasks according to what is stated in the Regulation of the Minister of Religion (PMA), where the Office of Religious Affairs (KUA) only plays a role in bridging the community in solving a problem including in overcoming the problem of marriage with the guardian adhal
