Abstract

In the study of ushul fiqh, Islamic legal sources occupy a fundamental position as a methodological framework in the process of establishing law. In addition to legal sources that have been widely agreed upon, such as the Al-Qur'an, Sunnah, ijma', and qiyas, there are also a number of other legal sources whose legal status is still debated among ulama. These differences arise due to variations in approaches to understanding propositions, the use of reason, and responses to social dynamics. This article comprehensively discusses disputed sources of Islamic law, including istihsan, maslahah murlah, 'urf, istishab, syar'u man qablana, sahabi school of thought, and sadd az-zari'ah, by highlighting the meaning, basis of argumentation, and its position in the ushul fiqh methodology. This research aims to expand understanding of the function of these legal sources as a means of ijtihad in resolving legal issues that are not explained directly in the Al-Qur'an and Sunnah. The method used is library research with a qualitative-descriptive approach through a review of classical and modern ushul fiqh literature. The analysis was carried out descriptively-analytically to describe the various views of ulama and the limits of application of each legal source. The results of the study show that even though the disputed legal sources are not accepted uniformly by all schools of thought, their existence still has an important role in the development of adaptive and contextual Islamic law. As long as their use does not conflict with the qath'i propositions and remains based on maqashid al-syariah, these legal sources are able to enrich the practice of ijtihad and maintain the relevance of Islamic law in the face of changing times.

Abstract

The Sanggring tradition is a cultural tradition that continues to be preserved upon the 23rd of Ramadan, as a form of respect and obedience by the local community to a history that has been going on for centuries. The purpose of this study is to explain the meaning of the Sanggring tradition for the Gumeno community and how it serves as a medium for building solidarity within the Gumeno community. The research method used is a qualitative research method with a phenomenological approach, utilizing Emile Durkheim's theory of social solidarity as its analytical tool. Data collection techniques included interviews, participatory observation, documentation, and literature review. The data analysis technique used descriptive analysis. The results show that the meanings found in the Sanggring tradition are divided into three aspects: historical, spiritual, and social. Historically, the Sanggring tradition is closely related to the story of Sunan Dalem's journey and struggle. Spiritually, the Sanggring tradition symbolizes the community's gratitude to Allah SWT for Sunan Dalem's recovery. Socially and culturally, the Sanggring tradition serves as a means for the Gumeno community to maintain close ties with one another. The solidarity established in the Gumeno community is a mechanical solidarity formed from a shared belief that sanggring dishes can cure various ailments. This research can be beneficial for the Gresik Regency government in designing effective and participatory policies for cultural preservation. The novelty of this research lies in its emphasis on the specific social function of the sanggring tradition in enhancing social solidarity and the involvement of local government, a role that has not been widely explored in previous research.

Abstract

The Family Planning (KB) program in Indonesia still demonstrates unequal participation between women and men, particularly in the use of permanent contraceptive methods such as vasectomy. This study aims to analyze the causes of low male involvement and examine the influence of masculinity construction on reproductive decision-making. The research employs a qualitative method using a literature review approach. The findings indicate that low male participation is influenced by strong patriarchal values, the perception of fertility as a symbol of masculinity, as well as limited knowledge and access to reproductive health services. From the perspective of hegemonic masculinity, vasectomy is often perceived as a threat to masculine identity, leading to social resistance. Consequently, the responsibility for contraceptive use remains largely borne by women. This study highlights that increasing male participation in the family planning program requires policy approaches that are not only technical-medical but also sensitive to social gender constructions.

Abstract

The results of the study show that the State in order to provide legal protection for the rights of victims of false information (hoax) through Instagram media in order to create order by enacting Law Number 19 of 2016 concerning Amendments to Law Number 11 of 2008 concerning Information and Electronic Transactions. In addition, every victim of crime has the right to be protected as regulated in Law Number 31 of 2014 concerning Amendments to Law Number 13 of 2006 concerning Protection of Witnesses and Victims, however, these two laws do not specifically regulate in providing protection for the rights of victims of false information through Instagram media. Law Number 31 of 2014 that those who are said to be victims are those who experience physical, mental, and/or economic loss caused by a crime. In cases of spreading false information or hoaxes, people who are considered victims must experience the direct consequences of the crime, whether in the form of physical, mental or economic financial losses. As for the protection of the rights of victims due to false information, they can file for legal protection through a civil lawsuit. A party who has suffered material losses as a result of a criminal act can file a civil lawsuit to recover the losses suffered in accordance with civil law. Civil lawsuits can be filed based on either breach of contract or an unlawful act.

Abstract

This study examines the layered barriers faced by Sherly Tjoanda in constructing her political leadership identity in North Maluku as a leader simultaneously carrying three minority attributes: a woman, of Chinese descent, and a Christian in a predominantly Muslim region. Employing a qualitative case study approach, the research draws on public document analysis, media coverage, KPU electoral data, and recent academic literature (2022–2025). The theoretical framework integrates intersectionality (Crenshaw, 1989), the glass ceiling concept (Morrison et al., 1987), hegemonic masculinity (Connell, 1995), and transformational leadership theory (Burns, 1978; Bass, 1985). Findings identify three clusters of barriers: gender-structural barriers rooted in patriarchal norms and party recruitment systems, ethnic-religious identity barriers that mobilize majoritarian sentiment, and legitimacy barriers questioning her political agency. Nevertheless, Sherly successfully navigated these barriers through transformational leadership strategies characterized by empathy, a public service narrative, and the productive mobilization of public sympathy. Her victory with 51.68 percent of the vote in the 2024 regional election demonstrates that local democratic maturity can transcend identity boundaries. This study contributes to the intersectional framework in Indonesian women’s leadership scholarship and enriches the literature on transformational leadership within complex identity contexts in local politics.

Abstract

Gender inequality remains an ongoing issue within Indonesia’s social dynamics. Although various policies have been introduced to strengthen the principle of equality between men and women, unequal gender relations can still be observed in both domestic and public spheres. In this context, feminism, which seeks to challenge gender inequality, is often misunderstood as a movement that opposes men or as an ideology that contradicts cultural values and social norms. This study aims to examine how feminism is perceived within Indonesian society and how patriarchal culture contributes to maintaining such misconceptions. This research employs a qualitative approach using a literature study method based on academic journals, scholarly books, and official publications related to feminism and patriarchy. The theoretical framework applied in this study is Judith Butler’s post-structuralist feminism, which emphasizes that gender identity is socially constructed through the repeated performance of cultural norms. The findings indicate that misconceptions about feminism are not only influenced by limited gender literacy but also by the internalization of patriarchal values that have long been normalized within social life. These values are reproduced through family structures, educational institutions, media representations, and cultural practices that shape the image of the “ideal woman.” Therefore, a more contextual understanding of feminism is necessary to foster a more constructive discussion on gender equality in Indonesian society.

Abstract

Economic inequality in rural Indonesia remains a significant challenge, especially for low-income families who have limited access to formal financial institutions. Microcredit emerges as an accessible alternative solution, particularly for women who manage household finances. This study was conducted in Simongagrok Village, Dawarblandong District, Mojokerto Regency, aiming to understand the meaning and utilization of microloans among housewives who are clients of Bank Mekar. Using a qualitative approach and Max Weber’s social action theory, the research explores the experiences, motivations, and strategies of women in obtaining and managing microloans. Findings reveal that microloans are predominantly used for daily consumption needs and debt repayment rather than productive business capital. Women play a central role as household managers, combining economic rationality with socio-cultural values. Social solidarity within borrower groups provides support as well as psychological pressure. The cycle of debt and strict repayment obligations create tension between aspirations for economic independence and the reality of financial constraints. This study emphasizes that microcredit is a complex socio-economic phenomenon that must be understood within the cultural and social structures of poor rural communities.

Abstract

This study aims to analyze the reproduction of patriarchy and masculine dominance in local politics in North Sumatra through a feminist perspective, highlighting the role of the patrilineal clan system in shaping social and political power structures. In Batak society, lineage is traced through men, thus positioning men as the successors of the clan and the primary representatives in both customs and social life. This condition causes male authority not only to remain within the family sphere but also extends into the public sphere, including local political practices. This study uses a qualitative approach with a desk study method through a review of literature, scientific journals, and regulations related to gender, customs, and local politics. The results show that patriarchy is reproduced through the clan system, customary practices, and the concept of Dalihan Na Tolu, which strengthens men's legitimacy in leadership and kinship-based power networks. In political contests, masculinity is often used as symbolic capital to gain voter trust, resulting in low female representation despite the 30 percent affirmative action quota policy. These obstacles are not only structural but also cultural, as customary norms still position men as more worthy figures for leadership. Therefore, efforts to achieve gender equality require changes not only in formal policies but also in cultural values and social practices within society.

Abstract

The diversity of religions, cultures, and social backgrounds in school environments requires leadership that can manage differences constructively in order to build an inclusive educational environment. However, studies on multicultural leadership models based on the practical leadership of school principals in plural elementary school contexts remain relatively limited. This study aims to analyze the implementation of the BRIDGE multicultural leadership model in improving school inclusivity. The research employed a qualitative approach using a case study method at SD Negeri Palalangon 2, Cianjur Regency. Data were collected through interviews, observations, and documentation, and then analyzed using the interactive analysis model of Miles and Huberman. The findings indicate that the implementation of the BRIDGE model—comprising the dimensions of Balanced Perspective, Respect, Interaction, Dialogue, Growth, and Empowerment—can foster a school culture that values diversity, strengthen cross-cultural communication, and enhance collaboration between the school and the community. The novelty of this study lies in the development of the BRIDGE multicultural leadership model as an integrative and contextual leadership framework for managing social diversity in elementary schools. This model contributes conceptually to the development of multicultural educational leadership studies while also offering a practical approach to building inclusive schools.

Abstract

This study aims to analyze the dynamics of gender power relations within bureaucratic structures through the perspectives of institutional patriarchy and hegemonic masculinity in the Department of Women’s Empowerment, Child Protection, Population and Family Planning (DP3AKKB) of Banten Province. The research employs a qualitative method with a case study approach. Data were collected through literature review and document analysis of official institutional documents, including strategic plans, performance reports, and organizational staffing data. Data were analyzed qualitatively using thematic reading and critical interpretation to identify patterns of position distribution, leadership practices, and organizational culture shaping gender relations in the bureaucracy. The findings indicate that women hold a strong numerical representation in the leadership structure of DP3AKKB, with the majority of strategic positions occupied by female officials. However, the hierarchical organizational structure and bureaucratic leadership norms emphasizing authority, seniority, and administrative rationality still reflect the influence of masculine values in leadership legitimacy. This condition creates an institutional paradox in which an institution mandated to promote gender equality continues to operate within a bureaucratic framework that potentially reproduces gendered power relations. The study suggests that gender equality in bureaucracy cannot be measured solely by women’s numerical representation but also requires transformation in organizational culture and substantive power distribution in decision-making processes.
