Abstract

This study aims to examine the legal-formal discourse structure within shopping center and supermarket regulations and analyze its normative implications for market accessibility for local enterprises. Using a qualitative document research method with a Critical Discourse Analysis (CDA) approach, the research instrument comprised a legal corpus inventory rubric alongside textual and contextual coding matrices to map ideological constructions regarding zoning clauses, partnership schemes, and local product quotas. Data analysis was executed following Norman Fairclough’s three-dimensional framework: microscopic textual analysis, discursive practice analysis (production and consumption of regulations), and socio-structural practice analysis. The results demonstrate that the regulatory text predominantly constructs an administrative-technical restrictive discourse that implicitly perpetuates the dominance of modern retail giants. Although existing legislation incorporates imperative clauses concerning mandatory partnerships and minimum local product quotas, its legal articulation remains ambivalent and highly formalistic. The lack of stringent administrative sanctions and clear standards for local product curation constitute the primary structural barriers hindering the competitiveness of micro and small enterprises. The study concludes that current regulations fail to function fully as affirmative protective mechanisms, instead relegating local businesses to a subordinate status within the modern retail ecosystem.

Abstract

The increasing mobility and investment activities of foreign nationals (WNA) affiliated with Israel in the Province of Bali have triggered complex issues in constitutional and administrative law. This phenomenon becomes more complicated when Israeli nationals enter Indonesia using dual passports, such as passports issued by European countries, in an attempt to circumvent immigration restrictions. Geopolitical sensitivities have prompted local public demands for the Bali Regional Government to take firm action to regulate the presence and business activities of such foreign nationals. However, unilateral action by the Regional Government may potentially exceed the limits of its legal authority. This normative legal research aims to examine the limits of applying the ultra vires doctrine to actions taken by the Bali Regional Government and to formulate a framework for harmonizing the respective authorities of the Bali Regional Government and the Directorate General of Immigration. This research employs a statutory and conceptual approach by analyzing the norms contained in the 1945 Constitution of the Republic of Indonesia, the Regional Government Law, the Immigration Law, and the Government Administration Law. The findings indicate that actions by the Bali Regional Government that directly restrict residence permits or prohibit the presence of foreign nationals holding dual passports constitute acts exceeding authority (ultra vires), as immigration affairs and foreign policy fall under the exclusive authority of the Central Government. Nevertheless, the Bali Regional Government retains the authority to take action against violations concerning spatial planning, regional licensing, illegal asset ownership through nominee arrangements, and disturbances of public order. Harmonization of authority can be achieved through integrated law enforcement within the framework of the Foreigners Monitoring Team (TIMPORA).

Abstract

This study examines the historical development of Islamic educational institutions in Indonesia, including pesantren (Islamic boarding schools), madrasah, and formal schools, along with integration models between schools/madrasah and universities with pesantren. Using a historical-descriptive approach through library research methodology, this study traces the historical roots of pesantren as the oldest Islamic educational institution in the Nusantara archipelago, the transformation of madrasah from Islamic boarding schools into nationally standardized formal institutions, and the dynamics of general schools within Islamic contexts. The findings indicate that all three institutions have undergone significant transformation, particularly following the enactment of the National Education System Law No. 20 of 2003 and the Pesantren Law No. 18 of 2019. Integration models that have emerged include: (1) campus pesantren model (ma'had al-jami'ah), (2) integrated madrasah based on pesantren, (3) Islamic boarding schools, and (4) higher education institutions based on Islamic boarding schools. These integrations reflect efforts to address the challenges of modernity while maintaining Islamic values and local wisdom.

Abstract

This study aims to examine the effect of capital structure, information asymmetry, and accounting conservatism on earnings quality and to investigate the role of managerial entrenchment as a moderating variable. This study employed an associative quantitative approach using secondary panel data. The population consisted of food and beverage subsector companies listed on the Indonesia Stock Exchange during the 2020–2024 period. The sample was selected using purposive sampling, resulting in 20 companies with a total of 100 observations. The data were analyzed using panel data regression and Moderated Regression Analysis (MRA). The results indicate that capital structure and information asymmetry have no significant effect on earnings quality, whereas accounting conservatism has a positive effect on earnings quality. Furthermore, managerial entrenchment has no significant effect on earnings quality and is unable to moderate the relationship between capital structure, information asymmetry, and accounting conservatism and earnings quality. Therefore, earnings quality in food and beverage subsector companies is influenced more by the implementation of accounting conservatism than by capital structure, information asymmetry, or managerial entrenchment.
