Abstract

Legal reasoning in Indonesia takes place not only within the framework of the legal-positivistic state legal system, but also within the customary legal systems that thrive and develop within local communities. This situation creates a pluralistic legal configuration, where two or more legal systems operate side by side, but not always harmoniously. This paper examines the characteristics of legal reasoning in the state and customary justice systems, as well as the various challenges to harmonizing them. It finds that state justice tends to prioritize legal certainty and procedural rationality, while customary justice prioritizes restorative, contextual, and communal-value-based justice. Epistemological inequalities, state dominance, and minimal institutional support are the main obstacles to recognizing customary legal systems. Nevertheless, there are positive prospects through hybrid approaches, regulatory reform, digital innovation, and strengthening the capacity of customary communities. Recognition of customary justice systems is not only crucial for expanding access to justice but also serves as a concrete step toward building a national legal system that is inclusive, democratic, and in line with Indonesia's social realities.

Abstract

This study explores the controversy surrounding the authenticity of President Joko Widodo's academic diploma, which has been alleged to be falsified by certain parties despite substantial legal and administrative evidence confirming its validity. The research aims to systematically analyze the legitimacy of the forgery accusations from the perspectives of criminal law, administrative law, and legitimacy theory within a constitutional democratic framework. A qualitative descriptive method is employed, based on phenomenological observation and normative-doctrinal approaches to statutory regulations, court decisions, and official institutional statements. Universitas Gadjah Mada has officially declared that President Joko Widodo is a legitimate graduate of the Faculty of Forestry, class of 1985, a claim further substantiated by the ruling of the Jakarta Administrative Court, which rejected a lawsuit challenging the authenticity of the diploma. From a criminal law standpoint, the elements of document forgery as stipulated in Article 263 of the Indonesian Penal Code (KUHP) are not fulfilled. Theoretically, the authenticity of the document is also supported by the presumption of regularity principle in administrative law, as well as Max Weber's rational-legal legitimacy theory. The study concludes that the fake diploma issue is legally unfounded and more politically motivated than juridically substantiated.

Abstract

Masyarakat Indonesia, khususnya di daerah-daerah tertentu, memiliki kepercayaan yang kuat terhadap praktik santet dan ilmu gaib. Keyakinan ini dapat mempengaruhi cara penanganan masalah hukum terkait, baik oleh masyarakat maupun penegak hukum. Hal ini menciptakan situasi di mana penilaian subjektif sering mempengaruhi laporan dan keputusan dalam kasus-kasus yang berkaitan dengan santet. Banyak praktik santet dihubungkan dengan keyakinan agama dan tradisi lokal. Beberapa umat beragama mungkin bersikap skeptis atau menolak hukuman untuk tindakan yang dianggap "spiritual" atau "kultural." Ini sering mempersulit proses hukum dan penegakan hukum. Adapun rumusan masalah dalam penulisan tesis ini adalah: (1) Bagaimana tinjauan yuridis alat bukti untuk membuktikan secara materiil adanya tindak pidana santet? (2) Bagaimanakah penerapan metode pembuktian terbalik untuk membuktikan secara materiil adanya tindak pidana santet? SEDANGKAN metodelogi yang digunakan adalah yuridis normative dengan menggunakan pendekatan Pendekatan Perundang-Undangan, Pendekatan Konseptual dan Pendekatan Sejarah.

Abstract

Since the enactment of Permenkumham Number 7 of 2021, the Estate Office has determined that every transfer of property rights involving underage heirs must go through the assistance of the Estate Office. The aim is to protect their civil rights and ensure the security and benefits for the parties, especially children who are still minors. The purpose of this study is to determine the implementation of the function of the Inheritance Office in the process of transferring land rights to heirs in guardianship and to analyze the urgency of the involvement of the Inheritance Office in the process of transferring land rights to heirs in guardianship. This study uses a normative research type with the focus of the study being positive law which is the law that applies at a certain time and place. The Inheritance Office functionally has the authority to provide assistance, approval, or recommendations in the process of transferring inherited property (including land and other assets), especially if there are heirs who are still minors in guardianship, even though the status of the child's guardianship has been determined by the court. Other objectives related to the involvement of the Inheritance Office as a supervisor of guardians or custodians can guarantee the rights of minors and people under guardianship, and prevent unlawful acts that can harm them in managing assets.

Abstract

The main duties of the TNI have been regulated in Article 7 paragraph 1 of Law Number 34 of 2004 concerning the Indonesian National Army. However, currently many active TNI members are found not only serving in their units but also actively involved in civil government positions which are suspected of being contrary to applicable laws and regulations. The problems in this study are how is the legality of Active TNI members who occupy civilian positions based on Law Number 34 of 2004 concerning the Indonesian National Army, and how are the problematic of dual positions of Active TNI members who occupy civilian positions. This research is a normative legal research. The results of the study show that the legality of active TNI members in occupying civilian positions has been regulated in Law Number 34 of 2004 concerning the Indonesian National Army and the Draft Law on Amendments to Law Number 34 of 2004 concerning the Indonesian National Army in 2025. The appointment of active TNI soldiers to civilian positions does not have to be a problem as long as it does not violate the provisions of applicable laws and regulations. This will certainly fulfill the principle of justice where the TNI has an important role in the process of independence of this country so that it is very appropriate to be given space to participate in determining the direction of national development. In addition, the TNI also has many superior human resources and can be utilized according to their competencies.

Abstract

This study analyzes the implementation of child maintenance rights fulfillment after divorce based on the Decision of the Religious Court of Surabaya Number 4971/Pdt.G/2024/PA.Sby. The research employs an empirical legal method with a qualitative approach through interviews with the involved parties. The results indicate that despite the court decision having permanent legal force, its implementation has not fully complied with the verdict, where the father only pays partial child support. These findings confirm systemic weaknesses due to the court's passive authority and the absence of a post-ruling monitoring mechanism. Grounded in John Rawls' social justice theory, this study recommends active state intervention through compulsory technical regulations to ensure certainty in fulfilling child maintenance rights, regardless of the parents' employment status. The research highlights the urgency of proactive legal protection for children as the most vulnerable party in divorce cases.

Abstract

Artikel ini menganalisis implikasi hasil United Nations Climate Change Conference Ke-30 (COP 30) tahun 2025 terhadap komitmen iklim Indonesia. Latar belakang penelitian didasari oleh posisi strategis Indonesia dalam isu perubahan iklim global, baik sebagai pemilik hutan tropis terbesar ketiga maupun sebagai pihak yang telah meratifikasi Paris Agreement 2015. Melalui pendekatan hukum normatif, penelitian ini mengkaji bagaimana hasil COP 30 yang dinilai kurang ambisius, khususnya terkait ketiadaan peta jalan penghapusan bahan bakar fosil yang mengikat berinteraksi dengan kewajiban hukum Indonesia berdasarkan asas pacta sunt servanda. Kesimpulan menunjukkan bahwa meskipun hasil COP 30 tidak memuaskan, komitmen Indonesia untuk mematuhi Perjanjian Paris dan Tujuan Pembangunan Berkelanjutan (SDGs) tetap mengikat secara hukum. Oleh karena itu, Indonesia diharapkan dapat memperkuat implementasi kebijakan iklim di tingkat nasional sebagai wujud tanggung jawab dalam tata kelola lingkungan global.

Abstract

Penelitian ini membahas bentuk dan mekanisme perlindungan hukum bagi pasien dalam penggunaan terapi sel punca (stem cell) berdasarkan kerangka hukum kesehatan di Indonesia, yang diatur melalui Undang-Undang Kesehatan, Undang-Undang Praktik Kedokteran, Undang- Undang Tenaga Kesehatan, Undang-Undang Rumah Sakit, serta secara khusus melalui Peraturan Menteri Kesehatan Nomor 32 Tahun 2018 tentang Penyelenggaraan Terapi Sel Punca. Terapi sel punca sebagai bentuk terapi medis lanjut memiliki risiko tinggi sehingga memerlukan perlindungan hukum yang bersifat preventif dan represif. Perlindungan preventif diberikan melalui hak atas informasi, mekanisme informed consent, standar kompetensi tenaga kesehatan, sertifikasi fasilitas kesehatan, serta prosedur teknis pengolahan dan penggunaan sel punca yang ketat. Sementara itu, perlindungan hukum represif diberikan melalui mekanisme administratif, perdata, dan pidana apabila terjadi pelanggaran, malpraktik, atau penyalahgunaan terapi sel punca. Pasien dapat menuntut ganti rugi melalui instrumen gugatan perdata berdasarkan Pasal 1365 dan 1367 KUH Perdata, sementara sanksi pidana dapat dikenakan terhadap penggunaan sel punca ilegal berdasarkan UU Kesehatan dan UU Praktik Kedokteran.

Abstract

The fulfillment of workers' rights within bankruptcy proceedings remains a critical issue in Indonesia's legal system. This study analyzes the legal implications of the bankruptcy ruling against PT Sri Rejeki Isman Tbk (Sritex) on the fulfillment of labor rights. The declaration of PT Sritex's bankruptcy by the Commercial Court of Semarang in 2024 resulted in legal consequences, including a general seizure of company assets and settlement by a curator. This study examines the position of workers as preferred creditors under the Manpower Act and Constitutional Court Ruling No. 67/PUU-XI/2013, which stipulates that outstanding wages must be prioritized over all other types of creditors, including secured creditors. Other normative rights, such as severance pay, long service pay, and compensation for rights, rank after secured creditors but before concurrent creditors. Although the legal framework provides priority protection for workers, its implementation in the PT Sritex case faces challenges due to the company's total debt significantly exceeding its asset value. The research concludes that in the settlement of PT Sritex's bankruptcy estate, the curator should refer to the Constitutional Court's Ruling to ensure the protection of labor rights.

Abstract

Non-performing loans (NPLs) at State-Owned Enterprise (SOE) banks are often seen as a civil issue between the bank and the debtor. However, in practice, certain non-performing loans involve abuse of authority, document manipulation, and collateral engineering that result in state financial losses. This article aims to analyze the position of non-performing loans at SOE banks from the perspective of criminal law regarding corruption. This study uses a normative legal research method with a legislative and conceptual approach. The research findings indicate that non-performing loans at SOE banks can be qualified as corruption offenses if, in the process of granting, disbursing, or managing them, there are illegal acts, abuse of authority, and malicious intent that cause state financial losses. Thus, a legal relationship that was initially civil in nature can shift into a special criminal law domain.
