Abstract

Termination abrogates or brings to an end a valid contract of employment. The act could be in form of notice of intention to bring the agreement between the parties to an end by employer or employee or it could manifest in the form of payment of salary in advance, i.e. in lieu of notice. Dismissal is instant removal from office without notice. Any employer need not adduce reason or motive for terminating the appointment of the employee with notice, but it is mandatory for the said employer to do so where he seeks to dismiss an employee. Dismissal must be based on cogent and compelling grounds as it carries with it the elements of shame, disgrace and odium as well as loss of earnings like wages and other benefits e.g. pension and gratuity. It is an affront to human dignity when one reads such dicta as ‘reinstatement will not be order even if the employee’s right to fair hearing is breached, ‘no employee can be imposed on an unwilling employer even where the employer’s behavior or motive for getting rid of the employee is wrongful, unjustifiable, unfounded or repulsive. Wrongful termination of employment, no matter how grievous can only result in damages. Nigerian employees need to be protected from the victimization, vindictiveness, nepotism and narrow-mindedness of the employers. Justice requires that punishment should be commensurate with the degree of wrongdoing.

Abstract

E-commerce has generated a lot of interest across the globe where individuals sit in the comfort of their homes and purchase goods and services. However, study linking youths in many developing countries to the new trend seem to be affected by skepticism. Therefore, this study examines perceived trustworthiness and perceived risk-taking as predictors of online shopping behavior among youths in Ibadan metropolis. Cross-sectional survey design was adopted while data were collected from 200 randomly selected participants. Data were collected using validated scales and analyzed using zero-order correlation, t-test for independent samples, and multiple regression analysis to test three hypotheses at a p < 0.05 level of significance. The result revealed that perceived trustworthiness and perceived risk-taking significantly correlated with online shopping behavior among study participants. Also, the results revealed that perceived trustworthiness and perceived risk-taking jointly predicted online shopping behavior. Finally, both perceived trustworthiness and perceived risk-taking independently predicted online shopping behavior among study participants. The study concluded that perceived trustworthiness and perceived risk-taking are excellent predictors of online shopping behavior among those who took part in the study. It is advised that web designers and internet marketers create online shopping platforms that foster confidence and discourage risk-taking in order to attract and retain more online customers.

Abstract

This study was conducted with the objectives: 1). To identify factors that influence farmers' decisions in using certified seeds in Pemayung District. 2). To analyze factors that influence farmers' decisions in using certified seeds in Pemayung District. The study was carried out in the Batang Hari Regency's Pemayung District. Because the majority of rice growers here utilize certified seeds, this location was selected. After the discussion, a constant value (a) of -3.085 was determined. This indicates that the value of the seed usage decision is -3.085 if all the factors under study (age, income, experience, education level, and land area) have values equal to zero (0). The value of the age coefficient (b1) is 0.142. This indicates that, provided the values of the other variables remain constant, an increase of one unit in the age variable will result in a 0.142 unit drop in the seed usage decision's value. The coefficient value (b2) for education level is 0.518. The results of Nagelkerke R Square demonstrate the influence of the variables of age (X1), education (X2), farming experience (X3), land area (X4), and income (X5) on this variable. This indicates that a 42% explanation of the dependent variables can be attributed to the independent variables in the model. Other factors not included in this study, such as the activity of farmer groups, risk preferences, land ownership status, and others, account for the remaining 58% (100% - 58%). The Education variable, with a Wald value of 4.613 and a Significance value of 0.032, and the Business Experience variable are the variables with a Wald value larger than 3.841 and a significance level lower than 0.05. While other factors, such as income, land area, and age, have significance values larger than 0.050 and Wald values smaller than 3.841, they have no effect on farmers' decisions to use certified seeds.

Abstract

Highways are infrastructure for smooth traffic, both in cities and in regions. Noise and vibration are one of the environmental health problems in large and developing cities, such as Padangsidimpuan City. The transportation sector is the main cause of environmental problems today, according to Minister of Health Regulation No.78/Men.Kes/Per/XI/1987, which is called Noise is the occurrence of unwanted sounds that disturb and/or endanger health. The noise level quality standard is used as a reference standard that ensures that a certain area/region does not cause disturbances, especially to human health and environmental comfort. (Ruly Asmarani, 2017) said that noise is a type of environmental stimulus to which each individual can respond differently. Based on the noise level captured by the SLM (Sound Level Meter), the highest noise level occurs at 07:00 - 08:00 WIB at 72.80 dB compared to other hours and is reviewed based on the characteristics of land use for the school area. The noise level limit value is 55 d.B(A) and the highest noise occurs at 07-08 am with a noise level of 72.8 decibels and the lowest noise occurs at 10-11 WIB with a noise level of 47.8 decibels. From the results of this research, it is recommended that schools close windows during the learning process to reduce the noise caused by passing vehicles.

Abstract

Decision of the Coca-Cola transfer pricing dispute in the United States Tax Court, which resulted in tax underpayment, can be used as a lesson for Indonesia. This research method is doctrinal, with a law, case, concept and interpretation approach. The data studied is secondary data in the form of laws, cases and relevant references, which are analyzed to obtain conclusions and recommendations. Research shows that the court considered using the Comparable Profits Method by tax authorities to evaluate the profitability of The Coca-Cola Company's supply points, given the difficulty of valuing intangible assets directly and the need for disproportionate profit adjustments. To avoid similar problems, companies in Indonesia must use transfer pricing methods that are reliable and appropriate to local conditions, as well as ensure good intellectual property management and documentation transparency, while tax authorities must monitor transactions between affiliated entities by international standards and the Arm's Length Principle.

Abstract

The educational process in higher education institutions no longer only prioritizes the acquisition of information, but rather focuses more on the development of skills and information processing. Therefore, it is necessary to increase student activity through group exercises or assignments and expression of ideas to peers. This has attracted the attention of researchers to observe how students learn in class when given an interactive learning model that is different from conventional methods. Based on the results of observations in class IX.6 SMP 29 Makassar, a problem was found where the monotonous learning process by the teacher and the initial pretest showed several students with low (D) and failed (E) scores. It can be concluded that the low learning outcomes are also influenced by the lack of student learning activities. This type of research is Classroom Action Research (CAR) with subjects of class IX.6 SMP 29 Makassar students. The research was conducted for two cycles with four meetings. The results of the study indicate that the application of an interactive learning model can improve student learning activities in the Introduction to Education course in Biology B class, Patompo University. The average percentage of student learning activities in cycle I was 56.55%, increasing to 81.55% in cycle II. Therefore, there was an increase of 25.00% from cycle I to cycle II. In addition, the use of interactive learning models also had a positive impact on student learning outcomes. The average post-test score of students in cycle I was 70, increasing to 81.43 in cycle II. Thus, there was an increase in the average value of learning outcomes of 11.43% from cycle I to cycle II.
