Abstract

This research is in the field of Islamic economic law, specifically muamalah jurisprudence, focusing on the concept of qabdh (control) in digital gold savings transactions at Bank Syariah Indonesia. The purpose of this article is to analyze the conformity of digital gold savings practices with the concept of qabdh hukmi and assess its legal implications for the validity of transactions. This topic is important because the development of Islamic financial technology has resulted in a shift in the form of control from physical to digital, which requires fiqh legitimacy. The research method used is qualitative with a normative-empirical approach through literature studies and analysis of operational practices. The hypothesis of this research is that qabdh hukmi can be the basis for legitimizing digital gold transactions as long as they comply with sharia principles. The results show that the practice of digital gold savings at Bank Syariah Indonesia has fulfilled the elements of qabdh hukmi through recording ownership and customer access control. This research contributes to the development of contemporary ijtihad regarding the digitalization of Islamic assets. In conclusion, qabdh hukmi is relevant as a legal basis, thereby strengthening the validity of digital gold transactions in the modern Islamic banking system

Abstract

This study aims to analyze the stock trading mechanism on the Indonesia Stock Exchange (IDX) and examine the Non-Cancellation Period policy from the perspective of Islamic law, particularly through the concept of khiyar. This research employs a normative legal method with a conceptual approach, focusing on the analysis of fiqh muamalah principles in relation to modern stock trading practices. The findings indicate that stock trading on the IDX is conducted through a structured electronic system, where transactions are deemed to occur upon the matching of buy and sell orders. The Non-Cancellation Period policy restricts the modification and cancellation of orders within a specific timeframe to maintain price stability and prevent potential market manipulation. From an Islamic law perspective, this restriction does not fundamentally contradict the concept of khiyar majlis, as orders that have not yet been matched cannot be considered legally binding contracts. Furthermore, based on the fiqh principles of dar’u al-mafāsid muqaddam ‘alā jalb al-maṣāliḥ (preventing harm takes precedence over attaining benefit) and lā ḍarar wa lā ḍirār (no harm and no reciprocating harm), the policy can be justified as it aims to prevent collective harm and preserve market integrity. Therefore, the Non-Cancellation Period reflects an adaptation of Islamic legal principles within modern trading systems while maintaining justice and public interest

Abstract

This study aims to analyze the feasibility of Pak Zain's cassava tapai agro-industry business using Hamdi's Method consisting of the Gold Value Method (GVM) and the Gold Index (GI). The research method used is a quantitative approach with a case study on Pak Zain's cassava tapai agro-industry business in Pekanbaru. The results of the study show that Pak Zain's cassava tapai agro-industry business using Hamdi's Method consisting of the Gold Value Method (GVM) obtained a positive gold value of 115.094 grams, which indicates that the investment for the business is feasible. The Gold Index (GI) value = 3.822 grams because GI> 1, then the cassava tapai business is declared feasible to run based on the GI criteria. As a comparison, using a conventional perspective, namely NPV and PI, produces NPV = Rp. 409,328,230.16 (positive) / (NPV > 0), so that the business is financially feasible to run according to the NPV decision criteria (NPV > 0 = feasible). Then, the Profitability Index value is 12.87 (PI) > 1, so that Mr. Zain's cassava tapai agro-industry business is profitable and feasible. From the results of the business feasibility analysis, it can be identified that Mr. Zain's cassava tapai agro-industry business in Pekanbaru city is financially feasible. The Hamdi's Method is effectively used for business feasibility analysis.

Abstract

This study is situated within the discourse of Islamic business law, particularly focusing on legal certainty in halal certification for Micro, Small, and Medium Enterprises (MSMEs) within Indonesia’s Islamic economic ecosystem. The issue addressed is that, despite the existence of a strong legal framework governing halal certification, its implementation for MSMEs continues to face challenges related to access, procedural complexity, assistance, and supervision. This study aims to analyze the construction of legal certainty in halal certification for MSMEs and to examine its role in strengthening the position of MSMEs within the Islamic economic ecosystem. The research employs a normative juridical method with statutory and conceptual approaches. Data are collected through a literature review of laws and regulations, official government documents, institutional reports, and relevant scholarly articles; this study does not involve population or sampling as it is non-empirical in nature. The findings indicate that halal certification is structured through mandatory certification, mandatory disclosure for non-halal products, phased implementation for micro enterprises, the self-declare scheme, and free halal certification facilitation programs. However, legal certainty is only meaningful when supported by clear procedures, accessible systems, affordable costs, adequate assistance, and consistent supervision. This study contributes to Islamic business law by positioning halal certification as a legal instrument that enhances consumer protection, market trust, and the sustainability of MSMEs. Halal certification should therefore be understood as an inclusive mechanism for strengthening the Islamic economy, rather than merely an administrative formality.

Abstract

The purpose of this study is to explore the potential and challenges associated with the implementation of the Halal Value Chain in halal food MSMEs in Bengkulu City's Berendo Area. Although the Halal Value Chain (HVC) has not yet been fully established, the Berendo Area was chosen because it has been designated as a Halal, Safe, and Healthy Culinary Zone (Zona KHAS). This study employed a descriptive qualitative technique and field research methodology. In-depth interviews, observation, and documentation were used to gather data. Purposive sampling was used to select five MSMEs and five customers as informants. Data reduction, data presentation, and conclusion drafting were used in the data analysis process. The findings demonstrate that while all MSMEs have received halal certification, the HVC's implementation is subpar. Weaknesses in the input stage, production process, and processing and service aspects have an impact on the compliance rate, which is around 75%. The region's backing as a halal hub, growing consumer confidence, and the possibility of halal culinary tourism make the implementation of HVC extremely promising. Low halal literacy, a lack of comprehension among MSMEs, business competition, and problems with parking and guest comfort are some of the obstacles.

Abstract

This study aims to examine the role of TikTok advertisements in shaping students' buying interest in fashion brands and the perspective of Sharia marketing ethics on these TikTok advertisement practices. This study uses a qualitative approach with the type of field research. Informants were selected using purposive sampling technique, totaling 9 active students from the Faculty of Islamic Economics and Business at UINFAS Bengkulu who use TikTok and have been exposed to fashion brand advertisements. Data collection was conducted through interviews, observation, and documentation. The results indicate that TikTok advertisements for fashion brands play a real role in shaping students' buying interest through four functions: informing, by clearly conveying fashion product information to attract attention; influencing, by affecting through visual appeal and content creativity; reminding, by maintaining students' memory of the brand and product; and adding value, by encouraging concrete actions up to purchase. From the perspective of sharia marketing ethics, the justice of Al-'Adl has been well fulfilled; however, the honesty of Shiddiq and the responsibility of Amanah have not been optimally fulfilled, as indicated by the tendency of sellers to only convey product advantages, inconsistency between advertisement appearance and the product received, and untimely delivery. This study concludes that there is still a gap between TikTok advertising practices by fashion brands and Islamic ethical values that need to be improved.

Abstract

The scarcity of subsidized fertilizer and inefficient distribution systems are challenges that can reduce farmers’ productivity and income. This study aims to analyze the effect of subsidized fertilizer scarcity and distribution efficiency on farmers’ income, with Islamic values as an intervening variable. The research used a quantitative method, with a sample of 60 farmers in Suka Makmur Village, BTS Ulu District, Musi Rawas Regency, and was analyzed using path analysis in SPSS 27. The results showed that subsidized fertilizer scarcity and distribution efficiency simultaneously affected Islamic values, but only distribution efficiency had a significant effect. In addition, Islamic values significantly influenced farmers’ income and acted as a full mediation variable. These findings indicate that implementing the principles of justice, trustworthiness, and transparency can improve farmers’ welfare. This study recommends the digitalization of fertilizer distribution and the strengthening of Islamic economic values in agricultural assistance programs.
