Abstract

The childfree phenomenon the deliberate choice of married couples not to have children is increasingly prevalent in Indonesia and has sparked serious debate in Islamic family law discourse, particularly regarding the principle of hifz al-nasl (preservation of progeny) as one of the fundamental elements of maqashid al-syari'ah. This study aims to deconstruct the meaning of hifz al-nasl from classical and contemporary perspectives, analyze the legal status of the childfree choice within the framework of Islamic family law, and formulate a comprehensive and contextual legal construction. This research employs a normative legal research method using library research, Jasser Auda's contemporary maqashid al-syari'ah approach, conceptual approach, and comparative approach. Data analysis was conducted qualitatively through content analysis, descriptive-analytical, deconstructive-reconstructive, and comparative techniques. The findings reveal three key conclusions: first, the deconstruction of hifz al-nasl produces a more comprehensive understanding through Jasser Auda's reconstruction that expands hifz al-nasl into hifz al-usrah (family protection), shifting the orientation of progeny preservation beyond mere biological reproduction to encompass family quality and overall well-being; second, the typological analysis of childfree yields a graduated legal mapping: voluntarily childfree without valid religious justification is ruled makruh to haram, temporarily childfree is permissible as equivalent to tandzim al-nasl, and voluntarily childfree due to medical emergency may be permitted; third, legal reconstruction based on Jasser Auda's system approach produces a more just and relevant legal construction for Muslim couples in Indonesia. This research contributes to the development of contemporary Islamic family law discourse in Indonesia.

Abstract

The purpose of this study is to focus on the role of innovative governance in supporting the digitalization of sustainable mobility to improve the efficiency and accessibility of urban transportation. This study aims to investigate the potential of the bright governance concept to accelerate digital transformation in Makassar City's transportation system. The research method used is a qualitative approach with data collection techniques through in-depth interviews, field observations, policy document analysis, and Focus Group Discussions (FGD). Key informants include local governments, transportation operators, academics, and community users of transportation services. The data obtained were analyzed using NVivo 12 Plus to identify patterns and relationships in digital transportation policies. The findings of this study indicate that transportation digitalization in Makassar City through Teman Bus Trans Mamminasata, QRIS payments, and intelligent transportation systems has successfully improved the efficiency, transparency, and quality of public services, as seen from the increase in the number of passengers despite still facing challenges such as declining interest in paying fares, public preference for private vehicles, limited information, and competition from other modes. The sustainability of this innovation depends on the implementation of an innovative governance model with cross-sector collaboration, data transparency, public participation, and analytics-based decision-making to realize modern, inclusive, and sustainable urban mobility in Makassar.

Abstract

The urgency of this research lies in the increasing risk of flooding and air pollution in Makassar City due to rapid urbanisation and the uncontrolled growth of motorised vehicles. The purpose of this study is to analyse the potential of urban planning and sustainable mobility policies in reducing disaster risks and environmental impacts, and to formulate more adaptive and data-driven policy strategies. This study uses qualitative methods by collecting data through interviews, documentation, observation, and focus group discussions (FGDs). Key informants include the Environmental Agency, the Spatial Planning Agency, and the Makassar Regional Disaster Management Agency (BPBD), which have strategic roles in spatial planning policies, environmental management, and disaster mitigation. The study findings indicate that flood risk and air pollution in Makassar City are complex problems influenced by population growth, land conversion, vehicle density, limited drainage, climate change, and industrial waste. Although various urban planning policies have been implemented, their effectiveness remains limited due to implementation constraints. Therefore, an integrated approach that combines adaptive urban planning, environmentally friendly mobility, effective waste management, and community participation is needed. With a systemic and coordinated strategy, Makassar has the potential to reduce flood risk, reduce pollution, and create a safer, healthier, and more sustainable urban environment.

Abstract

The growth of digital marketplaces in Indonesia has facilitated e-commerce activities; however, it has also given rise to various legal issues, particularly regarding the circulation of counterfeit products, which harm consumers and trademark owners. The sale of counterfeit products via marketplaces highlights the continued weakness of oversight over digital trading activities and the lack of adequate legal protection for consumers in electronic transactions. Consumers are in a vulnerable position due to the limitations in verifying the authenticity of goods directly before making a purchase. In addition to causing economic harm to consumers, the circulation of counterfeit products also results in intellectual property rights infringements and erodes public trust in Indonesia’s digital trading system. This study aims to analyse the form of legal liability of marketplaces regarding the sale of counterfeit products, as well as legal protection for consumers in digital marketplaces in Indonesia. The research method used is a normative legal study employing a statutory approach and a literature review The research findings indicate that marketplaces bear legal responsibility not only as digital platform providers, but also as operators of electronic systems who are obliged to establish a trading system that is secure, reliable and accountable in terms of consumer protection and the prevention of the circulation of counterfeit products. Marketplaces are obliged to monitor sellers and the products traded through verification mechanisms, the removal of illegal products, and the imposition of sanctions on offenders.

Abstract

This study examines the decision of the Purwakarta District Court Number 37/Pdt.G/2023/PN Pwk concerning issues related to land sale transactions without an official deed, which give rise to default (breach of contract) and legal certainty regarding changes in land ownership status. The main issues in this study are how the legality of land sale transactions without an official deed is positioned under civil law and agrarian law perspectives, as well as how the law is applied in the court decision against the Defendant who failed to follow up on the agreement to execute the making of a Sale and Purchase Deed (AJB) before a Land Deed Official (PPAT). This study uses a normative juridical method with a qualitative approach supported by literature review and analysis of court decisions, statutory regulations, and relevant legal literature. Based on the findings, it is known that normatively, land sale and purchase transactions that are not embodied in an official deed may still give rise to civil legal relations if they fulfill the requirements for the validity of an agreement. However, the transfer of land rights must still be carried out through a deed made by a PPAT and registered at the Land Office in order to obtain strong legal certainty. In this case, the panel of judges recognized the validity of the sale and purchase agreement under the law and found that the Defendant had committed a breach of contract as a legal consequence of failing to perform the obligations under the agreement, particularly in attending the process of making the sale and purchase deed. However, the judge partially rejected the claim for compensation due to insufficient supporting evidence. This decision shows that legal protection for good-faith buyers is still provided through the court system, but formal procedures for transferring land rights must still be fulfilled in order to prevent similar disputes from recurring.

Abstract

Worker protection for work accident insurance is a basic labor right guaranteed in Law Number 40 of 2004 concerning the National Social Security System. Every worker has the right to receive protection through the Work Accident Insurance (JKK) program. However, its implementation is still not optimal because there are still companies that have not registered their workers with BPJS Ketenagakerjaan and have not implemented work safety standards optimally. This study uses an empirical juridical method with a legislative approach and field facts through interviews with victims of work accidents at Bekasi Regency Companies. The results of the study indicate that the protection of workers' rights to work accident insurance in Article 3 of Law Number 40 of 2004. protection of workers' rights to work accident insurance has not been effective; companies commit legal violations by not registering workers with BPJS Ketenagakerjaan, ignoring occupational safety and health (K3) standards so that unsafe machines cause serious accidents, and failing to provide assistance and recovery after work accidents.

Abstract

The village is the lowest level of government with the authority to manage local community affairs and implement national policies in accordance with Law No. 3 of 2024 on Villages. In practice, the government adheres to the principle of decentralization, whereby each region has broad autonomy to manage its own affairs through the enactment of village regulations. The issues examined include the legal status of Village Head Regulations within the hierarchy of legislation, coordination mechanisms between the Village Government and the Village Consultative Body during Village Assemblies, and the implementation of beneficiary criteria in ensuring legal certainty and social justice. This study employs a normative legal method with a descriptive-analytical approach through a literature review of primary, secondary, and tertiary legal sources. The theoretical frameworks utilized include the Theory of Attribution and Delegation, Hans Kelsen’s Theory of the Function of Power, and Gustav Radbruch’s Theory of Legal Certainty. The research findings indicate that Village Head Regulations possess legal validity under Article 8 of Law No. 12 of 2011, with their authority derived from Law No. 3 of 2024. The mechanism for their formulation involves a Village Assembly that includes the Village Consultative Body and community representatives; however, there remains a risk that this process could devolve into a mere procedural formality. The implementation of beneficiary criteria has sought to achieve distributive justice through tiered verification, but lacks measurable parameters, potentially leading to subjectivity. This study recommends strengthening substantive parameters, optimizing oversight functions, and improving the quality of community participation.

Abstract

In Indonesian society, land has strategic importance from an economic, social, and legal perspective. Receipts are often used as proof of payment in land transactions, but because they are not original evidence and are vulnerable to loss, damage, or forgery, their validity is low. As seen in court practice, this situation often leads to disputes. The purpose of this study is to examine how digitalization of receipts can increase transaction transparency and help avoid ownership conflicts. Secondary legal materials in the form of literature and scientific publications are used to support the normative juridical research methodology, which includes a legal regulatory approach and case analysis. The gap between ideal legal provisions and community transaction practices, which are mostly still carried out informally, is examined in this study. The results show that digitalization of receipts can increase transparency through a secure, standardized, and verifiable electronic recording system. Features such as unique identities, time recording, and electronic signatures strengthen evidentiary value and facilitate transaction tracing. In addition, digitalization plays a preventive role by minimizing manipulation and loss of documents, and as a repressive measure by strengthening evidence in dispute resolution. In conclusion, digitalizing receipts is a strategic solution to increase legal certainty, transparency, and legal protection in land purchase transactions, while simultaneously preventing future land disputes.
