Abstract

The banking sector, as an intermediary institution, plays a strategic role in the national economy. However, the absence of regulations that explicitly limit the maximum loan interest rate in legislation creates a legal vacuum that has the potential to harm borrowers and weaken legal protections. The research questions in this study are: (1) How are loan interest rates determined under positive law in Indonesia; (2) What legal protections are in place for customers against the risk of loss resulting from the misuse of loan interest rate setting. This study employs a normative legal research method using a legislative and conceptual approach, along with the collection of legal materials through a literature review. The research findings indicate that existing regulations, including Financial Services Authority Regulation No. 13 of 2024, only address the transparency of the Base Lending Rate without setting a maximum limit, thereby creating a regulatory gap. Legal protection for customers includes preventive legal protection through transparency and supervision, as well as repressive legal protection through dispute resolution mechanisms and the provision of compensation; however, its implementation remains suboptimal. Therefore, regulatory strengthening is necessary to ensure legal certainty and fair protection for debtor customers.

Abstract

The Sehat Indonesiaku (ASIK) Application is a key policy instrument of Indonesia's Ministry of Health designed to improve community health data management, particularly toddler data in Integrated Service Posts (Posyandu). However, implementation at the village level continues to face operational challenges. This study analyzes the implementation of the ASIK program in managing toddler data at Posyandu in Kebonsari Village, Sidoarjo Regency, using George C. Edward III's policy implementation framework. A descriptive qualitative approach was employed, with data collected through in-depth interviews, observation, and documentation from purposively selected informants comprising Posyandu cadres, public health center midwives, and village officials. Data were analyzed using the interactive model of Miles, Huberman, and Saldaña (2014). Findings reveal that ASIK implementation has not been optimal due to constraints across all four Edward III variables: uneven program socialization (communication), limited digital literacy and inadequate device-network infrastructure (resources), dual manual-digital recording workloads (disposition), and over-reliance on core cadres (bureaucratic structure). Nonetheless, adaptive responses including continuous training, structured task delegation, and village government support have been established. This study highlights that the success of ASIK implementation fundamentally depends on human resource readiness, effective policy communication, and institutional support at the local level.

Abstract

Asset recovery is a strategic instrument in law enforcement against corruption and money laundering crimes. However, the practice of concealing illicit wealth through nominee schemes, shell companies, and offshore jurisdictions demonstrates weaknesses in national legal regulations, particularly regarding the identification of beneficial ownership. This study aims to analyze the weaknesses in Indonesia’s asset recovery regulations and to formulate a reconstruction of regulations based on the principle of beneficial ownership in order to prevent the concealment of illicit wealth. The research employs a normative juridical method with statutory, conceptual, and comparative law approaches. The results indicate that the existing regulations remain administrative in nature and have not yet been integrated into the asset recovery regime. Therefore, legal reconstruction is required through strengthening obligations for beneficial ownership disclosure, integrating cross-agency databases, and regulating non-conviction based asset forfeiture mechanisms. This study offers a more progressive regulatory model to enhance the effectiveness of asset recovery and close loopholes for concealing illicit wealth.

Abstract

This research focuses on the criminal liability of Notary Dewi Farni Dja'far (the Defendant) in the criminal case concerning corruption relating to the granting of a Refinancing Investment Loan (KIR) by PT Bank Negara Indonesia (BNI) to PT Barito Riau Jaya. The legal issue lies with the Defendant in issuing a number of letters of certification or cover notes, stating that the process of obtaining certificates for 502 (five hundred and two) plots of land used as collateral was underway at her office. However, in reality, the land parcels, which were still based on Land Certificates (SKT), were problematic and could not be upgraded to Certificates of Ownership and Certificates of Right to Use, meaning the bank disbursed the loan without valid collateral. The Defendant’s actions are deemed to have assisted the debtor Esron Napitupulu (Director of PT Barito Riau Jaya) in securing the loan, resulting in a financial loss to the state amounting to Rp22,650,000,000.00. The results of this study indicate that, based on Article 16 of Law No. 2 of 2014 amending Law No. 30 of 2004 on the Office of the Notary, a Notary is liable under civil law (compensation), criminal law (offences), and administrative law (code of ethics) if found to have committed a breach in the performance of their duties. The objective of this study is to analyse the liability of notaries regarding covernote in problematic credit agreements. The research method employed is normative in nature, with a descriptive qualitative approach. Data sources were obtained from court decisions, legislation, and other supporting sources.

Abstract

Legal disputes involving simultaneous criminal and civil dimensions often raise complex juridical issues, particularly in the context of business transactions. One relevant concept to address this issue is the prejudiciel geschill, a doctrine originating from Dutch law that regulates pre-judicial disputes as a condition for the suspension of criminal proceedings. This study aims to analyze the dispute resolution mechanism of prejudiciel geschill in criminal fraud cases and breach of contract, as well as to examine the judges' considerations in Civil Decision Number 1075/Pdt.G/2019/PN Sby and Criminal Decision Number 2482/Pid.B/2020/PN Sby. The research method used is normative juridical with a statutory and case approach. The results indicate that the application of prejudiciel geschill in both decisions reflects the interplay between civil and criminal judgments in the Indonesian judicial system. The Panel of Judges of the Surabaya District Court applied Supreme Court Regulation Number 1 of 1956 and SEMA Number 4 of 1980 as the basis for suspending criminal proceedings pending the final civil court decision. The study concludes that the concept of prejudiciel geschill plays a strategic role in preventing jurisdictional overlaps and ensuring legal certainty. A more comprehensive statutory regulation within national criminal procedural law is needed to accommodate the consistent application of this principle.

Abstract

The proliferation of hoaxes in the era of information transparency, committed not only by the public but also by journalists, forms the background of this research. This phenomenon raises legal concerns because journalists are required to provide accurate, balanced, and responsible information in accordance with Law Number 40 of 1999 concerning the Press. This study aims to examine the legal implications for journalists who engage in false reporting and to analyze how the law regulates the dissemination of false news by journalists. The research employs a normative juridical method using statutory, conceptual, and case approaches. Data were obtained from primary, secondary, and tertiary legal materials and analyzed qualitatively using a deductive approach. The findings reveal that Law Number 40 of 1999 does not specifically regulate criminal sanctions for false reporting by journalists, but instead prioritizes settlement through the Press Council and the Journalistic Code of Ethics, including the right of reply and correction. Nevertheless, journalists may still face legal responsibility under the Indonesian Criminal Code and the Electronic Information and Transactions Law if false reporting fulfills criminal elements. Therefore, law functions both as a protector of press freedom and as a limitation to prevent abuse, with ethical, administrative, and criminal sanctions applicable to journalists and press institutions.

Abstract

The principle of a fast, simple, and low-cost judiciary constitutes a fundamental principle in the administration of judicial power, as stipulated in Article 2 paragraph (4) of Law Number 48 of 2009 on Judicial Power. This principle aims to ensure access to justice for justice seekers, including in the enforcement of court judgments through execution mechanisms. However, in practice, execution proceedings often encounter various obstacles that cause the process to be slow, complicated, and costly. This study aims to analyze the effectiveness of the implementation of the principle of a fast, simple, and low-cost judiciary in execution cases at the Banjarbaru Religious Court and to identify the factors influencing its implementation. The research method employed is empirical legal research using a sociological-juridical approach. The results of the study indicate that the implementation of the principle of a fast, simple, and low-cost judiciary in execution cases at the Banjarbaru Religious Court has not yet been fully effective. This is due to juridical factors, non-juridical factors, as well as the level of legal awareness of the parties involved. Therefore, improvements are necessary in terms of regulatory frameworks, judicial administration, and the enhancement of public legal awareness in order to achieve effective and equitable execution of court judgments.

Abstract

Economic exploitation of children remains a serious issue within the child protection system in Indonesia, particularly in urban areas experiencing high socio-economic pressure. This study aims to analyze the forms of legal protection provided to children who become victims of economic exploitation by their parents in Manado City and to identify the factors that cause children to become involved in street-based economic activities. The research employed an empirical legal method with a socio-juridical approach. Data were collected through semi-structured interviews, documentation, library research, and case-handling records from the Office of Women’s Empowerment and Child Protection of Manado City. The data were analyzed using a qualitative descriptive method to understand the relationship between child protection legal norms and social practices within society. The findings reveal that legal protection has been implemented through preventive and repressive measures, including public outreach, legal education, psychological assistance, social rehabilitation, and inter-agency coordination. However, its implementation has not yet been optimal due to family poverty, low parental education, weak legal awareness, permissive social environments, and limited institutional capacity at the regional level. This study emphasizes that protecting children from economic exploitation requires stronger law enforcement, social protection for vulnerable families, community economic empowerment, and an integrated child protection system to ensure children’s rights to education, welfare, and development are sustainably protected.

Abstract

This study aims to analyze the reinterpretation function in the development of Orek-Orek Dance in Ngawi Regency carried out by Sanggar Tari Sri Budaya. Orek-Orek Dance is a reinterpretation of the traditional folk art of Orek-Orek, which previously existed in the form of petilan performances or traveling folk theater that developed within the society of Ngawi Regency. This study employed a qualitative descriptive method with data collection techniques consisting of observation, interviews, and documentation. The research informants included the founder of Sanggar Tari Sri Budaya, representatives from the Department of Tourism and Culture of Ngawi Regency, and the local community of Ngawi Regency. The results of the study indicate that reinterpretation was carried out through the modernization of dance forms without eliminating traditional elements, choreography development, the use of digital media, and the creation of new functions for Orek-Orek Dance. Sanggar Tari Sri Budaya succeeded in establishing Orek-Orek Dance as a cultural identity of Ngawi Regency through youth training programs, cultural performances, and digital promotion. The reinterpretation process generated educational, social, creative economic, cultural identity, and modern performance functions. Furthermore, reinterpretation successfully maintained the existence of Orek-Orek Dance amidst the development of modern times so that it remains recognized by people across generations.

Abstract

Freedom of opinion is an essential constitutional right for democratic accountability, citizen participation, and the exchange of ideas in digital public spaces. This right is guaranteed by the 1945 Constitution and various international human rights instruments that Indonesia has ratified. However, the expansion of social media, disinformation, hate speech, doxing, cyberharassment, and inconsistent law enforcement have made its protections even more complex. Tensions arise between the need to maintain order and protect the dignity of individuals on the one hand, and the state's obligation not to silence legitimate expressions on the other. This article examines the legal position of freedom of opinion in Indonesia, the validity of its restrictions in the digital environment, and the direction of reform after the amendment of the Electronic Information and Transaction Law (UU ITE) in 2024 and the latest Constitutional Court ruling. Using normative juridical methods through legislative, conceptual, case, and comparative approaches, this study analyzes how positive legal norms are applied in practice and how arrangements in other countries can be referenced. The results of the study show that multi-interpreted articles have the potential to cause excessive criminalization and a chilling effect on freedom of expression. Therefore, this article emphasizes the need to shift from a multi-interpretive and punitive model to a governance based on rights, proportionality, and transparency, so that the protection of freedom of opinion can run in balance with the protection of the rights of other citizens in the digital era.
