Abstract

This study aims to determine the requirements for applying the Doctrine of Judicial Activism in judicial decision-making and the errors contained in ConstitutionaL Court Decision Number 90/PUU-XXI of 2023.The research method used in this paper is a doctrinal approach. This research was conducted by reviewing literature such as previous research, journal references, laws and regulations, court decisions, reference books and research journals, and various oth er supporting sources. The results of this study answer two research questions. The research findings demonstrate how the doctrine of Judicial Activism operates effectively, in accordance with established requirements, and that the Constitutional Court must adhere to these requi rements and not rely solely on its own authority in making decisions. However, this research demonstrates that Constitutional Court Decision Number 90/PUU-XXI of 2023 erroneously applies the doctrine of Judicial Activism to the authority held by judges. This research also contributes to a deeper understanding of the limitations of the Constitutional Court's authority in material review, as well as the implications of applying this doctrine to the judicial process in Indonesia. Therefore, the results of this research are expected to serve as a reference for further legal studies on constitutional review in Indonesia.

Abstract

Land constitutes a limited asset whose availability does not significantly increase over time, thereby requiring strong legal assurance and protection. In Pekalongan City, recurrent tidal flooding (rob) has created uncertainties regarding land boundaries and the legal status of ownership rights. This research adopts a socio-legal approach with a qualitative descriptive design to examine these issues in depth, focusing on how legal norms interact with environmental changes and community practices. The findings indicate that inundated land cannot be legally regarded as extinguished or lost. Ownership rights remain attached to the land, even when its physical condition is altered by persistent flooding. Landowners can still identify and assert their territorial boundaries by installing higher and more adaptive boundary markers that accommodate fluctuating water levels. Furthermore, legal certainty over land ownership can be maintained through administrative mechanisms. These include applying for a Land Registration Certificate (SKPT) and requesting land re-measurement through the National Land Agency, which provides verified information on both juridical and physical aspects of the land. Thus, despite environmental challenges, the legal framework continues to offer avenues for protecting land rights and ensuring certainty for affected communities.

Abstract

This study aims to analyze the implications of the involvement of Land Deed Officials (PPAT) in assisting the calculation of seller and buyer taxes in land sale and purchase transactions. The research employs a normative legal method using statutory and conceptual approaches. The results indicate that PPAT is not authorized to determine the amount of tax but functions as a public official responsible for ensuring the fulfillment of administrative requirements, including tax obligations prior to the signing of the deed. In practice, PPAT’s involvement in estimating Final Income Tax and Duty on the Acquisition of Land and Building Rights helps parties plan transaction costs and improve efficiency. However, validation mechanisms by tax authorities may result in differences between estimated and actual tax amounts, potentially causing legal uncertainty and misunderstandings. Therefore, it is necessary to clarify the limits of PPAT’s role and apply prudential principles by providing disclaimers that calculations are only preliminary estimates. This is essential to maintain professional integrity and protect the interests of parties involved.

Abstract

The development of hamper-based florist businesses in Indonesia indicates a shift in business models from decorative services to the distribution of consumamble products, which has legal implications, particularly regarding halal certification obligations. This study aims to analyze halal certification obligations for hamper-based florist businesses from the perspectives of positive law and Islamic economic law. This study employs a normative juridical methodology with legislative, conceptual, and analytical approaches. The data utilized consists of primary, secondary, and tertiary legal sources obtained through literature review and analyzed qualitatively using deductive reasoning. The results of the study indicate that the halal certification obligations for hamper-based florist businesses is conditional, depending on the level of the business operator’s involvement in the production, repackaging, and distribution of consumamble products. Florists engaged solely in decorative services are not subject to such obligations, whereas florists involved in the production or repackaging of consumable products face a stronger juridical obligations. From the perspective of Islamic economic law, this obligation has a broader scope, as it takes into account the principles of halalan tayyiban, the prohibition of gharar, and the concept of maslahah. These three principles require clarity, safety, and benefit for consumers, so florist hamper businesses are required to exercise greater caution in ensuring the halal status of the products they trade.

Abstract

Legal protection for Indonesian Migrant Workers (PMI) remains a strategic issue in the context of global labor mobility, particularly given the complexity of challenges encompassing legal, social, economic, and cross-border governance dimensions. Although Indonesia has ratified the 1990 Migrant Workers Convention through Law No. 6 of 2012 and enacted Law No. 18 of 2017 on the Protection of PMI, the implementation of such protections continues to face significant obstacles. This study aims to analyze the effectiveness of legal protection for PMI, including non-procedural workers and their family members, as well as to evaluate the role of the state and relevant institutions in ensuring comprehensive protection. Employing a normative juridical method, data were collected through document analysis and literature review. The findings reveal a gap between the existing legal framework and its implementation, as evidenced by weak inter-agency coordination, limited diplomatic capacity, and low levels of legal literacy among prospective migrant workers. Furthermore, contemporary issues such as covert human trafficking, violations of migrant workers’ children’s rights, and inconsistencies in the enforcement of bilateral MoUs exacerbate the vulnerability of PMI, particularly in the informal sector. This study recommends strengthening community-based protection mechanisms, reforming migration governance, and mainstreaming human rights and gender-sensitive approaches in migration policies.

Abstract

This article aims to analyze the legal culture of family law in Indonesia using a futuristic approach. The study examines the characteristics of family legal culture within the context of legal pluralism, the influence of social and technological changes on its transformation, and its future projections. This research employs a normative legal method with statutory, conceptual, case, comparative, and historical approaches. The findings indicate that family legal culture in Indonesia is pluralistic, shaped by state law, religious law, and customary law. Technological advancements and globalization have influenced family relations, increased legal awareness, and introduced new digital-based legal practices. In the future, family legal culture is projected to evolve toward a more adaptive, digital, and human rights-oriented system while still maintaining local and religious values. Therefore, harmonization among legal systems and a responsive approach to social dynamics are necessary to ensure the relevance and effectiveness of family law.

Abstract

This study aims to analyze the implementation of civic responsibility among Street Vendors (PKL) in the implementation of Bandung City Regional Regulation Number 11 of 2024 concerning the Arrangement and Empowerment of Street Vendors. The study employed a qualitative approach using a case study method in the Jalan Saparua area, Bandung City. Participants were determined through purposive sampling, including officers from the Civil Service Police Unit (Satpol PP), the Office of Cooperatives and SMEs, and street vendors. Data were collected through in-depth interviews, observation, and documentation studies, then analyzed using the interactive model of Miles, Huberman, and Saldaña. The results showed that the implementation of civic responsibility among street vendors has not been optimal, as reflected in the low understanding of regulations, weak legal awareness and social responsibility, and participation that tends to be conditional and pragmatic. These conditions still lead to violations of street vendor arrangement regulations in the research area. In addition, economic factors and the need to maintain livelihoods also influence the level of compliance of street vendors with regional regulations. Therefore, educational, participatory, and empowerment-based handling strategies are needed to achieve sustainable compliance and create urban order and environmental comfort.

Abstract

This research is motivated by the existence of customary law as  a living law that is constitutionally  recognized and applied by the Dayak Bahau Community in Keliwai Village in solving the crime of theft. This practice prioritizes local wisdom and social balance through  the Antang and Mekau customary fine mechanism  as an alternative settlement outside the formal state criminal justice system. However, there are legal issues regarding the effectiveness of sanctions in providing a deterrent effect and protecting the rights of victims, especially vulnerable groups such as people with disabilities. The research uses socio-legal research methods  with a qualitative approach through in-depth interviews with traditional chiefs, victims' families, and community leaders. The results of the study show that the implementation of Antang (large urns) and Mekau (small urns) customary fines is carried out through customary deliberations led by the Customary Chief by involving the perpetrators, victims, and families. Philosophically, these fines function as a symbol of "village cleansing" (Ngaping Umaq) to restore the disturbed cosmic balance. Socially, this mechanism has proven to be effective in resolving conflicts and maintaining community harmony. However, the effectiveness of customary fines in terms of restoring victims' rights is considered not optimal. In certain cases, there is a significant gap between the value of the fine imposed and the real material losses suffered by the victim, so that the goal of restorative justice has not been fully achieved for the victim.

Abstract

This study analyzes the obstacles in fulfilling the proof of deposit for Final Income Tax (PPh Final) as a requirement for land certificate name transfer at the Land Office of Bandar Lampung City. These obstacles impact legal uncertainty regarding land ownership and slow down public services. The research employs a descriptive analytical method with a qualitative approach. Data were collected through in-depth interviews with counter officers, verifiers, and the Land Rights Determination and Registration section, as well as direct observation and documentation at the local office. The findings identify three main classifications of obstacles. First, technical obstacles include payment data not being readable in the Land Office Computerization System (KKP) and barcodes on tax clearance certificates being unreadable. Second, administrative obstacles encompass data mismatches (nominal amounts, identities, Tax Object Numbers) and incomplete documents. Third, document-related obstacles include poor-quality photocopies and discrepancies in tax dates or years. Contributing factors are data entry errors (human error), lack of thoroughness, integration issues between the KKP system and the tax system, as well as taxpayers' low technical understanding. The consequences include process delays, re-verification with the tax office, and document returns. This study concludes that system-related obstacles, particularly the lack of optimal integration, are dominant. Recommended improvements include integrating the KKP system with the Directorate General of Taxes, enhancing automatic validation, simplifying validation procedures at the tax office, and increasing tax literacy among taxpayers.

Abstract

Current business licensing governance in Indonesia exhibits an integration between the risk-based OSS-RBA System and halal certification. While OSS-RBA determines licensing based on business risk levels, halal certification emphasizes religious compliance, yet these frameworks operate in parallel without integration. A critical research gap exists because OSS-RBA does not incorporate ethical, moral, and spiritual risk factors core elements of halal certification. This study aims to analyze the urgency of integrating halal certification into OSS-RBA and formulate an ideal integration model. Using normative legal methods with statutory and conceptual approaches, data were collected through library research examining primary legal documents including Government Regulation Number 28 of 2025, Number 42 of 2024, the Halal Product Guarantee Law, and secondary literature on Maqashid Shariah. The study finds that the concept of halalan thayyiban has expanded through a progressive Maqashid Shariah paradigm, now encompassing environmental preservation and waste management obligations. The proposed integration model consists of an electronically integrated service system governed by "single submission with multi-institutional validation," producing three mechanisms: formal cooperation between BPJPH and the Ministry of Investment or OSS Institution; electronic data interoperability between OSS and SIHALAL systems; and coordinated supervision. Theoretically, this research unites spiritual values with ecological dimensions in the halal ecosystem. Practically, implementing an integrated system will foster a better business climate by simplifying procedure.
