Abstract

The structural realignment of public sector governance, catalyzed by rapid technological evolution, has compelled PT Pos Indonesia to institute the Pospay digital ecosystem. Nonetheless, this paradigm shift frequently collides with deeply entrenched sociological resistance in empirical settings. This inquiry endeavors to scrutinize the service quality of Pospay while exploring the systemic challenges posed by conventional transaction habits at the Main Branch Post Office in Surabaya. Adopting a descriptive qualitative approach, empirical data were garnered through semi-structured interviews, non-participant field observations, and institutional document analysis. Informants were selected via purposive sampling, encapsulating the operational manager, a front-line service officer, and a service consumer. Data processing adhered to the interactive analysis framework of Miles, Huberman, and Saldaña (2014). Framed through Parasuraman’s SERVQUAL model, the analytical results demonstrate that while the responsiveness and assurance parameters operate at an optimal level, the reliability dimension remains disrupted by sporadic system latency. More significantly, a profound cultural lag actively decelerates this technological migration. Service users manifest a chronic reliance on physical counters, structured by marginal digital literacy, a psychological mandate for physical artifacts as transaction validation, and a preference for real-time interpersonal encounters. Adaptive institutional countermeasures specifically on-site digital mentorship and hybrid validation mechanisms have been strategically deployed to attenuate this sociocultural disconnect.

Abstract

This study examines the implementation of Agile Governance in the development of the Integrity Zone at the Faculty of Social and Political Sciences, Universitas Riau. The study is motivated by the need for adaptive, responsive, and participatory governance to support bureaucratic reform and improve public service quality in higher education institutions. Despite ongoing efforts, the development of the Integrity Zone still faces challenges, including limited human resources, budget and facility constraints, inefficient administrative systems, and suboptimal digital service integration.This research employed a qualitative descriptive approach through observation, in-depth interviews, and documentation involving faculty leaders, the Integrity Zone team, educational staff, students, and alumni. The findings show that Agile Governance has been implemented through six indicators: good enough governance, business-driven, human-focused, quick wins, systematic and adaptive approach, and simple design and continuous refinement. Its implementation is reflected in administrative service digitalization, WhatsApp helpdesk services, consultation corners, the Complaint, Assistance, and Health Support Unit (P2K), service satisfaction surveys, integrity culture strengthening, and simplified service procedures. However, implementation remains uneven due to limited resources, inadequate digital integration, and organizational culture challenges. The study recommends strengthening digital service integration, enhancing human resource capacity, applying data-based service evaluations, and improving coordination and organizational culture to ensure sustainable and effective Integrity Zone development.

Abstract

A Limited Liability Company as a legal entity is required to update and adjust its corporate data in accordance with the provisions of the Company Law (UUPT). These obligations include amendments to the articles of association, changes to company administrative data, and reporting Beneficial Ownership information integrated with the Legal Entity Administration System (SABH) and the Online Single Submission Risk-Based Approach (OSS-RBA) system. This study aims to examine the juridical urgency of updating corporate data and to analyze the legal consequences of non-compliance, which may result in the blocking of SABH access and disruption of business activities. This research employs a normative legal method using statutory and conceptual approaches supported by primary, secondary, and tertiary legal materials analyzed qualitatively. The findings indicate that updating corporate data is essential for ensuring legal certainty, transparency, and corporate accountability. Failure to fulfill these obligations, including Beneficial Ownership reporting, may lead to administrative sanctions such as written warnings, suspension of SABH access, and obstacles in taxation and business licensing processes through OSS-RBA. The blocking of SABH access restricts companies from carrying out certain legal actions and may affect business continuity. In practice, notaries play a strategic role in facilitating corporate data adjustments through the AHU Online system. Therefore, greater corporate compliance and improved synchronization of legal administration systems are necessary to support legal certainty and a transparent business environment.

Abstract

Regional Regulations (Perda) constitute a fundamental legal instrument in the administration of regional autonomy in Indonesia. This study aims to: (1) analyze the judicial review mechanism for laws that harm individuals or legal entities within Indonesia's constitutional system; (2) examine procedures for reviewing Government Regulations with implications for harm to individuals or legal entities; and (3) evaluate Perda formation procedures of the West Java Provincial Government and DPRD from the perspective of the State Administrative Court (PTUN). The study employs a normative-empirical method with a descriptive-analytical juridical-normative approach, supplemented by semi-structured interviews with representatives of Bapemperda DPRD West Java Province. Findings indicate that the Constitutional Court's judicial review mechanism is insufficiently responsive to individual remediation; judicial review of sub-statutory regulations by the Supreme Court is not optimally integrated with PTUN mechanisms; and Perda formation in West Java faces procedural constraints including budget limitations, shortage of legislative experts, inadequate substantive public participation, and institutional political dynamics. The theoretical implication affirms the need for incidental review reform within PTUN as a complement to judicial review.

Abstract

This study aims to analyze the legal implications arising from the disharmony between regulations governing the expansion of large-scale oil palm plantations and the protection of Sustainable Food Agricultural Land (LP2B), as well as to examine the implementation of food agricultural land protection policies in Kutai Kartanegara Regency. The research employs an empirical legal method with a socio-legal approach, combining statutory analysis, document review, and interviews with relevant stakeholders. The data were analyzed qualitatively using the theories of legal politics and legal disharmony. The findings reveal the existence of regulatory disharmony in vertical, horizontal, and implementation dimensions. Regulations that support the expansion of oil palm plantations through licensing simplification, the extension of Land Use Rights (Hak Guna Usaha/HGU), and investment-oriented policies following the enactment of the Job Creation Law tend to conflict with the objectives of sustainable food agricultural land protection. The study also finds that the conversion of food agricultural land into oil palm plantations in Kutai Kartanegara is predominantly carried out independently by farmers as a result of economic pressures and socio-economic structural changes influenced by the presence of large-scale plantation companies. Furthermore, spatial planning decision-making processes demonstrate the dominance of investment interests over food land protection. Therefore, regulatory harmonization, the strengthening of LP2B protection instruments, and the provision of economic incentives for farmers are necessary to maintain the sustainability of food agricultural land and support national food security.

Abstract

Motorcycle gang activities are a form of street crime that often causes disturbances to public order through acts of violence, intimidation, demolition, and destruction of public facilities. The presence of Law Number 1 of 2023 concerning the Criminal Code brings a change in the criminal paradigm that emphasizes corrective, rehabilitative, and restorative aspects. However, the New Criminal Code does not explicitly regulate motorcycle gangs as a special criminal offense, thus raising questions about the basis of criminalization and criminal liability. This study aims to analyze the qualifications of motorcycle gang activities as criminal acts that disturb public order, forms of criminal responsibility against leaders and group members based on the theory of participation, and the regulation of criminal sanctions in the perspective of modern criminality. This study uses normative juridical methods with legislative, conceptual, and analytical approaches. The results of the study show that the criminalization of motorcycle gang activities in the New Criminal Code is still based on concrete acts that meet the elements of delicacy, not on the identity of the group. In addition, the theory of participation allows criminal liability to be imposed not only on the direct perpetrator, but also on the party who moves, commands, or participates in criminal acts. In the criminal aspect, the New Criminal Code provides space for the application of proportionate sanctions through a combination of criminal and rehabilitative actions to support the protection of public order as well as the purpose of fostering perpetrators. Thus, law enforcement against motorcycle gangs must be carried out carefully to remain in line with the principles of legality and the orientation of modern criminality.

Abstract

This study is based on the vulnerability of children as victims of sexual abuse, requiring strong juridical and procedural protection from the investigation stage to prevent revictimization and prolonged trauma. The research aims to evaluate the effectiveness of legal protections for child victims in Indonesia and assess how the principle of equality before the law ensures balanced justice for both victims and suspects. The method used is normative juridical research through library studies of primary, secondary, and tertiary legal sources, supported by interviews at the Women and Children Protection Unit (Unit PPA) of the Karawang Police Resort. Findings indicate that, normatively, Indonesia has a solid foundation through the 2025 Criminal Procedure Code, the Law on Witness and Victim Protection, the Child Protection Law, and Law No. 12 of 2022 on Sexual Violence Crimes, guaranteeing rights such as identity protection, expert accompaniment, and restitution. Practically, however, protection depends on adherence to cross-sectoral standard operating procedures, the involvement of certified female investigators, and coordination with institutions like the Regional PPA Unit, Social Services, and Correctional Guidance Office. The study concludes that restorative justice cannot be applied in child sexual abuse cases to protect the substantive rights of victims. Investigators face challenges in collecting psychologically affected testimony, limited eyewitnesses, and scarce evidence, resulting in incomplete protection. Therefore, strengthening formal judicial proceedings is essential to ensure justice for child victims.

Abstract

The practice of unregistered marriage (nikah siri) remains prevalent in Indonesia and raises serious legal issues, particularly for women as the most disadvantaged party. This study aims to juridically analyze the provisions of the Compilation of Islamic Law (KHI) relating to nikah siri and to identify its implications for the fulfillment of women's civil rights. This study employs a normative legal research method with statutory, conceptual, and case approaches, analyzing primary, secondary, and tertiary legal materials descriptively and analytically. The results reveal three main findings: first, the KHI contains a fundamental normative tension between the recognition of the religious validity of nikah siri under Articles 4 and 14 KHI and the provision of Article 6 paragraph (2) KHI which affirms that marriages conducted outside the supervision of the Marriage Registrar have no legal force; second, this normative tension demonstrably harms women by resulting in the loss of rights to maintenance, marital property, inheritance, divorce claims, and other legal protections, as well as affecting the status of children treated as illegitimate under Article 43 paragraph (1) of the Marriage Law jo. Article 100 KHI; third, the itsbat nikah mechanism under Article 7 KHI as an instrument for restoring civil rights has not been able to serve as a comprehensive solution due to normative limitations and contradictions with SEMA Number 3 of 2018. This study concludes that comprehensive and gender-just regulatory reform is needed to strengthen legal protection for women within Indonesia's Islamic family law system.

Abstract

The high rate of divorce due to continuous disputes in Religious Courts has prompted judges to use the jurisprudential maxim dar'u al-mafasid muqaddamun 'ala jalb al-mashalih as the normative basis for their legal considerations. However, the application of this maxim in judicial practice is often carried out disproportionately and without measurable standards, potentially producing decisions that are inconsistent with the objectives of Islamic law. This study aims to analyze the construction of the dar'u al-mafasid maxim in judges' decisions on divorce cases due to continuous disputes, evaluate its proportionality from the perspective of maqasid al-syari'ah, identify its construction patterns, and formulate an ideal and measurable construction model. This research employs a normative legal research method with statutory, conceptual, case, and philosophical-hermeneutic approaches. Legal materials were collected through documentation studies and analyzed qualitatively using content analysis, descriptive-analytical, comparative, and normative-evaluative techniques. The findings reveal that the construction of the dar'u al-mafasid maxim in judges' decisions is built through three stages: identification of mafsadat and maslahat, weighing (muwazanah) between them, and establishing priorities (awlawiyat); however, significant inconsistencies and disproportionality exist across various court levels. Three construction patterns were identified: fact-based, irreconcilability-based, and maqasid al-syari'ah-based. This study formulates an ideal construction model through five integrative stages: comprehensive fact verification, optimal reconciliation efforts, measurable mafsadat identification and assessment, proportional weighing integrating four dimensions of moderate jurisprudence, and maqasid al-syari'ah-based decision-making. This model is expected to serve as a guideline for Religious Court judges in producing substantively just decisions aligned with the objectives of Islamic law.

Abstract

The practice of unregistered marriage (nikah siri) and polygamy without court permission remains a persistent legal problem in Indonesia, causing serious consequences for the legal protection of women and children. This study aims to analyze the criminal law formulation policy against nikah siri and unauthorized polygamy practices based on Law Number 1 of 2023 on the new Criminal Code (KUHP), compare it with the formulation under the old Criminal Code, and evaluate its alignment with the objective of legal protection for women and children. This research employs a normative legal research method with statutory, conceptual, and comparative approaches, analyzing primary and secondary legal materials qualitatively. The results reveal three main findings: first, the formulation policy under the old Criminal Code contains structural weaknesses, including the absence of explicit criminal sanctions in the Marriage Law, the complaint-based nature of the offense that limits prosecution, inconsistent interpretation of Article 279 among law enforcement officers, and the misapplication of criminal provisions against perpetrators of secret polygamy; second, Law Number 1 of 2023 brings significant reforms through a more comprehensive reformulation of marriage offenses, more precise elements of criminal acts, a more flexible sanction system, and the integration of restorative justice principles; third, the formulation policy still requires strengthening in terms of protecting the rights of women and children, as criminal approaches alone are insufficient without synergy with administrative policies and community empowerment. This study concludes that the criminal law formulation policy in the new Criminal Code must be understood as an instrument for achieving substantive justice oriented toward the protection of life, lineage, and property as required by the principles of maqashid syari'ah.
