Abstract

The birth of a number of family-related legislation and a number of technical rules related to the implementation of the Pre-Marriage Course, even used as one of the requirements to be able tocarry out the marriage, indicating that the program isconsidered so important. But in reality, the Pre-Marriage Courseis not going well, still aformalist.Therefore, these programs should receive serious attention and increasingly and developed according to the needs and the times. Abstract

This study examines the recent developments of religious authorities among middle-class urban Muslims. It is constructed due to the emergence of new religious authorities in Indonesia after the collapse of the New Order and the response of traditional santri involving the use of new media technology. With a phenomenological approach, the study focuses on the Cariustadz.id platform as a Cyber Fatwa and Islamic preaching media developed by Pusat Studi Qur’an/PSQ (Center for Qur’an Studies) to respond to the trending pengajian (sermon) activities among urban Muslims, the majority of whom are transnational groups including Salafi and Jamaah Tabligh. The Cariustadz.id platform has actively played a part in accommodating their aspirations with various facilities and easy access through an information technology-based application (a new media).As a result, the study argues that the moderate Islam discourse offered by the Cariustadz.id platform is not a mainstream but an alternative to religious activities for middle-class urban Muslims. In addition, Cariustadz.id is a new media used for traditional religious authority to compete with new religious authority in religious fatwa and Islamic discourse in Indonesia. This study is significant to show that Cyber Fatwa and Islamic preaching in the form of new media can be used as a counter narrative for traditional religious authorities in dealing with the proliferation of the so called new religious authorities da’wah movement and Salafi and radical preaching movement in new media.Abstrak:Artikel ini mengkaji perkembangan terkini otoritas keagamaan kalangan kelas menengah Muslim perkotaan. Hal ini dilatarbelakangi oleh munculnya otoritas keagamaan baru di Indonesia pasca runtuhnya Orde Baru dan respons santri tradisional yang melibatkan penggunaan teknologi media baru. Dengan pendekatan fenomenologis, penelitian ini berfokus pada platform Cariustadz.id sebagai media fatwa siber dan dakwah Islam alternatif yang dikembangkan oleh PSQ (Pusat Studi Qur’an). Platform itu untuk merespons kegiatan pengajian yang sedang tren di kalangan Muslim perkotaan, yang mayoritas pesertanya adalah kelompok transnasional termasuk Salafi dan Jamaah Tabligh. Cariustadz.id berperan aktif dalam menampung aspirasi mereka dengan berbagai fasilitas dan kemudahan akses melalui aplikasi teknologi informasi.Penelitian ini menunjukkan bahwa wacana Islam mode yang ditawarkan oleh platform Cariustadz.id bukanlah mainstream, melainkan kegiatan keagamaan alternatif bagi Muslim perkotaan kelas menengah. Selain itu, Cariustadz.id merupakan media baru yang digunakan otoritas keagamaan tradisional untuk berkompetisi dengan otoritas keagamaan baru di bidang fatwa keagamaan dan wacana keislaman di Indonesia. Studi ini signifikan menunjukkan bahwa fatwa siber dan dakwah Islam dalam bentuk media baru dapat digunakan sebagai kontranarasi bagi otoritas agama tradisional dalam menghadapi menjamurnya apa yang disebut gerakan dakwah otoritas keagamaan baru dan gerakan dakwah Salafi dan radikal di media baru.

Abstract

Abstract: The Concept of  Joint Assets and its Implementation in the  Religious Court. Legislation in Indonesia stipulates that any property acquired during marriage becomes joint property of husband and wife, without distinguishing who works and who registered the property. If the marriage come to an ends, either through death or divorce, the property must be divided equally. In general, this study found that a panel of judges in the religious court division decided a case of the distribution of joint property is not outside of the statutory rules. Since no agreement or reconciliation had been made   by the husband and wife in dispute about the portion of the division of their property, the judge decided that the joint property be divided in the same amount. However, if there is an agreement between husband and wife, the division of the joint property will be based on that agreement.Keywords: community property, Compilation of Islamic Law, judgment, Court of Religion.Abstrak: Konsep Harta Bersama dan Implementasinya di Pengadilan Agama. Perundang-undangan di Indonesia mengatur bahwa setiap harta yang diperoleh selama perkawinan dijadikan sebagai harta bersama suami isteri, tanpa membedakan siapa yang bekerja dan harta itu terdaftar atas nama siapa. Apabila perkawinan itu berakhir, baik karena kematian maupun karena perceraian, maka harta tersebut harus dibagi dua sama banyak nilainya. Penelitian ini menemukan data bahwa secara umum majelis hakim Pengadilan Agama dalam memutuskan perkara pembagian harta bersama tidak keluar dari aturan perundang-undangan tersebut. Selama tidak ada kesepakatan atau perdamaian yang dibuat oleh suami dan isteri yang bersengketa tentang porsi pembagian harta bersama, majelis hakim memutuskan harta bersama tersebut dibagi sama banyak. Namun, apabila terdapat kesepakatan antara suami dan isteri, pembagian harta bersama didasarkan atas kesepakatan yang mereka buat.Kata Kunci: harta bersama, Kompilasi Hukum Islam, putusan hakim, Pengadilan AgamaDOI: 10.15408/ajis.v12i1.980

Abstract

This study focuses on the problem’s task of Penghulu about registering marriages and problems of unregistering marriages in the border areas of Indonesia and Malaysia, especially at Entikong-Sekayam, West Kalimantan. Communities in the area complained about the absence of KUA Staff which caused them not to receive maximum service. While on staff’s KUA perception, they have worked but the community does not want to adjust to them, such as obeying the applicable provisions. There is a possibility of a gap between written law as a reference for KUA Staff and customary law for communities. With the law in action approach, it’s found legal, social, economic, and political factors that cause marital problems in the border area.

Abstract

Family relationship for someone is something very important. Due to this relation, people would have family relation to whom they are connected. The importance of nasab discussion because it relates someone to a lot of matters, such as inheritance, guardian, and equality (kafâ’ah) of husband and wife before marriage. The fiqh scholars and commentators disagree with the meaning of nasab. Many Scholars say that nasab is the relationship between a man and his child related to legal marriage. Hanafiyah states that nasab is the relationship between a man and his child due to genetic relationship. The logical consequence of this difference is in inheritance. Many scholars assert that inheritance is only connected to legitimate family relationship while Hanafiyah tend to say that inheritance is related to blood relations.DOI: 10.15408/ajis.v16i1.2902

Abstract

Abstract: Waqf Fundraising Management Model. This article examines models of fundraising through conventional sources, waqf asset productivity at The Al-Falah Social Fund Foundation (YDSF) in Surabaya. This study shows that YDSF uses waqf fundraising management through developing a resource fundraising model such as  fundraising  method from conventional sources either directly or indirectly as well as grant fundraising model such as strengthening empowerment program on the distribution of endowments. Whereas in developing asset fundraising model and, in-kind waqf, YDSF has not yet developed such a model. Artikel ini mengkaji model fundraising wakaf melalui sumber-sumber konvensional, produktivitas aset wakaf, dan in-kind wakaf pada Yayasan Dana Sosial Al-Falah (YDSF) Surabaya. Studi ini menunjukkan bahwa Yayasan ini menggunakan manajemen fundraising wakaf dengan mengembangkan model resource fundraising seperti metode penggalangan dari sumber-sumber konvensional baik secara langsung maupun tidak langsung dan model grant fundraising seperti penguatan program pemberdayaan pada penyaluran wakaf. Sedangkan dalam pengembangan model asset fundraising, dan in-kind wakaf, YDSF belum dapat mengembangkannya sehingga YDSF termasuk nādhir wakaf yang masih dalam kluster pengelolaan wakaf langsung.Kata Kunci: ṣadaqah jāriyah, al-ḥabs, manajemen fundraising wakaf, corporate social responsibility

Abstract

This study explains the importance of the arbitration clause in determining the resolution of sharia economic disputes. The settlement of economic disputes in the Court is less in the interest of the economic actors, because of the long time, the limited resources and the results of the win-loss cause damage to future business relations. Resolution of arbitration disputes is an alternative choice. The research method used is a qualitative method, a type of doctrinal research with a normative juridical approach. Dispute resolution arbitrarily has many advantages over litigation (Court), the nature of which prioritizes negotiations, can avoid hostility so that business relationships will still be intertwined properly. To ensure that in the future will use the arbitration event, if there is a dispute in a commercial agreement between the two parties it is important to make an arbitration clause separate from the commercial agreement (principal agreement). The arbitration clause is binding on both parties. The power of the arbitration clause will give legal consequences to prevent one of the parties who have agreed on an arbitration agreement to seek a dispute resolution in the Court. These legal consequences are usually implemented in the form of the right to file exceptions to absolute authority over a lawsuit or case filed with the Court whose parties have been bound by an arbitration agreement. Arbitration agreements (arbitration clauses) are very important to be carried out to smooth the movement of the sharia economy in the future, especially when the sharia economic movement is international. Arbitration in Islamic law has long been known as a form of dispute resolution known as tahkim. Tahkim is to appoint someone as a referee or peacemaker, by two or more people who are in dispute in order to settle the case which they have peacefully divided. The selected referee or peacemaker is a person who is approved by both parties because they are considered able to resolve the dispute between them. This person who acts as a referee, peacemaker or arbitrator in Islamic law is called hakam

Abstract

What was found in this paper strengthen Syaltut Mahmud statement and some other scholars that the orders circumcision, for both men and women, not relying directly on religious scripture text, because no one else valid hadith regarding circumcision command. The arguments presented cleric who require circumcision is very weak. According to Mahmud Syaltut, the command of circumcision in Islam actually be accommodated only through the rule of jurisprudence that injure members of the living body (in this case circumcision) is allowed if it there is the benefit derived from it.DOI: 10.15408/ajis.v15i1.2851

Abstract

Abstract: Constructing a Political Theory af Islamic Law in Indonesia. This study confirms that the transformation of Islamic law into national law has no correlation with the struggle towards an Islamic country or Islam as the foundation of the state. Islamic law legislation are regulations that have a positive contribution to strengthening the commitment of Muslims towards the Indonesian nation-state. This study refutes the notion that the accommodation of Islamic law within legislation is an agenda aiming towards an Islamic state. The process of accommodation of Islamic law does not need to be feared, because the process is supported by the power of cultural Islam. Besides, Islamic law is at the legal source level so that the accommodation into pre-legislation undergoesstringent testing in order to always be in accordance with Pancasila and the 1945 Constitution.Keywords: politic law, legislation, Islamic law, constitutional theory and the theory of accommodationAbstrak: Membangun Teori Politik Hukum Islam di Indonesia. Studi ini menegaskan bahwa transformasi hukum Islam ke dalam hukum nasional tidak memiliki hubungan dengan perjuangan menuju negara Islam atau Islam sebagai dasar negara. Legislasi hukum Islam menjadi perundang-undangan memiliki kontribusi positif dalam memperkuat komitmen umat Islam terhadap negara kebangsaan Indonesia. Studi ini membantah pendapat yang menyatakan bahwa akomodasi hukum Islam oleh peraturan perundang-undangan merupakan agenda menuju negara Islam. Proses akomodasi hukum Islam tidak perlu dikhawatirkan karena proses itu didorong oleh kekuatan Islam kultural. Abstract

The influence of Qawl al-Shahâbî in Islamic Law.Islamic law is dynamic because it always responds to legal problems that concern social life. This dynamic has been supported by the limitless sources of Islamic law. There are two types of Islamic sources: undebatable sources (muttafaq ‘alayh) such as Alquran, hadîts, ijmâ’and qiyas, and debatable sources (mukhtalaf fîh) such as maslahah mursalah, istihsân, ‘urf, qawl al-shahâbî, istishhâband sadd al-dzarâ’i’. Qawl al-Shahâbîhas an important position in the formation of Islamic law because the fuqahâmuch refer to them when wanting to issue fatwâ. The disagreements of ulama over evidence do not die on rejection, but intensify on the use of the law as the main source.DOI: 10.15408/ajis.v14i2.1290
