Abstract

This article examines the issue of jarīmah ta'zīr as one of the dimensions of Islamic criminal law which has flexibility in its application.In contrast to ḥudūd and qisāṣ whose rules are very clear and detailed in the Qur'an, ta'zīr is not set clearly in the Qur'an. Therefore, the ijtihad of a ruleror judge to determine the type of crime and jarimah that can be punished (ta'zīr) and the type and form of punishment is really important. The flexibility of ta'zīr allows to accommodate the complex form of crime suchas gratification, corruption, sexual harassment, drugs, and pornography.But ta'zīr also opens the opportunity for the tyranny of the government inpunishing a person. Abstract

Abstrak: Presiden Non-Muslim di Negara Muslim: Diskursus Politik Islam dalam Konteks Politik Indonesia Kontemporer. Artikel ini secara spesifik dimaksudkan untuk membahas secara kritis pendapat  para cendekiawan Muslim Indonesia  tentang  kemungkinan non-Muslim menjadi presiden di Negara Republik Indonesia yang merupakan negara  berpenduduk  Muslim  terbesar  di dunia. Hingga  detik  ini, wacana  Islam klasik tentang masalah ini cenderung terjebak dalam model analisis  normatif  yang  terkesan  rigid  dan  tidak toleran. Wacana ini, sampai batas tertentu,  kurang dapat menghargai kondisi  sosial, budaya, sejarah, dan  kompleksitas politik  masyarakat  Muslim. Oleh karena itu, diskursus klasik mengenai masalah ini oleh banyak cendekiawan Indonesia kontemporer dipandang telah  gagal merespons  dinamika sosial-politik  saat ini,  terutama  bila dilihat dari  sudut  pandang multi-kulturalisme dan demokrasi. Artikel ini membahas  dimensi penting  mengenai kepemimpinan non-Muslim di Indonesia yang  sering  dilupakan  atau  sangat jarang didiskusikan.Kata Kunci: Islam di Indonesia, Presiden Non-Muslim, Otoritas Tuhan, Piagam Jakarta.Abstract: A Non-Muslim President in a Muslim State: Islamic Political Discourse in Contemporary Indonesia. This article charts the political discourse amongst Islamic leaders regarding the possibility of a non-Muslim becoming President in Indonesia, the world’s most populated Muslim state, an important issue but one that is only seldom discussed in an academic context. Until recently, classical Islamic discourse on this issue, which has generally rejected this possibility, had tended to be trapped in a normative model of analysis which today seems intolerant and rigid. This article contends that this discourse, to some extent, does not properly appreciate the complex social, cultural, historical and political realities of the Muslim community today. Indeed, many other contemporary scholars view this mode of discourse as failing to respond to the current social-political dynamic, especially those scholars coming at it from a multicultural democratic perspective. Perhaps most importantly, the legal reality—even though there is a reasonable degree of controversy surrounding it—which is that there is no criterion that the President has to be Muslim, is also rejected by this discourse.Keywords: Islam in Indonesia, Non-Muslim President, God’s Authority, Jakarta CharterDOI: 10.15408/ajis.v12i1.971

Abstract

The implementation of the principle of Pacta Sunt Servanda in every international agreement is crucial, considering that the principle necessitates both parties to comply with the agreement. However, in the case of a peace agreement between Israel and Palestine, the fact shows the opposite. This has been due to the violation of the agreement by Israel between 1993-2007. Employing a normative-empirical approach, this study analyzes Israel’s violations against the Israeli-Palestinian peace agreement between 1993-2007, which contradict the principle of Pacta Sunt Servanda and the Siyasah Kharijiyya concept. This study reveals that Israel neglected the principle of Pacta Sunt Servanda in the peace agreement with Palestine. The absence of sanctions for Israel shows that the International Court of Justice has not been able to provide legal certainty for the Palestinian people. Implementasi asas Pacta Sunt Servanda  mutlak ada dalam setiap perjanjian internasional.  Asas ini sebagai landasan bahwa perjanjian tersebut wajib dipatuhi kedua belah pihak. Namun,  faktanya sangatlah bertolak belakang dengan yang diharapkan. Pada perjanjian damai Israel-Palestina,  banyak  pelanggaran yang dilakukan Israel pada perjanjian damai tersebut terutama kurun waktu 1993–2007. Pada masa itu, telah terjadi rangkaian perjanjian damai antara Israel-Palestina, namun pihak Israel yang selalu melanggar hasil kesepakatan perjanjian tersebut. Dengan pendekatan normatif-empiris, penelitian ini menganalisis pelanggaran Israel pada perjanjian damai Israel-palestina dalam kurun waktu tahun 1993– 2007. Pelanggaran tersebut bertentangan dengan asas Pacta Sunt Servanda dalam konsep perjanjian internasional dan Siyasah Kharijiyyah pada kajian Fikih Siyasah. Temuan penelitian menjelaskan bahwa Israel tidak mengindahkan asas Pacta Sunt Servanda dalam melakukan perjanjian damai dengan Palestina. Tidak ada sanksi terhadap  Israel memperlihatkan bahwa Mahkamah Internasional belum dapat memberikan kepastian hukum terhadap rakyat Palestina.

Abstract

In liberal studies, Sharia and human rights are two issues that are often opposed to distort the role of sharia in solving human right cases. In his writings on sharia and human rights issues, Abdullahi Ahmed an-Naim often applies rational rules as the source of truth and human values as a goal, but he excludes the role of Islamic law and its interpretation. Naim states that the human right problems in the world can not be solved by the sharia but can only be solved by secular laws. For example, the practice of slavery and discrimination against women and non-Muslims ethnic is a subjective conclusion that is counter productive to the role of sharia. Therefore, this conclusion is unacceptable and is necessary to have objective assessment. It is really clear that sharia is glorious and never distorts human rights at all.DOI: 10.15408/ajis.v16i1.2893

Abstract

Corporate Social Responsibility (CSR) as an Implementation of Social Fiqh to Empower Society. Corporate Social Responsibility (CSR) is the responsibility of businesses in their undertakings. CSR in the perspective of social fiqh is no only position as an obligation of business that must be there as a part of social life. The government must support business in implementing CSR from voluntary to mandatory requirements so that the existence of CSR can be felt in reality by society. Optimisation of the CSR function in the supporting the success of development can be undertaken by synergising three potentials, namely tertiary education institutions who have the science, sufficient technology and human resources; government who has the space, society and development plans as well as businesses who possess CSR funding.DOI: 10.15408/ajis.v14i1.1253

Abstract

Political economy and religious policies affect the relationship between sharia and financial authorities. Countries that make Islam as the official religion put Sharia authorities within the scope of the state. Malaysia is one of the countries that put Sharia authorities in the structure of state authority, although it is subject to independency. In the meantime, Indonesia combines the two models of relationship: 1) granting broader independence to sharia authority (the Indonesian Ulema Council) and 2) forming sharia board to deal with sharia finance, among others. The comparison of Indonesian, Malaysian, and the Middle Eastern countries’ system shows that the independence and the effectiveness of sharia economic fatwa application are found to attract each other. This, in turn, influences the supervision of Islamic financial institutions.  AbstrakPolitik ekonomi dan kebijakan agama memengaruhi hubungan antara otoritas syariah dan otoritas keuangan. Negara yang menjadikan Islam sebagai agama resmi menempatkan otoritas syariah dalam ruang lingkup negara. Malaysia adalah salah satu negara yang menempatkan otoritas Syariah dalam struktur otoritas negara, meskipun tetap independen. Sementara itu, Indonesia menggabungkan dua model hubungan: 1) memberikan independensi yang lebih luas kepada otoritas syariah (Majelis Ulama Indonesia) dan 2) membentuk dewan syariah untuk menangani hal yang berkaitan dengan keuangan syariah. Perbandingan sistem Indonesia, Malaysia, dan negara-negara Timur Tengah menunjukkan bahwa independensi dan efektivitas penerapan fatwa ekonomi syariah terbukti saling berhubungan satu sama lain. Ini, pada gilirannya, memengaruhi pengawasan lembaga keuangan Islam.

Modernity Challenges of Islamic Criminal Law. One of the challenges facing the Islamic criminal law in the era of modernity is the advancement of science and technology in the fields of medicine and human rights. Science and technology can be used as a analysis method in Islamic criminal law, although the concept of human rights in the era of modernity bore dilemma. Abstract

Abstract: Problems with Family Law: The Phenomena and the Paradigm of Classical Texts. There are many factors that can trigger the emergence of family problems. One factor that is especially influential is diminished adherence to religious values, in which husbands, wives and children forgo using these values as the foundations upon which to live. If that is the cause of family problems, returning to religious values can provide one way of solving them. But these values aren’t problem-free either, given that religious texts, especially classical religious texts, seem misogynistic and too discriminatory towards women, limiting their roles only to inside domestic matters. Because of these problems, this article argues that creating a harmonious life between husband and wife must be guided by principles promoting equal rights and valuing each spouse’s role equally.Keywords: family law, religious value, classical textAbstrak: Problematika Hukum Keluarga: Antara Fenomena dan Paradigma Kitab Klasik. Banyak faktor yang menyebabkan munculnya masalah di dalam keluarga. Salah satu yang kuat pengaruhnya adalah karena lunturnya pengamalan nilai-nilai agama, yang tidak lagi dijadikan landasan dalam berpijak, baik oleh suami, isteri maupun anak. Karena itu, kembali kepada nilai-nilai agama menjadi salah satu solusi tawarannya. Namun bukan tanpa masalah, mengingat teks-teks keagamaan khususnya klasik, kadang terkesan mesoginis dan terlalu mendeskriminasi kaum perempuan dan membatasi peran mereka hanya dalam urusan domestik. Abstract

Inheritance law is one of islamic law that always dinamically follow the time. The history showed when abu bakr period, two years after the death of prophet, has renewed inheritance law. Indonesias became an important part of inheritace law. This development isnt regardless from the thinker and scholar in indonesia. Among scholar who have a great influence on inheritance law in indonesia are hazarin and munawir sjadzali. both of figures are famous for their controversy. Hazarin famous for the thought the equality of between grandchildren male and female. while sjadzali famous her thought the equality between man and women. hazarin tend to think that is still near to the nash alquran, while munawir to deviates from nash provisions. In its development, the development of hazarin was adopted by inherentance law in Indonesia. the compilation of islam law has decided the existence of substitute heird in which one of them comes from the thought on Hazarin who positioned equally between granddaughter and grandson.

Abstract

For some experts, Tunisia is tended to be the most progressive, liberal and radical among other Islamic countries in the world, particularly in addressing the issues of women's rights and the prohibition of polygamy. However, development in the areas of family law is not followed by progress in other fields, mainly in the development of waqf.  For this case, Tunisia is the most underdeveloped compared to other Muslim countries, such as Saudi Arabia, Egypt, Pakistan, Bangladesh, Sri Lanka, Jordan, Brunei Darussalam, Malaysia, and Indonesia; even though, around the 19th century, the contribution of waqf land of Tunisia in 1883 had reached 1/3 of the entire ownership of the land. Currently, Tunisia Tunisia do not yet have the institutions and the laws governing the waqf.DOI: 10.15408/ajis.v15i2.2857
