Abstract

Loyalty Sufis against Shari’ah. In the history of Islam, the Sufis always received criticism from some scholars that they ignore the laws of Sharia. Sufis are considered more priority the inner problem than Shari’a law. This paper proves that the criticism is not always true. The majority of the Sufis still loyal and running the Shari’a law. Even many Sufis who follow the habit of the Prophet until the small things that are not considered essential. Although a small group of Sufis who ignore the law, who are a small part of the malâmatiyyah, but this can not be generalized for all Sufis.DOI: 10.15408/ajis.v14i1.1249

Abstract

The two primary and significant roles of maqāṣid al-sharī‘at worth studying are directive and defensive systems. The directive system, for instance, puts the maqāṣid al-sharī‘at as the main reference for any reformation or changing processes and dynamization of the Islamic law, whereas the latter places it as the supreme principle of morality that provides the foundation and ethical-spiritual power for Muslim Societies when they interact with the law. With these two roles, the maqāṣid al-sharī‘at can serve as a driving force to create future changes towards a more constructive and humanistic society. This study is library research which examines the maqāṣid al-sharī‘at from the time of Prophet Muhammad (Peace be Upon Him) to this very day. It aims at elaborating the position of maqāṣid al-sharī‘at as the primary reference and ethical-spiritual foundation for the dynamization process of Islamic law in dealing with contemporary issues. It also examines the concept of maqāṣid al-sharī‘at and analyzes the flexibility, adaptability, and dynamic of Islamic law. In addition, it is intended to open the mind of those who claim that Islamic law is so immutable, doctrinal, eternal, and final. This means that Islamic law is assumed to be inadaptable to various forms of social changes and modernization.     AbstrakPeran paling utama dan penting maqāṣid al-sharī‘at yang patut dipelajari adalah sistem direktif dan pertahanan. Sistem direktif, misalnya, menempatkan maqāṣid al-sharī‘at sebagai rujukan utama untuk setiap reformasi atau proses perubahan dan dinamisasi hukum Islam, sedangkan yang terakhir menempatkannya sebagai prinsip moralitas tertinggi yang memberikan landasan dan kekuatan etis-spiritual untuk masyarakat Muslim ketika mereka berinteraksi dengan hukum. Dengan dua peran tersebut, maqāṣid al-sharī‘at dapat menjadi pendorong perubahan masa depan menuju masyarakat yang lebih konstruktif dan humanistik. Penelitian pustaka ini meneliti maqāṣid al-sharī‘at dari masa Nabi Muhammad Saw. hingga hari ini. Hal ini bertujuan untuk menguraikan posisi maqāṣid al-sharī‘at sebagai acuan utama dan landasan etis-spiritual bagi dinamisasi proses hukum Islam dalam menghadapi persoalan kontemporer. Ini juga mengkaji konsep maqāṣid al-sharī‘at dan menganalisis fleksibilitas, kemampuan beradaptasi, dan dinamika hukum Islam. Selain itu, dimaksudkan untuk membuka pikiran mereka yang menyatakan bahwa hukum Islam begitu lestari, doktrinal, abadi, dan final sehingga dianggap tidak dapat beradaptasi dengan berbagai bentuk perubahan sosial dan modernisasi yang membawa banyak isu kekinian.

Abstract

The phenomenon of Shi'ism in the discourse of Islamic thought becomes one of the interesting as well as controversial discourse. Shia Ja‘farī, known as the Shi'a Imamiyah is often a priori addressed. A lot of the literature on the founder’s thinking contains prejudices. As a result,Shia Ja‘farī is not only underestimated, but also regarded as an aberrationor misdirection. Serious accusations are often leveled by Sunni against the Shias. This study poses the real issue, referring to some authoritative literature on Shia about the historical background of the birth of the Ja‘farī school, its criteria of law, its attitude to the Qur'an, the Hadith of the Prophet, reason and qiyas.  DOI: 10.15408/ajis.v17i1.6221

Abstract

Abstract: Resistance and Intitation in the Implementation of the Syariah Economy in Indonesia Today, Syariah economics is experiencing significant development in Indonesia, signified by a positive reception to it in society. The implementation of Syariah economics in Indonesia has taken place over a long period of time, paralleling the arrival of Islam to Indonesia. Two-thirds of the way through the 20th century, discourse on Syariah economics began to grow, and since the 1990s Syariah economics has begun to be put into practice. But the implementation of Syariah economics has been faced with several challenges, shaped by political, sociological and economic conditions. This article outlines five initiatives that can be taken in order to implement Syariah economics in Indonesian society more systematically. First, the notion that a Syariah economy can be categorized as a legitimate economic system needs to be strengthened. Second, the scientific aspect of Syariah economics needs to be strengthened. Third, the socialization of the Syariah economy needs to be accelerated. Fourth, the Syariah economy needs to encompass the economic behavior of all people. Fifth, political reforms need to be carried out by elected politicians committed to developing Syariah economics in Indonesia.Keywords: challenges, initiatives, implementation, syariah economicsAbstrak: Tantangan dan Inisiasi dalam Implementasi Ekonomi Syariah di Indonesia. Dewasa ini, ekonomi Syariah mengalami perkembangan yang signifikan di Indonesia, yang ditandai oleh adanya respons yang positip dari masyarakat. Implementasi ekonomi Syariah di Indonesia telah berlangsung dalam jangka waktu yang lama seiring dengan datangnya Islam ke Indonesia. Sampai memasuki dua pertiga abad ke-20 ekonomi Syariah lebih banyak diwacanakan dan sejak 1990-an ekonomi Syariah mulai diimplementasikan. Implementasi ekonomi Syariah di Indonesia dihadapkan pada beberapa tantangan, yaitu kondisi politik, kondisi sosiologis, dan kondisi ekonomi masyarakat. Inisiasi yang bisa diambil dalam upaya mengimplementasikan ekonomi Syariah di Indonesia adalah pertama, perlu ada penguatan bahwa ekonomi Syariah itu dapat dikatagorikan sebagai sistem ekonomi. Kedua, perlu ada penguatan dalam aspek ilmu ekonomi Syariah. Ketiga, sosialisasi ekonomi Syariah dilakukan dengan akselerasi yang tinggi. Keempat, ekonomi Syariah diwujudkan dalam segala perilaku ekonomi masyarakat. Abstract

This paper discusses the role of women as witnesses in a court. This is one of debatable issues in Islamic law considering the provision stating that the value of two women’s testimony is equal to one man’s testimony. Based on a more comprehensive discussion and by revisiting the Islamic resources on this issue, this paper concludes that the provision in the hadith, historically, regards heavily on women’s capability and readiness to perform their duties as witnesses. It can be seen in the case of qadzaf where women can be witnesses for themselves (by stating four oaths in the name of Allah). Therefore, in the current development, women’s role as witnesses needs to be reconsidered so that women can appear in the judiciary to play a role in supporting justice. Penelitian literatur  (library research) ini bertujuan untuk menganalisa bagaimana pandangan kesaksian perempuan dalam Islam melalui pendekatan analitik terhadap ketentuan dalam fikih keadilan yang ditinjau melalui berbagai  berbagai corak diskusi dan referensi yang mendukung penelitian ini. Kesaksian merupakan proses menemukan dan membuktikan kebenaran dalam  perkara  perdata maupun  pidana. Dalam  hukum Islam, hal-hal yang membutuhkan kesaksian seperti itu adalah pernikahan dan perceraian yang menyangkut hudud dan qisha. Ada beberapa kriteria khusus dalam memberikan kesaksian. Dalam masalah-masalah spesifik, perempuan  tidak diizinkan memberikan kesaksian, diantaranya ialah wilayah hudud dan qisha. Ketentuan lainnya ialah  perempuan dapat  menjadi saksi di pengadilan, tetapi hanya dalam kasus perdata (transaksi keuangan), dan itupun bobot dua wanita sama dengan satu pria. Apabila  merujuk pada makna teks, maka jelas siapa pun dia (wanita) dan kualifikasinya tidak diperbolehkan untuk melayani sebagai saksi dalam kasus pidana. Meskipun secara historis,  terbukti banyak wanita cerdas, memiliki kedewasaan emosional, kredibilitas, dan berbagai kemampuan yang memenuhi syarat untuk tampil sebagai saksi dalam kasus-kasus, baik sipil maupun pidana. Masalah kesaksian seorang perempuan tersebut dinilai oleh sebagian orang sebagai salah satu perbedaan yang mensubordinasi perempuan.

Abstract

One of the interesting themes of Islamic family law reform is the legal status of polygamy. Almost all Muslim countries make efforts to narrow the space for the practice of polygamy by providing sanctions for the doers, including Tunisia, Pakistan, Egypt, Syria, Malaysia, and Indonesia. This article tries to discuss and analyze this case by making a comparison between the laws of family law in some countries—such as Tunisia, Pakistan, Egypt, Syria, Malaysia, and Indonesia—and the concept of classical fiqh. The study shows that even though each of these countries has the same spirit of renewal, they practice different reform issues related to polygamy. It can be clearly seen in the diversity of forms of sanctions for the doers of polygamy.DOI: 10.15408/ajis.v16i1.2891

Abstract

Demonstration is one application model of the people supervision against the government’s performances, which is based on amr ma’ruf nahi munkar and aims to realize people’s aspirations when they want to change a law and a government policies or aims showed disagreement over what happens inside the country or a broad, such as injustice, etc, and Islam has legalized demonstration during carried out public interest and in order to maintain security and stability of society, the government also has ensured this demonstration with giving rights and freedoms to every citizen to express their aspirations in accordance with applicable laws. DOI: 10.15408/ajis.v17i1.6228

Abstract

This article is a preliminary attempt do discuss and trace the status of qirâat sab’ah from the perspective of ulama. The writing of this article is done based on library research. The data, concept and theory for this writing are taken from ideas, concepts and theories written by ulama as stated in the list of references at the end of this article. The result of the analysis in this article indicates two main things related to the status of qirâat sab’ah, there are qirâat sab’ah is recognized as qirâat mutawâtir and as qirâat mutawâtir, it has fulfilled the criteria as proposed by well-known Islamic ulama.DOI: 10.15408/ajis.v15i1.2842

Abstract

Halâl Certification as an Application of Islamic Business Ethics in Muslim Consumer Protection Halâl certification in food is needed by Muslim consumers to provide assurances that they are not consuming or using product or service that are not halâl so that no sin is commited. It is the duty of government to provide assurances to Muslim consumers that consumer goods or services that are circulating amongst society are really halâl. The halâl label itself provides benefits to businesses such as improving consumer confidence to consume, reaching the global halâl food market, increasing the marketability of products in market and low cost investment. تهدف هذه الدراسة إلى توضيح أحكام موانع النفقة الزوجية في أقوال المذاهب الفقهية الأربعة المعتمدة عند أهل السنة ومذهب الجعفرية ومذهب الإباضية ومقارنتها بقانون الأحوال الشخصية الليبي رقم 10 لسنة 1984 ميلادي وتعديلاته، تحث اسم الأحكام الخاصة بالزواج والطلاق وأثارهما، وقد خصص اختيار هذا القانون لذهابِهِ في تعديله الأول إلى عدم الحديث عن أحكام موانع النفقة الزوجية واكتفي بالحكم في مسألة واحدة منها وهي حق النفقة للمطلقة البائن، بشرط أن لا تختل عقلياً، بل ذهب إلى أبعد من ذلك بإلغائه أحكام النشوز واعتبارها كأن لم تكن، وهي من موانع النفقة، وبقي هذا القانون على حالهِ إلى أن جاء في تعديلهِ الأخير رقم 14 أكتوبر 2015 ميلادي، بحذف مادة أحكام النشوز من الأساس واكتفى بالذكر أنه إذا لم يوجد نص تشريعي يمكن تطبيقه فيها فيحكم بمقتضى المذاهب الفقهية المعتبرة الأكثر ملاءمة لنصوص هذا القانون.    Abstrak: Studi ini bertujuan untuk menjelaskan hukum yang menghalangi hak istri atas nafkah dari suami berdasarkan empat mazhab fikih Ahlussunnah wal jama’ah, Ja'fari, dan Ibadhi, yang dibandingkan dengan Hukum Keluarga Islam Libya No. 10 tahun 1984 dan perubahannya, yaitu Peraturan Khusus tentang Perkawinan, Perceraian, dan Dampaknya. Peraturan ini dipilih karena amandemen pertama tidak menyebutkan ketentuan yang menghalangi hak istri untuk mendapatkan nafkah dari suami. Ketentuan yang disebutkan hanya tentang hak pasca cerai dalam hal perceraian ba'in dengan syarat istri memiliki kondisi mental yang sehat. Ketentuan mengenai nushuz dihilangkan meski konsekuensinya menghalangi hak atas nafkah. Dengan demikian, undang-undang tersebut tetap sama hingga amandemen terakhir diberlakukan pada 14 Oktober 2015. Dengan dicabutnya ketentuan nushuz, maka undang-undang tersebut mengikuti ketentuan empat mazhab fikih.
