Abstract

Halal food, which is characterized by lawful and good, has been measured by the standards of what can be eaten and cannot be eaten according to Islamic jurisprudence. The are condition and criteria of halalfood. Supervisory Board of the food products of the Council of Indonesian Ulama sends its inspectors to food factories in order to monitor the stages of production lines, and make sure to the safety of the food. In this article,halal food for Muslim will be discussed, including to unify the standards of halal products in Muslim countries, and implementing the Islamic way of undergoing contracts and transactions. DOI: 10.15408/ajis.v17i1.6222

Abstract

Abstract: Domination of the Fiqh Paradigm in Hadith Transmission and Codification. This paper primarily argues that fiqh has been dominating the transmission and canonization of Hadîts since the early Islamic period. The fiqh orientation in the transmission of Hadîts that has occurred since the early Islamic period, the formalization of fiqh schools, and the mainstreaming of fiqh in Hadîts works are the reasons that made it dominant. Moreover, the formation and acceptance of al-Kutub al-Sittah was also to pursue fiqh interests, rather than just the already important matter of Hadîts codification.Keywords: Hadîts Narration, Hadîts Records, Fiqh Codification.Abstrak: Dominasi Paradigma Fikih dalam Periwayatan dan Kodifikasi Hadis. Artikel ini utamanya menyatakan bahwa fikih telah mendominasi periwayatan dan pembukuan Hadis sejak periode awal Islam. Orientasi fikih pada periwayatan dan kodifikasi Hadis, formalisasi madrasah fikih, dan pengarusutamaan fikih pada karya-karya Hadis, adalah bukti-bukti yang menunjukkan fikih mendominasi periwayatan dan kodifikasi Hadis. Fakta lainnya adalah, pembentukan al-Kutub al-Sittah dan aspek penerimaannya ternyata lebih menunjukkan alasan pemenuhan kepentingan fikih ketimbang hanya periwayatan dan kodifikasi Hadis semata.Kata Kunci: Periwayatan Hadis, Pembukuan Hadis, Dominasi FikihDOI: 10.15408/ajis.v12i1.970

Abstract

The legal vacuum for of inter-faith marriage is one of the unresolved issues in Indonesia, especially with regard to civil rights. Indonesia’s Marriage Law No. 1 of 1974 has not accommodated the legal policy of marriage between different religions. Moreover, there are some different views between religious leaders on the permissibility of the inter-faith marriage. This study attempts to analyse the relations between Indonesia’s Religious Councils and the legal policies on inter-faith marriages. Data was collected through observation and semi-structured interviews with the representatives of Indonesia’s religious councils from six religions. It finds that Indonesia’s Religious Councils have no role by any means in the formation of legal policies related to inter-faith marriage in Indonesia since the Marriage Law had been created before the Religious Councils established. Regarding the legitimacy of inter-faith marriage, the religious leaders offered conflicting statements. Several religious leaders still decided to stay with the prohibition of interfaith marriage based on the popular religious traditions and the constitutional realm. Albeit religious leaders favour or disfavour inter-faith marriage, the practice is still widely flourished and rapidly increased. This observable fact should be an important reason for the Constitutional Court either to grant or deny the practices of inter-faith marriage in Indonesia. Terkait hak-hak sipil, terdapat kekosongan  landasan hukum dalam kasus perkawinan beda agama di Indonesia. Undang-Undang Perkawinan Indonesia No. 1 Tahun 1974 tidak mengakomodasi kebijakan hukum perkawinan beda agama. Selain itu, ada perbedaan pandangan antara para pemimpin agama tentang diizinkannya pasangan dari agama yang berbeda, misalnya dalam hal peninjauan materi Pasal 2 ayat (1) UU Perkawinan. Oleh karena itu, penelitian ini menganalisis hubungan antara Dewan Agama Indonesia dan kebijakan hukum tentang pernikahan antar agama. Sumber data penelitian ini adalah observasi dan wawancara semi-terstruktur dengan perwakilan dari Dewan Agama Indonesia dari lima agama yang diakui di Indonesia. Penelitian ini menemukan bahwa Dewan Agama Indonesia tidak memiliki peran apa pun dalam penentuan kebijakan hukum pernikahan beda agama. Hal ini  karena UU Perkawinan telah dibuat sebelum adanya Dewan Agama. Dalam topik legitimasi  pernikahan lintas agama, para pemimpin agama menyatakan pernyataan yang bertentangan. Sejumlah pemimpin agama masih memutuskan melarang  pernikahan antar agama berdasarkan tradisi keagamaan populer dan ranah konstitusional sedangkan bebera  lainnya memberikan sebaliknya. Meskipun belum ada kesepakatan  para pemimpin agama tentang  pernikahan antaragama, praktik ini masih terjadi bahkan meningkat pesat. Fakta ini harus menjadi alasan penting bagi Mahkamah Konstitusi untuk memberikan atau menolak praktik pernikahan antaragama di Indonesia.

Abstract

Human Rights contain provisions relating to Islamic law, especially family law. As a Sharia scholar, this topic is crucial to observe. This paper analyzes several aspects of family law in human rights, both universal human rights and universal human rights, such as marriage, inheritance, and child custody. There are the similarities and differences in both of these human rights like in the case of marriage. In Universal Declaration Human Rights, marriage is permissible for a couple without consideration of religion at all (article 2), whereas in Universal Declaration Human Rights, there is strong indication (Article 19 (1)a) that inter- religious marriage is forbidden, such as the comments of Elizabeth Mayer and others.DOI: 10.15408/ajis.v16i1.2892

Abstract

Juridist Reformulation of Halâl Products for Muslim Consumers in Indonesia. This paper examines the certification of halâl products that are becoming a social problem in the community as well as a responsibility of the state on the basis of the same reasoning, the assurance of halâl products. Halâl certification aims to protect the public from unlawful products and risks to health that often occur with differences of interests, especially between producers and consumers. The main source of this article is data obtained from field research that is related to the community to halâl certification LPPOM-MUI in Central and South Sumatra Province. The data is read through constructivism paradigm from a socio-legal approach with a pointed analysis of the codification theory of Islamic law, legal sociology by the American lawyer and scholar Rescoe Pound and mashlahah mursalah theory.DOI: 10.15408/ajis.v14i1.1241

Abstract

This study aims to compare the regulations of the Pre-Marriage Course and its implementation in Indonesia and Malaysia. Furthermore, this research seeks answers and a meeting point between the theory of maslahah and human rights in looking at the Pre-Marriage Course. This is a qualitative inquiry relying on a comprehensive literature study. The result indicates that the is no contradiction between the Pre-Marriage Course and the notion of mashalah and human rights. However, improvements and adjustment are still needed, which include sufficient infrastructures; professional organization; the commitment of future brides and grooms; as well as adequate financial supports. AbstrakPenelitian ini bertujuan untuk membandingkan aturan Kursus Pra-Nikah dan penerapannya di Indonesia dan Malaysia. Penelitian ini juga berupaya mencari jawaban dan menemukan titik temu antara teori maslahah dengan Hak Asasi Manusia dalam melihat Kursus Pra-Nikah. Penelitian ini merupakan penelitian kualitatif yang menekankan pada kajian literatur secara komprehensif. Dari kajian tersebut,  ditemukan bahwa tidak ada pertentangan antara aturan dan praktik Kursus Pra-Nikah baik dengan teori maslahah maupun Hak Asasi Mansuia. Akan tetapi, masih ada beberapa hal yang perlu ditingkatkan dan disesuaikan yaitu kecukupan infrastruktur, pelaksanaan yang profesional, komitmen dari calon pengantin, dan kecukupan dukungan finansial.

Abstract

Economy in The Perspective of The Quran Alquran discuss economic problems because of it’s importance for human life. The level of economic development for human needs is very clear in the Alquran. This article examines the economic values in tafsir of Alquran viewpoints and problems, economic paradigms that are in society. Beginning from the problems in the economy legally up to the principles of economy, this article focuses on a theme and then this study uses a method known as tafsir mawdû’î. The economy based on the Alquran is the study of science that studies the problems of the economy by increasing the values of Islam in deep. The existences of Alquran on the economic development become an integral part of Muslims. Abstract

Abstrak: Implementasi Isu Pada UU No. 1 Tahun 1974 tentang Perkawinan dan Kompilasi Hukum Islam. Diakui atau tidak, UU No. 1 Tahun 1974 tentang Perkawinan dan Kompilasi Hukum Islam pada praktiknya telah memperhitungkan hukum Islam pada batas-batas atau bagian tertentu. Hal ini dikarenakan kedua perangkat hukum tersebut mengatakan bahwa sengketa  perkawinan di seluruh negeri harus diselesaikan oleh hakim Pengadilan Agama. Sejak hukum syariah dan fikih bertindak sebagai panduan bagi para hakim dalam perselisihan tersebut, keduanya dapat dikatakan berlaku dalam kerangka hukum Nasional. Namun pada implementasinya, kedua hukum tersebut masih memiliki kelemahan. Untuk mengatasi ini, adalah kebutuhan penting untuk mengadopsi hukum pelengkap, seperti Hukum Terapan pada Peradilan Agama, yang akan segera dibahas di parlemen.Kata Kunci: perkawinan, cerai gugat, cerai talak.Abstract: Implementation Issues with the 1974 Marriage Law and the 1991 Compilation of Islamic Laws. Whether we appreciate it or not, the 1974 Marriage Law and the 1991 Compilation of Islamic Laws (KHI) pertaining to marriage do take into account shariah (Islamic law) into some extent. This is because both bodies of laws say that marriage disputes throughout the country are to be resolved by Religious Court judges. Since shariah and fiqh act as a guide for these judges in such disputes, both can be said to be in effect within the framework of national law. However there are still have shortcomings when it comes to implementating both. In order to overcome these, there is a vital need to adopt a supplementary law, such as the Religious Judicature Material Act, which will soon be deliberated in parliament.Keywords: marriage, wife-initiated divorce, husband-initiated divorceDOI: 10.15408/ajis.v12i1.961

Abstract

This paper examines how exactly the absolute competence of the Religious Courts and the application of syahadah istifadhah (testimonium de auditu) in the case of waqf determination submitted to the Religious Court as a judicial institution under the Supreme Court of the Republic of Indonesia. In the discussion, it is explained how the competence of the Religious Court especially in the case of waqf determination as arranged in Law No. 3 Year 2006 About Religious Courts combined with Law Number 41 Year 2004 About Waqf. In addition, this paper also compares between the concept of syahadah istifadhah and testimonium de auditu also its legal force in the case of verification at the court especially in the case of waqf determination. This paper concludes that the assignment of Waqf is the absolute authority of the Religious Courts. In addition, according to Islamic jursiprudence syahadah istifadhah can be used as a means of proof in waqf determination.

Abstract

This study aimed to find robbery criminal justice in KUHP and Jinayah perspectives. Robbery criminal justice is mentioned on Article 365 of Criminal Code, consisting of: prison nine, twelve, fifteen, and the death penalty, or life imprisonment or imprisonment for over twenty years. Meanwhile, in Islamic law, based on al-Qur’an, al-Ma’idah (5) verse 33 sated that the justice are sentenced to death by violently and authoritative, cross sentenced to death or executed after some time he hung, cut off his hands and legs intersect, and banished from the earth.DOI: 10.15408/ajis.v15i2.2858
