Abstract

Hermeneutics is often suspected as 'not from the Islamic treasury'. Although the topic of interpretation has been introduced by Aristotle in“ On Interpretation,” Hermeneutics became an independent subject in the science of philosophy in the seventeenth century mainly related to theinterpretation of texts and literary works. Another suspicion of the presence of Hermeneutics in Islamic treasures is the interpretive methodology that makes reconstructed texts as a center of study. It may lead the reader toother dimensions outside the convention. Beyond the pros and cons of thestudy of hermeneutics, this article explores the importance of hermeneutic methods and the contextualization of legal verses in the Qur'an to meet the needs of dynamic societies. DOI: 10.15408/ajis.v17i1.6088

Abstract

Economic Development Prospects of Sharia in the Banjar Society in South Kalimantan. Currently Islamic economics, with a wide range of variants, is developing widely and dynamically. The development of Islamic finance has been extended to almost all parts of Indonesia, both in urban and rural areas. The Banjar tribe are a sub-ethnic group that inhabit the South Kalimantan area originating from the Malay coast. Islam is the foundation of culture and identity of the community of the Banjar. The presence of the Islamic economic concept in Banjar society is no longer unusual because Islamic values associated with it have become common place. The development of Islamic economics in Banjar society will continue to flourish if supported by government policy (top-down approach).DOI: 10.15408/ajis.v14i2.1281

Abstract

This study aims to reveal the linguistic violence in the Indonesian Ulama Council’s fatwa texts on Ahmadiyah. The data in this study is in the form of words, phrases, sentences, and discourses from the MUI fatwa texts in 1980 and 2005 on Ahmadiyah. Some words contain linguistic violence such as “deviant”, “infidel”, and “a state threaten”. This study concludes two forms of linguistic violence in those fatwas: the subtle and abusive forms of violence. In the subtle form, the language is operated to dominate other parties. In addition, the language is also used as an offensive and abusive expression carried out consciously in a discourse. This is used to attack other parties and as a tool to hurt others.Abstrak:Penelitian ini bertujuan  mengungkap kekerasan linguistik dalam teks fatwa Majelis Ulama Indonesia (MUI) tentang Ahmadiyah. Dalam teks tersebut terdapat kata-kata yang mengandung unsur kekerasan linguistik seperti “sesat menyesatkan”, “berada di luar Islam” dan “bahaya bagi ketertiban dan keamanan negara.” Data dalam penelitian ini berupa kata, frasa, kalimat, dan wacana yang berasal dari teks fatwa MUI tahun 1980 dan 2005 tentang Ahmadiyah tersebut. Penelitian ini menyimpulkan bahwa terdapat dua bentuk kekerasan linguistik pada kedua fatwa tentang Ahmadiyah tersebut. Pertama, kekerasan linguistik bentuk halus (subtle form). Kedua, kekerasan linguistik bentuk kasar (abusive form). Pada kekerasan linguistik bentuk halus (subtle form), bahasa dioperasikan sebagai wahana untuk mendominasi pihak lain. Sementara pada kekerasan linguistik bentuk kasar (abusive form) bahasa digunakan sebagai ekspresi ofensif yang dilakukan secara sadar dalam sebuah wacana. Dalam kekerasan linguistik bentuk kasar, bahasa dimanfaatkan untuk menyerang pihak lain seperti memberi label sesat menyesatkan. Selain itu, bahasa juga digunakan sebagai sarana untuk menyakiti pihak lain.

Abstract

Abstract: Formalization of an Islamic Law Paradigm in Indonesia. Formalization of Islamic law in Indonesia in principle is an effort of transformation of substantive values of Islamic Law within the system of National law. Indonesia is a constitutional state, so the formalization of Islamic law must refer to the constitution of the state. Therefore, the transformative paradigm of the means of formalization of Islamic law within the constitutional system is an appropriate choice and provides for broader prospects. Thus, the formalization of Islamic law in formal symbolic manner, especially in an effort to establish an Indonesian Islamic State, will only undergo distortions and will not provide benefits for the Islamic community in Indonesia.Keywords: formalization, Islamic law, national constitutionAbstrak: Paradigma Formalisasi Hukum Islam di Indonesia. Formalisasi hukum Islam di Indonesia pada prinsipnya merupakan upaya transformasi nilai-nilai subtanstif hukum Islam dalam sistem hukum Nasional. Indonesia adalah negara hukum, sehingga formalisasi hukum Islam mesti mengacu pada hukum negara. Oleh karena itu, paradigma transformatif bagi upaya formalisasi hukum Islam dalam sistem hukum Nasional adalah pilihan yang tepat dan memberikan prospek yang lebih besar. Abstract

Abstrak: Penelitian ini membahas masalah kontemporer yang penting berjudul  “  seputar penerapan hukum berdasarkan pendapat ahli dalam transaksi keuangan kontemporer “. Di sini para peneliti memulai dengan menjelaskan definisi “Ahli”, mengungkap jenis jenis nya, lalu menjelaskan persyaratannya untuk kemudian disimpulkan sejauh mana kekuatan opini dan pendapat para ahli itu bisa digunakan. Kemudian para peneliti membahas beberapa bidang  yang menjadi acuan perkataan para ahli dalam penerapan dua transaksi keuangan kontemporer  bernama ; Murabahah Pesanan pembeli  dan perusahaan kontruksi.Kami telah sampai kepada beberapa kesimpulan dimana hal hal terpenting nya adalah sebagai berikut; bahwa kompensasi kerusakan barang dalam akad Murabahah pesanan pembeli dirujuk ke perkataan para ahli  dalam dua kasus: Kasus pertama, ketika kompensasi kerusakan finansial yang disebabkan oleh lembaga keuangan, seperti : pengembalian barang dagangan yang rusak. Kasus Kedua, ketika kompensasi kerusakan finansial disebabkan oleh pemesan barang, seperti : mundurnya si pemesan dari pembelian  barang pesanannya.Adapun dalam hal perusahaan kontruksi, maka boleh merujuk kepada perkataan para ahli dalam dua kasus juga; Kasus pertama: menjalankan perkataan Ahli dalam kompensasi kerusakan finansial yang disababkan oleh perusahaan kontruksi, seperti : kompensasi atas tidak terpenuhi nya kontrak. Kasus ke dua : kompensasi  kerusakan finansial yang disebabkan oleh mitra / klien, seperti : kompensasi akibat tidak profesional nya kontraktor yang bersangkutan dalam menjalankan kontrak nya.Kata kunci : Kompensasi kerusakan, transaksi keuangan, Murabahah pesanan pembeli, perusahaan kontruksi     Abstract: This research discusses an important contemporary issue, namely, the domains of making judgments upon expert’s opinion in contemporary financial transactions. Both researchers start by presenting the concept of the expert, revealing its types, clarifying its terms, and determining the extent of its power. The researchers then discuss the domains of referring to expert’s opinions relevant to two questions of contemporary financial transactions, namely: Murabaha to purchase orderer and contracting companies. This paper draws a number of findings, the most important of which are: Expert's opinion can be referred to in indemnity for damages in Murabaha to the purchase orderer in two cases: indemnity for financial damages caused by the financial institution, such as: returning defective merchandise. The second case is: indemnity for financial damages caused by the purchase orderer, such as: the buyer's abstention from buying the items ordered for purchase.In contracting companies, expert’s opinion is referred to in two cases as well: first: indemnity for financial damages caused by contracting companies, such as: compensation for not completing the contract. The second case is: compensation for financial damages caused by the client, such as: compensation for not enabling the contractor to complete the contract.

Abstract

The Contributions of Islamic Order to Deliberative Democracy in Indonesia. Many references indicate the dynamic development of democracy with various definitions and classifications. The founding fathers did not want liberal democracy. Therefore, the consultative democracy was selected as outlined in the formulation of the fourth principle of Pancasila. This decision was considered special because there has been a contribution of Islamic thought. This article describes the principles of Islam in the deliberation that carry deliberative democracy including the meaning and purpose of deliberation, the agency that deliberation, and decision making. Those principles are reflected in the formulation of the fourth principle, the existence of the people’s Consultative Assembly, the membership of the Assembly in 1945 before amendments, and decision making method.DOI: 10.15408/ajis.v16i2.4446

Abstract

Abstract: Domestic Violence in Fiqh Perspective. This study intends to explore the views of Islamic Jurists against domestic violence and   their perspective in preventing the violence in the house hold. According to Islamic jurisprudence, domestic violence committed by a husband to his wife is against law. The violence itself can be implemented by many forms such as physical, psychological, sexual, as well as economic violence. In order to give lesson, a husband is allowed to beat his wife, if only not hurting her. On the other hand, a husband is obliged to fulfill economical, pschychological and sexual needs of his wife. As a preventive measure, jurisprudence offer measures, such as choosing a devout husband or wife to be maried and preventing children become a target of domestic violence.Keywords: islamic jurisprudence, nushūz, domestic violenceAbstrak: Kekerasan dalam Rumah Tangga Perspektif Fikih. Studi ini bermaksud menggali pandangan ulama fikih terhadap kekerasan dalam rumah tangga dan bagaimana upaya preventif dari tindak kekerasan dalam rumah tangga tersebut. Menurut fikih Islam, kekerasan dalam rumah tangga yang dilakukan suami kepada istri adalah haram hukumnya, baik kekerasan fisik, psikis, seksual, maupun ekonomi. Karena itu dispensasi suami memukul istri yang nusyu hanyalah upaya edukatif namun tidak boleh menyakiti istri. Suami diharamkan mengancam, mengabaikan nafkah batin, nafkah lahiriah, serta kebutuhan seksual istrinya. Sebagai langkah preventif, fikih menawarkan langkah- langkah, antara lain memilih calon suami atau istri yang taat beragama dan menghindarkan anak dari suasana kekerasan dalam rumah tangga.Kata Kunci: fikih Islam, nusyu, kekerasan dalam rumah tangga

Abstract

Critics of Islamic banking argue, that how could Islamic banking work when interest (riba) is prohibited? Those in favour argue that Islamic banks can operate without interest. This is the contention of the paper. Islamic bank is a banking which operates without the norm of interest. However, the Muslim scholars have never seriously discussed the three basic questions. Riba, interest, are riba and interest synonymous. The most common application of riba is on monetary transaction relating to “loans” and “credits”. A unique feature of Islamic banking is its profit-and-loss sharing (PLS) paradigm, which is predominantly based on the mudarabah (profit-sharing) and musharaka (joint venture) concepts of Islamic contracting. However, Islamic banks are also criticized for not applying the principle of mudaraba in an acceptable manner. Where banks are eager to take part in profit-sharing but they have little tolerance for risk. Jaiz bank plc, the first Islamic bank in Nigeria, is a quoted public company owned by over 26,000 shareholders. Based on recommendations from Islamic Development Bank (IDB), which is also a shareholder of the bank, Jaiz Bank PLC had partnered with Islamic Bank of Bangladesh (IBBL). However, the Islamic Banks, generally, seem to attract a fraction of the business of financial transactions in any country where conventional banks operate. The challenge facing Islamic banks is the diversity of opinion among the Sharia scholars. Whether the particular practice or product, is Sharia compliant. The paper therefore, concludes that, by prohibition of riba, Islam wishes to establish an economic system where all forms of exploitation are eliminated. The difficulty to understand the prohibition comes from lack of appreciation of the whole complex of Islamic values.  Thus, the future of Islamic banks depends not only upon investing in new products but also upon the satisfying the faith of the stakeholders.

Abstract

Abstract: An Evaluation Study on Haji Bridging Funds of Shariah Banking Products in Indonesia. Hajj bridging funds are one of the financing products of Islamic banking based on a fatwa of the National Shariah Council that was endorsed by the Ijtimak Ulama of Fatwâ Commission throughout Indonesia. The bridging funds are to be provided to the customers who are able to settle up the loan before the hajj. Different transactions are used in hajj bridging funds. There are transactions of ijârah, qard, or both. Hajj bridging funds provide a positive impact (maslahah) like the ease for customers to obtain the hajj departure portion. However, the disadvantage (mafsadah) of hajj bridging funds are the increasing waste of the criteria of ability (istitâ‘ah) in hajj and the extending of hajj departure waiting lists.Keywords: hajj bailout, istitâ‘ah, maslahah, transaction of ijârah, transaction of qardAbstraks: Studi Evaluasi atas Dana Talangan Haji Produk Perbankan Syariah di Indonesia. Dana talangan haji merupakan salah satu produk pembiayaan perbankan syariah yang berlandaskan fatwa Dewan Syariah Nasional yang diperkuat oleh Ijtimak Ulama Komisi Fatwa seluruh Indonesia. Dana talangan haji diberikan kepada nasabah yang mampu melunasinya sebelum melaksanakan ibadah haji. Akad yang digunakan dalam talangan haji berbeda-beda. Ada yang menggunakan akad ijârah, qard, dan gabungan keduanya. Dana talangan haji memberikan dampak positif (maslahah) berupa adanya kemudahan kepada nasabah untuk mendapatkan porsi keberangkatan haji. Sedangkan dampak negatif (mafsadah) dana talangan haji adalah semakin mengaburkan kriteria mampu (istitâ‘ah) dalam haji dan memperpanjang daftar tunggu keberangkatan haji.Kata Kunci: dana talangan haji, istitâ‘ah, maslahah, akad ijârah, akad qardDOI: 10.15408/ajis.v13i2.943
