Abstract

Suatu tindakan kejahatan tidak dibenarkan dalam undang-undang salah satunya tindak pidana dibidang pelayaran. Seorang yang melakukan suatu tindak kejahatan seharusnya dapat dipertanggungjawabkan secara pidana. Namun pertanggungjawaban dalam perkara Nomor: 474/Pid.B/2021/PN Byw. Didapati dalam perkara ini terdakwa yang melakukan kesalahan tidak dapat dipertanggungjawabkan karena hakim tidak melihat kesalahan yang dilakukan terdakwa melanggar ketentuan undang-Undang Pelayaran dan KUHP. Penelitian yang dilaksanakan mempunyai tujuan untuk menjelaskan atau mengartikan bagaimana proses pengambilan keputusan dipengaruhi oleh pertimbangan yudisial dan tanggung jawab syahbandar? Masalah ini menjadi pusat diskusi melalui penggunaan metodologi seperti legislatif, konseptual, dan analisis studi kasus. Metode yuridis normatif diterapkan pada penelitian ini, yang melibatkan pemeriksaan data sekunder yang kemudian dianalisa secara kualitatif. Hasil penelitian menunjukkan bahwasannya pertanggungjawaban dalam kasus Nomor: 474/Pid.B/2021/PN Byw. Tidak sesuai pada ketentuan Undang-Undang Pelayaran dan KUHP yang berlaku. Kesalahan yang di perbuat oleh terdakwa seharusnya dapat dipertanggungjawabkan secara pidana karena telah memenuhi unsur-unsur pasal yang didakwakan. Selain itu, putusan yang dijatuhkan majelis hakim kepada terdakwa kurang tepat karena tidak melihat kesalahan yang dilakukan oleh terdakwa sehingga hakim menyatakan terdakwa terbukti tidak bersalah dan dinyatakaan bebas.

Abstract

Low vision is a form of visual impairment that limits daily activities and cannot be corrected with glasses, contact lenses, medication, or surgery (Jennifer Hissett 2008, 1032-33). Social workers have unique abilities in carrying out their role as professional experts in implementing low vision services at LAYAK Foundation's. One of the social institutions in Jakarta that participates in the implementation of social welfare that raises the issue of low vision is Yayasan Pelayanan Anak dan Keluarga (LAYAK). So the researcher wants to see what role social workers can play in helping low vision disabilities overcome limitations through the LAYAK Foundation's rehabilitation services. Research using qualitative methods using observation techniques, interviews and also using documentation studies, researchers focus the problem on the role of social workers carried out in rehabilitation services at LAYAK Foundation. Based on Walter A Fridlander's theory, the role of social workers is divided into 7 roles, namely as a catalyst, informator, mediator, motivator, counselor, facilitator and educator. In the research findings, it can be concluded that the role of social workers in increasing client independence in rehabilitation services at the LAYAK Foundation has advantages and disadvantages.

Abstract

Perjudian online merupakan fenomena yang harus ditangani secara serius terlebih aktivitas perjudian memiliki dampak yang bukan hanya dirasakan kepada pemainnya, melainkan lingkungan sosialnya. Tujuan dari penelitian ini untuk mengetahui faktor perjudian online pada kalangan pemuda di RW.004, Ceger, Cipayung, Jakarta Timur. Penelitian ini menggunakan pendekatan kualitatif dengan menggunakan studi deskriptif. Data yang didapatkan melalui hasil wawancara, observasi dan dokumentasi serta penentuan informan menggunakan teknik purposive sampling. Hasil penelitian ini menunjukan bahwa perjudian online yang terjadi pada pemuda di RW.004, Ceger, Cipayung, Jakarta Timur dipengaruhi oleh faktor lingkungan (eksternal) yaitu pertemanan dan belum adanya himbauan terkait perjudian oleh pihak kepolisian maupun masyarakat serta faktor yang ditimbulkan dari dalam diri sendiri (internal) yaitu ambisi mengalahkan bandar, mencari keuntungan, dan menghilangkan stress sebagai sarana hiburan.

Abstract

Penelitian ini membahas mengenai Sikap kemandirian Remaja Broken Home Dengan Tidak Selalu Mengidealkan Orang Tuanya Di Kelurahan Cilangkap Jakarta Timur. Penelitian ini menggunakan metode kualitatif hasil penelitian dituliskan secara deskriptif. Teknik pengumpulan data berupa wawancara, observasi dan studi dokumentasi. Hasil dari penelitian ini ialah diketahui jika para remaja dengan latar belakang broken home di Kelurahan Cilangkap, Jakarta Timur sudah tidak menganggap orang tua sebagai sosok yang selamanya benar dalam mengambil sikap, serta sudah mampu untuk mulai melepas ketergantungannya kepada orang tua dan mempunyai sikap tanggung jawab

Abstract

This article discusses the role and importance of titles and headlines in the structure of the general text, its pragmatic-functional tasks in ensuring the success of the text. The linguistic elements perform pragmatic function. The opinions of famous linguists on the titles and headlines, its structure and pragmatic functions are cited. Functions and syntactic models of titles and headlines are presented. Examples of popular science text titles, headlines and their translations into Uzbek and Russian are presented and analyzed.

Abstract

This article explores the application of constructive grammar, a linguistic approach that integrates cognitive, syntactic, and semantic frameworks to analyse causative constructions in English and Russian languages. Constructive grammar interprets not only the form and content of linguistic components but also the structure itself, which influences and imposes constraints on these components. The study considers the methodological evolution from traditional syntactic theories to cognitive models, particularly the influence of Ch. Fillmore’s work. By focusing on causative constructions, specifically analytical causatives like "The police made him confess," the research draws upon the theories of V.P. Nedyalkov, G.G. Silnitsky, and A.A. Kholodovich, among others, to provide a comparative analysis of causative structures in different languages. Cognitive and generative grammar perspectives, including R. King's spatial metaphor and L. Talmy’s force dynamics, are integrated to establish a comprehensive framework for understanding the universal and language-specific properties of causative expressions. The findings highlight the importance of the cognitive interpretation of syntactic structures, the role of energy transfer between agents and patients, and the diverse semantic types of causative situations. The study concludes by suggesting future research directions in the syntactic classification and formal expression of causative components.

Abstract

The article explores the Roman concept of civitas, which defined their society as a civil collective bound by shared rights, duties, politics, religion, and ideology. Cicero described civitas as encompassing common laws, justice, and social ties. Unlike Greek polis, Roman citizenship was managed by high magistrates like the censor, emphasizing a hierarchical structure. Roman voting operated on a "one centuria - one vote" principle, differing from the Greek model, and Romans extended more rights to outsiders. Land ownership linked citizenship, with communal land (ager publicus) available for rent. The city boundary (pomerium) had religious importance, protecting civic life. The Romans valued freedom (libertas) and upheld collective values like dignity, courage, and piety. Ancestral customs (mores maiorum) and historical memory were central, maintained through ceremonies and funerary traditions. Debate exists on whether the Roman civitas was a state, with differing views across German, Anglo-American, and Southern European historians. Scholars also disagree on how long the civitas remained a polis-like entity, with opinions ranging from its decline in the 1st century BC to its influence in the Mediterranean empire.

It explores the dynamics of spiritual culture, highlighting the interconnectedness of historical stages and the processes of inheritance that shape cultural evolution. The discussion draws on insights from prominent philosophers such as Hegel, Plekhanov, and others, emphasizing the dialectical nature of cultural inheritance and the complex relationships between past and present. The article delves into various cultural phenomena, including the Baroque period, folklore, and mythological traditions, illustrating how these elements contribute to the ongoing dialogue between historical legacy and contemporary identity. By analyzing the mechanisms of cultural assimilation and the transformation of ideas over time, the article underscores the significance of understanding cultural heritage as a continuous, evolving process that informs present and future societal values.

Abstract

The pandemic became the defining event of early 2020, impacting culture as well as all other areas of life. It emerged as the main architect, artist, director of silence, and dramatist of emptiness. It brought different cities around the world closer together and made them similar with empty streets and a slower pace of life. The pandemic placed new demands on many fields of art; it was a "timeout" for both the world and culture. In some places, art adapted to open spaces, but even in this openness, creative energy remained constrained, and much of what was expressed could not be fully articulated. There were instances where the pandemic became a source of "inspiration" for some artists, prompting them to compose original music, create new works of art, or transition to the online space, finding new ways to use this platform. Covid-19, which suddenly struck the world, drastically changed the global agenda. New regulations were imposed, the usual way of life was disrupted, and the world was unprepared for many of the challenges it faced. Before scientists and researchers could develop effective methods to combat the coronavirus, humanity had already shifted to a remote format. In this paper, we will explore the impact of the pandemic on art and how this period was reflected in print media, using the example of Georgian and American magazines such as "Teatri," "Aril," "Art in America," and "ARTFORUM".

Abstract

This paper explores the philosophical, historical, and legal evolution of Uzbekistan's Prosecutor's Office, tracing its roots from ancient concepts of justice through Soviet influence to modern democratic ideals. Emphasising its dual role as a guardian of the law and a moral custodian, the study analyses the Office’s trajectory from a Soviet-era mechanism of control to an institution aligned with the democratic aspirations of an independent Uzbekistan. Through a comparative historical analysis, the research highlights significant stages of development, including the Soviet period's impact on judicial independence and subsequent post-independence reforms aimed at increasing transparency, accountability, and alignment with democratic standards. Additionally, this paper discusses the Prosecutor's Office’s responsibilities in upholding the rule of law, enforcing public welfare, and fostering social trust. The findings suggest that Uzbekistan’s prosecutorial system has evolved uniquely, reflecting both the nation’s historical legacy and its commitment to global legal principles, thus positioning itself as a robust institution of democratic governance and societal welfare.
