Abstract

Indonesia as a legal country adheres to a legal system influenced by colonial countries, namely the Netherlands which adheres to the Continental European legal system or Civil Law System. The aim of this research is to determine the influence of the common law legal system on the Indonesian legal system. This research uses legal research with a normative juridical approach. The research results show that the influence of the common law legal system on the legal system in Indonesia is much related to economic activities, including business contracts, court decision making is also affected by this legal system, such as arbitration and commercial advertising in resolving contract disputes. Meanwhile, regarding the influence of common law in business contracts in Indonesia, it can be seen from the first entry of foreign capital. The implementation of legal institutions originating from the Common Law legal system in Indonesia which adheres to the Civil Law legal system shows that there is a situation of mixed legal systems (mixed jurisdiction). With the entry of the Common Law legal system into Indonesia's economic institutions, the law requires adjustments because the law must provide legality for all changes that occur.

Abstract

The purposes of this study are to analyze and examine the rehabilitation arrangements for Notaries declared bankrupt according to Law Number 37 of 2004 concerning Bankruptcy and Suspension of Debt Payment Obligations; and the legal consequences of temporary dismissal of Notaries that exceed the time period according to Law Number 2 of 2014 Position. This research uses normative legal research with statutory and conceptual approaches and qualitative analysis as data analysis. The results of the research are first, rehabilitation applied to Notary should be able to restore his position so that this is fairly applied to all bankrupt debtors without exception. The separation between the position and Notary as a person should be considered for the reappointment for Notary by the Minister. It should be emphasized that the focus of bankruptcy is the debtor's assets, not his/her person, so that the Notary's position should be restored; second a Notary temporarily dismissed in a bankruptcy process that exceeds the 6 (six) month time limit will result in the uncertain status of the Notary position and substitute Notary also automatically ends when the temporary dismissal date ends, and the protocol must be returned to the Notary concerned. There is no regulation regarding the extension of the temporary dismissal period of a Notary due to bankruptcy proceedings which implicate the principle of business continuity that is not fulfilled and the principle of legal certainty regarding the status of the Notary position

Abstract

Research conducted to see and find out how customers behave in saving at Baitul Mal Wat Tamwil Raudhah Medan. Research conducted using descriptive qualitative methods to interpret or examine the phenomena that occur. With the subject of research in this study is a customer from BMT Raudhah himself. From the results of the research conducted, there are several conclusions that researchers can conclude including: 1) customers need a lot of consideration in taking the decision to save at this financial institution for reasons of trust, 2) In making this decision, customers have gone through several processes such as recognizing needs, looking for various information, evaluation, decisions in saving, and evaluation after saving, 3) customer decisions to save at BMT Raudhah are based on customer trust in the manager of financial institutions, namely Islamic boarding schools Ar-Raudhatul Hasanah, , 4) in addition to these factors, service to customers also makes the reason or behavior of customers to make decisions to save at BMT Raudhah.

Abstract

In the context of globalization and digital transformation, national competitiveness is crucial for sustainable economic growth. This research aims to understand the complex relationship between government innovative strategies, national competitiveness, and market equilibrium. Through a literature review approach, this research highlights the important role of innovation in improving economic competitiveness, creating added value, and unlocking growth opportunities. The impact of fiscal policies, such as taxes and subsidies, on market equilibrium is also discussed in depth. In conclusion, effective integration between efforts to improve national competitiveness and achieve sustainable market equilibrium is key to inclusive and equitable economic growth.

Abstract

Unemployment is one of the problems caused by the problems caused by the economy in Indonesia by labor imbalance which shows that the number of workers is supplied exceeds the quantity of labor demanded. High unemployment rate if this occurs, it will reflect the good and bad of the economy of a country or region. Apart from that, one of the problems that is very important for a country or country to pay attention to in this area, the problem of unemployment will have an impact on various crimes, social politics and poverty. Apart from that, inflation is also a problem that is often a topic of discussion in economic circles. Inflation can be influenced by various factors, for example high public consumption patterns. Indonesia’s economy will decline if inflation is not controlled properly. To control the rate of inflation is necessary forecast of inflation rate in Indonesia. The results can be used as information for the government to prepare government policies to reduce inflation remained relatively stable. The research method used is descriptive qualitative with secondary data sources.

Abstract

This research aims to describe the Islamic Economic Perspective on Fiscal Policy. The method in this research uses a library research method, namely research whose object of study uses library data. This research was carried out by reading, reviewing and analyzing various existing literature, in the form of journals, articles, books and the internet originating from journals, government and company documentation, and government publications. And in this research the author uses a qualitative approach using secondary data sources. The findings of this literature review study conclude that the Islamic Economic Perspective on Fiscal Policy is a policy that is expected to carry out allocation, distribution and stabilization functions in a country that has certain characteristics of value orientation, ethical and social dimensions in the income and expenditure of an Islamic country. The Islamic taxation system must ensure that only the rich and prosperous groups who have advantages bear the main burden of taxes.

Abstract

Every country has the same goal, namely achieving a high level of prosperity for its country. Nowadays, one of the important conditions for achieving prosperity is globalization, making a country's economic system develop in a more open direction, both in the economic and financial fields. Indonesia is a country with an open economic system. Whatever happens to the global economy, the impact will be felt in the national economy. An open economic system provides opportunities for its people to interact in the economic sector with other countries, whether individuals, the private sector or government, where economic activities can take the form of trade in goods and services, exchange of technology and so on. the relationship between the value of other imports made and the level of community income and national income achieved. As has been stated, imports are affected expenditure, which means that the higher the national income, the higher the imports.

Abstract

The purpose of writing this research is to determine the effect of interest rate inflation and exchange rates on the profitability of sharia banking. The method used in this research is literature, namely by collecting data by looking for sources from various sources such as books, journals, articles that are appropriate to the topic of discussion. Banks are business entities that collect funds from the public in the form of savings and distribute them to the public in the form of credit and/or other forms in order to improve the standard of living of many people, one of the ratios that can measure banking performance is the profitability ratio with indicators including Return On Assets.

Abstract

This research discusses problems related to the criminal act of premeditated murder committed by the former head of the National Police Prompam Inspector General Pol. Ferdi Sambo, S.H., S.I.K., M.H against his own aide Brigadier Nofriansyah Joshua at the National Police's official residence. In this research there are two problem formulations including; 1) What is the regulation of the crime of premeditated murder committed by Ferdi Sambo? 2) what was the perpetrator's motive for carrying out the premeditated murder? This research is a normative legal research based on statutory regulations and data obtained by the author on social media. others can be subject to imprisonment for a maximum of twenty years and even the death penalty. The high-ranking police official who was named a suspect also threatened his subordinates who were members of the police not to report the premeditated murder and gave bribes to his subordinates in return for keeping their mouths shut

Abstract

The launch of inclusive education in Indonesia with the aim of facilitating the educational needs of children with special needs (ABK) has been widely implemented throughout Indonesia, especially in big cities, but in its implementation there have been many obstacles or problems in schools, especially for teachers. This research aims to determine the problems experienced by teachers and schools in implementing inclusive education at the elementary school level in the Muara Bungo City area. The research subjects were teachers who taught at schools providing Inclusive Education. Data was obtained through an open-ended questionnaire (open questions). Research shows that there are various problems encountered by teachers related to school readiness itself, such as a lack of teacher competence in dealing with ABK students, problems related to the lack of parental concern for ABK. Solutions for implementing learning in the classroom, teachers must implement modifications to the classroom learning process.
