The Law and Economics is an interdisciplinary Publication. It seeks to promote an understanding of many complex phenomena by examining such matters from a combined law, economics, and organization perspective (or a two-way combination thereof). In this connection, we use the term organization broadly - to include scholarship drawing on political science, psychology and sociology, among other fields. It also holds the study of institutions - especially economic, legal, and political institutions - to be specifically important and greatly in need of careful analytic study.

Abstract

This research provides a legal analysis of communal rights in copyright protection within the. Indonesian legal framework, focusing on the challenges faced by indigenous and local communities in safeguarding their traditional cultural expressions and knowledge. The study reveals that Indonesia's Copyright Act No. 28 of 2014 predominantly emphasizes individual authorship, offering limited protection for communal intellectual property. Through a comparative analysis of international best practices and case studies from jurisdictions such as Australia and Canada, the research underscores the inadequacies of current laws in addressing collective ownership. Key findings indicate that the lack of legal recognition for communal rights, coupled with weak enforcement mechanisms, leaves traditional knowledge and cultural heritage vulnerable to exploitation. The research highlights the need for comprehensive legal reforms that explicitly protect communal intellectual property, enhance enforcement, and ensure community participation in the legal process. Recommendations include amending the copyright law to incorporate communal ownership provisions, developing policies that promote community engagement, and aligning Indonesia’s legal framework with international intellectual property standards. This study contributes to the broader discourse on intellectual property law by proposing actionable solutions to bridge the gap between individual rights and communal interests, ultimately aiming to protect Indonesia’s cultural heritage in a more equitable and effective manner.

Abstract

This research investigates the impact of taxation on investment and economic growth, emphasizing the intricate relationships between various tax policies and economic behavior. Through a comprehensive analysis of corporate, personal income, and capital gains taxes, the study reveals that lower corporate tax rates significantly enhance investment levels, while high personal income taxes can deter consumer spending and consequently affect business investment. Additionally, the research introduces the Human Development Index (HDI) as a complementary measure to traditional economic indicators like GDP, underscoring the importance of considering social well-being in evaluating economic growth. Using a mixed-methods approach, including quantitative data analysis and qualitative insights from stakeholder interviews, this study provides a nuanced understanding of the effectiveness of tax incentives and the perceptions surrounding them. The findings highlight the need for competitive and equitable tax structures that incentivize investment and foster economic activity. Policy implications suggest that targeted tax incentives for innovation and sustainable practices can stimulate growth in key sectors, while transparency and fairness in tax policy are essential for building trust among taxpayers.

Abstract

This research examines the impact of monetary policy on Indonesia's fintech industry, focusing on how changes in policy affect fintech growth, consumer behavior, and financial inclusion. Using a mixed-methods approach that combines quantitative data analysis with qualitative insights from industry stakeholders, the study finds a significant correlation between accommodative monetary policy characterized by lower interest rates and increased fintech lending, as well as greater consumer adoption of digital financial services. This growth notably benefits underserved populations, showcasing fintech's potential to enhance financial inclusion. However, the research also identifies challenges, such as the tendency for increased risk-taking during low-interest periods and the need for effective risk management practices. Furthermore, the study underscores the necessity for adaptive regulatory frameworks to protect consumers and maintain financial stability. Based on these findings, several policy recommendations are proposed to cultivate a supportive environment for fintech innovation while addressing the challenges associated with monetary policy changes. Overall, this research deepens the understanding of the relationship between monetary policy and the fintech sector, providing important insights for policymakers, industry stakeholders, and future research endeavors.

Abstract

This research investigates the impact of foreign income on local currency exchange rates, emphasizing the complex dynamics between various components of foreign income including remittances, foreign direct investment (FDI), and export revenues and currency behavior. Employing a mixed-methods approach, the study combines quantitative analysis using econometric models with qualitative insights derived from expert interviews and case studies across different countries. The findings reveal a significant positive correlation between foreign income inflows and local currency appreciation, particularly in developing and emerging economies. However, the study also highlights potential inflationary pressures resulting from increased foreign income, suggesting that policymakers must carefully manage these dynamics through proactive monetary policies and fiscal strategies. Furthermore, the research underscores the importance of understanding currency risk for investors, particularly in emerging markets where foreign income plays a pivotal role in shaping economic stability. Overall, this study contributes to the existing literature by elucidating the multifaceted relationship between foreign income and exchange rates, providing critical implications for policymakers and investors in a globalized economy.

Abstract

This study examines the implementation of Regional Regulation Number 19 of 2017 in Bangka Belitung Province, which mandates palm oil farmers to integrate cattle farming into plantation management. The research employs a normative-empirical legal approach, combining analysis of legal frameworks with field research. Primary data was collected through semi-structured interviews with 30 smallholder farmers and 10 local government officials between January-June 2023, focusing on implementation challenges and compliance factors. Secondary data included regional regulations, implementation reports, and official correspondence, analyzed using qualitative content analysis methods. The study reveals several implementation barriers: lack of sanctions, high initial costs, limited technical knowledge, and insufficient government support. Analysis of interview transcripts and documents, conducted through systematic coding and thematic analysis, indicates significant challenges for smallholder farmers, particularly financial constraints and inadequate incentives. The findings demonstrate that weak supervision and policy design compromise the regulation's effectiveness. The study recommends incorporating sanctions, providing financial assistance, implementing technical training programs, and enhancing monitoring mechanisms. These recommendations aim to improve compliance and align the regulation with its objectives of economic growth and environmental sustainability. This research contributes to understanding how legal frameworks can better support sustainable agricultural practices while considering farmers' socio-economic conditions
