Abstract

This research analyzes judges' considerations in adjudicating lawsuits for child māḍiyah maintenance from the perspective of progressive legal theory and Maqashid Al-Syariah, with case studies on Decision Number 4115/Pdt.G/2023/PA.Kab.Mlg. and Decision Number 229/Pdt.G/2021/PA Sak. The study results show that judges strive to achieve substantive justice by prioritizing the child's welfare. Progressive legal theory is applied by considering the social context and factual conditions. At the same time, Maqashid Al-Syariah ensures that decisions are aligned with the objectives of sharia, namely the protection of religion, life, intellect, lineage, and property. The combination of these two perspectives allows judges to make formally and substantively just decisions, and provide optimal protection for children's rights. This study highlights the importance of flexibility and adaptation in the application of law to achieve true justice in cases of child māḍiyah maintenance.

Abstract

Polygamy is a topic that always invites polemics in society, especially in the context of households. Although polygamy existed long before Islam, Islam accommodates this practice with several limitations and conditions, especially in terms of justice for wives. Problems that often arise in the practice of polygamy include abuse of rights and obligations, physical and psychological violence, and negative impacts on women and children. This study aims to understand more deeply the legal perspective of polygamy, especially according to the views of Buya Hamka and Nasr Hamid Abu Zayd. This study uses a normative juridical method with a literature study approach, utilizing primary legal materials such as the Al-Qur'an interpretation book by Hamka and Abu Zayd, as well as secondary legal materials from Islamic law literature and related laws. The analysis was carried out by describing, recording, and interpreting data to understand the differences in the views of the two figures regarding the law of polygamy. The results of the study show that there are uniqueness and differences in the thoughts of Hamka and Abu Zayd that can influence the implementation of polygamy law in Indonesia. This study provides important insights into the dynamics of polygamy law in the modern context and its contribution to legal policy in Indonesia.

Abstract

This study analyzes the juridical aspects of Minister of Religious Affairs Regulation (PMA) Number 11 of 2019, which addresses the provision of performance allowances in the Ministry of Religious Affairs (Kemenag) from the perspective of the principle of tabadul manafi. Using a normative approach with qualitative descriptive analysis, the research examines how the regulation impacts employee motivation and performance. While the PMA has clearly outlined the mechanisms for performance allowances, including assessment criteria and procedures, it has not significantly improved work ethic and performance, particularly due to the standardized performance achievement requirement. Challenges such as uneven appraisals and insufficient socialization of the regulation have led to administrative inefficiencies. The study recommends periodic evaluations and increased transparency to ensure fair and effective implementation of performance allowances.

Abstract

In creating a clothing design, it takes a long process to obtain inspiration and careful consideration accompanied by research first. However, this time-consuming process causes many people to not appreciate the process of creating a clothing design. So many people decide to imitate other people's pre-existing designs. The violation of industrial design rights discussed by this author is that an unregistered mark imitates or plagiarizes a registered mark as determined in Article 54 of Law of the Republic of Indonesia Number 31 of 2000 concerning Industrial Design. In fact, this of course violates the copyright of the work created by the designer, where he does not get the commission rights that he should get. In this research, the author used a Normative research method, in legal research there are several statutory approaches which are carried out by examining the laws and regulations that are related to the issue at hand. The results of this research show that there is imitation of t-shirt designs in the market place shop. The imitation is in the same shape, image and lines. According to MUI Fatwa NUMBER 1 MUNAS VII/MUI/5/2005, protection for t-shirt designs is preventive or preventive in nature because violations of IPR are haram and according to the law will be subject to criminal or civil sanctions.

Abstract

Tafâ'ul is a good sentence that someone hears as a good sign. Tafâ'ul is used for things that are encouraging through an attitude of kindness towards Allah. Decorative Bathing is a bathing and sprinkling ceremony carried out after the marriage ceremony. The decorative bathing procession is usually carried out by the Batubara Malay community. When showering, the bride and groom wear clothes covered with private parts, then they are doused by sprinkling water by the practitioners of the decorative bath and their respective parents and the bride and groom are sprayed with water, then they untie the coconut leaves and close by washing the feet of each bride and groom. However, in the practice of ornamental bathing in Batubara Regency, there are still questions about the purpose and law of performing tafaul in the ornamental bathing tradition. This research is a type of field research, using a sociological juridical approach because this research has a close relationship with the subject and object of study. The data sources for this research consist of primary data sources which are data sources obtained directly from the community and secondary data sources, namely data sources that are not directly obtained from original sources such as books, journals, theses, and so on. The data collection method uses informant techniques, data obtained uses observation, interview and documentation techniques. From the results of this research, it is concluded that if the decorative bathing tradition is viewed using the istinbath method of Islamic law, namely with 'urf, it is included in 'urf sahih because it has a positive value, namely, to ask for goodness and blessings from Allah SWT so that the bride and groom will last forever, have good fortune, be healthy and many descendants.

Abstract

This study evaluates the effects of service quality, pricing, location, and promotion on decision-making regarding taking laboratory examinations in a clinical lab clinic in Solo City. Given the rapid pace of development in both technology science and healthcare needs, these factors must be understood to improve the competitiveness and performance of clinical laboratories. SEM data was collected from 100 respondents who were examined at the Solo City Clinical Laboratory using Smart PLS software. The results support the hypothesis that service quality, pricing, and promotion have a significant impact on patient trust, influencing their brand decision-making process. But on trust and judgment, that doesn't appear to be a factor. This study underscores the need for a holistic approach to patient engagement, recognizing the interrelated nature of these elements in constructing trust and decisions. Our study does offer rich perspectives that can help clinical laboratories develop best practices, especially in resource-limited settings that would Strive to provide universal access to high-quality diagnostic services. Generalization to other healthcare contexts and longitudinal studies of the relationships with patient loyalty/retention are warranted in future research.
