Abstract

This research aims to discuss the tradition of distributing inheritance among the people of Subulussalam City, especially in Penanggalan District from a maqashid sharia perspective. The type of research used is empirical research, meaning that the researcher goes directly into the community to obtain primary data through observation, interviews and documentation, and combined with secondary data such as books, the internet and other reading sources, then processed and analyzed to obtain a conclusion. The results of the research concluded that the distribution of inheritance among the people of Subulussalam City, especially in Penanggalan District, still uses customary law. In general, the people of Penanggalan District come from the Pakpak Batak ethnic group who adhere to a patrilineal family system, meaning that the male lineage takes precedence. However, in practice the distribution of inheritance does not adhere to this patrilineal system absolutely. The author found that there are two ways of dividing inheritance assets. First, sometimes assets are divided directly by parents while they are still alive in the form of a gift, to prevent disputes or quarrels between heirs in the future. Second, if the parents have died, the inheritance is divided peacefully through deliberation and consensus among the heirs. And traditions like this have become urf (custom), and they consider this tradition of distributing inheritance as quite good and considered fair. When viewed from the perspective of maqâshid syari'ah, the tradition of distributing inheritance like this fulfills the elements of benefit, especially in protecting the soul, offspring and property.

Abstract

This study examines the implementation of the Minister of Religious Affairs Regulation No. 20 of 2019, focusing on marriage registration among the Muslim community in Simpang Kanan Subdistrict, Aceh Singkil Regency. The regulation mandates a minimum age of 19 years for both brides and grooms. However, challenges persist, particularly regarding young marriages and the community's understanding of marriage registration requirements. Utilizing a qualitative approach, including observation, documentation, and interviews, this research reveals that while the regulation has been generally applied, some provisions remain inadequately implemented. Key issues include incomplete documentation by prospective couples and a lack of awareness regarding the regulation's Article 7, which leads to the rejection of marriage registration in cases of administrative errors. The study suggests that the Office of Religious Affairs should enhance its socialization efforts and collaborate more closely with local authorities to ensure the proper application of the regulation and the accuracy of population data. These findings underscore the need for continued efforts to improve the understanding and implementation of marriage regulations in the region.

Abstract

A will in Islamic law (wasiah) is a written or oral declaration made by a person (wasi) during their lifetime to regulate the distribution of their property after their death. The following are some important points about wills under Islamic law. A will in civil law, also known as a testament or probate, is a written instruction made by a person (testator) to arrange for the distribution of their property after their death. In practice, wills in Islamic law can provide individuals with the flexibility to organize a fraction of their estate according to personal wishes, albeit subject to the limitations set out by Sharia. In the context of civil law, will give individuals control over the distribution of their property after death and ensure that their wishes are respected. Wills can also help avoid inheritance disputes and provide legal certainty for heirs. The focus of this research is: First, how is the comparison of Islamic law with civil law in the regulation of wills in the State of Indonesia, second, how is the analysis of the perspective of the majority of people using the law in the application of wills? The model used in this research is qualitative, while the approach used is a literature study by analyzing the data obtained. The preliminary step in this research is to search for relevant literature data sources from various contexts by analyzing the findings and arguments from each source, as well as comparing and contrasting information to conclude. The results of this research show that there are similarities and differences between wills in Islamic law and civil law. The similarities can be seen in the validity of wills, the necessity to be written, and witnesses, and the differences can be seen in the limitations of inheritable property, cancellation and amendment of wills, the implementation of wills, disputes over wills, and the purpose of wills. The perspective of the majority of people in using the law related to the application of wills in Indonesia can be seen from the influence of culture and religion, legal rudeness and level of legal knowledge, legal practice in the field, trust and compliance, and involvement of legal professionals.

Abstract

This research examines the influence of HRM Practices, Positive Emotions, and Knowledge Management on Employee Attachment, as well as the influence of Employee Attachment on Talent Retention in the oil and gas industry in Indonesia. The unit of analysis in this research is employees in the oil and gas industry, using causal relationship models and cross-sectional data methods. The variables tested include HRM Practices, Positive Emotions, Knowledge Management, Employee Attachment, and Talent Retention, which are measured with an interval scale using a Likert scale of 1-5. Data was collected through a Google Forms questionnaire distributed via WhatsApp and Instagram to employees of PT. Donggi Senoro LNG (DSLNG), JGC Indonesia (JIND), JOB Pertamina Medco E&P Tomori Sulawesi (JOB Group), and other oil and gas companies, used a purposive sampling technique. Data collection was conducted from June 3, 2024, to July 5, 2024, resulting in 268 respondents with 230 valid responses. The research results show that HRM Practices do not positively affect Employee Attachment, indicating that the increase in HRM Practices perceived by employees has no significant influence on their level of attachment. On the other hand, Positive Emotions and Knowledge Management were found to positively affect Employee Attachment. This confirms that the higher the level of Positive Emotions and Knowledge Management possessed by employees, the higher their attachment to the company. Additionally, Employee Attachment has been proven to have a positive effect on Talent Retention, showing that the higher the employee attachment, the higher the level of talent retention in Indonesia's oil and gas companies. These findings provide important insights for companies in designing strategies to increase employee engagement and retention.

Abstract

Nowadays, early marriage often occurs in every sub-district with various causal factors, even though the age of marriage is regulated in Law Number 16 of 2019 in Article 7 which states that marriage is only permitted for men and women who have reached the age of 19 years. One of the sub-districts that practices early marriage is Ranah Batahan sub-district, West Pasaman district. The problem of the dangers of early marriage practices in Ranah Batahan sub-district, West Pasaman regency, has an impact on increasing cases of stunting in children. Early marriage is not only detrimental to children physically and mentally but is also contrary to the Child Protection Law Number 35 of 2014. This research is qualitative research using empirical juridical research methods which use two data sources, namely primary and secondary, with a different approach method. Used are field research and library research. The research results about the impact of early marriage on stunting prevention show the need for stricter law enforcement against the practice of early marriage in accordance with Article 66 of the Child Protection Law which stipulates that underage marriage is invalid. Public education is also important to increase awareness of children’s rights and encourage better social change. Protection of children suffering from stunting requires joint involvement from the state, community, family, and parents, by providing holistic legal, economic, social, and cultural protection. Thus, collaboration between stakeholders is key in ensuring optimal fulfillment of children’s basic rights
