Jurnal Keamanan Nasional is a scientific and open-access journal managed and published by Puskamnas, Universitas Bhayangkara Jakarta Raya. This journal is a peer-reviewed journal that aims and focuses to publish new work of the highest caliber across the full range of legal scholars, which includes but is not limited to works in security studies, terrorism, political killings, riots, mass riots, rebellions, security disturbances, maritime security, food security, economic security, and others. However, articles are not included in the area of security studies, national security, human security, or any dimension as long as it is in a security perspective, both traditional and non-traditional security.

Abstract

The post-9/11 rehabilitation programs have become attention in various countries. The projects for terrorism rehabilitation planning programs are systematically and structured carried out in several countries, such as Saudi Arabia, Singapore, Pakistan, Malaysia, Egypt, Iraq, and Uzbekistan. Whilst, this program is conducted through ad hoc institutions in some countries, such as in Nigeria, China, Indonesia, Bangladesh, Denmark, Germany, Britain, and Nepal. The terrorism rehabilitation program of the post-9/11 tragedy tended to be focused on terrorist groups that used Islamic symbols. This book consists of a series of case studies of different terrorist rehabilitation initiatives that have been attempted around the world. Rehabilitation programs in countries are critically analyzed to develop a good understanding of the significance of different approaches and strategies of terrorist rehabilitation in helping potential terrorists to integrate back into society. This book provides vital tools to address the challenges faced by practitioners of terrorist rehabilitation programs.

Abstract

This study is motivated by the number of crimes in Indonesia in 2015-2017 that are fluctuating. Efforts and policies to prevent and reduce crime have been carried out by state in this case the security apparatus (Polri), but the implication is that not all regions can reduce the number of crimes. Therefore this study tries to examine whether economic factors influence the number of crimes. The model used in this study is a random effect model with a period of research from 2015 to 2017. The results of the study indicate economic inequality has a positive effect significant on the number of crimes, while the variables of economic growth, poverty, and unemployment do not affect significantly to the number of crimes.

Abstract

Papuan ethnonationalism is the oldest Papuan nationalist movement that arose when outsiders began arriving in Papua with the intention to control the region, since the arrival of Protestant and Catholic missionaries, and the presence of Dutch, Japanese, and Indonesian Indies. Five roots have fostered Papuan ethnonationalism that has evolved to the present: the roots of the Melanesian race, the roots of local religions, the roots of indigenous ties, the roots of the formation of government and political elites in the Dutch East Indies era, and the roots of Feelings of being deprived/uprooted from their land economic exploitation. Papuan ethnonationalism was transformed into Papuan Nationalism which was formed by the Dutch East Indies Government was intended so that West Papua would not become part of the Republic of Indonesia and become an independent state in the process of decolonization carried out by the Dutch in West Papua. But after Indonesia succeeded in taking over West Papua, Papuan Nationalism was transformed back into Ethnonationalism, the symptoms of which have strengthened in the last two decades. This symptom of ethnonationalism strengthens the resilience of the Papua independence movement on the one hand and weakens Indonesia’s national resilience on the other. Papuan ethnonationalism is identical with theories about ethnonationalism and the characteristics of Kurdish and Tamil ethnonationalism.

Abstract

This research purpose the issue of maritime security through. One of the maritime security issues in Indonesia is the issue of waste management at sea. As a country that wants to establish itself as the world’s maritime axis, it should make waste at sea an important issue and need serious attention. Research from Ocean Conservancy reports that around 8 million tons of plastic pass into the sea every year. If the condition cannot be controlled, by 2025 about 1 ton of plastic waste will be found in every 3 tons of fish taken from the sea. This research was conducted in Pandelela Region, Banten Province from May to December 2019. This study wanted to look at the marine waste management challenge in Pandeglang District and its completion strategy. With the case study method through a qualitative research paradigm with data collection techniques, field observations, interviews, and literature review, the results were obtained while that waste management in Pandeglang Region has not been a government priority. The government is still focusing on poverty, education and health issues. To 2020 and has been included in the regional strategic plan. Challenges obtained in waste management are problems of policy orientation, economic problems, cultural issues, and resources. For this reason, hopefully, this study can be useful for many parties, including government, academia, students and the community.

Abstract

The purpose of this study is to find out what the police need in facing the challenges of policing in the social media space. The development of social media on the one hand provides benefits for human life, but social media is also used as an instrument of crime. For example, hoaxes, pornography, online prostitution, and hate speech. Therefore, the large number of users of social media and interactions on existing social media, gives birth to new problems and challenges in handling order and security. This study uses a literature review approach or research fundamentals with a focus on the keywords policing and social media.

Abstract

A large number of criticisms on the effectiveness of imprisonment, which in reality cannot decrease the level of criminality in a particular country so other alternatives are required to solve this problem. Besides, this research revealed that judges in Indonesia tend to determine the imprisonment verdict on the criminal act with a criminal charge of under 5 (five) years that classified as minor criminal. The concept of Judicial Pardon along with the Purpose of Punishment will be applied in the Draft of the Criminal Code (RKUHP) has been implemented in several countries also one of the alternative penal measures to short imprisonment and judicial corrective to the legality principle, which in the end is expected the concept can decrease the level of existing criminality.

Abstract

Good ethnic minority justice is a notion that stipulates equal treatment for all people, including ethnic minorities, regardless of their ethnic, religious, or cultural background. This paper will discuss the vital demand for the implementation of good governance in providing justice to ethnic minorities. Good governance, at least, comprises of the principle of transparency, the principle of participation, and the principle of human rights. Furthermore, this paper will focus on theoretical and philosophical analyses of the need for good ethnic minority justice. Some examples are mentioned from the situation of legal protection of ethnic minorities in Indonesia and the Netherlands. Meanwhile, philosophical discourses emphasize good ethnic minority justice which is the opposite of the dominant theory of justice. The theory of justice mostly supports the position of the majority. Good ethnic minority justice highlights the legal protection of ethnic minorities.

Abstract

Nowadays, perpetrators on terrorism are not male dominated. Research in this thesis discusses women's involvement as terrorist wives to support their husband and their terrorist groups. This research focused on the process of how wives were brought and involved in terrorism by their husband. Terrorist wives are the invisible victim of terrorism, they are involved not by their own will. Pressure, intimidation, dominance and symbolic violence in their household move toward a new kind of victimization. Using a qualitative approach in-depth interview with two terrorist wives, this research found terrorist wives experienced multiple victimizations. Another finding is also made that wives are unconscious that they are actually victims with society's unawareness showing that there is an omission by the government. Terrorist wives not only experience multiple impacts, but also they are neglected victims of counter-terrorism systems.

Abstract

The effort by Indonesia to exert their influence in the Southeast Asia region has been motivated by Indonesian leaders to develop a zone where solidarity is possible. The backdrop of post-colonial and Cold War context shaped this exertion into modest aspiration. Indonesia employs ASEAN into various dealings with regional affairs. The achievement of ASEAN has been its step-bystep arrangement which quite conforms its internal contrast of socio-cultural diferences among nation. This worked until the coming of globlisation which bring a various contest of interest, aspiration, and infuence. The proposition of employing UNCLOS in supporting and extending Indonesia’s exertion is not very prominent. However, UNCLOS, in significant part, reflects the history of “Djuanda Declaration”. UNCLOS has potential in covering the width and complexity of the reality of archipelago. The case for UNCLOS is based on revisit into institutional framework of “national security” and the rearticulation of provision of UNCLOS as important part of this framework.

Abstract

Penanggulangan kejahatan terorisme di masa kini dan masa depan tidak hanya mengandalkan upaya penegakan hukum karena eskalasi ancamannya bukan hanya mengancam keamanan dan ketertiban hukum di masyarakat. Lebih dari itu yaitu, mengancam keamanan nasional yang terdiri atas pertahanan negara, keamanan negara, keamanan masyarakat dan keamanan insani yang dapat membahayakan eksistensi kedaulatan NKRI. Tulisan ini membahas tentang pentingnya peran Indonesia sebagai negara hukum untuk melanjutkan pembangunan Sistem Keamanan Nasional Indonesia berdasarkan kerangka legal system yang terdiri atas substansi hukum, struktur hukum dan budaya hukum. Tujuannya agar di masa depan Indonesia dapat menanggulangi kejahatan terorisme secara komprehensif melalui upaya-upaya yang strategis. Penulisan ini menggunakan metode penelitian hukum normatif karena fokus kajian berangkat dari kekosongan dan/atau kekaburan norma.
