Abstract

This study aims to analyze the effectiveness of consumer protection regulations in digital transactions in Indonesia from both legal and economic perspectives. Using a qualitative descriptive method through a library research approach, the study explores relevant laws, government regulations, academic publications, and institutional reports. Data were collected through literature review and document analysis, followed by thematic and inductive interpretation to identify patterns related to legal enforcement, regulatory gaps, and market efficiency. The findings indicate that while Indonesia’s regulatory framework—comprising Law No. 8 of 1999 on Consumer Protection, Law No. 11 of 2008 on Electronic Information and Transactions, Government Regulation No. 80 of 2019 on Electronic Trade, and Law No. 27 of 2022 on Personal Data Protection—is normatively comprehensive, its implementation remains weak. The study reveals persistent issues such as overlapping institutional authority, limited enforcement capacity, low consumer literacy, and minimal compliance incentives for digital business actors. From an economic standpoint, these weaknesses contribute to high transaction costs, information asymmetry, and inefficiency in e-commerce markets. The research underscores the need for adaptive, harmonized, and incentive-based regulatory mechanisms to foster a safer and more transparent digital marketplace. It concludes that strengthening inter-agency coordination, enhancing consumer awareness, and promoting digital ethics are crucial to achieving sustainable consumer protection in Indonesia’s growing digital economy.

Abstract

This study aims to analyze the position of psychopathy as a criminogenic factor in criminal responsibility and to examine the application of criminal liability to perpetrators with psychopathic characteristics under Indonesian criminal law. The research employs a qualitative method with a normative juridical approach by analyzing statutory regulations, court decisions, and literature in criminal psychology. The study focuses on identifying psychopathic characteristics within the framework of criminal psychology and assessing their juridical implications in determining criminal responsibility. The results show that psychopathy is formed through the interaction of biological, psychological, social, and environmental factors, which contribute to an individual’s ability to plan and execute criminal acts consciously. From the perspective of Indonesian criminal law, perpetrators with psychopathic traits are considered legally accountable because they retain awareness and rational functioning despite having deviant personality structures. Consequently, psychopathy does not eliminate criminal responsibility, and judicial practice tends to impose full criminal sanctions. These findings indicate the need for a proportional and multidisciplinary approach in adjudicating psychopathic offenders, balancing legal certainty, individual accountability, and the protection of society.

Abstract

This study aims to analyze breach of contract in the fulfillment of concert services by Mecimapro from a civil law perspective, as well as the legal consequences for consumers. The method used in this study is a normative legal method with a legislative and case approach. The legal material consists of primary sources, including the Indonesian Civil Code and the Consumer Protection Law, as well as secondary sources such as law books and scientific journals. The results of the study show that the discrepancy between the promised concert services and their actual implementation can be legally categorized as a breach of contract. The legal consequences include the right of consumers to file claims for compensation, refunds, or other forms of restitution in accordance with applicable laws. Therefore, concert organizers are legally responsible for consumer losses in order to ensure legal certainty and consumer protection.

Abstract

Maladministrasi dalam pelayanan publik merupakan permasalahan struktural yang mencerminkan disfungsi hukum administrasi negara sekaligus kegagalan penerapan prinsip good governance. Penelitian ini bertujuan untuk menganalisis konsep maladministrasi dalam pelayanan publik, peran Ombudsman Republik Indonesia sebagai lembaga pengawas eksternal, hambatan yang dihadapi dalam pengawasan maladministrasi, serta upaya penguatan peran Ombudsman dalam menjamin hak warga negara atas pelayanan publik yang berkualitas dan berkeadilan. Metode penelitian yang digunakan adalah kualitatif deskriptif dengan pendekatan studi kepustakaan, melalui penelaahan terhadap peraturan perundang-undangan, buku, jurnal ilmiah, laporan resmi, dan dokumen relevan lainnya. Analisis data dilakukan secara deskriptif dengan tahapan reduksi data, penyajian data, dan penarikan kesimpulan secara induktif. Hasil penelitian menunjukkan bahwa maladministrasi tidak hanya disebabkan oleh kesalahan individual aparatur, tetapi juga dipengaruhi oleh lemahnya akuntabilitas, transparansi, serta budaya birokrasi yang belum sepenuhnya berorientasi pada pelayanan publik. Ombudsman Republik Indonesia memiliki peran strategis dalam pencegahan dan penyelesaian maladministrasi melalui mekanisme pengaduan, investigasi, dan pemberian rekomendasi, namun efektivitasnya masih dibatasi oleh lemahnya daya ikat rekomendasi, resistensi birokrasi, keterbatasan sumber daya, dan rendahnya kesadaran hukum masyarakat. Oleh karena itu, diperlukan penguatan kewenangan hukum Ombudsman, sinergi antar lembaga pengawas, transformasi digital sistem pengaduan, peningkatan kapasitas kelembagaan, serta peningkatan partisipasi publik sebagai langkah sistemik untuk mewujudkan pelayanan publik yang berlandaskan prinsip good governance.

Abstract

Tujuan penelitian ini, Untuk Mengetahui Pengelolaan Pengaduan Telah Sesuai Dengan Prinsip-Prinsip Pelayanan Publik Menurut UU Nomor 25 Tahun 2009. Kedua, Untuk Implementasi Pengelolaan Pengaduan Sebagai Upaya Peningkatan Kualitas Pelayanan Administrasi Terpadu di Kecamatan Rambipuji Kabupaten Jember. Metode penelitian yang diterapkan ialah pendekatan normatif dengan menganalisis peraturan perundang-undangan dan konsep hukum. Temuan penelitian bahwa Pengelolaan pengaduan di Kecamatan Rambipuji tidak berjalan sesuai amanat UU Nomor 25 Tahun 2009 karena belum terpenuhinya hak masyarakat untuk menyampaikan keluhan secara layak dan terjamin, dan Implementasi pengelolaan pengaduan di Kecamatan Rambipuji tidak hanya menjadi kewajiban administratif, tetapi juga strategi penting dalam membangun kepercayaan publik dan meningkatkan kualitas pelayanan. Kesimpulan dari penelitian ini bahwa Pengelolaan pengaduan tidak berjalan sesuai dengan prinsip-prinsip pelayanan publik karena belum terpenuhinya hak masyarakat untuk menyampaikan keluhan secara layak dan terjamin, dan Implementasi pengolaan pengaduan pelayanan adminitrasi di kecamatan rambipuji belum terlaksana secara optimal ditunjukkan dengan tidak tersedianya tempat atau sarana pengaduan yang khusus. Pelayanan publik  perlu membentuk partisipatif dan melibatkan masyarakat secara aktif dalam proses program pelayanan dan juga kegiatan dalam lingkup masyarakat guna menciptakan informasi pelayanan yang bagus. Penerapan prinsip-prinsip pelayanan publik ini memperlihatkan bahwa pengelolaan pengaduan di Kecamatan Rambipuji tidak berjalan sesuai amanat UU Nomor 25 Tahun 2009. Meskipun demikian, masih diperlukan upaya berkelanjutan seperti peningkatan literasi masyarakat mengenai hak pengaduan dan penyempurnaan sistem pencatatan elektronik.
