Abstract

Tujuan penelitian ini adalah untuk mengetahui formula penyelesaian yang digunakan oleh Advokat dalam upaya penyelesaian sengketa keluarga melalui jalur non litigasi, dan konstruksi maqashid syariah yang menilai peran Advokat dalam upaya rekonsiliasi perselisihan keluarga dengan cara non-litigasi. Penelitian ini merupakan penelitian hukum normatif empiris dengan menggunakan pendekatan hukum dan pendekatan kasus. Data dianalisis menggunakan teknik analisis deduktif. Temuan penelitian menunjukkan bahwa untuk mendamaikan perselisihan keluarga yang dilakukan oleh advokat, rumus yang dapat digunakan adalah negosiasi, musyawarah dan rekonsiliasi serta peran aktif para pihak yang bersengketa juga diperlukan untuk mewujudkannya secara damai dan bermartabat. Berdasarkan konstruksi maqashid syariah yang menilai peran advokat dalam upaya rekonsiliasi perselisihan keluarga, yaitu secara normatif sangat efektif karena perintah untuk berdamai dalam perkara perdata yang terkandung dalam kode etik advokat sesuai dengan maqashid syariah sebagaimana dinyatakan oleh Jasser Auda berdasarkan pendekatan teori sistemnya bahwa Perdamaian dalam perselisihan keluarga adalah daruuriyyah karena perdamaian dapat membawa manfaat bagi yang bersengketa, yaitu memberikan rasa keadilan dan damai serta menjauhkan diri dari bahaya. Bahwa dalam praktiknya peran seorang advokat untuk mendamaikan perselisihan keluarga tidak efektif karena mereka tidak memahami semangat perdamaian yang terkandung dalam kode etik advokat.

Abstract

Background. The total rejection and cancellation of ash-Shafi'i RA against Istihsan as a legal postulate, both Istihsan carried out by Imam Abu Hanifah RA and his disciples and Istihsan carried out by his followers, and Istihsan carried out by Imam Malik RA and his disciples and followers. Purpose. The study examines the rejection and cancellation of asy-Shafi'i RA against Istihsan. Method. This literature study illustrates the rejection and cancellation of asy-Shafi'i RA against Istihsan. Data was collected from various main sources in the form of books and opinions. The data were analyzed descriptive-qualitatively in the form of causal relationships, associative relationships, and comparisons. Result. The rejection and cancellation of ash-Shafi'i RA against Istihsan is the Istihsan of Imam Abu Hanifah which is narrated by his disciples according to Imam ash-Shafi'i RA has caused many legal decisions that are considered strange because they have left the meaning of the Qur'an and sunnah. As for the accusations of Hanafiah scholars regarding istihsan carried out by as-Shafi'i in a number of his ijtihad practices, none of them have been proven to be true. Which means that Imam as-Shafi'i was consistent in his rejection of Istihsan in his ijtihad.

Abstract

Pornography and pornography are social issues that have a negative impact on people's morals and morals. In the perspective of the Qur'an and Islamic law, these acts are categorized as prohibited behaviors because they are contrary to the values of holiness and ethics upheld in Islam. This research aims to examine the phenomenon of pornography and pornography that is increasingly prevalent in the perspective of the Qur'an and Islamic law. Pornography and pornography are seen as forms of deviant behavior that damage individual morals, social structures, and family orders. This research uses a qualitative method with a literature study approach that focuses on the study of Qur'anic verses, hadiths, fatwas of the Indonesian Ulema Council (MUI), and the thoughts of scholars. The findings of the study show that the Qur'an expressly prohibits all forms of actions that lead to adultery, display the aurah, and arouse orgasm, as reflected in surah al-Isra' verse 32 and al-Ahzab verse 59. In Islamic law, pornography and pornography are categorized as fahisyah (heinous acts) that are contrary to maqashid al-shariah, especially in preserving reason (hifz al-'aql) and heredity (hifz al-nasl). The MUI fatwa in 2001 also confirmed that all activities that lead to pornography and pornography are haram according to shari'i, so Islam views this phenomenon as a serious threat that must be prevented through moral, legal, and public education approaches.

Abstract

This study discusses the implications of changing Law Number 1 of 1974 to Law Number 16 of 2019 related to the age limit for marriage, reviewed from the perspective of the hadith of the Prophet Muhammad ﷺ. This change shows the state's commitment to reducing the rate of early marriage and ensuring the physical and psychological maturity of the bride-to-be. This research uses a descriptive qualitative method with a normative and sociological approach, through a study of regulations and sahih hadiths about the recommendation of marriage for youth. The results of the analysis show that both the hadith and the provisions of the law emphasize the importance of physical, mental, and financial readiness in marriage. Although the sharia does not stipulate a numerical age, the principle of "who is able should marry" in the hadith is in line with the age limit of 19 years in Law No. 16 of 2019. This research emphasizes that harmonization between religious norms and state laws is an important step in building healthy, religious, and dignified families.

Abstract

Indonesia's cultural richness, especially Javanese traditions, demands sustainable preservation. One of the traditions that is still strongly adhered to is the calculation of weton as a reference in marriage. This study aims to analyze the practice of calculating weton in Singa Gembara Village from the perspective of Islamic law, as well as identify problems and solutions that can be applied. The research method used is qualitative descriptive with a field study approach, through observation and interviews with the local Javanese community. The results of the study show that people are still very attached to the weton tradition in determining the compatibility of couples and the good day of the wedding, although the calculation methods vary. In the view of Islamic law, this practice is acceptable as 'urf as long as it is not believed to be the absolute determinant of fate or to associate with Allah. However, excessive dependence on weton can cause problems such as marriage annulment, family conflicts, and the potential erosion of faith. Therefore, it is necessary to strengthen religious education about destiny, develop Islamic-based premarital guidance, a balanced cultural approach, and counseling services. This study recommends the integration of local cultural preservation and sharia obedience as a path to a harmonious marriage and according to Islamic guidance.

Abstract

The law of inheritance divides property for Muslims through a composition that is considered equal based on sharia, such as a 2:1 division between men and women. In the social system, there is a gap between men and women. This difference does not only occur in the household but also becomes a community culture. Habits that are still influential in people's lives both in rural and urban areas. This also affects the implementation of inheritance distribution. In the midst of social change and increasing awareness of gender equality, contemporary Muslim society in Indonesia has begun to question the relevance of these provisions, especially regarding the dual role of women in the domestic and public spheres. This study examines how the people of Purworejo Regency understand and apply Islamic inheritance law, as well as how the influence of social justice values in inheritance distribution practices. Using sociological and empirical juridical approaches, it was found that societies tend to combine Sharia principles with deliberation and grant approaches to achieve contextual justice. So that the distribution of inheritance using a 2:1 section needs to find a new opportunity, this is in line with the theory of social justice in contemporary society, where social justice provides equal rights for every individual, both male and female.

Abstract

This study examines the tension between the religious legitimacy of Islamic sharia and contemporary social norms in the practice of polygamy in Indonesia. While polygamy is permitted in Islam under the fundamental condition of justice among wives, its practice frequently encounters social resistance rooted in values of gender equality and family integrity. Employing a descriptive qualitative approach, this research combines field studies and literature review methods. Data were collected through semi-structured interviews involving women in polygamous marriages, religious leaders, women’s rights activists, and members of the general public. The findings indicate that polygamy is predominantly perceived negatively by Indonesian society, largely due to prevailing social constructions, collective experiences associated with marital conflict, and biased representations in mass media. Women who become second wives often experience social stigma in the form of negative labeling and social exclusion, which adversely affects their psychological well-being and social standing. Moreover, mass media tends to reinforce narratives of injustice and conflict within polygamous households, producing a monolithic image that fails to capture the diversity of lived experiences. This study concludes that polygamy constitutes a complex and multidimensional social phenomenon that cannot be assessed solely on the basis of religious permissibility. Accordingly, a more equitable, contextual, and gender-sensitive approach is necessary for understanding and evaluating the practice of polygamy within Indonesian society.

Abstract

Indonesian marriage law ideally stipulates that marriage should be entered into by men aged 21 and women aged 19, reflecting the assumption that individuals at this stage have reached sufficient maturity to assume marital responsibilities and roles. However, in practice, marriages involving minors—many of whom are still in school—remain prevalent. Early marriage has increasingly become a normalized phenomenon within society and has even emerged as a trend among younger generations. This study employs field research with an empirical approach to examine the factors influencing early marriage and its impacts. Primary data were obtained through direct interviews with individuals who entered into early marriage, while secondary data were collected from academic articles and relevant literature, including analyses based on the burhani, irfani, and bayani methodological perspectives. The findings identify several key factors contributing to early marriage, including economic pressure, low educational attainment, family and parental influence, individual motivation, exposure to technology and social media, as well as customary and cultural norms. The study further reveals that early marriage generates significant negative impacts, particularly on adolescents and children. Married adolescents, especially those who become pregnant at a young age, face heightened health risks such as anemia, which contribute to increased maternal and infant mortality rates. Early marriage also limits access to education, restricts employment opportunities, accelerates the loss of adolescence, and ultimately contributes to higher unemployment rates. Children born from early marriages are more likely to experience low birth weight, premature birth, and increased health vulnerabilities. Based on the perspectives of the interviewed participants, early marriage is considered better avoided due to its extensive negative consequences, despite the presence of limited perceived benefits.

Abstract

The widespread phenomenon of “Marriage is Scary” on social media represents a shift in the perception of Indonesian Generation Z towards the institution of marriage. This study aims to analyze the implications of this phenomenon on the implementation of Law Number 1 of 1974 concerning Marriage. Through a socio-legal approach, the study reveals that the fear of marriage triggered by economic, psychological, and socio-cultural factors has created structural challenges for marriage law, which is built on normative assumptions about marriage as a desirable social norm. Data from the Central Statistics Agency shows a significant and sustained decline in the number of marriages from 2,110,776 (2014) to around 1,478,302 (2024), confirming the real impact of this phenomenon and signaling a change in social paradigm. The research findings reveal three main challenges: (1) the irrelevance of the Ministry of Religious Affairs' marriage guidance function, (2) disruption to the marriage registration system and population projections, and (3) regulatory gaps that do not accommodate the phenomenon of delayed and reluctant marriage. The study concludes that the Marriage Law requires a paradigmatic reorientation that is responsive to social change and recommends a holistic, integrative approach that encompasses legal, economic, and psychological aspects.

Abstract

Kinship care constitutes an important alternative form of childcare when biological parents are unable to provide adequate protection and meet their children’s needs due to factors such as divorce, poverty, or death. In the Semampir area of Surabaya, kinship care is widely practiced; however, the fulfillment of children’s rights remains suboptimal. Many children living under kinship care arrangements experience unequal access to education, healthcare services, psychological support, and adequate housing, while also facing social stigma that exacerbates both their vulnerability and the burden placed on caregivers. This study examines the protection of children’s rights within the context of kinship care through the lens of John Rawls’s theory of distributive justice. Employing an empirical socio-legal method, data were collected through in-depth interviews, participatory observation, and documentation analysis of divorce-related cases. The findings reveal that economic constraints, social discrimination, and weak legal support mechanisms contribute to the unequal distribution of resources and inadequate protection afforded to children in kinship care settings. The study concludes that the application of social justice principles is essential to strengthening child protection mechanisms and ensuring the fair and equitable fulfillment of children’s rights. Accordingly, policy interventions should actively involve the government, social institutions, and community actors to create an integrated and justice-oriented kinship care framework.
