Abstract

The problem that will be discussed in this article is about the inheritance rights of a widower according to the customary inheritance of the Batak Toba, whether the widower according to the customary inheritance law of the Batak Toba gets an inheritance from his wife's family. The type of normative legal research used in this article is supported by references or secondary data as the basic material for research related to the issues discussed, that is the rights of the inheritance of widowers in Batak Toba. The data sources used are primary data and secondary data. The data from the results of this study will be analyzed with a qualitative approach, then will be described descriptively. The conclusion obtained from this study is that a Toba Batak widower, in the customary inheritance law of the Batak Toba does not inherit from his wife's family because the wife is a family member of the husband (honest marriage), because the wife herself does not also get an inheritance fromhis parents, because in Batak Toba community, only sons (his wife's brother) get a share of the inheritance and become the heirs of the wife's parents.

Abstract

Korupsi politik memiliki kaitan dengan penyalahgunaan wewenang/kekuasaan. Tulisan ini menggunakan metode penelitian socio legal, bertujuan untuk mengkaji penegakan korupsi politik, dalam perspektif hukum dan kriminologi. Penegakan korupsi politik dalam perspektif hukum, dapat ditempuh oleh hakim dengan memaksimalkan pidana penjara serta penjatuhan pidana tambahan, berupa pembayaran ganti rugi dan pencabutan hak politik. Upaya tersebut, perlu diperkuat pula dengan pendekatan nilai, yang berkelanjutan dan integral. Dalam perspektif kriminologi, korupsi politik berkaitan dengan teori pertukaran sosial. Pejabat atau penyelenggara negara mempertukarkan nilai-nilai moral, integritas, profesionalisme, jabatan, kekuasaan, maupun pengaruh dengan uang, barang, rabat (diskon), komisi, pinjaman tanpa bunga, pengobatan gratis, perjalanan wisata, dan kemudahan fasilitas lainnya secara tidak sah. Bahkan juga mempertinggi persahabatan, kepuasan, dan meningkatkan harga diri atau status sosial dengan kekuasaan yang lebih besar atau dengan penguasa yang lebih tinggi darinya. Oleh karenanya, rumusan pasal memperdagangkan pengaruh, perlu dimasukkan dalam revisi Undang-Undang Pemberantasan Tindak Pidana Korupsi. Law Enforcement on Political Corruption Political corruption has to do with abuse of authority / power. This papers uses the socio legal research method, it aims to examine enforcement on political corruption, in a legal and criminological perspective. Enforcement of political corruption in a legal perspective, can be taken by judge by maximizing imprisonment and additional criminal imposition; by payment of compensation and revocation of political rights. These efforts need to be strengthened by a value approach, which is sustainable and integrated. In a criminology perspective, political corruption is related to social exchange theory. State officials or state administrators exchange moral values, integrity, professionalism, position, power and influence with money, goods, discounts, commissions, interest-free loans, free medical treatment, tours and other facilities in an illegal manner. It also enhances friendship, satisfaction and increases self-esteem or social status with greater power or with a higher authority. Therefore, the formulation of the article on trading influence must be included in the revision of the Law on the Eradication of Corruption Crimes.

ABSTRAK. Dengan dicabutnya UU No. 22/1999 tentang Pemerintahan Daerah, yang digantikan dengan UU No. 32/2004 tentang Pemerintahan Daerah, kemudian diganti lagi dengan UU No. 23/2014 tentang Pemerintahan Daerah, menimbulkan implikasi pada pergantian PP No. 25/2000 tentang Kewenangan Pemerintah dan Kewenangan Pemerintah Propinsi sebagai Daerah Otonom, yang digantikan oleh PP No. 38/2007 tentang Pembagian Urusan Pemerintahan antara Pemerintah, Pemerintahan Daerah Provinsi, dan Pemerintahan Daerah Kabupaten/Kota. Berkaitan dengan kewenangan pemerintahan, khusus untuk Aceh dibentuk satu peraturan pemerintah tersendiri, yaitu PP No. 3/2015 tentang Kewenangan Pemerintah yang Bersifat Nasional di Aceh. UU Pemerintahan Aceh diakomodir baik paham pembagian kewenangan maupun paham pembagian urusan. Padahal antara pembagian kewenangan dan pembagian urusan terdapat perbedaan yang mendasar. Government of Aceh Authority in Aceh Forest Management ABSTRACT. With the revocation of Law No. 22/1999 on Local Government, which was replaced by Law No. 32/2004 on Local Government, was then replaced by Law No. 23/2014 on Local Government, implications at the turn of the PP 25/2000 regarding Government Authority and Provincial Government Authority as Autonomous Region, which was replaced by Regulation No. 38/2007 on the Division of Government Affairs between the Government, Provincial Government, and the Government of Regency/City. In connection with governmental authority, especially for Aceh set up a separate government regulation, namely PP 3/2015 of the National Government Authority Characteristically in Aceh. The Law on Government of Aceh accommodated better understand the distribution of authority nor understand affairs division. Whereas the distribution of authority and distribution of affairs there is a fundamental difference.

Abstract

ABSTRACT: This research is to investigate and evaluate the implementation of special autonomy as it is regulated in the act No. 11, 2006 on the Government of Aceh. Data far this research was gathered by library resources, such as primary, second, tertiary law resources. Field study by interviewing some parties who were related this research was done in order to support secondary resources. The research findings show that the special autonomy in Aceh did not effectively implementation yet, this factor was caused by procedures of implementation (peraturan pelaksanaan) was not fulfilled by the center government. Special Autonomy Implementation in Province Aceh based on the act Number 11 of 2006

Abstract

ABSTRACT: Prior to colonization of Dutch, most of Indonesian solve legal problem by making an agreement. A court is a modern legal representation for Indonesian that is the last way taken if fail to reach an agreement. The settling of criminal case through a court is often leaving social problem. The enforcement of juvenile case is a dominant problem that can be seen. Raju case and AAL are juvenile cases causing social tension. In the context of modern law, a crime is a crime, law must be enforced. Despite the fact that most Indonesian believe that two cases are insignificant for being tried before the court that may bring negative impact on the future of the children. Abstract

This article examines the criminal aspect of using blank bilyet giro (BG) as a payment method in breach of contract cases in Indonesia. It argues that such a practice could potentially constitute fraud, necessitating its differentiation from a mere contract breach. Utilising a doctrinal approach, underpinned by both statutory and conceptual analysis, it formulates a legal rationale for constructing a criminal case predicated on a contract breach involving a blank BG. Furthermore, it deliberates on the ramifications of this issue for business law and law enforcement practices. The primary objective of this article is to furnish pragmatic guidance for legal practitioners such as lawyers and investigators, while concurrently stimulating scholarly discourse.

Abstract

Penelitian ini difokuskan pada studi jasa pelayanan pendaftaran tanah di Indonesia melalui peran Pejabat Pembuat Akta Tanah (PPAT) dalam mencapai cita-cita pelaksa-naan pendaftaran tanah demi kepentingan kesejahteraan masyarakat. Penelitian ini berangkat dari studi normatif untuk menemukan proses pendaftaran tanah, kemudian dilanjutkan dengan proses rekonstruksi untuk menawarkan nilai keadilan sosial dalam penyertifikatan tanah. Penelitian ini menemukan bahwa pendaftaran tanah yang berkea-dilan sosial sangat ditentukan oleh keberadaan para pihak terkait, salah satunya adalah PPAT dalam memberikan jasa kepada orang yang tidak mampu secara gratis dalam proses pendaftaran tanah. Orientasi keadilan sosial sangat penting disebabkan orientasi negara ini yang ingin mewujudkan kesejahteraan. Di samping itu dengan angka kemiskinan, serta harus ada proses pembelajaran bagi masyarakat untuk mengakses kebutuhannya. Social Justice Oriented Cost Services Land Certification This research is focused on policy study on land registration services in Indonesia through the role of Land Deed Official (PPAT) in achieving the ideals of implementing land registration for the benefit of community welfare. This research starts from a normative study to discover the land registration process, followed by a reconstruction process to offer social justice values in land certification. The research found that land registration that is socially just is very much determined by the existence of related parties, one of which is the PPAT in providing services to poor people for free in the land registration process. The orientation of social justice is very important due to the orientation of this country which wants to create prosperity. In addition, with the poverty rate, there must be a learning process for the community to access their needs.

Abstract

This article examines the relationship between the national economic strain and crimes in Indonesia during the COVID-19 pandemic. This research is legal-doctrinal writing with a conceptual approach and a case approach. The data collection technique was through a literature study which was analyzed descriptively-qualitatively. The research results show; First, there is a significant relationship between the economic crisis and the high crime rate during the pandemic. The condition illustrates the strain theory, where the strain that occurs in society due to the non-fulfillment of economic needs triggers some of them to commit crimes to achieve their economic goals finally. Second, the economic strain adaptation policy can solve the crimes due to economic strain. The adaptation is to implement preventive measures by strengthening coordination and supervision between institutions providing economic stability and repressive efforts through optimizing strict law enforcement against crime during the pandemic.

Abstract

Penelitian ini bertujuan untuk membandingkan perkawinan masyarakat Baduy (baik Baduy Dalam, Baduy Luar, maupun Baduy Muslim) dengan perkawinan yang diatur dalam Kompilasi Hukum Islam. Penelitian ini juga menjelaskan tentang perlunya pembentukan peraturan daerah yang berkaitan dengan prosedur perkawinan bagi masyarakat Baduy dalam rangka mendukung kelestarian hukum adat Baduy, seperti peraturan daerah yang telah ada sebelumnya (Peraturan Daerah Kabupaten Lebak No. 32 Tahun 2001 tentang Perlindungan Atas Hak Ulayat Masyarakat Baduy). Penelitian ini menggunakan metode penelitian normatif, dengan studi terhadap bahan hukum. Hasil dari penelitian ini menunjukkan bahwa terdapat banyak perbedaan antara perkawinan masyarakat Baduy dengan perkawinan yang diatur dalam Kompilasi Hukum Islam, seperti masyarakat Baduy tidak mengenal poligami, tidak mengenal perceraian, melakukan pernikahan dini, dan lain-lain. Padahal Kompilasi Hukum Islam telah mengatur poligami, perceraian, dan batas umur menikah. Karena masyarakat Baduy semakin lama-semakin banyak keturunannya, maka peraturan daerah yang mengatur perkawinan Baduy pun harus segera dibentuk sesuai dengan hukum adat Baduy dan Kompilasi Hukum Islam (bagi Baduy Muslim). The Comparison of Marriage Procedures Between Baduy and Kompilasi Hukum Islam This study aims to compare between the marriages in the Baduy community (Inner Baduy, Outer Baduy, and Muslim Baduy) and marriages arranged by the Compilation of Islamic Law. This study also examine the need for the establishment of a Regional Regulation relate to marriage procedures in the Baduy community in order to support the preservation of Baduy customary law (such as the pre-existing Regional Regulation namely Lebak District Regulation No. 32 of 2001 concerning Protection of the Customary Rights of the Baduy). This study uses normative methods. The results indicate that there are many differences between Baduy marriages and marriages arranged in the Compilation of Islamic Law such as Baduy people never do a polygamy, divorce, early marriage, and others. Though Compilation of Islamic Law has regulated polygamy, divorce, and the age limit for marriage. In addition, because the Baduy community is getting more and more offspring, as aresult it needs the Regional Regulation governing Baduy marriages in accordance with the Baduy Customary Law and Compilation of Islamic Law (for Muslim Baduy).

Abstract

Wakaf, an obligatory religious donation for certain Muslim, has usefully flexible values and been a significant thing that can improve for prosperity, especially in Semarang. This research explores the donation that is done by BMH Semarang, constraints and step to optimize the management of it for prosperity. Semarang territory is too wide to be used by the BMH Semarang to manage the donation in order to increase the wealth of people in Semarang. However, the BMH of Semarang has not been able to optimize its management. The constraints faced are lack of Human Resources and competence, society culture that is illiterate on the matter, lack of publication and the support of the local government. Steps taken to optimize are to increase the human sources to be more professional and understanding, people understanding, the reference on the issue for the business sectors, the acceptance of the donation and coordinate with the government. The Optimalization of Wakaf Money for Public Prosperity
