Abstract

ABSTRAK. Tuntutan terhadap pelayanan perizinan usaha yang baik, cepat, mudah dan murah merupakan kebutuhan penting bagi dunia usaha. Dalam memberikan pelayanan kepada pelaku usaha maka diperlukan upaya dari pemerintah untuk menerapan pelayanan yang baik dengan menerapkan prinsip-prinsip transparan, partisipatif dan akuntabel, sehingga masyarakat sebagai kelompok yang dilayani akan mendapatkan pelayanan yang baik. Kabupaten Aceh Besar melalui Kantor Pelayanan Terpadu Satu Pintu Kabupaten Aceh Besar dan Kabupaten Aceh Barat Daya melalui Kantor Pelayanan Perizinan Terpadu Kabupaten Aceh Barat Daya telah melakukan inovasi dalam pelayanan perizinan usaha. Inovasi penting yang dilakukan Kantor Pelayanan Terpadu Satu Pintu Kabupaten Aceh Besar adalah membuka kantor pelayanan perizinan di Lambaro untuk memudahkan masyarakat menjangkaunya, sementara inovasi penting yang dilakukan oleh Kantor Pelayanan Perizinan Terpadu Kabupaten Aceh Barat Daya adalah membuka loket perizinan di beberapa kecamatan di Kabupaten Aceh Barat Daya. Inovasi pelayanan yang diberikan oleh institusi penyelenggara perizinan sangat membantu para pelaku usaha dalam memperoleh perizinan untuk melakukan usaha di kabupaten tersebut. One Top Service Innovation of Business Licence in Aceh Besar and Aceh Barat Daya Districts  ABSTRACT. Demand on good, quick, easy and cheap business licence service in the important need for the business. In providing the service for the businessmen hence it is required the efforts from the government to apply good service by implementing the principles of transparant, participating and accountable hence the people as the group serviced will accept good service. Aceh Besar and Aceh Barat Daya Districts through the On Stop Service Offices have innovated in providing the services. Important innovations done by the office in Aceh Besar District in the opening of the office in Aceh Besar District of the Lambaro to ease the service for the people, while the office in Aceh Barat Daya is the opening the locket of licence in several subdistricts. The one stop service innovations provided by the institutions holding the licence is really helpful the businessmen in obtain the licence to conduct the business in the districts.

Abstract

ABSTRACT: The purpose of this paper examines Islam and human mental health, health is one of the maqhasid syariah, and health in the study of Islamic law. The method used is the approach to library research with content analysis of the various references relevant to the subject matter covered. The results indicate discussion of Islam and the health of the human spirit can not be separated, because the most able to help people when you get a load and disasters are Allah SWT then ask Allah SWT to be given the power to deal with any heavy trials. Maintaining healthy (mind) is one of the maqhasid syari'ah. Islamic law applies flexible in addressing the technological advancement of health. Nevertheless, there remain limitations and restrictions, such as blood transfusion is permissible based on the loose in an emergency. Likewise, transplantation of animal organs in human organs, in a state of emergency can be done with the record organs that organ must necessarily have a part in the excreta (najis), as well as the organ in the human body. While human cloning is forbidden in Islam because the Al-Qur'an surat At-Tin: 4, states, which means: “Sesungguhnya Kami telah menciptakan manusia dalam bentuk yang sebaik-baiknya”. Abstract

ABSTRACT: In accordance to the Law Number 25, 2004 on National Development Planning System, regional development is one of the subsystems of such National System. Therefore, regional development must be able to accommodate two important needs, namely superior government and local community needs. In order to get legal certainty in fulfilling the important needs, it is significant to know a juridical basis that can be used as legal protection in deciding regional development planning system, which is conducive to demand aspiration of community and certain laws. It is found that the basis of regional/municipal developments in Aceh province is in accordance to the Law Number 11, 2006 on Aceh Government in relation to the Law Number 25, 2004 on National Development Planning System which has given autority to regional/municipal governments in order to design their regional development planning system by Qanun. Abstract

The objectives of this research are to examine how Article 70 paragraph (1) of Aceh Qanun Number 8, 2012 stipulates the formation of the Wali Nanggroe Election Commission through a process of deliberation and consensus, following democratic principles. and to analyze the characteristics of an ideal Wali Nanggroe Aceh election system, as it pertains to the Regional Head Election Regime. The research methodology employed in this study is normative legal research, utilizing a qualitative approach. The provision stated in Article 96 paragraph (4) of the aforementioned law serves as a safeguard for the distinctiveness and prerogatives of Aceh, as well as the electoral process for the position of Wali Nanggroe Aceh, which aligns with the principles outlined in Article 18B paragraph (1) of the 1945 Constitution. The findings are the selection process for the period of office of Wali Nanggroe should adhere to a pattern of specificity and privilege, while still respecting the principles underlying the establishment of the Wali Nanggroe position, even within the framework of the regional head regime. The regionalization of Wali Nanggroe's tenure should be implemented alongside respected leaders of society in Aceh, to provide a comprehensive and systematic accommodation of all segments of the Acehnese society.

Abstract

Tujuan penelitian ini adalah menganalisis asas lex spesialis terkait dengan keharmonis-an Undang-Undang Perseroan Terbatas dalam Pendirian Perseroan Daerah. Perusahaan perseroan daerah merupakan salah satu badan usaha dari sejumlah badan usaha yang dikenal dalam sistem hukum di Indonesia. Ciri khas hukum perusahaan di Indonesia, masing-masing jenis perusahaan diatur dengan undang-undang yang terpisah. BUMD diatur dengan Undang-Undang Pemerintah Daerah, sedangkan perseroan terbatas diatur dengan Undang-Undang Perseroan Terbatas. Penelitian ini menggunakan metode yuri-dis normatif, dengan mendalami upaya harmonisasi hukum. Hasil penelitian menunjuk-kan bahwa perseroan daerah pada dasarnya juga perseroan terbatas yang dapat dimiliki sepenuh sahamnya oleh satu pemerintah daerah, namun dalam UUPT, tidak diakomodir sebagai perseroan terbatas dengan saham tunggal dapat didirikan oleh satu pemerintah daerah. Namun dalam praktiknya sebagian notaris berupaya melakukan terobosan yang kemudian diakui oleh pemerintah dengan memberikan status badan hukum pada perseroan yang didirikan sepenuhnya oleh satu pemerintah daerah sebagai satunya pendirinya Perseroda. Hal ini, menimbulkan pertanyaan hukum, apakah landasan hukum yang dapat digunakan oleh notaris dan pemerintah untuk menerobos UUPT untuk memenuhi kaedah yang terdapat dalam Undang-Undang Pemda. Bringing the Harmony of the Limited Liability Law in the Establishment of Regional Company The purpose of this study is to analyze the lex specialist principle related to the harmony of the Law on Limited Liability Companies in the establishment of regional companies. Regional company is one of business entities in Indonesia legal system. The characteristic of company law in Indonesia is each type of company regulated by a separate law. BUMD (regional company) is regulated by the regional government law while limited liability company is regulated by UUPT. This study uses a normative juridical method, by exploring efforts to harmonize the law. The results showed that the regional company is basically also a limited liability company that can be fully owned by regional government, but based on the company law, it is not accommodated as a limited liability company because the company has only a single share which is one local government. However, in practice some of notaries tried to make a breakthrough which was later recognized by the government by giving legal status to regional company. This raises the question of what legal basis can be used by notaries and the government to break through the company law so that it meets the methods contained in the regional government law.

Abstract

ABSTRAK: Pasal 12 ayat (2) huruf d Undang-Undang Nomor 23 Tahun 2014 tentang Pemerintahan Daerah dinyatakan bahwa, bidang pertanahan merupakan urusan wajib yang tidak berkaitan dengan pelayanan dasar. Pengertian urusan wajib dimaksudkan “adalah urusan pemerintahan yang wajib diselenggarakan di semua daerah”. Ketentuan tersebut menimbulkan ketidak pastian apabila dikaitkan dengan Pasal 33 ayat (3) Undang-Undang Dasar 1945 yang merupakan sandaran dari Undang-Undang Nomor 5 Tahun 1960 tentang Peraturan Dasar Pokok-Pokok Agraria (UUPA), secara tegas dinyatakan bidang pertanahan harus dikuasai oleh Negara demi terciptanya kemakmuran rakyat. untuk mengetahui dan menjelaskan potensi konflik kewenangan bidang pertanahan di Aceh dengan berlakunya Undang-Undang Nomor 11 Tahun 2006, dan implikasi potensi konflik Pemerintah Aceh dan Pusat dalam bidang pertanahan. Potential Conflict Between Aceh Governance and The Government of Indonesia in Land Field ABSTRACT: Article 12 (2) Point d of the Act Number 23, 2014 regarding Regional Governance states that in the field of land, it is compulsory task aimed at it is conducted by everu region. This rule causes uncertainty if it is related to Article 33 (3) of the Indonesian Constitution 1945, which a base of the Act Number 5, 1960 regarding the Main Regulation of Land, it is stipulated in the field must be controlled by the state for the people wealth. It also explores the potential conflict between the Government of Aceh and Indonesia by the implementation of the Act Number 11, 2006 and its implication.

Gerakan refomasi sebagai proses menata kembali kehidupan bernegara dan bermasyarakat yang mengacu kepada nilai-nilai demokrasi dan hak asasi manusia telah dihadapkan pada berbagai tantangan. Tantangan terberat adalah penataan kembali peran militer dalam konteks hubungan sipil dan militer yang demokratis. Terkait dengan persoalan ini, masalah redefinisi peran dan keterlibatan militer dalam konteks transisi demokrasi dapat mempengaruhi berhasil atau gagalnya proses demokratisasi itu sendiri. Militer tidak menyadari bahwa dalam masa demokratisasi ini, militer hanya pelaksana dari pemerintahan sipil. Paradigma baru militer tidak mengubah secara signifikan budaya dan posturnya dalam ruang sosial-politik, militer tetap berada dalam ruang konservatisme dengan kepercayaan pada supremasi sipil dalam pengelolaan negara. The Politics of Law Development of The Military Entitlement in Indonesia's Democracy Transition The reform movement as a process rearrangers the statehood and society that refers to the values of democracy and human rights has been faced with numerous challenges. The toughest challenge is the restructuring of the role of the military in the context of civil and military relations. Problem of related to this issue redefinition of the role and involment of the military in the context of democratic transition can influence the success of failure of the democratic process itself. Military its mot realize that in the future this democratization as norms that are exposed in the front and military is implementing from a civilian government. In other words the new military paradigm its not significantly change the posture military cultural and socio political space conservatism with confidence on civilian supremacy in the management of the state.

Abstract

This article examines the liability of land transportation providers for passengers' annoyance resulting from delays. Article 186 of the Traffic Law and Transportation Code obligated every public vehicle to transport passengers following an agreement. In reality, however, there were still businesses that were not meeting their obligations. The purpose of this study was to explain the causes of the delay and the company's liability as a result of the delay. This study employed empirical legal research methods and a sociological law perspective. The study revealed that the terminal operator's management of services was suboptimal, the drivers were unprofessional, the vehicle's engine malfunctioned, and passengers were picked up outside the terminal, but the land transportation companies that caused the delay were not responsible for their passengers and did not offer compensation. This case required the Service Unit Coordinator of the Bus Station in Banda Aceh to be resolute in following up on the Land Transportation Management Center's warnings to revoke the permits of irresponsible companies toward passengers due to their negligence.

Abstract

Penelitian ini ingin menjawab kesesuaian Qanun Aceh dengan sistem peraturan perundang-undangan, dengan mengidentifikasi kedudukan qanun dalam sistem peraturan perundang-undangan, dan kewenangan lembaga dalam hak uji materil terhadap qanun sebagai produk hukum. Penelitian ini bersifat yuridis-formil melalui kajian pustaka terhadap peraturan perundang-undangan untuk mendeskripsikan kesesuaian qanun Aceh dalam sistem peraturan perundang-undangan. Penelitian ini menemukan bahwa Qanun Aceh ada yang berkaitan dengan penyelenggaraan pemerintahan dan ada yang berkaitan dengan pelaksanaan syariat Islam kedudukannya dianggap sama dengan peraturan daerah pada umumnya dalam perspektif Undang-Undang Nomor 12 Tahun 2011 tentang Pembentukan Peraturan Perundang-Undangan. Argumentasi yuridis yang menyatakan bahwa qanun sejajar dengan peraturan daerah ini diperkuat oleh Peraturan Menteri Dalam Negeri Republik Indonesia Nomor 53 Tahun 2011 tentang Pembentukan Produk Hukum Daerah. Namun berkenaan dengan hak menguji untuk membatalkan Qanun Aceh dalam pelaksanaan syariat Islam hanya dapat diuji dan dibatalkan melalui judicial review oleh Mahkamah Agung sebagaimana diatur dalam Pasal 235 ayat (4) UU Nomor 11 Tahun 2006. Asking for Aceh Qanun Legality: Compatible With Legislation System This study aims to answer the compatibility between the Aceh Qanun and the system of legislation by identifying the position of qanun in the system and the authority of the institution in the rights to materially verify qanun as a legal product. This study uses a juridical-formal method through a literature review of the laws and regulations to describe the suitability of the Aceh qanun in the statutory system. This study found that the Aceh Qanun relating to the administration of government and relating to the implementation of Islamic law, its position is considered the same as local regulations in general in the perspective of Law No. 12/2011 on the Formation of Legislation. The juridical argument that states that the qanun is in line with this regional regulation is reinforced by the Republic of Indonesia Minister of Home Affairs Regulation No. 53/2011 on the Establishment of Regional Legal Products. However, the right to examine the cancellation of qanun in the implementation of Islamic Shari'a, it can only be examined and canceled through a judicial review by the Supreme Court as stipulated in Article 235 paragraph (4) of Law Number 11/2006.
