Managed by the Faculty of Law at Syiah Kuala University in Banda Aceh, Indonesia, KJIH has been fostering legal scholarship since its establishment in June 1991, with the ISSN: 0854 – 5499 and e-ISSN (Online): 2527 – 8428. Abstract

 Law Number 2 of 2012 states that the acquisition of land for public interests must be accompanied by adequate and fair compensation, as well as the protection and respect of human rights. However, the construction of the Tebing-Tinggi - Kuala Tanjung Toll Road in Sipare-pare and Pasar Lapan Villages, Air Putih Subdistrict, Batu Bara Regency, Indonesia, exemplifies how compensation is frequently unfair. This study seeks to determine the suitability of implementing land acquisition using current laws and regulations. The primary data is gathered through interviews with landowners and the Regional Office of the National Land Agency of the Province of North Sumatra. While secondary data are gathered via literature and legal research. The results revealed that the provided compensation did not meet the requirements of Law No. 2/2012, prompting the public to file an objection with the Kisaran District Court.

Abstract

Penelitian ini ingin menjawab bagaimanakah kekuatan yuridis akta hibah untuk anak angkat dalam kasus perkara XXX/Pdt.G/2012/MS-Aceh tentang Pembatalan Hibah. Hibah adalah pemberian yang dilakukan oleh seseorang kepada pihak lain yang dilakukan ketika masih hidup dan pelaksanaannya dilakukan pada waktu penghibah masih hidup. Hibah dalam hukum manapun pada dasarnya tidak dibatalkan, kecuali memenuhi syarat-syarat tertentu hibah dapat dibatalkan. Dengan menggunakan metode normatif yuridis, penelitian menemukan bahwa hibah untuk anak angkat secara normatif melalui akta hibah Nomor 04/V/2007 sah dan mempunyai kekuatan hukum, karena telah memenuhi syarat dalam perjanjian hibah baik secara formil maupun materiil. Putusan pembatalan hibah dalam perkara Nomor XXX/Pdt.G/2012/MS-Aceh telah sesuai dengan hukum yang berlaku. Hakim mempertimbangkan bahwa anak angkat di Indonesia sama statusnya seperti anak kandung, maka apa yang berlaku pada anak kandung berlaku juga pada anak angkat.  Legal Force of the Bequest Certificated for An Adopted Child This study wants to answer how the juridical power of certificate grants (Hibah) for adopted children in Case Number XXX/Pdt.G/2012/ MS-Aceh regarding Hibah Cancellation. Hibah is a gift made by someone to another party when a donor is still alive. Hibah in any law are basically irrevocable, unless it meet certain conditions, the hibah can be canceled. By using the juridical normative method, the study found that the Certificated of Hibah No. 04/V/2007 is valid and has legal force, because it has fulfilled the terms of the grant agreement both formally and materially. Decision on cancellation of the hibah in Case Number XXX/Pdt.G/2012/MS-Aceh is in accordance with applicable law. The judge considered that adopted children in Indonesia had the same status as biological children, so what applies to biological children also applies to adopted children.

Abstract

This research aims to explore the concept of protection on micro, small and medium based on economic justice approach of John Rawls and constitutional protection of such enterprises. It is explored through John Rawls justice and the wealth management. This is descriptive qualitative research. The research applies juridical normative. The data are then analysed through qualitatively. The protection on the businesses is not implemented well. The Act on the Small and Medium Enterprise and the Qanun No. 10, 2004 is not effective in its efforts to realize the opportunity of the enterprises. Abstract

ABSTRACT: Increased attention to the problem of efficiency and equity in the provision of medical equipment and limited people's choice to make health care reform the health sector become an important agenda in many countries. Although health policy implications into the discourse of prominent intensity in the academic literature, however, health policy implications are not commonly found in developing countries. It is difficult because of the exchange balance (trade off) between on the one hand the efficiency and equity on the other side. Decentralization became a kind of necessity, the sine qua non, in connection with the idea of democratization in the administration of state power. Abstract

ABSTRACT: The Association of South East Asian Nations was established as a political and economic entity through Bangkok Declaration in 1967. Among its seven objectives are: to accelerate growth, social progress and cultural development, to promote regional peace and stability through abiding respect for justice and the rule of law in the relationship between countries in the region and adherence to the principle to the United Nations Charter. Although the term ‘human rights’ is not explicitly used in the Declaration, by affirming adherence to the principle of the United Nations Charter, the founding members of ASEAN accepted its purposes and principles. The Association of South East Asian Human rights issues and the establishment of Association South East Asian Nations (ASEAN) human rights mechanism are still very challenging matters for ASEAN. Generally speaking, ASEAN has been making a slow progress in the field of human rights. ASEAN has long empashized that the promotion and the protection of human rights by the international community must recognize national sovereignty, national border and non-interference in another state’s affairs. ASEAN views human rights as an internal affairs. The establishment of human rights mechanism was provided for by the Charter but what kind of human rights body ASEAN would be comfortable with was a crucial question for ASEAN and its people. Abstract

This article examines whether mukim customary law communities are entitled to control customary forests, without conflicting with existing villages, while customary forests have traditionally been controlled by mukim and their customary law communities in Pidie Regency Aceh Province, Indonesia. The government has not recognized the proposed mukim forest as it potentially leads to conflict between customary institutions. This study describes such a dynamic for better understanding and finding a way to future solutions. The customary forest proposal by the Mukim has yet to receive formal government recognition. This study used socio-legal research methods. Data was obtained through observations and interviews with imuem mukim, traditional leaders in several mukims, i.e. Paloh mukim, Kunyet Mukim, and Beungga Mukim, in Pidie Regency. This article showed that the recognition of mukim customary forests in Pidie Regency has not received formal recognition from the government. Therefore, new efforts to propose the recognition of mukim as a Customary Law Community known as Masyarakat Hukum Adat/MHA) especially in Pidie Regency needs to be done by all stakeholders.

Abstract

Kajian ini bertujuan untuk mendeskripsikan penegakan hukum terhadap pembajakan karya cipta melalui pendekatan indikator penegakan hukum dalam perspektif teori fungsionalisme struktural. Metode yang digunakan dalam kajian ini adalah yuridis empiris, yaitu mendeskripsikan fenomena (penegakan hukum terhadap pembajakan karya cipta) dalam perspektif fungsional struktural. Sedangkan analisis data yang digunakan adalah kualitatif. Data yang telah diperoleh dianalisis melalui penalaran berdasarkan logika untuk dapat menarik kesimpulan yang logis. Hasil kajian menunjuk-kan bahwa penegakan hukum terhadap pembajakan karya cipta melalui rezim hukum hak cipta tidak efektif, karena itu perlu pendekatan sistematis berdasarkan teori fungsionalisme struktural, yaitu adaptation (harus menyesuaikan dengan lingkungan  hukum hak cipta itu berlaku), goal attainment (memenuhi tujuannya yaitu kepastian hukum, keadilan, dan kemanfaatan), integration (satu kesatuan yang mencakup hukum-nya [Undang-Undang Hak Cipta], penegak hukum, fasilitas  pendukung, masyarakat dan budaya [hukum]), latency (melengkapi, memelihara, dan memperbaiki, motivasi individu maupun pola-pola kultural yang menopang motivasi untuk mentaati Undang-Undang Hak cipta). Law Enforcement on The Study of Copyright Works In Perspective Theory of Structural Functionalism This study aims to describe law enforcement against copyright piracy through an Indicator of Law Enforcement approach in the Perspective of Structural Functionalism Theory.The approach method used in this study is empirical juridical, which is to describe the phenomenon (law enforcement against copyright piracy) in a functional structural perspective. While the data analysis used is qualitative, ie the data that has been obtained is analyzed through logic based reasoning to be able to draw logical conclusions.The results of the study show that law enforcement against copyright piracy through an ineffective copyright law regime therefore requires a systematic approach based on structural functionalism theory, namely: Adaptation, must adapt to the applicable copyright law environment. Goal attainment, fulfilling its objectives, namely legal certainty, justice and expediency. Integration, is a unit that includes: the law (copyright law), law enforcement, supporting facilities, society and culture (law). Latency, equipping, maintaining, and improving, individual motivation and cultural patterns that support motivation to comply with the copyright law.

Abstract

ABSTRACT: The contentious issue dealt with economic sovereignty for host states after decolonisa-tion process is foreign investment protection from expropriation by newly independent states. Hull formula has been widely used as an international law standard for compen-sation of expropriation. However, this standard has perceived as an unfair treatment from the former coloniser to its former colony. Even there has been an assumption that the existence of this standard is merely to protect and to maintain the economic dominance of developed states and their multinational companies in the Third World. This issue will be viewed through critical legal studies methodology, to assess the extent to which the ‘hull formula’ standard compatible to current need of postcolonial states. It would contribute to conceptual understanding and to attempt to reformulate the international standard of expropriation based on justice and fairness in postcolonial context. Hull Formula dan Standar Kompensasi dari Expropiasi di Negara-Negara Poskolonial ABSTRAK: Setelah progam dekolonisasi negara-negara jajahan, salah satu isu yang mencuat dalam hukum internasional adalah perlindungan investasi asing dari nasionalisasi  negera negara baru merdeka. Dalam hal ini hull formula yang mulanya didesain oleh negara Amerika terhadap Mexico, digunakan sebagai standar kompensasi dari nasionalisasi. Dari perspektif negara negara poskolonial standar ini dianggap tidak adil, bahkan standar ini digunakan hanya untuk memperkuat dominasi negara negara penjajah di bekas jajahannya. Dengan menggunakan metodologi kajian hukum kritis, tulisan ini ingin mengkaji sejauhmana relevansi hull formula untuk diterapkan dalam konteks negara-negara poskolonial. Tulisan ini diharapkan dapat berkontribusi untuk pemahaman konsep tentang standar kompensasi terhadap nasionalisasi di negara negara poskolonial, dan dapat membuka wacana merumuskan kembali standar secara lebih fair dan adil dari perspektif  negara postkolonial.

Abstract

ABSTRACT: This article is aimed to explore the rules relating to the limit of maximum land wide owning in terms of balancing land owning fairly. In regard with such purpose, the study on rules and experts perspective is conducted. The findings are that although there are rules regulate the limit of the land owning for agriculture, the rules are providing the chance for imbalance owning that has been put under personal title right and for the corporation with exploration rights. The rule on the limit for buildings is limited to title right for home, and it is based on the minister decree. The rules are tend to imbalance the owning of the land and difficult to fulfill fair ownership. Thus, it is required for the rule regulating the maximum limit of the land either for agriculture or building by looking at the availability and need of it for several necessary.  Maximum Wide Limit of Owning Land
