Abstract

This study aims to analyze and find the ideal legal design of the relationship of authority between the central and regional governments in order to strengthen synergy in public services. In essence, the granting of autonomy to the regions is directed at accelerating the realization of public welfare, through the implementation of government affairs. Concurrent government affairs as stipulated in Law no. 23/2014, is a governmental affair that is divided between the central government, provincial government and district/city governments. In practice, when problems occur in the implementation of concurrent affairs which fall under the central authority, the regional government is in a powerless position. This research uses normative legal research methods with statutory, case, and conceptual approaches. The results of this study indicate that: the absence of a legal instrument that accommodates and bridges central and regional authorities causes problems that occur in the community to continue and do not immediately find solutions. It is necessary to have legal instruments in the form of government regula-tions in bridging the authority of the central and regional governments to build synergy in public services, especially to resolve conflicts that occur in society so that government administration can run effectively.

Abstract

Ketimpangan antara angkatan kerja dan lapangan pekerjaan di Indonesia memaksa para pencari pekerjaan merambah lapangan pekerjaan di negara lain, namun Tenaga Kerja Indonesia di luar negeri mayoritas merupakan pekerja pada sektor-sektor dengan risiko tinggi. Negara seharusnya memberikan perlindungan secara menyeluruh kepada tenaga kerja di luar negeri mulai dari fase sebelum bekerja, selama bekerja, dan fase purna bekerja. Permasalahan dari perlindungan Tenaga Kerja Indonesia adalah bagaimana politik hukum Indonesia dalam perlindungan Tenaga Kerja Indonesia fase purna bekerja. Perbaikan secara menyeluruh dari instrumen politik hukum perlindungan Tenaga Kerja Indonesia diharapkan untuk mewujudkan target Pemerintah untuk Zero Tenaga Kerja Indonesia Pembantu Rumah Tangga dapat terwujud. Legal Politics Protection of Indonesian Migrant Workers in Full-Phase of Work The gap between workforces and jobs in Indonesia forces job seekers to look for job opportunities in other countries, but most of Indonesian migrant workers work on the high risk sectors. The state should provide comprehensive protection to migrant workers from the pre-work phase, during the work, and the full-work phase. The problem of the protection of Indonesian migrant workes is how Indonesian political law in the protection of migrant workers on the full-phase of work. The overall improvement on the instrument of legal political of protection of  Indonesian labor is expected to realize in order to achieve the government target for zero Indonesian migrant domestic workers.

Abstract

ABSTRAK. Lembaga adat di Aceh sebetulnya telah ada sebelum adanya UU tentang Pemerintahan Aceh. Artikel ini dikaji dengan menggunakan pendekatan yuridis normatif. Sementara analisis data akan menggunakan teknik content analysis. Dari bahasan ditemukan bahwa dukungan utama kedudukan Mahkamah Adat dalam UU tentang Pemerintahan Aceh adalah Pasal 98 ayat (1), ayat (2), dan ayat (3) yang mengatur tentang lembaga adat dengan kewenangan menyelesaikan persengketaan masyarakat. Keberadaan mahkamah kemudian dipertegas dengan Qanun  Nomor 9 Tahun 2008 yang menguraikan tentang  prosedur dan struktur perangkat mahkamah adat, tata cara persidangan di mahkamah adat, jenis-jenis kasus yang dapat diselesaikan dan jenis hukuman yang dapat diberikan. Adat Court Position After the Law on Government of Aceh  ABSTRACT. Customary institutions in Aceh actually existed before the Law on Government of Aceh. This article examined using normative juridical approach. While the data analysis will be using content analysis techniques. From the discussion it was found that the main support position the Adat Court in Law on Governing Aceh is Article 98 paragraph (1), paragraph (2), and paragraph (3), which regulates the customs agency with the authority to resolve disputes society. The existence of the court then reaffirmed by Qanun No. 9 of 2008 which elaborates on the procedure and device structures customary tribunals, court proceedings in court custom, the types of cases that can be resolved and the type of punishment that can be given

Abstract

ABSTRACT: The child protection, particularly in intercountry adoptions, should be increased considerably. It is needed a government to government intervention to impede and discontinue the illegal intercountry adoption practices. There are systemic gaps in the current intercountry adoption systems, for instance it happens in some poor countries and developing countries. This article concludes that contracting countries involving in the intercountry adoption practice should ratify the Hague Convention, and at the same time poor country should enters into a bilateral agreement with some certain developed countries, such as the USA and France, in order to protect children from abduction of, traffic in or sale of children. International Law Protection Towards the Children Adoption

Abstract

ABSTRAK: Eksistensi gampong sebagai MHA, sudah sesuai dengan Pasal 18B ayat (2) UUD 1945. Masalahnya, apa saja dan bagaimana hak-hak tradisonal masyarakat hukum adat wujud dalam tataran empirik ? Aceh sebagai daerah istimewa dan berotonomi khusus, mulai mengisi implementasi MHA dengan diberinya kewenangan kepada gampong untuk melakukan peradilan adat guna menyelesaikan sengketa/perselisihan secara adat. Hak dan kewenangan ini tegas diatur dalam UUPA, Qanun Aceh 9/2008, Qanun Aceh 10/2008, Pergub 60/2013, dan menjadi lebih operasional dengan adanya Surat Keputusan Bersama Gubernur, Kapolda Aceh, dan Majelis Adat Aceh tahun 2012. Sehingga, secara juridis formal, gampong sebagai MHA telah menjadi dasar kewenangan yang cukup legal dan kuat.  Customary Dispute Settlement in Aceh ABSTRACT: The existence of the village as MHA (customary villagers) is pursuant to Article 18B paragraph (2) 1945. The problem raised are what and how the rigths of indigenous people’s traditional form of the empirical level. Aceh’s special and special autonomy, began to fill with the implementation MHA gave the authority to the village to perform customary judicial system to resolve customary disputes. Right and authority are firmly set in the rule, Qanun Aceh Number 9, 2008, 20, 2008, 60 and the Governor Regulation Number 2013, and becomes more operational by the Joint Decree of the governor, police chief of Aceh, and the Aceh Adat Council in 2012. Thus, in formal judicial, gampong as MHA has become the basis of legal authority and strong enough.

Abstract

This paper investigates the orientation and implications of using trade secrets as collateral, by analyzing legal regulations, case studies, and applicable legal approaches. The research method employed is a legal research method with a descriptive-analytical approach. Data sources include legal documents, court decisions, and relevant scholarly literature. The data is analyzed qualitatively to identify patterns, trends, and implications of using trade secrets as collateral in business transactions. This paper indicates that utilizing trade secrets as collateral has the potential to support companies in obtaining funding and maintaining financial stability. However, this involves complexities in assessing the value of trade secrets, legal protection, information security, and trust among parties involved. Laws safeguarding intellectual property rights and trade secrets are crucial in governing and safeguarding this mechanism. The use of trade secrets also has broad impacts, encompassing legal, economic, and business aspects. In Indonesia, Law Number 30 of 2000 concerning Trade Secrets provides a legal basis for the protection of trade secrets. However, the use of trade secrets as collateral requires strong cooperation among involved parties, a deep understanding of rights and obligations, and thoughtful strategic considerations.

Abstract

Penelitian ini dilakukan untuk melihat penyelesaian wanprestasi pada jasa penitipan hewan di Banda Aceh, dan menggunakan pendekatan yuridis empiris. Hasil penelitian menunjukkan bahwa pelaku usaha dan pengguna jasa penitipan hewan tidak memenuhi atau lalai melaksanakan prestasi sebagaimana yang telah ditentukan dalam perjanjian yang dibuat, yaitu hewan yang dititipkan saat diambil dalam keadaan sakit, hilang atau mati, dan bentuk wanprestasi yang dilakukan pengguna jasa yaitu tidak mengambil kembali hewan yang sudah dititipkan. Faktor penyebab terjadinya wanprestasi ialah kesalahan dan kelalaian dari pelaku usaha dan faktor kesengajaan dari pengguna jasa yang mengakibatkan kerugian materill dan immaterial. Penyelesaian wanprestasi yang ditempuh oleh para pihak yaitu negosiasi dengan penggantian kerugian berdasarkan kesepakatan bersama. Disarankan kepada pelaku usaha agar bertanggung jawab dalam melaksanakan kewajibannya serta meningkatkan syarat-syarat penitipan hewan. Bagi pengguna jasa disarankan agar memilih jasa penitipan hewan yang memiliki fasilitas yang memadai, dan bertanggung jawab terhadap hewan yang dititipkannya. The Settlement of Default in the Pet Care Services in Banda Aceh The study aims to investigate the settlement of defaults on pet care services in Banda Aceh by using an empirical juridical approach. The results showed that business owners and users did not fulfill or neglected to carry out the agreement, namely animals that were entrusted when taken in a state of illness, lost or died, and forms of default performed by service users is they are not taking back animals that have been entrusted. Factors causing defaults are errors and negligence of business operators and intentional factors of service users resulting in material and immaterial losses. Solution of defaults taken by the parties is negotiation with compensation based on mutual agreement. It is recommended to business owners to be responsible for carrying out their obligations and to improve conditions for animal care. It is recommended for users to choose a day care service that has adequate facilities and users should responsible for their entrusted pets.

Abstract

ABSTRAK: Tanggung jawab untuk melindungi merupakan norma yang muncul dari hukum internasional yang bertujuan untuk menyediakan sarana bagi masyarakat internasional untuk mencegah kejahatan kekejaman massal yang terjadi dalam batas-batas negara yang berdaulat. Meskipun memiliki asal-usul langsung dalam upaya untuk mereklasifikasi gagasan kedaulatan, dan pergeseran itu semata-mata sebagai hak untuk termasuk tanggung jawab, sumber sebenarnya adalah Konvensi Den Haag 1899 dan Marten Clause. Ada optimisme yang luar biasa di tahun-tahun setelah adopsi oleh Komisi Internasional tentang intervensi dan kedaulatan negara pada tahun 2001 dan ketika itu diadopsi dengan suara bulat sebagai bagian dari dokumen Hasil World Summit tahun 2005. Artikel ini mencoba untuk mengeksplorasi pengembangan tanggung jawab untuk melindungi, bahasa yang bereda digunakan untuk menggambarkan tanggung jawab untuk melindungi dan implikasinya. Responsibility to Protect as A Doctrine or Emerging Norm in International Law ABSTRACT: Responsibility to protect is an emerging norm of international law that seeks to provide a means for the international community to prevent mass atrocity crimes occurring within the boundaries of a sovereign state. While it has its direct origins in attempts to reclassify the notion of sovereignty, and shift it away solely as right to include responsibilities, its real source is the Hague Convention 1899 and its Marten Clause. There was tremendous optimism in the years after its adoption by the International Commission on Intervention and State Sovereignty (ICISS) in 2001 and when it was adopted unanimously as part of the World Summit Outcome document in 2005. This article attempts to explore the development of responsibility to protect, the different language is used to describe responsibility to protect and its implications for responsibility to protect and the implementation of responsibility to protect.

Abstract

Keterbatasan jumlah dokter gigi mengharuskan pelimpahan wewenang agar pelayanan kesehatan berjalan dengan baik. Penekanan studi kepada bagaimanakah budaya hukum dokter gigi dalam pelaksanaan pelimpahan wewenang dan akibat hukumnya, dengan pendekatan penelitian metode socio-legal. Temuan penelitian tidak ada satupun dokter gigi melakukan pelimpahan wewenang kepada perawat gigi secara tertulis sesuai kewenangan dan kompetensi perawat gigi sebagai pelaksana tugas berdasarkan UU No. 38/2014 tentang Keperawatan, dan Peraturan Menteri Kesehatan No. 2052/MEN-KES/PER/X/2011 tentang Izin Praktik dan Pelaksanaan Praktik Kedokteran. Budaya hukum dokter gigi cenderung mengabaikan sehingga tidak ada pemahaman prosedur pelimpahan wewenang yang benar disebabkan pengetahuan hukum dokter gigi sangat terbatas sehingga sulit untuk menuntut kesadaran dan kepatuhan hukum. Konsekuensi yuridis bila pelaksanaan pelimpahan wewenang tersebut tidak dilaksanakan sesuai dengan Permenkes No. 2052/MENKES/PER/X/2011 penerapan sanksi administratif dapat berupa peringatan lisan, tertulis sampai dengan pencabutan Surat Izin Praktik. Legal Culture of Dental Doctors in The Authority of The Author and the Consequences of Law Limitations on the number of dentists require delegation of authority to make health services work well. The emphasis of the study on how the dental legal culture in the implementation of the delegation of authority and its legal consequences, with research approach socio-legal method. The findings of the study of none of the dentists delegated authority to dental nurses in writing in accordance with the authority and competence of dental nurses as executors of duties based on Law No. 38/2014 on Nursing, and Regulation of the Minister of Health No. 2052/MENKES/PER/X/2011 on Practice License and Implementation of Medical Practice. The dental legal culture tends to ignore so that there is no understanding of proper delegation procedures due to the limited knowledge of dental law that it is difficult to demand legal awareness and compliance. The juridical consequences when the implementation of the delegation of authority is not carried out in accordance with the Minister of Health Decree no. 2052/MENKES/PER/X/2011 the application of administrative sanctions may include oral warning, written up to the revocation of Practice License.

Abstract

ABSTRACT: A City problem is very complicated; it is caused by the needs of human being life, which increases routinely. In solving that problem, it requires the availability solution through regulation. One of the regulations needed is through the City Region Spatial Planning. The people must obey that regulation.
