Abstract

ABSTRAK: Lemahnya pengakuan terhadap hak ulayat masyarakat hukum adat menyebabkan hak ulayat berada pada posisi yang dilematis ketika berhadapan dengan hak menguasai negara. Hak menguasai negara sesungguhnya bertujuan untuk menciptakan kesejahtera-an rakyat. Namun, selama ini peraturan perundang-undangan yang menjadi penjabaran dari hak menguasai negara tersebut cenderung mengganggu atau bahkan menghilangkan hak-hak dari masyarakat hukum adat. Oleh sebab itu, agar hak ulayat tidak terganggu apalagi dihilangkan oleh hak menguasai negara maka perlu pembatasan dari hak menguasai negara yaitu memajukan kesejahteraan masyarakat hukum adat dan perlindungan kepada hak asasi manusia. Kebijakan terkait masyarakat hukum adat juga haruslah aspiratif. A State’s Right to Control and Legal Protection Towards Indigenous People’s Right to Have a Land: Theories and Its Implementation ABSTRACT: The weakness of indigenous people recognition has made indigenous people right is in dilemmatic position when facing state authority. Actually, the purpose of state authority is people prosperity. In contrast, regulations in field of state authority can disturb or even deplete indigenous people right. So that, in order indigenous people right can be looked after, there must be limit of state authority namely indigenous people prosperity and human right. The policy related to indigenous people right also must be aspirated.

ABSTRACT: Insurance is an agreement between two or more parties that the payer binds inself to the paid by receiving premi for compensating the paid because of loss, damage or miss he benefit or the law responsibility of third party that might burdened the pid because of something that is not exactly happens or to compensate due to the death or life the paid as mentioned in Article 1 verse 1 of the Act Number 2, 1992. Abstract

Law Number 23 of 2014 requires local governments to obtain a register number in the formation of the Perda (regional regulation) as part of supervision. Furthermore, Law Number 15 Year 2019 requires Regional Governments to harmonize, unify, and implement conceptions of the formation of Regional Regulations as part of coaching. In the context of regional autonomy, the constitution gives authority to the regions to regulate and manage government affairs by themselves according to the principles of autonomy and duty of assistance as well as to carry out the broadest possible autonomy. The research aims to study and explain the methods and stages used by the central government in fostering and supervising regional legal products from the perspective of autonomy and their material boundaries. The method used in this research is normative legal research method.harmonizing, rounding off and stabilizing conception. While supervision by giving register numbers, clarifications, and cancellations.The limitation of guidance and supervision material is based on the category of legal products classified as facilitation or evaluation.

Abstract

Penelitian ini ingin menjawab interpretasi dan pelaksanaan asas ketertiban umum terhadap putusan arbitrase asing di pengadilan Indonesia. Dengan berbasis pada penelitian hukum, penelitian diharapkan akan menjawab pengakuan dan pelaksanaan keputusan arbritase asing tersebut. Hasil penelitian menunjukkan bahwa pengecualian terhadap ketertiban umum ditemukan dalam Pasal V Paragraph 2 angka (b) Konvensi New York 1958 tentang Pengakuan dan Pelaksanaan Keputusan Arbitrase Asing. Konvensi menentukan bahwa pengakuan dan pelaksanaan putusan arbitrase dapat ditolak apabila kemudian ditemukan pengakuan dan pelaksanaan putusan tersebut melanggar ketentuan ketertiban umum di negara yang bersangkutan. Namun demikian, Konvensi tidak memberikan pengertian secara jelas tentang ketertiban umum, hal ini diserahkan kepada masing-masing negara peserta konvensi. Berdasarkan putusan pengadilan, konsep ketertiban umum yang diterapkan di Indonesia diinterpretasi secara luas dan domestik. The Implementation of Public Order Principle on Foreign Arbitral Awards in Indonesia This study aims to answer the interpretation and implementation of public order principle on foreign arbitral awards in Indonesian courts. Based on legal research, it is expected to answer the recognition and implementation of foreign arbitral awards. The results show that the exception to public order is found in Article V Paragraph 2 Number (b) of the 1958 New York Convention concerning the Recognition and Implementation of Foreign Arbitral Awards. The Convention stipulates that the recognition and implementation of an arbitral award can be rejected if later found that the recognition and implementation of the award violates the provisions of public order in the concerned country. However, the Convention does not provide a clear conception of public order, this is submitted to the respective countries participating in the convention. Based on a court decisions, the concept of public order applied in Indonesia was interpreted widely and domestically.

ABSTRAK. Lahirnya UU No. 11/2006 tentang Pemerintahan Aceh memberi harapan bari Aceh, khususnya terkait dengan keberadaan lembaga adat. Artikel ini ingin menjawab keberadaan salah satu lembaga yang mengoordinasi lembaga adat di Aceh. keberadaan lembaga Wali Nanggroe sebagai lembaga baru diharapkan dapat mengemban lembaga kepemimpinan adat sebagai pemersatu masyarakat dan pelestarian kehidupan adat dan budaya. Keberadaan Wali Nanggroe diatur dalam pasal 96-98. Dalam prosesnya, setelah meninggalnya Hasan Tiro, Qanun tentang Wali Nanggroe mengamanahkan Meuntroe Malik Mahmud Al Haytar ditetapkan sebagai Wali Nanggroe Ke-9. Keberadaan lembaga Wali Nanggroe harus diwujudkan karena perintah UU. Lembaga Wali Nanggroe dimaksudkan sebagai lembaga adat dan simbol pemersatu rakyat Aceh. Perintah UU sendiri juga berkaitan dengan perintah penyusunan Qanun Wali Nanggroe. Standing Wali Nanggroe After Birth the Law on Government of Aceh ABSTRACT. The existence of Wali Nanggroe arranged in chapters 96-98. In the process, after the death of Hasan Tiro, Qanun on the Wali Nanggroe mandate to Meuntroe Malik Mahmud Al Haytar set as Wali Nanggroe All 9. The existence of the Wali Nanggroe be realized because the commands of law. Wali Nanggroe institution intended as a unifying symbol of traditional institutions and the people of Aceh. Commands of law itself is also related to the preparation Qanun of Wali Nanggroe.

Abstract

ABSTRACT: Mukim is one of the unique structure in Governance of Aceh, in which it is federation from several Gampong (village) which exist since Islam Religious lesson came to Aceh region. Therefore Mukim has long path story, it resulted authority and authority of Mukim in the past has already sufficient known and obeyed by the people who stayed in the Mukim area.  Mukim has authority toward all of its territory, in the land and also in the sea. In the lagal aspect, Mukim since past until nowadays has the power basis or legal jurisdiction toward the Forrest in each Mukim area. The forrest exist in the Mukim area measured by the requirement go and back for a day, it is understood by the Mukim community as Uteun Mukim in which it is also called as rights of Kullah (Uteun Potallah). So terminology of Uteun Mukim is equivalent with Customary Forrest (hutan adat) in the Indonesia’s of national law.  In the managerial aspect, in the Forrest management affair, the roles and responsibilities in the Mukim area are led by the customary chief of Forrest (Panglima Uteun or Pawang Glee). Abstract

ABSTRACT: Each child facing with criminal laws either as violator or victim is entitled to get physical, mental, spiritual and social protection based on the principles of the Convention of the Rights of the Child and the Act of Juvenile Court namely non discrimination, the best interests of the child, right to life, the live sustainability and the development and the respect towards the child opinion. The children having problem with law has a right to get especial protection that must be provided by the government and government institutions. The Unit of Women and Children Service is the first meeting point of the Juvenile Justice System of the child. This research aims to obtain the description of the minimum service of standard applied by the Unit of Banda Aceh Resort Police Station, in dealing with the child, the constraints faced in treating them and the efforts to solve the constraints. To gather the data, the library and field research are applied. The data obtained from library and field research then combined and analysed qualitatively. Abstract

Local wisdom that regulates life to maintain the balance of natural resources and supports ecological wisdom is essential in Gayo Lues Regency, Aceh Province. This local wisdom has been implemented from generation to generation as village regulation known resam kampung. The article investigates the effectiveness of the implementation of  resam kampung in the management of natural resources, specifically for water source areas in Gayo Lues Regency, by choosing  three villages, i.e  Sangir, Agusen and Rerebe, in Gayo Lues Regency. This article utilises a qualitative descriptive analysis method through interviews and FGD (focus group discussions), and data analyzed using the scoring method to obtain an effectiveness value of legal factor indicators based on Soerdjono Soekanto's legal theory, i.e. legal factors, law enforcement factors, facilities factors, community factors and cultural factors. Resam kampung is effectively applied for natural resource management based on the value of the legal factor especially in the management of water resources area. The application of rules with local cultural values and wisdom coupled with the guidance and cooperation of agencies related to forest and natural resource supervision is important to sustain natural resource management under the reusam kampung in future.

Abstract

This research is based on the essence of the ownership rights of higher education foundations in the perspective of social justice. By looking at several facts related to ownership rights and institutions and their management. This research method is normative with a philosophical approach, laws, theories/concepts, and cases. The data used are secondary data in the form of primary and secondary legal materials. The results show that ownership rights to tertiary institutions are public/community ownership rights that are responsible for trust, not those of the founders, supervisors, administrators, and supervisors. The ownership rights of this foundation are pseudo or imperfect because it is only limited to the right to use or benefit from the existence of the higher education foundation. The ownership rights of the student community over foundations have implications for the management of foundations and universities with the foundation's obligation to provide academic services and economic assistance for underprivileged students.

Abstract

Pariwisata menjadi prioritas nasional dalam RPJM 2015 2019. Secara bertahap dari tahun ke tahun dalam periode 5 tahun RPJM 2015-2019 pembangunan pariwisata dipri-oritaskan dan diberi target pencapaiannya. Sumatera Barat juga mendukung pariwisata untuk mendukung pembangunan ekonomi. Adapun rumusan masalah dalam penelitian ini adalah: 1) bagaimana peranan investasi dalam pembangunan ekonomi di bidang pariwisata di Sumatera Barat? 2) bagaimana dukungan pemerintah terhadap pem-bangunan ekonomi di bidang pariwisata di Sumatera Barat? Penelitian hukum yang dipakai dalam penelitian ini adalah penelitian hukum normatif dengan metode pendekatan yuridis normatif. Hasil penelitian ini menjelaskan bahwa peranan investasi dalam pembangunan ekonomi di bidang pariwisata sangat penting, terutama untuk memudahkan pembangunan pariwisata di Sumatera Barat. Dukungan pemerintah terhadap pembangunan ekonomi di bidang pariwisata di Sumatera Barat ditandai dengan pembangunan infrastruktur pariwisata, pembangunan rel kereta api sebagai moda transportsai serta pemberian pinjaman dan dimudahkannya pemberian izin di dalam berinvestasi di Sumatera Barat oleh BKPM.  Role Investment in Development Policy of Tourism Economics in West Sumatera Province Tourism becomes a national priority in the 2015 2015 RPJM. Gradually from year to year within a 5-year period of RPJM 2015-2019 tourism development is prioritized and targeted for achievement. West Sumatra also supports tourism to support economic development. The formulation of the problem in this study are: 1) how the role of investment in economic development in the field of tourism in West Sumatra? 2) how is government support for economic development in tourism sector in West Sumatera? The legal research that is researched in this research is normative legal. The results of this study explain that the role of investment in economic development in the field of tourism is very important, especially to facilitate the development of tourism in West Sumatra. Government support for economic development in tourism in West Sumatra is characterized by the development of tourism infrastructure, railway development as transportsai mode as well as lending and facilitating the granting of permits in investing in West Sumatra by BKPM.
