Abstract

Law No. 6 of 2023 concerning Job Creation Law (JCL), has  little attention,  specifically on the impact of zoning to business licensing in Indonesia. This study applies a normative legal method with a comparative approach to assess zoning in Indonesia and East-Timor. Despite differences in the extent of areas, both countries have undertaken spatial planning integration. Zoning is part of spatial planning made by local governments to determine land allotment. Prior to the JCL, spatial planning was not integrated. The results show that zoning integration provides transparency which can simplify business licensing. However, locating zoning at the local level creates disparity. Public participation is vital to ensure that zoning accommodates development needs without neglecting environmental and safety considerations. Local governments must implement zoning properly by encouraging compliance, improving violation detection, and imposing administrative/ criminal sanctions.

Abstract

Dalam mengoptimalkan penerimaan pajak, pemerintah selayaknya mendesain sistem perpajakan yang berpegang prinsip efisiensi dengan tetap memperhatikan aspek keadil-an dan kesederhana. Dalam sistem perpajakan, hukum formal mempunyai peranan penting dalam mengejawantahkan hukum material, karena itu Undang-undang Ketentu-an Umum dan Tata Cara Perpajakan (KUP) menjadi salah satu kunci keberhasilan implementasi kebijakan pajak. Mengingat strategisnya peran UU KUP, perlu untuk mereview kembali UU KUP yang saat ini berlaku serta perlu dilakukan suatu penyempurnaan. Penelitian ini menggunakan pendekatan kualitatif dengan teknik pengumpulan data kualitatif yang terdiri dari studi literatur dan focus group discussion. Penelitian bertujuan memberikan masukan atas KUP yang saat ini masih dalam proses pembahasan dengan menekankan pada aspek kemudahan (ease of administration), keadilan (equity) dan kepastian hukum (law enforcement). Hasil penelitian ini menekan-kan pada hal-hal terkait (i) perlunya meningkatkan basis data perpajakan, (ii) perlunya menjalankan kemudahan administrasi yang berdasarkan ketentuan yang tegas, jelas, dan sederhana, (iii) penegakan hukum yang tegas, (iv) adanya sanksi yang sebanding dengan pelanggaran yang dilakukan oleh wajib pajak, dan (v) peningkatan kualitas layanan dan profesionalisme petugas pajak. Kajian ini diharapkan mampu mendorong terwujudnya regulasi perpajakan pro terhadap optimalisasi penerimaan tanpa mencede-rai hak-hak wajib pajak. Proposal for Amendment of Formal Law on Taxation Procedure  In optimizing tax revenue, the government should design a taxation system that adheres to the principle of efficiency, justice and simplicity. In the taxation system, formal law has an important role in manifesting laws, therefore laws and taxation procedures (KUP) are one of the keys to the successful implementation of tax policies. Considering the strategic role of the KUP Law, it is necessary to review the KUP Law which is currently in force and needs to be improved. This study uses a qualitative approach with qualitative data collection techniques consisting of literature studies and focus group discussions. The research aims to provide input on KUP which is currently still in the process of discussion by emphasizing aspects of ease (ease of administration), justice (equity) and legal certainty (law enforcement). The results emphasize issues related to (i) the need to increase the taxation database, (ii) the need to carry out administrative facilities based on firm, clear and simple provisions, (iii) strict law enforcement, (iv) comparable sanctions with violations committed by taxpayers and (v) improving the quality of service and professionalism of tax officials. This study is expected to be able to encourage the realization of tax regulations that are pro to the optimization of revenue without harming the rights of taxpayers.

Abstract

ABSTRAK: Hasil penelitian menunjukkan bahwa lokasi penelitian yang dilaksanakan semua kabupaten/kota telah membuat Berita Acara Rapat Koordinasi antara kabupaten/kota yang berbatasan. Bahkan Berita Acara Konsultasi dan Sinkronisasi juga telah dibuat antara Provinsi Aceh dan Provinsi Sumatera Utara. Hasil dari analisa dari data di lapangan dalam penelitian, bahwasanya telah ada jalan keluar antara kabupaten/kota yang berbatasan dalam lingkup wilayah Provinsi Aceh yang berkaitan dengan penataan ruang. Sehingga berita Acara Rapat koordinasi dan  koordinasi tersebut diharapkan dapat  menyelaraskan dengan serasi, seimbang akan hal pemanfaatan ruang pada masing-masing kabupatenkota yang berbatasan. The Region Spatial Planning in Border Municipalities/District in Relation to the Regional Authorities in Aceh Province ABSTRACT: The research shows that the research location conducted in all districts/municipalities has made Coordination Meeting Proceeding between border districts/municipalities. Even the consultation proceeding and sincronization has been made between the Province of Aceh and North Sumatera Province. The analysis shiws that there is a way between the district and municipalities border areas in the province relating to the spatial planning. Thus, the proceedings are expected to be suitable and balance in using the space in every district/municipalities that are bounderies.

Abstract

ABSTRAK: Pembiayaan kesehatan sejatinya digunakan untuk sebesar-besarnya memenuhi kebutuhan masyarakat. Anggaran kesehatan dapat dikatakan sebagai instrumen pemerintah dalam pemenuhan hak-hak kesehatan bagi warga negara. Undang-Undang Kesehatan mensyaratkan pembiayaan kesehatan minimal 10 % dari APBD, dan 2/3 dari dana tersebut diperuntukan untuk belanja publik, khususnya untuk rakyat miskin perempuan, dan anak terlantar. Penelitian ini menggunakan metode penulisan hukum normatif, dengan pendekatan perundang-undangan dan pendekatan konseptual. Hasil penelitian menunjukkan bahwa tidak konsistennya antara tujuan pembiayaan yang diatur Undang-Undang Kesehatan dan implementasi anggaran. Anggaran sebagian besar digunakan untuk belanja aparatur, bukan belanja publik. Belanja perjalanan dinas Dinas Kesehatan dengan jumlah yang tidak wajar. Di pihak lain, belanja modal untuk pertambahan aset mendapatkan porsi yang lebih. The Problems of Allocation and Distribution of Health Budget at The Health Office of Central Sulawesi Province ABSTRACT: Ideally, health funding is actually used to maximally fulfill the needs of the community. Health budgets can be deemed as government instruments in the fulfillment of health rights for citizens. The Health Act requires health financing of at least 10% of APBD (revenue and spending budgets), and 2/3 of the funds are allocated for public expenditures, especially for poor women, and abandoned children. This research uses normative legal writing method, with approach of legislation and conceptual approach. The research shows that the inconsistency between the financing objectives governed by the Health Act and the implementation of the budget. The budget is mostly used for personnel expenditure, not public spending. Expenditures for the institution are strange amount. On the other hand, capital expenditures for additional assets get more portions.

Abstract

ABSTRACT: The village governance in the era of special autonomy has been legally recognized. This paper is conducted to answer and explain how the preparation, materials, and development establishment in the District Panteraja in enacting rules for villagers. It combines normative and empirical legal research. The data anlysed, while the report prepared by descriptive analysis. The enactment mechanisms in Panteraja is simpler than the one set out in the Qanun Pidie Jaya No. 5 Year 2011, which is divided into the Pre-draft Qanun, the submission, determination, and the enactment phases. The material contains are generally associated with local regulations relating to the village budget. A village has begun to regulate certain material on the concept of commerce, immoral, customs disputes, mutual cooperation, keurija mate (lethal working), social levels, and so on. The developments of qanun formation are generally still very limited. Abstract

This research aims to examine the effectiveness of Panglima Laot's institution authority in the maritim area to resolve sea disputes and to find an ideal dispute resolution model to be used. This research uses qualitative method by sociological juridical approach in the form of descriptive analytical. The Panglima laot's authority in an effort to assist the government in resolving maritime disputes is a formal authority granted by a law which is attributively regulated in Article 28 of Qanun Aceh Number 10 of 2008 concerning Customary Institutions. However, when dealing with certain cases between fishermen where the regulation is not very clear in the Qanun, Panglima Laot seeks to resolve cases by using traditional approaches, religious values, propriety, a sense of justice and human conscience. Therefore, Panglima Laot needs detailed and written instructions for carrying out tasks in the form of Government Regulations or Qanuns. Including dealing with refugees who come from abroad.

Abstract

Penelitian ini bertujuan untuk menjelaskan perlindungan hukum internasional terhadap negara yang disadap secara melawan hukum oleh negara lain dan menjelaskan metode penyelesaian sengketa yang dilakukan Indonesia dalam  menyelesaikan konflik antar negara akibat penyadapan yang dilakukan Australia terhadap Indonesia Tahun 2013. Penelitian ini menggunakan jenis metode penelitian hukum yuridis normatif. Hasil penelitian menunjukkan bahwa hukum internasional belum memberikan perlindungan yang cukup kepada negara yang disadap oleh negara lain. Adapun metode penyelesaian sengketa yang digunakan Indonesia dalam menyelesaikan kasus penyadapan dengan Australia adalah penyelesaian sengketa internasional secara damai melalui cara negosiasi. Oleh karena itu, peraturan mengenai penyadapan lintas negara harus segera dibentuk, sehingga perlindungan hukum terhadap negara yang disadap bisa dilakukan. Serta kedua negara harus membentuk code of conduct. Inter-State Conflict Under International Law International relation between two countries at some time could evoke problems which are caused by the cheating action of one party, such as interception resulting in conflict between them. This study aims to explain the protection of international law against countries that are illegally intercepted by other countries and explain the method of dispute settlement conducted by Indonesia in resolving inter-state conflicts resulting from Australian interception to Indonesia in 2013. This study uses a normative-juridical legal research method, by using legislation, case study , and conceptual approach with library data sources. The result shows that international law has not provided sufficient protection to countries intercepted or tapped by other countries. The method of dispute resolution used by Indonesia in solving wiretapping case with Australia is the peaceful settlement of international disputes through negotiation. Therefore, regulations concerning cross-country intercepting must be established immediately, thus legal protection of the tapped countries could be proceeded, and the two countries must establish a code of conduct.

Abstract

This article aims is to explain the basic authority of the enactment of Qanun (local law) Aceh No. 3, 2013 regarding the Flag and Symbol of Aceh. Furthermore, it examines whether the law infringes higher laws and public interest. In addition, it explores the validity of the law and its legal mechanism which is available regarding the cancellation of the law. This   is  normatif legal research. The data is obtained through library research. The approach research used is statute approach. The findings show that, the law infringes Government Regulation No. 77, 2007 regarding the Symbof of Region and public interest. Nevertheless, the existence of the law is legally valid because the Government has exceeded the time period of 60 days since it received the law, and has not issued the President Regulation regarding the cancellation of it. It means that if the Government has not issued it, it is legally that the law is valid as mandated in Article 145 paragraph, sub article (7) of the Act No. 32,  2004 regarding on the Local Government . The Legal Aspect of The Enacment Qanun Number 3, 2013 Regarding The Flag and Emblem of Aceh

Abstract

ABSTRACT: Penananaman modal mempunyai arti penting dalam pembangunan ekonomi suatu bangsa. Penanaman modal yang mudah dan murah merupakan idaman dan kebutuhan yang diidamkan oleh penanam modal. Dalam perjalanannya, penyelenggara penanaman modal di Indonesia dapat dilihat dan dibedakan pada sentralisasi penyelenggara penanaman modal dan desentralisasi penanaman modal. Sesuai dengan semangat reformasi, yaitu kehadiran otonomi daerah, dimana pemerintah daerah diberikan kewajiban dan kewenangan untuk mengatur dan mengurus urusan masyarakat dan pembangunan di wilayahnya. Undang-Undang Nomor 25 Tahun 2007 tentang Penanaman Modal yang lahir pada era reformasi, seyogyanya memuat materi yang sesuai dengan semangat reformasi. Abstract

ABSTRACT: This research aims to (1) the process of negotiation as an important process in the alteration of domestic law in terms of determining whether the international conventions should be adopted or not by the government (2) after the ratification, it requires the harmonisation and sincronization institutionally hence it is admitted as the domestic law based on the constitution 1945. (3) all the process heading to the ratification of the convention reflects national politic in increasing international relatinship. Based on those considerations the process must be planned seriously, consistently and continuously by the related institutions under the ministry of foreign affair, and should be consultated with the House of Representative of the Republic of Indonesia.
