anun: Jurnal Ilmu Hukum (KJIH), the Indonesian Journal of Autonomy Law, is an international journal dedicated to the study of autonomy law within the framework of national and international legal systems. Published thrice annually (April, August, December), KJIH provides valuable insights for scholars, policy analysts, policymakers, and practitioners. Managed by the Faculty of Law at Syiah Kuala University in Banda Aceh, Indonesia, KJIH has been fostering legal scholarship since its establishment in June 1991, with the ISSN: 0854 – 5499 and e-ISSN (Online): 2527 – 8428. In 2020, it received national accreditation (SINTA 2) from the Ministry of Research and Technology of the Republic of Indonesia and the National Research and Innovation Agency. KJIH is actively pursuing indexing in prestigious databases like Scopus, Web of Science and other global indexes. We publish in English for accessibility, not as a political statement. The Editorial Board shall not be responsible for views expressed in every article.

This article examines the policies aimed at protecting peat ecosystems in Indonesia and identifies gaps or challenges in controlling forest and land fires (karhutla), particularly concerning the preservation of the Hydrological Unity Policy in Riau Province, Indonesia. The peat ecosystem is a cohesive entity that encompasses various elements, influencing each other to maintain balance, stability, and productivity. The Hydrological Unity of Peat (KHG) refers to the peat ecosystem situated between rivers, between rivers and seas, and/or within swamps. The Peat Ecosystem serves multiple functions, including safeguarding water availability, conserving biodiversity, storing carbon as oxygen producers, and contributing to climate regulation. These functions are categorized into protected and cultivation functions. However, rapid development has exerted significant pressure on preserving the KHG. This study emphasizes the need for comprehensive support from all sectors of society and active community participation to effectively reduce the risk of forest and land fires.

Maraknya kejahatan seksual terhadap anak, menimbulkan persepsi bahwa kebijakan hukuman penal yang ada saat ini, dipandang tidak mampu meminimalisir kejahatan seksual terhadap anak. Tulisan ini mempertanyakan bagaimana kebijakan kriminal sanksi tindakan kebiri terhadap pelaku kejahatan seksual terhadap anak yang diatur dalam PERPU No. 1 Tahun 2016 saat ini dan masa mendatang? Tulisan ini merupakan penelitian yuridis normatif yang mengkonsepkan hukum sebagai ius constitutum, ius constituendum dan hukum in concreto. Hasil penelitian menyimpulkan bahwa kebijakan kriminal melalui hukum pidana berupa hukuman kebiri kimia, perlu diikuti dengan Peraturan Teknis Pelaksana; (a) Pelaksanaan sanksi tindakan kebiri tidak dapat dite-rapkan untuk semua pola-pola kejahatan seksual, tetapi bersifat kasuiistis; (b) Diperlu-kan dukungan sarana prasarana sumberdaya manusia untuk teknis pelaksanaanya; (c) Diperlukan dukungan anggaran biaya yang secara tegas dimuat dalam DIPA untuk menjalankan eksekusi kebiri; (d) Diperlukan kajian akademik yang mendukung revisi atau perubahan atas Undang-Undang No. 17 Tahun 2016 tentang Penetapan Peraturan Pemerintah Pengganti Undang-Undang No. 1 Tahun 2016 tentang Perubahan Kedua atas Undang-Undang No. 23 Tahun 2002 tentang Perlindungan Anak menjadi UU. Castration Punishment for Child Sexual Abuser The increasing number of child sexual abuse considered as an impact of penal punishment incapability. The aim of this research is to examine the enforcement of PERPU No.1/ 2016 specifically about crastation punismneht for child sexual abuser, currently and its future development. This is a juridical normative research by ceoncepting law as ius constitutum, ius constituendum and law in concreto. The research conclude that criminal law in the form of chemical castration punishment, needs to be followed by Implementing Technical Regulations; (a) The implementation of the castration sanction cannot be applied to all kind of sexual abuse, but it is casuiistic in nature; (b) Infrastructure and human resources is needed for the technical implementation; (c) The inportance of financial support that’s explicitly mentioned in DIPA to enforce the castration execution; (d) Lastly, an academic study is also needed to support a revision for Law Number 17 of 2016 concerning the stipulation of PERPU number 1 of 2016 concerning the second amendment to law number 23 of 2002 concerning child protection, transform to be a law.

Berdasarkan ketentuan Pasal 44 ayat (1) Peraturan Menteri Keuangan No. 27/PMK.06/2016 tentang Petunjuk Pelaksanaan Lelang (PMKN 27/2016) diketahui bahwa bank kreditur menetapkan nilai limit berdasarkan penilaian penilai atau penaksiran penaksir. Pasal 45 PMKN 27/2016 menentukan, penetapan nilai limit berdasarkan penilaian oleh penilai dilakukan apabila nilai limit objek hak tanggungan paling sedikit Rp. 1.000.000.000 (satu miliar rupiah) atau apabila bank kreditur akan ikut sebagai peserta pada lelang tersebut. Terhadap nilai limit objek hak tanggungan yang nilai limitnya berada di bawah Rp. 1.000.000.000 nilai limit akan ditetapkan bank kreditur berdasarkan penaksiran penaksir. Penaksir ini merupakan pihak yang berasal dari pihak bank kreditur, yang melakukan penaksiran berdasarkan metode yang dapat dipertanggungjawabkan oleh bank kreditur, termasuk kurator untuk benda seni dan benda atik atau kuno. Penelitian menggunakan pendekatan yuridis normative bersifat eksplanatoris, yang akan dianalisis dengan pendekatan kualitatif. Perlu dilakukan evaluasi dan deregulasi terkait penetapan nilai limit yang dilakukan berdasarkan penaksiran penaksir. Determining the Limit Value by the Seller Based on the Implementation of the Minister of Finance Based on the provisions of Article 44 Paragraph (1) of Regulation of the Minister of Finance Number 27 / PMK.06 / 2016 concerning the Auction Directive (PMKN 27/2016) it is known that the creditor bank determines the limit value based on the assessor assessment or appraisal assessment. In the subsequent provision that Article 45 of PMKN 27/2016 is known that the determination of the limit value based on the assessment by the assessor is made if the limit value of the object of mortgage right is at least Rp.1.000.000.000 (one billion rupiah) or if the creditor bank will participate as a participant in the auction. Whereas to the limit value of the mortgage object whose the limit value is below Rp.1.000.000.000 (one billion rupiah) it will be determined by the creditor bank based on the appraisal of the appraiser. This estimator is a party that comes from the bank, which conducts an assessment based on methods that can be justified by the creditor bank, including the curator for art objects and ancient objects. This research used a normative juridical approach that is explanatory, which will be analyzed with qualitative approach. It is important to evaluate and deregulate the determination of the limit value based on the assessment of the estimator.

The role of Keujruen Blang in Irrigation Management for irrigating farmer's rice fields has been regulated in Aceh Qanun Number 10 of 2008 and the Governor's Regulation. Number 45 of 2015 concerning the Role of Keujruen Blang in Irrigation Management. However, the implementation of Keujruen Blang's role in irrigation management in North Aceh District has not been fully implemented as stipulated in the regulations. This study aims to realize the role of Keujruen Blang in the irrigation management of farmer’s rice fields and to scrutinize the strengthening of the role of Keujruen Blang as stipulated in the rules as a traditional institution whose job is to help farmers to obtain water for irrigating their fields. This study used empirical juridical research with a qualitative approach. The main data were collected by interviewing respondents and informants. Secondary data were obtained by reviewing current and related literature. The result shows that the role of Keujruen Blang in irrigation management to irrigate rice fields has not been implemented in accordance with the Qanun and Aceh Governor's Regulation. The obstacles in the implementation of the duties, functions, and authorities of Keujreun Blang among others are Keujreun Blang does not know and fully understand their functions, roles, and authorities yet; poor water discharge management due to limited availability of water discharge; inadequate infrastructure; lack of socialization carried out by the government about the role and function of Keujrun Blang. Therefore, in order to strengthen the role of Keujruen Blang in irrigation management needs to conduct coaching and socializing the duties, functions, and roles of Keujruen Blang in accordance with Qanun and the Governor Regulations; and involve Keujruen Blang in the irrigation management process started from the stage of policy planning, implementation, to supervision so that they can provide recommendations needed by villages regarding irrigation management to irrigate rice fields.

Tulisan ini membahas bagaimana peran kepolisian dalam menanggulangi pungutan liar, dan bagaimana optimalisasi perannya dalam menanggulangi pungutan liar terebut. Pemberantasan pungli harus dilakukan secara terpadu dengan cara moralistik (pembinaan mental dan moral manusia) dan cara abolisionistik (cara penanggulangan gejala) sebagai tindakan preventif. Penelitian ini merupakan penelitian deskriptif, dengan pendekatan yuridis normatif yang didukung pendekatan yuridis empiris. Hasil penelitian menunjukkan bahwa peran Kepolisian Daerah Sumatera Barat dalam menanggulangi pungutan liar dengan cara tindakan represif berupa penyidikan pemberantasan pungutan liar ditinjau dari sudut objeknya yakni dari hukumnya itu sendiri. Pada dasarnya tujuan dari penegakan hukum untuk menanggulangi pungutan liar yang ingin dicapai adalah pemidanaan untuk memperbaiki pribadi penjahat itu sendiri dan membuat orang menjadi jera untuk melakukan kejahatan-kejahatan dan untuk membuat mereka menjadi tidak mampu untuk melakukan kejahatan yang lain. Optimalisasi peran kepolisian dalam menanggulangi pungutan liar terbagi atas dua yaitu peningkatan kemampuan sumber daya organisasi kepolisian terutama di Direktorat Kriminal Khusus dan penanggulangan pungutan liar yang dilakukan kepolisian dengan pendekatan kebijakan kriminal berupa pendekatan penal dan nonpenal policy. Handling of Illegal Levies Cases by Investigators of The Special Criminal Directorate This paper discusses the role of the police in tackling illegal levies, and optimizing its role in tackling these illegal levies. Eradication of illegal levies must be carried out in an integrated manner with a moralistic way (human mental and moral guidance) and an abolitionistic way (a way to deal with symptoms) as a preventive measure. This research is a descriptive study, with a normative juridical approach supported by an empirical juridical approach. The results showed that the role of the West Sumatra Regional Police in tackling illegal levies by means of repressive measures in the form of investigating the eradication of illegal levies was viewed from the point of view of the applicable law. Basically the goal of law enforcement to overcome illegal levies to be achieved is to punish the criminal person personally and make people become deterrent to committing crimes and to make them unable to commit other crimes. Optimizing the role of the police in tackling illegal levies is divided into two, namely increasing the ability of police organizational resources, especially in the Special Crimes Directorate and handling illegal charges by the police with a criminal policy approach in the form of a penal and nonpenal policy approach.

ABSTRAK: Aceh adalah provinsi di Indonesia yang diberi kewenangan khusus untuk mengatur dan mengurus sendiri urusan pemerintahan. Salah satu kewenangan khusus yang diberikan adalah memasukkan zakat sebagai salah satu sumber pendapatan asli daerah. Lembaga Baitul Mal dibentuk dengan qanun untuk melakukan pengelolaan dana zakat tersebut. Mengenai tata cara pengelolaan zakat sebagai pendapatan asli daerah yang dikelola Baitul Mal diatur dalam qanun dan peraturan gubernur. Pembelanjaan atau penyaluran zakat disesuaikan dengan tuntunan syariat Islam, yaitu hanya boleh bagian yang ditentukan dalam al-Quran, tidak boleh untuk yang lainnya. Salah satu bentuk pendistribusian zakat yang dilakukan adalah pemberian modal usaha kepada penerima zakat produktif melalui Unit Pengelola Zakat Produktif. Wujud pendistribusian dilakukan dalam bentuk pinjaman tanpa bunga. Hal ini sedikit berbeda karena zakat harus dibagi secara habis tanpa perlu dikembalikan lagi. Meskipun pinjaman tanpa bunga ini bersifat legal namun membutuhkan penjelasan lebih lanjut untuk menghindari pandangan negatif dari pihak lain. Dari hasil penelitian menunjukkan bahwa Baitul Mal Aceh untuk tahun 2013, 2014 dan 2015, terdapat kelebihan dana zakat. Hal tersebut membutuhkan penanganan yang cermat sehingga tidak menimbulkan masalah di kemudian hari. Authority of Baitul Mal Aceh in the Distribution of Zakat ABSTRACT: Aceh is a province in Indonesia that is granted a special authority to govern and manage its own government affairs. One of them is zakat as one of the original source of income. Baitul Mal institution is established by qanun (local law) to manage the zakat fund. In regard with its management procedure as the original revenue of the area, which is managed by Baitul Mal, is regulated in qanun and governor regulation. Its expenditure or distribution is in accordance with the guidance of the Islamic Sharia, that is, it may only be the part specified in the Qur'an, not for others. One of the forms of its distributions’ forms is the provision of vocational capital to productive zakat recipients through Productive Zakat Management Units. It is done in the form of interest-free loans. It is slightly different, as the zakat must be divided in full without needing to be returned. Although its interest-free loan is legal, it requires further explanation to avoid negative views. The finding shows that in 2013, 2014 and 2015, Baitul Mal Aceh, gains its funds more than expected. It requires careful handling in order to avoid any problems in the future.

In Aceh there are patterns of local wisdom that hukom Laot custom has been known since the kingdom. This article aims to analyze the urgency of strengthening the rights and participation of indigenous peoples in customary forest management in Indonesia. Law No. 41/1999 on Forestry, which is still centralized in nature, has limited the rights and roles of indigenous peoples in managing their customary forests. The regulation regarding customary forest in the Forestry Law is inconsistent with protecting ecosystem carrying capacity and democratic decentralization. This article was prepared using a normative legal research methodology in which a statutory and conceptual approach is used. Then, secondary sources of legal material were analyzed and qualified to be narrowed down to answer existing juridical problems. The results show that the rights and roles of indigenous peoples in managing their customary forests are still minimal. Customary forest management centered on the central government and prioritized a sectoral approach can have implications for exploitation that ignores the interests of conserva-tion and sustainability of customary forest natural resources.

Permasalahan hukum yang akan dibahas dalam tulisan ini mengenai gambaran sistem Peradilan Tata Usaha Negara Jerman dan Peradilan Tata Usaha Negara di Indonesia. Sistem Peradilan Tata Usaha Negara Jerman pada hakikatnya sama dengan sistem Peradilan Tata Usaha Negara di Indonesia. Sistem tersebut dapat dilihat dari adanya jenjang sistem peradilan mulai dari tingkat pertama, tingkat banding, dan tingkat akhir atau kasasi. Selain itu akan diulas berkaitan dengan proses peradilan, dasar-dasar dilakukannya gugatan yang diajukan terhadap pemerintah serta cara pelaksanaan proses peradilan tata usaha negara di masing-masing negara. Metode penelitian adalah penelitian hukum normatif dengan pendekatan peraturan perundang-undangan dan perbandingan hukum. Tujuan dari penelitian ini untuk mengetahui sistem Peradilan Tata Usaha Negara baik di Indonesia maupun di Jerman serta mengetahui perbedaam sistem Peradilan Tata Usaha Negara baik di Indonesia maupun di Jerman serta melakukan suatu pembaruan sistem Peradilan Tata Usaha Negara di Indonesia sebagai bentuk suatu perlindungan hukum kepada rakyat A Comparative Law of Administrative Court and Verwaltungsrecht as a Form of Legal Protection to People Legal issues that will be discussed in this paper regarding the description of the Germany Administrative Court system and the Indonesia Administrative Court system. Generally, There are similarities between the Administrative Court system in Germany and in Indonesia. It can be seen from the level of the justice system starting from the first level, the appeal level and the final level or cassation. In addition, this paper will review the judicial process, the basics of lawsuit against the government and how to implement the state administrative court processes in each country. The research method is normative legal research with legislation and legal comparison approach. The purpose of this research is to find out the Administrative Court System and to know the difference between the Administrative Courts System both in Indonesia and in Germany and also to reform the Administrative Court system in Indonesia as a form of legal protection for people.
