Abstract

ABSTRAK. Pakta Integritas merupakan surat pernyataan yang berisi ikrar untuk mencegah dan tidak melakukan kolusi, korupsi dan nepotisme dalam Pengadaan Barang/Jasa. Pakta Integritas pada Pengadaan Barang/Jasa Pemerintah mulai diperkenalkan dalam Keputusan Presiden Nomor 80 Tahun 2003 tentang Pengadaan Barang/Jasa Pemerintah. Setelah Keputusan Presiden Nomor 80 Tahun 2003 tentang Pengadaan Barang/Jasa Pemerintah dicabut dengan Peraturan Presiden Republik Indonesia Nomor 54 Tahun 2010 tentang Pengadaan Barang/Jasa Pemerintah, pakta integritas masih tetap dipertahankan dalam peraturan presiden tersebut. Pengaturan pakta integritas pada pengadaan barang/jasa pemerintah merupakan salah satu upaya untuk mewujudkan pemerintahan yang baik dan bersih (good governance and clean government). Namun yang lebih penting adalah penerapan materi dari ikrar untuk mencegah dan tidak melakukan kolusi, korupsi dan nepotisme sebagaimana tertuang dalam pakta integritas. Penerapan pakta integritas pada pengadaan barang/jasa pemerintah merupakan salah satu upaya pemerintah dalam rangka mewujudkan pemerintahan yang baik dan bersih (good governance and clean government). Integrity Pact Implementation of Procurement of Goods/Services to Realize That Clean Government ABSTRACT. Integrity Pact is an affidavit which contains a pledge to prevent and not collusion, corruption and nepotism in the Procurement of Goods / Services. Integrity Pact on Procurement of Goods / Services introduced in Presidential Decree Number 80 Year 2003 concerning Procurement of Government Goods / Services. After the Presidential Decree Number 80 Year 2003 concerning Procurement of Government Goods / Services revoked by Indonesian Presidential Regulation Number 54 Year 2010 concerning Procurement of Government Goods / Services, the integrity pact is still maintained in the presidential decree. Setting the integrity pact in procurement of government goods / services is one of the efforts to achieve good governance and clean government. But more important is the application of the material and does not pledge to prevent collusion, corruption and nepotism as stated in the integrity pact. The implementation of integrity pacts in procurement of government goods / services is one of the government's efforts in order to realize Good Governance and Clean Government.

Abstract

ABSTRACT: Fisheries condition of Aceh is currently being critical. The condition was one of them caused by the pattern of fisheries management. In fisheries management in Aceh is known pattern of local wisdom in the form of hukom adat laot communities living in 147 lhoks. This wisdom pattern sets five key areas, namely laot abstinence, Laot custom, environmental maintenance custom, laot feast custom, and drifting item custom. The pattern is also recognized in the laws and regulations in Indonesia. But in reality, the traditional wisdom is implemented through the concept of division of roles among the government, fishermen, indigenous institutions, and other fisheries stakeholders. The Fisheries Management Policy Based on Local Wisdom

Abstract

ABSTRACT: Violence behavior might happen in every household. The violence is not on its criteria but more on the reasons for committing it. This paper explores (1) Phenomena of cases of domestic violence in Kupang (2) phenomena of the violence viewed from criminology aspect. This research applies by applying analytical method by applying juridical empirical research. This research starts by exploring and assessing laws either criminology factors in secondary data and will be then followed by empirical factors by gathering primary data. From its character, this is descriptive analytical research. The data applied are primary data and secondary data. To analyze it, quantitative analysis is then used. The findings show that based on criminology aspect, the violence committed in Kupang is due to economy, jealous and drinking factors. In solving it always used custom approach and also the law. It is recommended that the violence should be monitored by society and it is not only internal problem but also legal one and the family should prevent it from committed. Criminology Study on Settling Domestic Violence Case in Kupang Municipality

Abstract

This paper explores the dimensions of gender equality within the context of law-making in Aceh province, emphasizing the importance of a gender perspective. Categorized as a normative study, it addresses the current issue by analysing principles, levels of synchronization, legal histories, and comparisons of constitutions. Additionally, an empirical study was conducted, involving interviews with relevant stakeholders directly involved in the development of Aceh Qanun. The findings of this paper highlight that Pancasila, the 1945 Constitution, and CEDAW serve as primary parameters for law-making and the implementation of gender equality in Indonesia. The formalization of shari'a in Aceh province, as a political endeavour by authorities, is seen as crucial for achieving both gender equality and the goals of shari'a (maqasid al-syariah). The inclusion of gender equality in the law-making process, particularly in relation to the implementation of shari'a in Aceh, is a principle that should be comprehensively understood and applied to ensure justice and equality for all genders in the formulation of qanun in Aceh.

Abstract

This purpose of this research is to identify the constrains that arise in the inventory efforts carried out by the Directorate General of Intellectual Property at the Ministry of Law and Human Rights of the Republic of Indonesia in order to realize the legal protection of communal intellectual property. The method used is normative legal research with an evaluative nature, where the sources of legal material obtained in this research are then analyzed qualitatively. The constrains that have been identified are: Constraints in terms of substance, related to the confusion of communal intellectual property rights holders; Constraints in terms of structure, related to coordinating the inventory of communal intellectual property without involving a custodian; Constraints in terms of culture, related to the culture of speech for the custodian of communal intellectual property in Indonesia. These constrains will certainly hinder the government’s efforts to realize the legal protection of Indonesian communal intellectual property. Therefore, it is necessary to make improvements from several aspects, namely: First, the holder of communal intellectual property rights is the custodian; Second, the inventory should be carried out directly or at least involve the custodian; Third, grounding the documentation culture in communal intellectual property custodians in Indonesia

Abstract

Tujuan penulisan ini adalah mengkaji penegakan hukum terorisme di Indonesia terkait peran advokat, dengan menggunakan pendekatan hukum transendental. Pendekatan yang digunakan adalah nondoktrinal (socio-legal research), yang menjelaskan hukum tidak hanya dari sudut pandang konsepsi abstrak-normatif, namun juga melihat keberlakuan hukum di masyarakat. Metode penulisan dalam penelitian ini meng-gunakan pendekatan teori hukum dan filsafat. Hasil penelitian menunjukkan bahwa berdasarkan data dalam kurun waktu 13 tahun, polisi berhasil melakukan penangkapan teroris sebanyak 850 orang. Data tersebut menunjukkan keseriusan pemerintah Indonesia dalam menegakkan hukum terorisme. Namun nampaknya, dalam beberapa kasus menunjukkan ketidakjelasan prosedur penanganan terhadap pelaku atau terduga terorisme, sehingga menimbulkan kontroversi termasuk dari sisi kemanusiaan.  Dalam penegakan hukum, advokat sebagai penegak hukum memegang peran penting, dimana dari sisi kemanusiaan, terduga kasus terorisme penting diperhatikan proses penegakan hukumnya. The Role of Advocates in the Enforcement of Terrorism Law by Transcendental Legal Approach This study aims to examine the enforcement of terrorism law in Indonesia in relation to the role of advocates by using transcendental legal approach. The approach used is nondoctrinal (socio-legal research), which explains the law not only from the perspective of abstract-normative conceptions, but also looks at the validity of law in society. The writing method in this study uses a legal theory and philosophy approach. The results showed that based on data within a period of 13 years, the police managed to arrest terrorists totaling 850 people. The data shows the seriousness of the Indonesian government in enforcing terrorism laws. However, it seems that in some cases the procedure of handling perpetrators or terrorism suspects is unclear causing controversies including from the human right perspective. In law enforcement, advocates as law enforcers play an important role where in terms of humanity, for terrorism suspected are important to pay attention to their law enforcement processes.

Abstract

Maritime and fishery development provides important meaning for the development in Aceh Besar. In final report of Head and Vice Head period 2007-2012 has been mentioned that the development fishery providing big opportunity in PDRB of the region is decreased. It results from many infrastructures are destroyed due to the tsunami disaster. Law might play a role in economic development. In this case, it creates stability, predictability, and fairness. Based on that view on the regulation both Qanun Aceh Besar and the Regulation of Head District issued is based on maritime and fishery sectors. Abstract

ABSTRAK: Sekalipun berakar pada budaya Melayu Islam-Sunni Syafi'iyah namun hudud yang dirumuskan dalam Qanun Aceh dan Brunei terindikasi berbeda, padahal secara konseptual dikenal sebagai perkara qath’i, sehingga menarik untuk mengetahui bagaimana sesungguh-nya konsepsi, implikasi, serta hal-hal yang memengaruhi konsepsinya. Hasil penelitian yuridis-normatif ini menunjukkan: meski memperlihatkan “benang merah” dengan fikih klasik namun secara keseluruhan QJA membentuk konsepsi hudud yang lebih moderat dan khas Aceh-Indonesia sehingga berbeda dibandingkan KHJB yang secara murni mere-presentasikan Syafi’iyah; perbedaan konsepsi berimplikasi pada bercampurnya pidana hudud dan ta’zir dalam konteks pemberatan pidana hudud dalam QJA; dan perbedaan konsepsi dipengaruhi oleh paradigma legislasi hukum Islam. Disarankan pidana hudud dalam QJA disusun lebih komprehensif-sistematis sesuai klasifikasinya; untuk menghindari bercampurnya hudud dan ta’zir dalam formulasi ketentuan pidana, Aceh perlu melihat perbandingan “dua stelsel ketentuan pidana” dalam KHJB; dan sebagai the living law wajar sekiranya mazhab Syafi’i diprioritaskan, tetapi mesti tetap mengedepankan relevansi, tanpa mengekang kreatifitas pemikiran. Hudud Conception in Islamic Criminal Canon of Aceh-Indonesia and Brunei Darussalam ABSTRACT: Although derive from Malay Islam-Sunni Shafeites, the hudud in Islamic Criminal Canon of Aceh and Brunei is indicated to be worded differently, whereas conceptually is known as a “definitive matter”, so it’s interesting to find out how the actual conception is, its implications, as well as things impacting. This normative legal research shows: although showing "red thread" with classical fiqh thought but overall it seems to be more moderate and suit generic of Aceh-Indonesia, so substantively different from KHJB that is purely represent Shafeite thought; the conception has implication on the mixing of hudud and ta’zir in the hudud criminal weighting context of QJA; and the both conceptions is interfered by the existence of paradigm of Islamic law legislation. It is recommended that the substance of QJA is arranged comprehensively and systematically based on its classification; to avoid the mixing of hudud and ta'zir in the crimes wording of hudud, the QJA could find the comparison of a “two-criminal law formulation” in KHJB; and as the living law it is alright that the fiqh of Shafi’i is prevailed in Islamic law process but by persist to prioritize the relevant aspect and without limiting the thought creativity.

Abstract

ABSTRACT: Islamic view on adultery concept in Article 284 of the Indonesian Penal Act is more limited compared to the concept of it in Islamic law. In addition, the reaction of criminal law towards the perpetrator in Article 284 of the Act is too lenient as it only charges by prisonment maximally 9 months. Consequently, the punishment as wording in the article has not had suffering impact towards the violator. Abstract

This article delves into the implications of the Constitutional Court's decision on Law Number 1 of 1974 through the lens of Maqashid Asy-Syariah, aiming to comprehend its impact on gender equality within Indonesian marriage law, aligning with the principles of Maqashid Asy-Syariah. Employing a normative legal research method with a legislative approach, the study analyzes legal norms, drawing from relevant legal documents and literature as data sources. The descriptive-normative data analysis method is applied to articulate the implications of the Constitutional Court's decision from the Maqashid Asy-Syariah perspective and its consequential effects on Indonesian marriage law. This pivotal decision reinterprets Article 43, paragraph (1), enabling children born out of wedlock to establish a civil relationship with their fathers. This alteration serves to protect individual rights, uphold principles of justice, ensure family welfare, and synchronize state and religious laws. Furthermore, the decision abolishes discriminatory polygamy provisions and equalizes age limits for marriage between men and women, fostering gender equality. This move not only safeguards individual rights, particularly those of women but also upholds the principles of justice, equality, and social welfare within the Maqashid Asy-Syariah framework.
