Abstract

ABSTRACT: Corruption has been increasing rapidly and destroying life of nation. It is not only making loss of state financial but also economic of people and becoming threat for national stability and international. This paper is going to answer the policy of corruption policy in the act applying now and in the future. This research applies juridical normative method by conceiving law as a norm that is a measure for human behavior by focusing on secondary data that are collected from primary data that are laws. Based on the research, it reveals that the policy of criminal law on preventing crime of corruption are facing some weakness hence the restoration is required by focusing on the element of making loss for the state. Abstract

ABSTRACT: Income tax is a tax levied on income, the meaning of income according to article 4 paragraph 1 of income tax’s constitution enacton in 2009 is any additional economic capability received by the taxpayer either coming from Indonesia and outside Indonesia that could be used for consumption or to increase the wealth of taxpayers concerned with the name and in whatever form as well. While the value added tax is a kind of center that collected taxes done at the time of the transfer of taxable goods and taxable services from one taxpayer to another taxpayer. Related to both these tax law on January 10, 2011 the government through the Directorate General of Taxation issued a Circular Letter Number. 3 / PJ/2011 (SE DGT) on Income Tax Form Income Royalties and Treatment of Value Added Tax on Importation of Films Imports to Indonesia. Issuance of this circular by the government is in order to provide a uniform understanding and application of the Income Tax treatment of Royalty Income and Value Added Tax on imported film entry Indonesia with the DGT S.E No. 3 / PJ / 2011, has received a serious response by Frank. S Rutten Vice President of the Motion Pictures Association (MPA) to Southeast Asian countries rather on Thursday, February 17th, 2011 ago, which immediately gave a statement that the Association of American film producer (Hollywood) will decide the distribution of their films to the country of Indonesia during the government still treats the new tax provisions related to the imposition of uniformity Royalty imported films. So that, we formulate the problem as follows, how the legal position of Director General of Taxes Circular and anything that is applied from both Tax Act above in the Circular Letter. Abstract

Sexual violence against children is an abhorrent act that profoundly impacts their growth and development. To address this issue, the government has a responsibility to educate teenagers about sexual education, as outlined in article 136-137 of Law (UU) Number 36 of 2009, which focuses on Adolescent Health. However, despite these efforts, the prevalence of sexual violence continues to rise. One contributing factor is believed to be the lack of comprehensive sex education for children at an early age. Therefore, it is crucial to provide age-appropriate sex education to children, tailored to their developmental stage. This education aims to empower children to recognize and prevent acts of sexual violence. It includes teaching children about the importance of safeguarding and protecting their private body parts, establishing boundaries, and equipping them with procedures to protect their body and dignity. By implementing such measures, we can strive to create a safer environment for children and reduce the occurrence of sexual violence.

Abstract

The purpose of this study is to analyze the responsibility of taxpayers who manipulate transaction values in order to reduce Fees for Acquisition of Land and Building Rights (BPHTB). This research is inspired by the results of previous research that many BPHTB taxpayers manipulate transaction values to reduce BPHTB, but they are missed from legal responsibility, so that their actions seem normal in society and are not perceived as despicable and violating of the law. This research is a normative legal research using a statutory approach, so that it can be seen how the responsibility of taxpayers who are not honest in paying BPHTB. The results showed that in statutory regulations cannot be found administrative sanctions imposed on taxpayers who manipulated transaction values to reduce BPHTB. In fact taxpayer's actions are really detrimental regional finance, because their taxes are paid to the Regional Treasury as the original financial resources. Sanctions contained in statutory regulations are only criminal sanctions, as regulated in Article 174 of Law Number 28 of 2009 with the threat of imprisonment for a maximum of one year if due to negligence and a maximum of two years if done intentionally.

Abstract

Pemikiran the king can do not wrong dapat dikatakan sebagai alat kekuasaan penguasa untuk merekayasa warga negara. Produk hukum Indonesia saat ini telah terkontaminasi oleh pemikiran tersebut. Tidak heran warga menginginkan keseimbangan politik hukum untuk menuntuk keadilan hukum penguasa. Pertanyaan yang timbul tentang pemikiran the king can not do wrong terhadap system ketatanegaraan Indonesia menjadi satu topik kajian. Melalui metode pengkajian terhadap beberapa telaah pustaka dan sejarah di belahan dunia, dapat membudahkan pembahasan yang disajikan melalui penggambaran dalam bentuk kalimat. Hasil dalam pembahasan didapatkan perlawanan terhadap produk hukum bukan hanya terjadi di Indonesia saja, malainkan jauh sebelumnya terjadi di beberapa negara. Di Indonesia sendiri berkenaan perlawanan terhadap produk hukum berusaha dilakukan terutama terhadap produk hukum positif yang dinilai kurang memberikan keadilan. Sebagai bentuk negara kesatuan kesalahan produk hukum sering dilakukan oleh eksekutif. Namun, hal yang rumit berkenaan pengguasa yang tidak dapat dihukum atas pembuatan produk hukum. Maka dapat ditarik kesimpulan bahwa produk hukum pada dasarnya dibuat penuh dengan kepentingan terutama kepentingan penguasa yang bernaung di bawah legitimasi. Theory of the King Can Do Not Wrong on Legal Politics Under Indonesian Constitutional System The thought of the king can do not wrong can be said as an instrument of power of the authorities to engineer citizens. Indonesia's legal products are now contaminated by such thoughts. No wonder citizens want a political balance of law to seek justice of the ruling law. Questions that arise about the thinking of the king can not do wrong to the Indonesian state administration system into a single topic of study. With the method of studying some of the literature review and history in the world, can facilitate the discussion presented through the description in the form of a sentence. Results in handling not only occur in Indonesia alone, but far earlier in several countries. In Indonesia itself is against the legal products. How the country works. However, the very thing concerning the unreliable. Then it can be recalled the above products are made full of interests above the interests of the rulers who take shelter under legitimacy.

ABSTRAK. Artikel ini berisi politik hukum perlindungan dan pengelolaan lingkungan terkait ekokrasi di Indonesia. Ada dua hal pokok yang ingin dikaji, yakni (1) bagaimanakah politik hukum perlindungan dan pengelolaan lingkungan hidup di Indonesia? dan (2) bagaimanakah bangunan politik hukum perlindungan dan pengelolaan lingkungan dalam rangka mencapai ekokrasi Indonesia. Dalam penelitian ini termasuk jenis penelitian hukum normatif dengan pendekatan perundang-undangan dan pendekatan konseptual. Sebagai pisau analisa menggunakan teori sistem hukum dan konsep politik hukum sebagai pegangan dalam membahas permasalahan terkait. Adapun pembahasannya menguraikan politik hukum perlindungan dan pengelolaan lingkungan hidup di Indonesia sekarang telah mengarah ke arah hukum yang demokratis dan responsif. Politik hukum yang demokratis dan responsif memberikan jalan untuk menuju cita-cita ekokrasi Indonesia. Legal Politic of Protection and Management of Environment Heading to Indonesia Ecocracy ABSTRACT. Abstract

ABSTRACT: Dissatisfaction that occurs in a social community of injustices in the treatment due to politics, economics and law has led to social conflicts that lead to a variety of social behavior in the context of civic life. One of the social perubahana in the application of the law of politics in Indonesia since the end of the New Order regime, and the period of reform can be seen in efforts to address the phenomenon of Indonesian statesman disintegritas arising in Aceh so that eventually gave birth to Law Number 11 Year 2006 about the government of Aceh, the Act has brought great changes to the law in force in Aceh. The birth qanu-qanun and implementation efforts of Islamic law in Aceh has extended the range deversitas kaffah laws of the Republic of Indonesia with the 1945 constitutional system. On the one hand the notion as a group of people about the rights of autonomy that is so vast and highly principled for the Aceh region of Act No. 11 of 2006, who were later considered to be one of the basic implementation of Islamic sharia in Aceh kaffah is a part of Indonesia's legal system. Abstract

ABSTRACT: The Province of Aceh has wide forest area which is potential for forest carbon trade in international market. However, incomplateness of legal bases for carbon trade which is consistant to wide-special  Aceh autonomy and sincron and harmonis with Indonesian national law may create abstracles in utilizing that opportunities. This research is aimed at providing input to Government of Aceh in selecting alternative precise legal entities and regulating Aceh forest carbon trade in international market. In this research the combination of normative, comperative, and social-legal research approaches, to answer legal issues as research questions. The finding shows that is utilized proper implementing legal entities for Aceh forest carbon trade in international market is that which can combine various elements and interests of right holders and stakeholders. Combination of government, componies and civil society will  strengthen synergicity and strengths in performing activities. Regulating Aceh forest carbon trade can be implemented in form of specific Qanun Aceh or as a part of contents of Qanun Aceh on Forestry and/or in governatorial decree, as implementing regulation which is already directed by related Qanun Aceh. Tidak ditaatinya pedoman kode etik dalam pengelolaan dana pensiun dapat menyebabkan kerugian bagi dana pensiun itu sendiri, sehingga berpotensi gagal dalam memberikan manfaat pensiun kepada peserta. Penelitian ini bertujuan menjelaskan mekanisme pengelolaan dan penegakan kode etik Dana Pensiun Syariah Muhammadi-yah. Metode penelitian ini menggunakan jenis penelitian normatif-empiris. Penelitian normatif dilakukan untuk memperoleh bahan hukum sekunder melalui studi pustaka, sedangkan penelitian empiris dengan wawancara untuk memperoleh bahan hukum primer. Data yang diperoleh kemudian dianalisis secara deskriptif dengan pendekatan konsep dan perundang-undangan. Kode etik pengelolaan dana pensiun syariah Muham-madiyah mencakup iman dan taqwa kepada Allah Swt, taat hukum, relasi dengan peserta dan pihak eksternal, kepatutan dalam bertindak, hutang, hubungan insan dana pensiun dengan dana pensiun, penggunaan fasilitas lembaga, penyalahgunaan informasi dan jabatan, menjaga rahasia, akurasi pencatatan, transaksi dengan mitra kerja, benturan kepentingan, suap, korupsi dan nepotisme, keterlibatan dalam politik, dan pekerjaan di luar dana pensiun. Penegakan kode etik ini bagian dari penerapan good pension fund governance dalam rangka memberikan kesinambungan bagi peserta. Melanggar kode etik dapat diberi sanksi indisipliner. Urgency of Enforcement of Code of Ethics in Muhammadiyah Syariah Pension FundsFailure to implement code of ethics guidelines in pension fund management can lead to the pension fund management losses, so that it will potentially fail to provide pension benefits to participants. This study aims to explain the management and enforcement mechanisms of the Muhammadiyah Sharia Pension Fund code of ethics. This study uses a normative-empirical method. Normative research is conducted to obtain secondary legal material through literature study, while empirical research is conducted by using interview method to obtain primary legal material. The data collected were then analyzed descriptively with the conceptual approach and legislation. The code of ethics for the management of Muhammadiyah sharia pension funds includes faith and piety in Allah swt, obeying the law, relationships with participants and external parties, appro-priateness in acting, debt, relationships between pension fund recipients and pension funds, use of institutional facilities, misuse of information and positions, maintaining confidentiality, recording accuracy, transactions with work partners, conflicts of interest, bribery, corruption and nepotism, involvement in politics, and work outside pension fund management. The enforcement of this code of conduct is part of the implementation of good pension fund governance in order to provide sustainability for participants. Violating the code of conduct can be subject to disciplinary action.
