Abstract

Penyelesaian perkara pada anak kategori juvenile delinquency dilakukan dengan upaya diversi, yaitu penyelesaian perkaranya di luar jalur peradilan yang tujuannya untuk melindungi hak anak, antara lain hak tumbuh dan berkembang sesuai dengan usianya. Tujuan dilakukannya upaya diversi agar anak bisa bertanggung jawab terhadap perbuatan yang sudah dilakukannya sehingga tidak mengulangi lagi. Syarat dilakukannya diversi adalah ancaman pidana tindak kejahatannya dibawah tujuh tahun dan tidak berulang kali dilakukannya. Penulisan ini menggunakan metode yuridis normatif yang menganalisa kesesuaian penerapan upaya diversi pada anak kategori juvenile delinquency dalam rangka melindungi terpenuhi hak anak sebagaimana diatur dalam Undang-Undang Perlindungan Anak.Children's Rights Protection in the Juvenile Delinquency Category Children cases settlement in the juvenile delinquency category are conducted with diversion efforts, that is the case settlement outside the judicial system which aims to protect children's rights, including the rights to grow and develop in accordance with their age. The purpose of the diversion effort is the children can be responsible for the actions they have done so in the future they won't repeat them. The requirement to do diversion is the criminal threat of children which are under seven years and do not commit a crime repeatedly. This is a normative juridical research that analyzes the suitability application of diversion efforts in children of the juvenile delinquency category in order to protect the fulfillment of children's rights as stipulated in the Child Protection Act.

Abstract

This study examines the usage of toll road sections that have fully recovered their investment as state-owned assets, and evaluate the compatibility of the Toll Road Concession Agreement (Perjanjian Pengusahaan Jalan Toll/PPJT) about granting concessions for the operation of these toll road sections that have paid off their investment. This research employs a normative juridical method, analyzing relevant literature on using toll road sections that have reached the return on investment as state-owned assets. The findings indicate that the State's utilization of these toll road sections does not uphold justice, as it fails to maximize the community's welfare. The PPJT on the concession of operating toll road sections that have paid off their investment differs from the utilization of state-owned assets as stipulated by existing regulations due to the imposition of general contributions and profit sharing. It is the government to consider the concession agreement to include toll road sections that have completed their investment to return into the government for maximizing public welfare.

Abstract

Penelitian ini bertujuan untuk menjawab proses pemeriksaan tindak pidana korupsi terhadap pejabat pemerintahan kabupaten oleh penyidik. Realitas ini menuntut kehati-hatian, profesional, dan bertanggung jawab dalam pelaksanaan tugas pemerintahan oleh pejabat atau perangkat daerah sebagai pejabat daerah. Penelitian ini menggunakan Kenyataan memperlihatkan bahwa walaupun sudah bekerja profesional, jujur, adil, dan bertanggung jawab, namun tidak tertutup kemungkinan seorang pejabat daerah menjadi tersangka atau saksi tindak pidana korupsi, terutama yang berkaitan dengan jabatan yang dipercayakan kepadanya. Untuk itu tentu saja hak-hak mereka sebagai seorang saksi atau tersangka harus diberikan secara optimal. Namun pemanggilan terhadap pejabat daerah oleh penyidik masih ada yang dilakukan dengan menggunakan pesan pendek melalui telepon genggam atau sms (short messaging service), pemanggilan tanpa melalui atau diketahui oleh atasan, bahkan pemanggilan Bupati tidak sesuai dengan ketentuan Undang-Undang Nomor 11 Tahun 2006 tentang Pemerintahan Aceh, sehingga penyidik dirasakan masih kurang menghargai hukum dalam penanganan saksi dan tersangka yang berasal dari pejabat daerah. The Examination of Corruption Cases of District Government Officials by Investigators This study aims to answer the process of examining corruption cases against district government officials by investigators. This reality requires prudence, professionalism, and responsibility in carrying out governmental tasks by regional officials. This research uses the fact that shows that although they have worked professionally, honestly, fairly and responsibly, it is also possible for a regional official to be a suspect or witness of a corruption case, especially related to the position entrusted to him. For this reason, their rights as witnesses or suspects must be optimally granted. However there are still summons to regional officials by investigators that are done by using short messages via cell phone or sms (short messaging service), summons without going through or being known by superiors, even the calling of the Regent is not in accordance with the provisions of the Law Number 11/2006 concerning the Government of Aceh, so that investigators felt they still lacked respect for the law in handling witnesses and suspects who came from regional officials.

Abstract

ABSTRAKManajemen personalia, di era otonomi daerah pada dasarnya telah mengalami pertumbuhan yang pesat, terutama dalam kasus penyusunan kebutuhan karyawan, bersama dengan proses pengadaan dan pengangkatan pegawai negeri sipil. Dalam mengembangkan kebutuhan karyawan, manajemen personalia penentuan persyaratan didasarkan pada analisis jabatan dan beban kerja yang didasarkan pada kebutuhan prioritas daerah. Selain proses pengadaan dan pengangkatan PNS juga memuat ketentuan yang menempatkan sistem profesionalisme berdasarkan kemampuan masing-masing calon PNS serta beberapa persyaratan kualifikasi untuk mengaktifkan PNS untuk dapat bersaing pengembangan dorongan dalam wilayah, disertai dengan gaji manajemen dan tunjangan didasarkan pada pengelolaan kebutuhan anggaran masing-masing daerah. Personnel Management in the Era of Regional Autonomy ABSTRACTPersonnel management in the era of regional autonomy in essence , has experienced rapid growth , especially in the case of the preparation of the needs of employees , along with the procurement process and the appointment of civil servants. In developing the needs of employees , management personnel requirements determination is based on job analysis and workload that is based on the priority needs of the region . Besides the procurement process and the appointment of civil servants has also contains a provision that puts the professionalism system based on the ability of each candidate civil servants as well as some of the qualification requirements to enable the civil servants to be able to compete boost development in the region , accompanied by the management salary and allowances are based on the management of the budget needs of each region.

Abstract

ABSTRAK: Perlindungan anak merupakan hal yang mutlak dilaksanakan oleh republik ini, karena republik ini di dalam konstitusi sudah menyatakan sebuah negara hukum yang menjunjung tinggi hak asasi manusia. Perlindungan anak sebagai salah satu jaminan dari hak asasi manusia merupakan wujudnya nyata dari perkembangan regenerasi perkembangan sebuah negara. Sungguh sangat disayangkan ketika anak sudah mendapatkan kekerasan seksual di masa kanak-kanak mereka. Masa depan mereka hancur, karena ada trauma psikis dan mental. Dalam menata perlindungan anak dari bahaya kekersan seksual maka diperlukan reformasi penegakan hukum terhadap ancaman kekerasan seksual terhadap perlindungan anak. Pola penataan pengakan hukum atas perlindungan anak yang berkelanjutan memang benar-benar harus dilaksanakan sehingga menciptakan perlindungan anak berkelanjutan. Reform of Law Enforcement of Sexual Violence to Children as the Form of Sustainable Children Protection ABSTRACT: Child protection as one of the guarantees of human rights is evident from its form regeneration development of a country. It is very unfortunate when children are sexually assaulted during their childhood. Their future is ruined because there are psychological and mental traumas. In restructuring the protection of children from the dangers of sexual violence will require reform of law enforcement to the threat of sexual violence. The pattern of structuring reform of law enforcement on an ongoing child protection must be implemented.

ABSTRACT: A notary is a public officer which has an authority to issue authentic document and other authorities as ruled in Article 15 of the Notary Act. In regard with original legal documents made and witnessed by notary, a notary has an obligation to keep it as ruled by Article 16 (1) words b and i of the Act. Abstract

The purpose of the research aims to analyse the validity of the decision by Panwaslih Aceh number 001/PS/SN.20/VII/2018 as opposed to article 60 section (1) letter j under KPU regulations number 14 in 2018. KPU regulations do not allow individual prospective candidates to participate in the regional representative board election whose former drug convicts, had committed sexual crimes against children, or had corruption before. the research is normative juridic research using theory and legislation approach. The result of the research showed the moment of decision was made, KPU regulations still applied. The decision of Panwaslih Aceh has already exceeded its own authority as a result of not accommodating KPU regulations. KPU regulations should be changed at first or being said by the supreme court that KPU regulations are contrary to the law. DKPP as electoral management body ethics council was expected to run its function more actively without a complaint first.

Abstract

Artikel ini ingin menjawab bagaimana kepastian hukum dalam pelaksanaan perlindungan hukum terhadap anak sebagai korban tindak pidana pencabulan di Kota Padang. Dengan menggunakan metode yuridis sosiologis, penelitian ini menemukan bahwa keikutsertaan penyidik dalam proses memilih menentukan bentuk perlindungan dan dukungan keamanan anak korban tindak pidana pencabulan. Kendala yang dihadapi oleh penyidik dalam melaksanakan pemenuhan hak-hak anak sebagai korban tindak pidana pencabulan terbagi atas kendala internal dan eksternal. Secara internal, kurangnya sarana dan prasarana yang memadai dan tidak adanya laporan dari korban atau keluarga korban pencabulan. Upaya dalam mengatasi kendala adalah sosialisasi dan koordinasi sehingga tidak membutuhkan waktu yang lama dalam penanganan kasus tindak pidana pencabulan. Hal ini mengingat korban membutuhkan pertolongan segera karena mengalami penderitaan secara fisik dan mental. Legal Protection on Children as Victims  of Sexual Abuse This article wants to answer how legal certainty in implementing legal protection for children as victims of sexual abuse in the city of Padang. By using a sociological juridical method, this study found that the participation of investigators in the process determines the form of protection and security support for children victims of sexual abuse. Constraints faced by investigators in carrying out the fulfillment of children's rights as victims of sexual abuse are divided into internal and external constraints. Internally, the lack of adequate facilities and infrastructure and the absence of reports from victims or families. Efforts to overcome obstacles are socialization and coordination so it does not require a long time in handling sexual abuse cases. This is because the victims need immediate help because they suffer physically and mentally.

Abstract

Historically, the governance of Imeum Mukim is a legacy of the Aceh Empire. It is not created by the colonialism of the Dutch or the Indonesiian Government, but, it is created by the empire. The existency is a part of customary and conducted based on customs and customary law. This research explores such existence from the era of the Aceh Empire to nowadays. After the independence of Indonesia, its existence is influenced by the laws regulating Local and Villaage Governances. Surprisingly, the existence was not recognized by the Act Number 5, 1979. Abstract

ABSTRACT : Berdasarkan Undang-Undang Nomor 11 Tahun 2006 tentang Pemerintahan Aceh, dalam Bab XII dan XIII diatur tentang Lembaga Wali Nanggroe dan Lembaga Adat. Pasal 98 Undang-undang ini menyebutkan lembaga adat berfungsi dan berperan sebagai wahana partisipasi masyarakat dalam penyelenggaraan pemerintahan Aceh dan pemerintahan kabupaten/kota di bidang keamanan, ketentraman, kerukunan dan ketertiban masyarakat. Pada ayat berikutnya dalam pasal ini, menyebutkan tentang penyelesaian masalah sosial kemasyarakatan secara adat, ditempuh melalui lembaga adat. Lembaga Adat seperti yang disebutkan di atas, meliputi : Majelis Adat Aceh, Imeum Mukim atau nama lain, Imeum Chik atau nama lain, Keuchik atau nama lain, Tuha Peut atau nama lain, Tuha Lapan atau nama lain, Imeum Meunasah atau nama lain, Keujruen Blang atau nama lain, Panglima Laot atau nama lain, Pawang Glee atau nama lain, Peutua Seuneubok atau nama lain, Haria Peukan atau nama lain dan Syahbanda atau nama lain. Dalam pasal 99 Undang-undang Pemerintahan Aceh ini, disebutkan bahwa pembinaan adat dan adat istiadat dilakukan sesuai perkembangan keistimewaan dan kekhususan Aceh yang berlandaskan pada nilai-nilai Syariat Islam dan dilaksanakan oleh Wali Nanggroe. Selanjutnya disebutkan, bahwa penyusunan ketentuan adat yang berlaku umum pada masyarakat Aceh dilakukan oleh lembaga adat dengan pertimbangan Wali Nanggroe. Untuk lebih lanjut, hal diatas diatur dengan qanun tersendiri. Kebutuhan manusia akan keteraturan melahirkan adagium “Ibi Ius Ibi Sociales”, artinya dimana ada masyarakat di situ ada hukum. Adagium ini juga menunjukkan bahwa setiap masyarakat mempunyai hukum tersendiri yang dapat saja berbeda dengan masyarakat lainnya, sesuai dengan filosofi yang dianut oleh masyarakat tertentu. The Existence of Customary Law in Special Autonomy
