anun: Jurnal Ilmu Hukum (KJIH), the Indonesian Journal of Autonomy Law, is an international journal dedicated to the study of autonomy law within the framework of national and international legal systems. Managed by the Faculty of Law at Syiah Kuala University in Banda Aceh, Indonesia, KJIH has been fostering legal scholarship since its establishment in June 1991, with the ISSN: 0854 – 5499 and e-ISSN (Online): 2527 – 8428. In 2020, it received national accreditation (SINTA 2) from the Ministry of Research and Technology of the Republic of Indonesia and the National Research and Innovation Agency. Abstract

ABSTRACT: The international society considers the existence of forest has  close relation to biodiversity and climate changing problems. Therefore, the countries are required to manage forest  prevent it from causing a damage or pollution direct or indirectly to the environment in national territory or beyond the limit of national jurisdiction. Indonesiahas been implementing this principles in state obligation to harmonize the policy and national regulations according to the international agreements in the realization to suistainable forest management. For this purpose, the government has made some provisions related to forest such Undang-undang No. 41 in 1999 concerning foresrtry. For the Leuser forest in Nanggroe Aceh Darussalam Province has somes provisions on suistainable forest management such as in Intruksi Gubernur No.5/Instr/2007 relating to Moratorium Logging. Abstract

ABSTRAK: Nafkah tidak hanya suatu pemberian yang diberikan seorang suami kepada istrinya, namun juga merupakan kewajiban antara bapak dengan anaknya dan juga memiliki tanggung jawab antara seorang pemilik dengan sesuatu yang dimilikinya. Kewajiban nafkah tersebut telah tercantum dalam sumber hukum Islam al Quran dan al hadits,  diantaranya terdapat dalam Surat  Ath-Thalaq ayat (6), Al-Baqarah ayat: 233, dan lainnya. Nafkah berarti sebuah kewajiban yang mesti dilkasanakan berupa pemberian belanja terkait dengan kebutuhan pokok baik suami terhadap istri dan bapak kepada anak ataupun keluarganya.  Begitu pentingnya nafkah dalam kajian hukum Islam, bahkan seorang istri yang sudah dithalaq oleh suaminya masih berhak memperoleh nafkah untuk dirinya beserta anaknya. Disamping itu, meskipun nafkah merupakan suatu kewajiban untuk dipenuhi namun menyangkut kadar nafkahnya, harus terlebih dahulu melihat batas kemampuan si pemberi nafkah. Conjugal Need Concept in Islamic Law ABSTRACT: Conjugal need is not only a gift that is provided by a husband to his wife, but also an obligation of the father to his child and the responsibility of an owner to something. The need liabilities have been ruled in Islamic texts of Qoran and al-Hadith, which there are in the Chapter of Ath-Thalaq paragraph (6), Al-Baqarah: 233, and more. The need means an obligation that must be done by the form of expenditures related to the basic needs of both the husband against the wife and father of the child or his family. Due to its importance of it in the study of Islamic law, even a wife who has been dithalaq by her husband still has the right to earn a living for themselves and their children. In addition, although a living is an obligation to be met but concerns the level of living, it should be first to find the limits of  its provider.

Abstract

ABSTRACT: The review in this paper is to discuss the cause of the child out of wedlock, understanding and the status of illegitimate children, inheritance law of children out of wedlock and custody of the child of adultery under Islamic Law Compilation method used was content analysis (content analysis) of references relevant to the problem discussed. The legal consequences for the child out of wedlock under Islamic Law Compilation is a child born outside marriage has only nasab relationship with her mother and her family alone, so it legally, the child can not be completely attributed to the father  father nature, although the real father/natural father (genetic) are the men who impregnate women who gave birth to her it. Abstract

In the business world, business competition is a natural thing. Business actors conduct business competition to dominate the relevant market or achieve a dominant position. Mastery of a dominant position is allowed as long as it is achieved in one's own capacity and in an equitable manner. To achieve a dominant position in the market, it is not uncommon for business actors to use unjustified methods so that actions from prohibited business competition emerge. The purpose of this study is to determine the regulation of the dominant position in business competition law in Indonesia and to analyze indications of abuse of the dominant position by PT Forisa Nusapersada as containedinKPPU's Decision Number: 14/KPPU-L/2015which continues until the cassation as decided inSupreme Court Decision Number: 1106 K/Pdt.Sus-KPPU/2017.Through this research, it is concluded that the dominant position regulation in business competition law in Indonesia is contained inLaw Number 5 of 1999 concerning the Prohibition of Monopolistic Practices and Unfair Business Competition.In the case of PT Forisa Nusapersada,there are different indications of abuse of the dominant position which have led to different decisions between the KPPU and the Supreme Court.

Abstract

Penelitian ini bertujuan membahas mekanisme pemilihan kepala daerah di Indonesia, dengan melakukan perbandingan sistem pemilihan kepala daerah di sejumlah negara, antara lain: Amerika Serikat, Belanda, dan India. Mekanisme ini sebagaimana dalam Pasal 18 ayat (4) UUD NRI 1945 yang menyebutkan bahwa gubernur, bupati, wali kota masing-masing sebagai kepala pemerintahan provinsi, kabupaten dan kota, dipilih secara demokratis. Frasa dipilih secara demokratis selalu ditafsirkan bahwa pemilihan kepala daerah harus dilakukan secara langsung oleh rakyat. Penelitian ini menggunakan penelitian yuridis normatif dengan menggunakan pendekatan perundang-undangan dan pendekatan perbandingan. Penelitian menemukan bahwa potret pemilihan kepala daerah saat ini menunjukkan bahwa pemerintah belum mampu menciptakan kesejahteraan rakyat, bahkan menyebabkan semakin rusaknya moral para pejabat negara dan rakyatnya. Regional Election in Indonesia and the Comparison in United States, Netherlands, and India This research aims to discuss the mechanism of regional election in Indonesia by compairing it with others country, which are United State, the Netherland, and India. This mechanism as in Article 18 paragraph (4) of the Indonesian Constitution 1945 (UUD 1945) which state that the governors, regents and mayors as heads of provincial, district and city governments, are democratically elected. The phrase democratically is always interpreted that the regional election must be carried out directly by the people. This study applies normative juridical research by using a statutory approach and a comparative approach. The study found that the current portrait of regional elections shows that the government has not been able to create people's welfare, even causing moral damage to state officials and people.

Abstract

Land is one of the important natural resources for humanbeing sustainability. Relation both of them is not only a place for life, but also it is providing resources for life. Thus, the government policy on land for development must be managed wisely today and for future. The policy includes also life provision for development. One of the government actions, the provision of it must be fair. It based on the principle that it must be protected by law, right to property or right of having it guaranteed by the constitution. Abstract

ABSTRAK: Pembaruan hukum atas Hukum Acara Pidana dapat dilakukan dengan menelisik sisi dinamis manusia dan kemanusiaan aparat penegak hukum.Metode penulisan demikian menggunakan perspektif ilmu hukum yang dikonsepsikan sebagai realitas. Oleh karenanya, kajian empiris atas Hukum Acara Pidana dipilih sebagai kajian yang memandang hukum sebagai kenyataan yang dilakukan oleh manusia. Kajian pada aspek manusia inilah yang akan meruntuhkan Hukum Acara Pidana yang disebut sebagai ‘hukum yang tiada tempat untuk menafsir’. Pembaruan hukum yang tidak sebatas mengkaji norma namun memfokuskan hingga ke tataran nilai demikian, pada akhirnya menemukan keseimbangan penegakan hukum dan perlindungan hak asasi manusia yang harus dipahami oleh para aparat penegak hukum dengan prophetic intelligence. Renewal of Criminal Procedure Law Through the Study of the Human Side of Law Enforcement Officers ABSTRACT: Reform the law on penal procedure can be done by searching the human dynamic and the human side of law enforcement officers. This writing method using the perspective of jurisprudence ia conceived as areality. Therefore, empirical studies on criminal procedural law chosen as the study that looked at the law as a reality that is done by humans. Thus studies of the human aspect, which further undermine the criminal procedural law known as the ‘law that has no place to interpret’. Legal reform is not limited to assessing the norm, but also focus up to the level of value, finally found a balance of law enforcement and the protection of human rights that must be understood by law enforcemeny officer with prophetic intelligence.

Abstract

ABSTRACT: In social life, the law has many functions. In this case the law became a tool in resolving the conflict in Aceh. The conflict in Aceh has long occurred. Several rounds of dialogue has been conducted, but has not achieved satisfactory results. Dialogue after the tsunami last December 26, 2004, facilitated the Crisis Management Institute (CMI), the conflicting parties and the Government of the Free Aceh Movement reached a peace agreement. In peace, produced a memorandum of understanding (MoU) signed in Helsinki on August 15, 2005, in which the MoU is to be hold in drafting a legislation for Aceh, which was then named the Law Number 11 Year 2006 on the Government of Aceh. Legal Form for Aceh Peace

Abstract

The concept of the creative economy revolves around fostering community participation and developing the micro, small, and medium enterprise (MSME) sector. This orientation is closely linked to the presence of Village-Owned Enterprises (BUMDes) institutions. However, legal challenges arise when separate regulations govern MSMEs and BUMDes, hindering the optimization of the creative economy within society. This article aims to address these legal issues by examining the integration of BUMDes and MSMEs to enhance the creative economy in Indonesia. Drawing on normative research, this article takes a conceptual and statutory approach to shed light on the matter. The findings affirm the need for specific legal policies that facilitate the integration of MSMEs and BUMDes, enabling them to collaborate and regulate their potential collectively. Special regulations should be established to govern the various aspects of integration, including the forms of integration, the fields that can be integrated, and the legal processes involved in developing the creative economy. By establishing comprehensive regulations, Indonesia can foster a conducive environment for the creative economy to thrive, promoting collaboration between MSMEs and BUMDes while harnessing their potential for societal development.

Abstract

Illegal fishing cases often occur in waters at the edge of Indonesia. This article is focused on examining and analyzing the synergy between the authorized institutions in the process of monitoring and handling illegal fishing cases that occur in the waters of Aceh province. This study uses a descriptive qualitative research design. The four authorized institutions coordinate the performance of each other to help each other's role to reduce illegal fishing violations in Aceh Province. LANAL Sabang helped mobilize forces to carry out law enforcement at sea from the threat of violations as well as to safeguard marine resources. PSDKP Lampulo is the foundation for supervising marine and fishery resources in Aceh Province. Panglima Laot has more authority in regulating laot customary law and fishing communities in general. DKP Aceh is the axis of the service and movement for the protection and utilization of marine resources in Aceh Province.
