Abstract

This study aims to determine the application of the final and binding principles in sharia economic dispute resolution through Basyarnas. This research method used empirical research with secondary and primary data. Secondary data was complemented by primary and secondary legal materials, while primary data was obtained through interviews. The data analysis was carried out in a descriptive qualitative manner. The results indicated that the final principle is applied to the settlement of sharia economic disputes through Basyarnas when the parties have received the sharia arbitration decision and do not object to the decision issued by Basyarnas, or when one of the parties submits an objection to the sharia arbitration decision, and the arbitrator re-signed the revised decision in accordance with Article 58 of Law Number 30 of 1999 and Article 20 of the 2017 Basyarnas Rules of Procedure. The final sharia arbitration decision will have binding power for the parties (binding) after the decision is registered with the Religious Court in accordance with the respondent’s regional laws.

Abstract

Artikel ini ingin menjawab permasalahan utama terkait pajak di daerah. Dengan menggunakan pendekatan normatif, dapat digambarkan bahwa era otonomi daerah, dikaitkan dengan pajak daerah melalui asas desentralisasi, pemerintah daerah diberikan kewenangan untuk memungut pajak daerah. Pajak tersebut dalam rangka meningkatkan pendapatan asli daerah dan menyelenggarakan serta membiayai pembangunan di daerah. Dasar hukum bagi pemerintah daerah untuk memungut pajak adalah Undang-Undang Pajak Daerah dan Retribusi Daerah. Selain itu, Pemerintah Daerah juga membentuk peraturan di daerah sebagai peraturan teknis dibidang pajak daerah dan retribusi daerah. Peraturan yang dibentuk di daerah disebut politik hukum, yang merupakan kebijakan hukum negara untuk mencapai tujuan nasionalnya dengan membentuk hukum untuk mengatur sesuatu hal yang berkaitan langsung dengan kepentingan nasional. Political Law of Regional Tax in Polewali Mandar District West Sulawesi This article aims to answer the main problems related to taxes in the region. This is a normative research, aiming to describe the regional autonomy era to be associated with regional taxes through decentralization principle, local governments are given the authority to collect regional taxes. The tax is used to increase local revenue and organize the finance development in the region. The legal basis for local governments to collect taxes is the Regional Tax Law and Regional Retribution. In addition, the Regional Government also established regulations in the region as technical regulations of regional taxes and regional retribution. Regulations established in the region are called legal politics, which are the state legal policies to achieve national goals by establishing laws to regulate issues related to national interests.

Abstract

ABSTRAK. Perekonomian kuat membutuhkan lembaga keuangan yang aman untuk melakukan berbagai aktivitas keuangan. Salah satunya dengan menggunakan elektronik banking atau lebih dikenal dengan internet banking yaitu pelayanan jasa bank yang memungkinkan nasabah memperoleh informasi, melakukan komunikasi dan transaksi perbankan, dengan cepat, serta dapat dilakukan dimana saja dan kapan saja. Transaksi internet banking juga dapat menimbulkan beberapa risiko, pasal 1 ayat (2) Peraturan Bank Indonesia Nomor 5/8/PBI/2003 tentang Penerapan Managemen Risiko bagi Bank Umum, yang menyebutkan bahwa risiko adanya potensi terjadinya peristiwa yang dapat menimbulkan kerugian, seperti risiko yang dialami oleh nasabah PT. BNIS dan PT. BCA. Merujuk Peraturan Bank Indonesia Nomor 10/10PBI/2008 tentang Penyelesaian Pengaduan, nasabah yang mengalami kerugian dapat mengajukan pengaduan ke bank. Perlindungan nababah dari segi hukum belum ada aturan terinci tentang internet banking, maka pihak bank melakukan perjanjian standar yang dibuat oleh pihak bank, perjanjian tersebut lebih mengutamakan kewajiban daripada hak nasabah. Responsibility to Customers Who Experience Bank Losses in The Use of Electronic Banking ABSTRACT. The strong development economy requires a bank as a financial institution that is safe for undertaking various financial activities.The positive impact of developments on financial services is the use of e-bankingis also known as internet banking is the bank services that enable customers to obtain information, communicate and conduct banking transactions through the internet, quickly, can be done anywhere and anytime. Internet banking transactions can also pose some risk, Article 1, paragraph (2) of Bank Indonesia Regulation No. 5/8/PBI/2003 on the Application of Risk Management for Commercial Bank said that the risk is the potential for the occurrence of an event  that can cause harm. Risks experienced by customers of PT. BNIS and PT. BCA. According to the Bank Indonesia Regulation Number 10/10/PBI/2008 on the Settlement of customer complaints,customers who suffered the financial  losses can lodge a complaint by means of submitting a complaint to the bank. The protection from a legal perspective rule has no detail rules yet about internet banking so bank makes initiave on internet banking terms and condition.The agreement prioritize customer client obligations rather than rights.

Abstract

ABSTRACT: Customary law of Aceh has a number of legal principles such as acceptable, accountability, non-discrimination/equality before the law; accessible to the public, win-win solution, consensus, transparency, competent, and presumption of innocence. The principles are not only found in Adat Law of Aceh but also in other civilized legal systems in the world. In practice, the principles are applied strictly (see the case of Sultan Iskandar Muda). Adat guidelines or legal procedure of Adat is badly needed by informal justice providers in order to have legal certainty. There are some reasons why the guide line is necessary; (1) during new order (35 years) central government denied the existence of adat law, (2) during the conflict era (30 years) Acehnese did not have enough opportunity to practice their customary law, and (3) most of you people today are head of village  and they do not have enough knowledge and experience on guide line of adat. The Application Guideline of Informal Justice in Aceh

Abstract

ABSTRACT: Convention on the Total Prohibition of Anti-Personnel Mines, was formed with a view to realizing the "Free Mine World ". Indonesia has ratified the convention, commonly known as the Ottawa Convention 1997 to the Undang-Undang Nomor 20 Tahun 2006. As a State Party, Indonesia is obliged to fulfill all the provisions of the convention and the most important is the commitment to protect every citizen from falling victim to anti-personnel mines. In armed conflict of Aceh, mines were used by both parties that the Government of the Republic of Indonesia and the Free Aceh Movement, indications are casualties is dominated by civilians after the armed conflict stopped. For these reasons, the parties are considered not to comply and execute its responsibility of each as intended conventions and International Humanitarian Law Principles. The reality is stands to reason, because the implementation of the state responsibility principle for the total prohibition anti-personnel mines are less than the maximum and seemed to slow. Abstract

The management of mineral and coal resources is affected by the shift in the paradigm of regional government administration, which now emphasizes aspects of regional autonomy. Law Number 23, 2014 concerning Regional Government, which genuinely adheres to the maxim of maximal regional autonomy, appears to be incompatible with Law Number 3, 2020 concerning the revision of Law Number 4, 2009 on Mineral and Coal Mining. In practice, this results in a variety of interpretations of the nature and significance of regional autonomy, which ultimately has repercussions for the management of mineral and coal resources. This research aims to investigate the significance and nature of regional autonomy in connection to the management of mineral and coal resources. This is doctrinal legal research and a philosophical approach is applied based on legal principles. The findings are the fundamental principles of managing mineral and coal resources in the future era of regional autonomy focuses on returning to the principle of being a state, which means that the use of mineral and coal resources must be in accordance with the ideals of the state outlined in paragraph 4 of the Preamble of the 1945 Constitution, aspects of environmental harmonization and spatial alignment and the application of the principle of proportionality in regulating government and local government authorities.

Abstract

Penelitian ini bertujuan mendeskripsikan pengaruh ajaran Islam dan pemisahan kekuasaan pada perumusan prinsip bone montete inda posala-sala. Penegakan hukum di Kesultanan Buton didasarkan pada prinsip kesetaraan di hadapan hukum yang disebut bone montete inda posala-sala. Penelitian ini merupakan penelitian yuridis normatif dengan menggunakan pendekatan konseptual dan pendekatan historis serta menggu-nakan data sekunder, yaitu bahan hukum primer dan bahan hukum sekunder. Hasil penelitian ini menunjukkan bahwa asas bone montete yinda posala-sala pada Kesultanan Buton dipengaruhi oleh ajaran Islam. Ini tampak dari ilmu tasawuf yang mendasari perumusan asas tersebut. Pemisahan kekuasaan di Kerajaan Buton turut mendukung implementasi asas bone montete yinda posala-sala. Fungsi peradilan yang dilaksanakan oleh sultan sebagai lembaga eksekutif diawasi Siolimbona sebagai lembaga legislatif. Direkomendasikan bahwa pemerintah mengadopsi nilai-nilai lokal dalam perumusan asas kesetaraan di hadapan hukum dan intensif mengkaji nilai-nilai lokal yang dapat berkontribusi dalam pengembangan hukum nasional. Bone Montete Inda Posala-Sala: Equality Before the Law in Buton Sultanate This research aims to describe the influence of Islamic teachings and the separation of powers in formulating the principle of “bone montete inda posala-sala”. Law enforcement in Butonese Sultanate is based on the equality before the law principle named “bone montete inda posala-sala”. This research apply normative juridical method by using conceptual and historical research based on secondary data namely primary and secondary legal materials. The results indicates that the principle of bone montete yinda posala-sala is influenced by Islamic teachings. This can be seen from the sufism that underlies the formulation of the principle. The separation of powers also supported the implementation of the principle. Judicial function under Sultan as an excecutive is supervised by Siolimbona as an legislative agency. It is recommended that the government should adopts local wisdoms in the formulation of the principle and intensively studies local values that can contribute to the development of national law.

Abstract

The Renewal and the development of the national legal system, including the criminal law and criminal procedure law, is one of the major issues on the political agenda in Indonesian law and should be done immediately. The concept of the New Criminal Code has been exposed, but until now it has not been completed with a variety of problems because there is no agreement in several aspects.  The Criminal Procedure Code is a masterpiece of Indonesia creation, it also needs to be harmonized with the development given the growing globalization of crime. Abstract

ABSTRACT: Protection against forest ecosystem conservation in Aceh Tamiang manggrove decreased. This can be seen from the policy of land conversion in the forest ecosystem manggrove. Local governments have issued policies on the conversion of mangrove forest ecosystems that are not in accordance with its provisions, the conversion of the ecosystem of the mangrove forest to plantations. In addition, the exploitation of the mangrove forest by the community to the needs of charcoal that has lasted a long time and generations as well as land clearing for aquaculture ponds also cause damage to mangrove ecosystems. The conversion of mangrove forests has led to the effect that should be shouldered by the public, which reduced the catch of fishermen, the pollution of mangrove forest ecosystems.  The Convertion of Mangrove Forest Ecosystem  in Aceh Tamiang District

ABSTRACT: Both province and regional may establish Regional or Provincial Company that can be formed as Regional Company or Limited Company. The establishment of such company shold be based on local regulation aiming to collect the revenue supporting the development and public facilities. The establishment of such company must be in obligatory implementation and optinal matter owned. The option is based on special patent owned by the area.
