Abstract

The arrival of refugees in Aceh province, specifically the Rohingya from other countries, initially received assistance from the Acehnese people while they were in the middle of the sea. However, in the following years, various challenges have arisen. As a response to this situation, Presidential Regulation No. 125 of 2016 was established to address the handling of refugees from abroad. This regulation highlights the role of the Central Government. However, there is currently no operational regulation from the local government regarding budgets, adaptation to customary values and local wisdom, and coordination with relevant institutions such as UNHCR, IOM, volunteers, police, and other organizations. It is crucial to establish Standard Operating Procedures that can serve as a reference for all parties involved in the process of locating, searching, and assisting refugees from abroad. Additionally, there is a need for the establishment of immigration detention centers in Aceh, as the current temporary shelters are only available in the cities of Lhokseumawe and North Aceh.

Abstract

The purpose of this research is to analyze the exclusion of monopoly by State Owned Enterprises (BUMN) based on the provisions of business competition law in the procurement of the Covid-19 vaccine by Bio Farma (Persero) Ltd. Indonesia is being hit by the Covid-19 outbreak. This condition has had a negative impact in various fields. To overcome this, one of the government's efforts is to bring in vaccines to prevent the spread, and the procurement of vaccines is given to Bio Farma Ltd. There are indications of monopoly actions in the procurement of Covid-19 vaccines by Bio Farma Ltd. This research uses the approach statute approach and conceptual approach. The technique of tracing legal materials uses field study techniques and document studies (library research), as well as study analysis is using qualitative analysis. The results of the research and the discus-sion show that the procurement process for the Covid-19 vaccine is strictly regulated by the government. Even the quantity, procurement, and distribution are coordinated by the government in this case through the assignment of SOEs (BUMN) as regulated in Presidential Regulation Number 99 of 2020 as amended by Presidential Regulation Number 14 of 2021. The results of the study show that the actions taken by SOEs (BUMN) in this case Bio Farma (Persero) Ltd in procuring the Covid-19 vaccine is included in the excluded monopoly category, because it meets the elements of the provisions in Article 50 paragraph a. Law Number 5 of 1999 concerning Prohibition of Monopolistic Practices and Unfair Business Competition.

Abstract

Berdasarkan Peraturan Bank Indonesia Nomor: 7/46/PBI/2005 tentang Akad Penghimpunan dan Penyaluran Dana Bagi Bank yang Melaksanakan Kegiatan Usaha berdasarkan Prinsip Syariah menyebutkan “Qard adalah suatu akad penyaluran dana oleh Bank Syariah atau Unit Usaha Syariah (UUS) kepada nasabah sebagai utang piutang dengan ketentuan bahwa nasabah wajib mengembalikan dana tersebut kepada Bank Syariah atau UUS pada waktu yang telah disepakati. Rahn emas Syariah atau qard beragun emas adalah produk di mana bank memberikan fasilitas pinjaman kepada nasabah dengan jaminan berupa barang/harta Nasabah yang bersangkutan dengan mengikuti prinsip rahn emas. Perkembangan produk qard beragun emas di mana bank syariah mulai mengombinasikan gadai dengan pembiayaan kepemilikan emas yang dikenal dengan beli gadai emas yang mengandung spekulatif. Hal ini mengakibatkan resiko terhadap bank timbulnya resiko terhadap perbankan syariah yaitu Market risk (resiko pasar), penurunan harga emas yang menyebabkan turunnya pengembalian investasi pemilik emas. Liquidity risk (risiko likuiditas), sulitnya menjual emas di saat harganya turun. kemudian Capital risk (risiko modal), kerugian karena penurunan harga emas dapat menambah kerugian bank dan berpotensi menurunkan Capital Adequet Ratio (CAR) atau rasio kecukupan modal. Credit risk (risiko kredit), penurunan harga emas berpotensi menunda ditebusnya kembali emas oleh nasabah debitur. Reputation risk (resiko reputasi), maraknya qard untuk rahn emas dan berkebun emas berpotensi menurunkan fungsi dan peran utama bank syariah dalam membiayai usaha produktif di sektor riil, mengingat prinsip kehati-hatian bank sehingga Bank Indonesia menghentikan kegiatan produk ini sementara waktu dengan menerbitkan Surat Edaran Bank Indonesia Nomor 14/7/DPbS  tanggal 29 februari 2012 tentang Produk Qard Beragun Emas bagi Bank Syariah dan Unit Usaha Syariah. Selanjutnya di singkat dengan SEBI 14/7/2012 karena menyalahi tujuan dan karakteristik dari produk qard beragun emas dan melanggar prinsip kehati-hatian bank (prudent banking principle) yang menimbulkan resiko terhadap perbankan syariah.  The Termination of Qard Gold-Warranty Practice Based on Bank Indonesia Letter Number 14/7/DPBS Year 2012 in Shariah Banking  Based on Bank Indonesia Regulation Number 7/46 / PBI / 2005 towards Agreement for Collection and Distribution of Funds for Banks Conducting Business according to Sharia Principles, stipulated that "Qard is a contract for the distribution of funds by Sharia Bank or Sharia Business Unit (UUS) to customers as debt receivables provided that the customer is required to refund the funds to the Sharia Bank or UUS at the agreed time. Sharia gold rahn or qard gold-warranty is a product in which the bank provides loan facilities to customers with warranty in the form of goods/property of its Customer by following the principle of gold rahn. Such goods/property are put under control and maintenance of the bank, and for its maintenance bank impose a rental fee on the basis of the Ijarah Principle. The development of qard gold-warranty products where sharia banks begin to combine mortgages/fiduciary/pledge with financing ownership of gold which also known as speculative gold-buying pledge. This matter create a risk to the bank so that Bank Indonesia ceased/terminated this product activity temporarily by issuing Bank Indonesia Letter Number 14/7 / DPbS dated 29 February 2012 onQard Gold-warranty Products for Shariah Bank and Shariah Business Unit. Furthermore, it is in brief stated as SEBI 14/7/2012 because it violates the purpose and characteristics of qard gold-warranty products and also infringing the prudent of banking principle which create a risk to sharia banking.

Abstract

ABSTRAK. Pemberian harta peunulang biasanya dilakukan pada saat peumengkleh, yang menurut adat terjadi dalam rumah tangga yaitu keluarga pihak orang tua dengan anak-anaknya yang lain dan keluarga anak perempuan dengan suami dan anak-anaknya. Ketika dilakukan peumengkleh, kepada anak perempuan tersebut diberikan harta oleh orang tuanya sebagai bekal membina rumah tangga baru. Bekal yang diberi tersebut, dalam bahasa Aceh disebut dengan peunelang. Semenjak peumengkleh dilaksanakan, saat itu juga sudah terjadi peralihan hak milik atas harta, yaitu dari orang tua isteri kepada anaknya. Harta ini menjadi hak milik anak perempuan sepenuhnya, sedangkan suami mengurusi dan menikmati hasilnya bersama isteri dan anak-anaknya. Kenyataan terjadi, bahwa sebagian masyarakat memberikan harta peunulang untuk anak perempuan lebih banyak dibandingkan dengan anak laki-laki sebelum harta warisan dibagi. Peralihan hak milik dari orang tua kepada anak perempuan lebih banyak dibandingkan dengan anak laki-laki tidak menimbulkan sengketa ketika orang tuanya masih hidup. Perselisihan baru timbul setelah orang tua yang telah memberikan hareuta peunulang meninggal dunia. Dari hasil penelitian diketahui sepanjang tahun 2007-2012 terdapat enam kasus perselisihan hareuta peunulang yang diselesaikan melalui Mahkamah Syar’iyah Banda Aceh dan empat kasus melalui keuchik tempat letaknya harta peunulang tersebut. An Analysis on Settling Inheritance in Accordance with Customary and Islamic Laws in Banda Aceh  ABSTRACT. The provision of inheritance is done through the separation, according to the custom happening in the family that is the parent and their children and the family of daughters, husband and children. When the separation is being conducted, the daughter is given the property by the parent as the capital for beginning the life. The property is called as peuneulang in Acehnese. Since it is being tranfeering, the assets are tranferred from the parent to the doughter. It belongs to her while a husband is managing the aseet for her wife and children. There is the fact that the doughter gets more property than the son before the assets shared. The transfer of the asset from the parents to the doughter has coused problem when the parent still alive. The problems arised when the parent die. The research shows that from 2007-2012 there are six cases of the assets dispute solved by Mahkamah Syariyah Banda Aceh and four cases through the head of village where the property placed.

Abstract

ABSTRACT: Article 175 (2) on the Islamic Law Compilation states that the responsibility of inheritor towards the loan belongs to bequeathor is limitted to amount of the inheritance property. In Islamic Law Compilation does not explain completely regarding the loan of the bequeathor that in what kind of loan will be the responsibility of the heirs. In practice, the dispute between the heirs and the people providing the loan. The loan between them happens without written roof of argument but the contract is mode vocally; hence causes the dispute between them. This article aims to explain the biews of the priest regarding the obligation of the heirs to pay the loan. The research shows that the obligation of the heirs to pay the loan must be paid first before the property divided to the based on each portion. Abstract

ABSTRACT: A district government is trying to attract authority of the governmental management into the region especially that can increase the original revenue shortly, for instance a forest management authority. Despite the Act Number 41, 1999 regarding Forestry has been passed but the Government Regulation has not followed it. Thus, the government has no any clear reference in determining the forest management in the area. District body can do the management independently and it can also be submitted to the third party in some kinds of management. The Regional Forestry Department as similar to other regional departments, even it has been joined with other departments, its duty seems administratively only. Thus, it requires the establishment of the Forest Management Unit that can manage the forest directly. The body is better established in sort of the United of Forest Authority that is divided into the Part of the United Forest Authority then minimizes into the Resort of Forestry Police and it is done for all forms or functions of forest area that is not submitted its management to the third party. Abstract

ABSTRAK: Pertimbangan mengenai hal-hal yang memberatkan dan meringankan putusan diatur dalam Pasal 197 huruf d dan 197 huruf f KUHAP. Dalam Pasal 197 huruf d  berbunyi “pertimbangan yang disusun secara ringkas mengenai fakta dan keadaan yang diperoleh dari pemeriksaan disidang yang menjadi dasar penentuan kesalahan terdakwa”, sedangkan Pasal 197 huruf f berbunyi pasal peraturan perundang-undangan yang menjadi dasar pemidanaan atau tindakan dan peraturan perundang-undangan yang menjadi dasar hukum dari putusan, disertai keadaan yang memberatkan dan meringankan terdakwa. Namun ada beberapa putusan hakim yang hanya mendasarkan pada hal-hal yang memberatkan atau meringan saja. Sehingga konsekuensi dari putusan tersebut dapat mengakibatkan putusan batal demi hukum.  Judge Consideration Regarding the Imposition of Punishment Relating to Criminate and Incriminate Decision ABSTRACT: Consideration in regard with criminate and incriminate is ruled in Article 197 d and 197 f of the Criminal Procedure Code. Article 197 letter d states "consideration compiled briefly about the facts and circumstances derived from the examination trial on which the determination of guilt of the accused", while Article 197 f stipulates chapter of the legislation that became the basis of criminal prosecution or action and legislation the legal basis of the decision, accompanied by aggravating circumstances and relieve the defendant. However, there are some verdicts only based on things that are burdensome or incriminate only. Thus, the consequences of such decision may result in a decision null and void.

Abstract

Teknologi koran digital di Indonesia kini membawa persoalan baru ketika hadirnya aturan hak melupakan secara implisit dalam Pasal 26 ayat (3) UU No 19/2016 tentang Informasi dan Transaksi Elektronik, yaitu terdapat kerugian yang dapat timbul tanpa disadari oleh calon mahasiswa yang memiliki rekam jejak tersangkut masalah hukum di Kota Makassar. Keadaan dilematis begitu cepat dirasakan ketika aturan baru ini diterapkan akibat sifat aturan belum memberikan petunjuk dalam aturan turunannya, dalam penerapannya cenderung hukum melahirkan sebuah masalah baru, yaitu kebijakan yang timbul mengacu pada rekam jejak calon mahasiswa. Karya ilmiah ini menggunakan metode sosio yuridis, yaitu data primer, dan dianalisis kualitatif. Hasil karya ilmiah ini menunjukkan bahwa calon mahasiswa yang penah menjalani putusan pengadilan dan terpublikasi dapat mengambil haknya untuk bebas memilih institusi pendidikan lanjutan, walaupun bersama pernyataan untuk tidak mengulangi perbuatan yang bertentangan dengan hukum. Harapan kedepannya agar tidak kembali menjadi aturan yang dapat menimbulkan masalah baru karena adanya benturan antar norma yang berlaku, sehingga tercipta aturan yang berkualitas dan dapat diterapkan. Legal Harmonization Rights to be Forgotten for Digital Newspaper of Students Candidates in Makassar Sustainability technology of digital newspaper in Indonesia as referred to in Article 26 paragraph (3) Law No. 19/2016 about Information and Electronic Transactions, that is not realized there is a loss for prospective students who have a problematic track record with the law in Makassar City. The situation became so quickly perceived dilemma because it has not given instructions in derivatives rules, in practice the new law arises, ie policies that arise at the track record of prospective students. This paper uses a me-thod socio-juridical, primary data, and analyzed qualitatively, and than will shows the prospective students who have had a court decision and publicly to take their right to freely choose the educational institution, even tought with a statement unrepeat unlawful act. The idea is not become repeated new rules making new problems because of a clash between prevailing norms, so as to manifest the rules of quality and can be applied.

Abstract

ABSTRACT: Arbitration is a forum for dispute resolution outside of court that has been chosen by the businesses. One of benefits and advantages has by the arbitration body is the force of law from a final decition (a decition the final level) and binding (binding both parties to the dispute). In the implementation of international award, Indonesia has ratified New York Convention in 1958 through Presidential Decree No. 34 of 1981 that authorizing the execution of foreign arbitration in Indonesia. In addition, through Act No. 30 of 1999, requires that the courts play an important role in the enforcement of international arbitration. Abstract

Daily workers often express concerns about whether their wages are sufficient to provide them with a decent standard of living. Government Regulation Number 36 of 2021 regarding Wages states that the calculation of minimum wage is determined based on economic and employment conditions, which differs from the previous regulation that emphasized setting the minimum wage according to a decent living standard. This change has had a significant impact on wage determination. This study aims to examine how the latest wage policy can contribute to ensuring a decent living for daily laborers in Indonesia. The study adopts a normative legal research method and provides analytical descriptive data. It involves analyzing legal materials and comparing them with the main issues at hand. The calculation of wages for daily laborers is based on factors such as working hours, working days, or work results. However, it is important to note that the mandatory wage component for daily workers is solely the minimum wage, excluding allowances and non-wage income components. This confirms that the current wage structure for daily workers falls short of meeting the needs of a decent life for both workers and their families, as it solely relies on working hours. Therefore, it is crucial to prioritize efforts to improve the standard of living for daily workers in Indonesia.
