Abstract

The development of information technology has significantly influenced the Indonesian judicial system. Courts have implemented digital services to improve efficiency, transparency, and public access to justice. Electronic court systems, online case registration, and digital hearings are examples of legal technology implementation in Indonesia. This study aims to analyze the utilization of information technology in legal services within Indonesian courts. The research uses a normative juridical method through statutory and conceptual approaches. The findings indicate that information technology has improved judicial administration and accelerated legal processes. However, challenges remain regarding digital infrastructure, cybersecurity, and public understanding of electronic legal services. The study concludes that strengthening digital infrastructure and legal literacy is necessary to optimize technology-based legal services in Indonesia.

Abstract

Legal professional ethics play an important role in maintaining integrity, justice, and public trust in law enforcement institutions. Ethical violations committed by legal professionals may weaken the credibility of the legal system and create injustice in society. This research aims to analyze the implementation of legal professional ethics in maintaining the integrity of law enforcement officials in Indonesia. The study uses a normative juridical method with statutory and conceptual approaches. The findings indicate that legal ethics are fundamental principles that guide judges, prosecutors, advocates, police officers, and other legal professionals in carrying out their duties responsibly. However, challenges such as corruption, abuse of authority, conflicts of interest, and weak supervision continue to affect ethical enforcement in legal practice. Strengthening ethical education, improving supervision systems, and enforcing professional codes of ethics are necessary to maintain the integrity of law enforcement institutions.

Abstract

Artificial Intelligence technology has significantly influenced the development of legal systems and law enforcement practices in Indonesia. The implementation of Artificial Intelligence in legal services offers efficiency, accuracy, and easier access to legal information. However, the use of Artificial Intelligence also creates legal and ethical challenges related to accountability, privacy, and legal certainty. This study aims to analyze the development of Artificial Intelligence in the Indonesian legal system. The research uses a normative juridical method with statutory and conceptual approaches. The findings reveal that Artificial Intelligence can improve the effectiveness of legal services and judicial administration. Nevertheless, Indonesia still lacks comprehensive regulations regarding the use of Artificial Intelligence in legal practice. Therefore, adaptive legal policies and stronger supervision mechanisms are required to ensure responsible technological implementation.

Abstract

This study aims to analyze the Supreme Court Decision Number 1699/K/Pid/2025 concerning fraud from the perspectives of positive law and Islamic criminal law. The study focuses on the legal considerations of the judges in categorizing the legal relationship between the defendant and the victim as a criminal act of fraud under Article 379a of the Indonesian Criminal Code, despite the existence of civil elements such as debt acknowledgment, partial payment, and installment agreements. This research employs normative juridical methods using statutory, conceptual, and case approaches. The legal materials consist of primary legal sources in the form of court decisions and legislation, as well as secondary legal sources including journals, books, and scientific articles published within the last five years. The findings indicate that the Supreme Court's decision remains debatable because there are doubts regarding the existence of criminal intent from the beginning of the transaction. From the perspective of positive law, the decision potentially contradicts the principles of legal certainty, ultimum remedium, and in dubio pro reo. Meanwhile, in Islamic criminal law, the case contains elements of syubhat due to the ambiguity between fraud and breach of contract, thus punishment should be avoided based on the principle of al-hudud tudra'u bisy-syubuhat. Therefore, settlement through civil mechanisms is considered more reflective of justice and legal benefit than criminal punishment.

Abstract

Labor migration causes some children to lose direct care from their biological parents so that childcare is transferred to surrogate families or Child Social Welfare Institutions (LKSA). The focus of this research is the implementation of the fulfillment of children's rights, alternative parenting mechanisms, and the relevance of the concept of the sakinah family in supporting the childcare of migrant families. This research is field research with a qualitative approach. The data was collected through observations, interviews, and documentation at the Social Service for Women's Empowerment and Child Protection of Lumajang Regency and LKSA under his guidance. The data were analyzed descriptive-analytically by relating field findings to the theory of childcare, fulfillment of children's rights, and the family of sakinah. The results of the study show that alternative parenting in Lumajang Regency is carried out through cooperation between families, local governments, communities, and LKSA to maintain the fulfillment of children's rights in the aspects of education, protection, health, emotional attention, and spiritual and moral development. LKSA implements a family-based parenting pattern through habituation of learning, worship, discipline, and daily mentoring. This study concludes that alternative parenting plays a role as a form of temporary protection as well as a means of character development for children of migrant families when the nuclear family is not able to carry out the parenting function optimally.

Abstract

This study aims to examine the legitimacy of strengthening the protection of women and children within Islamic family law through the perspective of the Maqashid Sharia Index as a normative and socio-legal evaluative framework. The study is motivated by the increasing complexity of issues affecting women and children, including domestic violence, child marriage, gender-based discrimination, and other forms of vulnerability that require a more comprehensive and welfare-oriented legal protection system. This research employs a qualitative approach using a library research method. Data were collected through documentation of primary sources, including legislation, Islamic family law literature, and classical and contemporary works on maqashid al-shariah, supported by secondary sources such as scholarly articles, research reports, and policy documents. Data were analyzed using content analysis and normative interpretation techniques. The findings reveal that strengthening the protection of women and children possesses strong legitimacy within Islamic family law because it aligns with the fundamental objectives of maqashid al-shariah, namely the protection of religion (hifz al-din), life (hifz al-nafs), intellect (hifz al-'aql), lineage (hifz al-nasl), wealth (hifz al-mal), and human dignity. Furthermore, the Maqashid Sharia Index provides an analytical framework for assessing the effectiveness of family law policies and practices in promoting justice, welfare, and the protection of vulnerable groups. This study highlights the importance of reformulating Islamic family law policies that are more responsive to the protection of women and children and suggests further research on developing empirical indicators of the Maqashid Sharia Index within the implementation of family law in Indonesia.

Abstract

This journal examines the comparative legal strength between authentic deeds and private deeds in the context of civil disputes. Authentic deeds, which are executed before a competent public official, possess full and binding evidentiary strength, unless proven otherwise. In contrast, private deeds only hold evidentiary value if their content and signatures are not disputed by the concerned parties. This. This research uses a normative juridical method with a legislative approach, a comparative approach, and a conceptual approach. The research shows that although Article 1338 paragraph (1) of the Civil Code sets the principle of freedom of contract, allowing parties to choose between written or oral forms and authentic or private deeds, this freedom is not absolute. Research shows that in civil cases, authentic deeds have a stronger legal standing compared to private deeds, especially in terms of their evidential strength.

Abstract

The Red and White Cooperative (Koperasi Merah Putih) is a strategic government policy aimed at strengthening the people's economy through community empowerment at the village and sub-district levels. This study aims to analyze the implementation of the Red and White Cooperative as an instrument of people-centered economic development and to identify the challenges arising from its implementation within the perspective of national law. This research employs a normative legal research method using statutory and conceptual approaches. Legal materials were collected through library research, including primary, secondary, and tertiary legal sources. The findings indicate that the Red and White Cooperative plays an important role in expanding access to productive economic activities, strengthening local economic institutions, and promoting equitable welfare. However, its implementation still faces several challenges, including regulatory disharmony, overlapping authority with Village-Owned Enterprises (BUMDes), limited human resource capacity, capital constraints, and inadequate supervision mechanisms. Therefore, strengthening regulations, institutional capacity, and supervisory systems is necessary to enhance the effectiveness of the Red and White Cooperative as an instrument of people-centered economic development in Indonesia.

Abstract

This study aims to examine the relationship between peer social support and self-disclosure among senior high school students in a pesantren (Islamic boarding school) setting in the Jabodetabek area. This research employed a quantitative correlational design with a sample of 208 students selected through purposive sampling. Data were collected using the Peer Social Support Scale developed based on Sarafino and Smith's (2014) theory, encompassing four dimensions (emotional, instrumental, informational, and appraisal support), and the Self-Disclosure Scale adapted from the Revised Self-Disclosure Scale (RSDS) by Wheeless (1976), measuring five dimensions (intent, amount, valence, depth/intimacy, and honesty/accuracy). Instrument validity was assessed through expert judgment and construct validity using Confirmatory Factor Analysis (CFA), while reliability was measured using Cronbach's Alpha (α = 0.950). Prior to correlation analysis, a normality test using the One-Sample Kolmogorov-Smirnov test revealed that the data were not normally distributed (p = 0.000 < 0.05); therefore, data were analyzed using Spearman's rank correlation. The results showed a significant positive relationship between peer social support and self-disclosure (r = 0.595; p = 0.000), indicating a moderate-to-strong relationship. These findings suggest that higher perceived peer social support corresponds to higher levels of self-disclosure among pesantren students. The findings have practical implications for Islamic Guidance and Counseling (BKPI) services, particularly in designing peer-based intervention programs to enhance students' self-disclosure and mental health in pesantren settings.

Abstract

The purpose of this study is to implement legal aid services for advocates at the Makale District Court and to find out the implementation of the role of advocates as providers of legal aid services at the Makale District Court has been carried out in accordance with statutory regulations. This study uses a normative juridical research type that is sourced from primary and secondary and tertiary, as well as an empirical juridical research type which is analyzed qualitatively by describing descriptively the results of the existing data. The results of the study are that the implementation of legal aid at the Makale District Court is carried out based on the principle that advocates are people who work in providing legal aid services inside and outside the court that are litigation or non-litigation, which is manifested in the interaction between advocates and clients in resolving legal problems, and the implementation of the function of an advocate at the Makale District Court is carried out through two main activities, namely as a potential person in the field of law, then an advocate is a legal service provider who receives compensation in the form of a fee or honorarium and advocates are within the scope of their ideals as law enforcers, so that pure advocates do not consider compensation in the form of fees/honorariums or provide free legal aid services for professional work in defending and assisting clients as recipients of legal services.
