International Journal of Nusantara Islam is a multi-disciplinary publication, dedicated to the scholarly study of all aspects of Islam and focused on Islamic studies, receives articles from researchers who have new and progressive issues on scholarly study of all aspects of Islam related to its teachings resources, thoughts, philosophy, geography, history, law, political science, economics, education, culture, anthropology, sociology, literature, Islamic propagation, communication, psychology, science and technology, international relations, environmental and developmental issues, as well as ethical questions related to scientific research available in the Nusantara territories i.e. Indonesia, Malaysia, Thailand, Brunei Darussalam, Singapore, Philippine, Timor-Leste, Myanmar, Vietnam and Laos. The journal also covers contemporary Islamic issues emerging in the Southeast Asia territories or countries. Abstract

Sharia-influenced regional regulations (perda sharia) are regulations or laws that are created by district governments and use Islamic moral teachings as a reference point. This article based on a qualitative research in two districts: Cianjur, West Java and Bulukumba South Sulawesi.  In general, perda sharia seeks to manage three aspects of public life: firstly, to eradicate moral and social problems such as prostitution, drinking alcohol and gambling; secondly, to enforce ritual observances among Muslims such as reading the Qur’an, attendance at Friday prayers and fasting during Ramadan, and thirdly, to govern the way people dress in the public sphere, especially in relation to head-veiling for the women.

Abstract

This research is motivated by the partnership dispute on financing contract between PT. Bank Sumut Syariah;Branch Padang sidimpuan and Rip. Ongku Sutan Harahap. its dispute was occurred after the customer death,and so on causing the termination of the financing installment, because the financing is not covered by the insurance, so the bank asks the heir to be responsible for completing the remaining installment of the financing. The settlement of the dispute is settled through a litigation under the agreement of both parties to the dispute. The results of this study obtained that, PT. Bank Sumut Syariah Branch of Padangsidimpuan has neglected to apply the principle of prudence in the musyarakah (partnership) financing contract, namely disbursing financing funds without first being insured. Therefore, the Panel of Judges of  Medan Religious Court granted the heirs' petition. But the decision was canceled by the Medan High Religious Court, because the Panel of Judges found a formal defect in the form of obscuur libel, error in persona, disqualification in person. The formal defect resulted in the lawsuit not being accepted or N.O. (Niet Ontvankelijk verklaard). With the verdict N.O (Niet Ontvankelijk verklaard), the case becomes the quo status, it means back to its original state. Thus, the partnership (musyarakah) financing contract will remain valid and binding on both parties, their rights and obligations must be implemented in accordance with the contract.

Abstract

This research is motivated by the existence of a standard contract which is a written agreement made or provided by one party, by including various contract clauses that have been standardized by one party without giving the other party the opportunity to negotiate them. The existence of a standard contract in the sharia business world is a pros and cons among the public, especially among legal experts, because in addition to making it easier and saving time, it is also considered to be against the principles of sharia, namely persecuting other parties. The theory used in this research is that the grand theory uses the rule of law theory; Middle Rangge Theory uses the Shahadah Theory from al-Syafi'i then the Social Juctice Theory; and the application theory uses a legal system supported by the theory of legal change. This study uses descriptive qualitative research, in collecting data, the authors use the method of observation, interviews and documentation using descriptive analysis to describe and describe the data obtained by using words or sentences that are separated according to the research data category in order to obtain a conclusion. The result of the research shows that the standard contract is legally valid because it has fulfilled the terms and conditions of contract in Islam which are marked by the signing of the standard contract by both parties as proof that both parties are equally pleased.

Abstract

Zakat has not been utilized intensively for the empowerment of mustaḥiq (zakat beneficiaries) in the form of productive economic business. The objective of the research was to analyze the level of mustaḥiqs’ business independency; to analyze dominant factors that influenced mustaḥiqs’ business independency, and to formulate an appropriate strategy to develop the mustaḥiqs’ business independency. The research has been carried out on 254 mustaḥiqs in Bogor Regency (66 mustaḥiqs engaged in vegetable production at Cibungbulang District, 85 mustaḥiqs in skewer business at Tenjolaya District, and 103 mustaḥiqs in shoe business at Taman Sari District). A census sampling, data collection through a questionnaire, an in-depth interview and observation were carried out in 2013. Data were analyzed descriptively and statistically, using structural equation model (SEM). The results of the research showed that: (1) the strategy of mustaḥiq empowerment could be carried out through strengthening the intrinsic motivation, training technical aspects, assisting business capital and assistance. Empowerment can be conducted synergically by the government (arrangement, service, and counseling), private sectors/State Owned Business (BUMN), higher education and community.

Abstract

This study aims to comprehensively explore the multifaceted nature of Tazkiyatun Nafs as a pathway to enhance intuition and prevent unethical behavior. Through a meticulous examination of the transformative potential inherent in Tazkiyatun Nafs, this research endeavors to shed light on how this spiritual practice can assist individuals in recognizing and overcoming negative inclinations that manifest within their own beings. The methodology employed in this study is a literature review, specifically adopting a library research design. The primary sources of data for this research consist of reputable scholarly books and journals. The findings of this study reveal the pivotal role of intuition in the acquisition of knowledge, serving as a complementary faculty to rational and sensory capacities, thereby forming a comprehensive wellspring of human understanding. Through intuition, individuals possess an inherent ability to safeguard themselves from various perils, independent of conscious deliberation. The cultivation of a robust intuition can be achieved through the practice of Tazkiyatun Nafs, a process of self-purification aimed at alleviating the afflictions of the heart that contaminate the essence of the soul.

Abstract

The threat of radicalism in the Pancasila state has become an important issue in Indonesia, various research and studies on the phenomenon of the development of radicalism against the disintegration of the nation. The radicalism movement as an ideology is not always marked by acts of violence, but can also be limited to an ideology that does not use violent means. The research method uses a qualitative approach, the analysis is carried out using a qualitative analysis method with descriptive decomposition. In this study, the author only describes and sees the condition of the object of research and analyzes by comparison or comparison of various books, articles, journals and data relating to the impact of radicalism on the disintegration of the nation. The results of the research show that the disintegration of the nation is a serious problem for the nation and state. Disintegration can trigger various conflicts that are even bigger and do not even rule out the possibility of giving birth to a new nation. Radicalism can be suppressed by bringing up an attitude of nationalism.

Abstract

The main key to quality education management is how to carry out good and quality education to give birth to a generation of people who have potential, abilities, talents that grow and develop in all areas of life so that they are able to compete globally. For the implementation of quality education (quality), quality organizational management is also needed, one of which is by implementing Total Quality Management. Efforts to standardize quality and guarantee the implementation of higher education must meet quality standards in an effort to maintain and improve the quality of education nationally. In general, the definition of quality assurance in higher education is: The process of establishing and fulfilling education quality standards consistently and continuously so that customers get satisfaction. The process to ensure that the quality of graduates is in accordance with the specified/promised competencies so that quality can be consistently maintained and continuously improved.

Abstract

West Sumatra owns a very prospective waqf asset. Yet, in general it has been managed traditionally. Only some counties have already implemented productive waqf management. This study examines the productive waqf management roles in empowering the ummah economy in West Sumatra including the supporting and inhibiting factors in implementing the productive waqf management in this province. This work is a qualitative descriptive study which verbalizes and analyzes the data holistically. The data of this research are collected from interviews and written documents. The purpose of this research is to analyze the role of productive waqf in empowering the ummah’s economy in West Sumatra as well as to elaborate the supporting and inhibiting factors in developing the waqf productive in West Sumatra. Business facilities provided by the waqf management institutions give communities more chances to get employed or to expand their businesses and gain more profits so increase their living standards as well. As a whole the waqf management in West Sumatra has gone well and got supported from most community members. The only obstacle is limited cash waqf so make it rather difficult to expand the waqf assets. Therefore in order to make the ummah economic empowerment on the basis of productive waqf becomes more effective, it is suggested that the waqf management institutions introduce a money waqf movement.

Abstract

Transnational ideology springs the faded attitude of state defends. On another side, state defend is always connected with the military. The concept of jihad (struggle) in the Qur’an can be understood as an obligation to defend the state at all levels. The obligation could be in the form of guarding unity and integrity, culturalizing of deliberation, struggling justice, and maintaining freedom. The obligation of state defends in the form of physical form could not be conducted whether individually or collectively. This obligation is performed only if a ruler commands to battle against, and when an enemy has besieged a region. If defending Indonesia's state is one of the requirements for the existence and glory of Muslims in materializing Islamic values and universal of humanity, so struggling for state defend is a condition sine qua non.

Abstract

This study aimed to analyze the influence of service quality on satisfaction and the impacts on loyalty intention of students Al Ma’soem Boarding School. The research data was obtained from primary data by distributing questionnaires to 100 students of junior high school and senior high school in Al Ma’soem Boarding School. The findings of this study indicate that there is influence between the Service quality and satisfaction  on the loyalty students in Al Ma’soem Boarding School. F test results showed that the Service quality and the satisfaction simultaneously affect to loyalty students in Al Ma’soem Boarding School. The R-square value obtained amounted to 0.417, or 41,7%, meaning that simultaneous Service quality and satisfaction contribute to the effect of 41,7% on loyalty students in Al Ma’soem Boarding School, as for the influence of others factors are 58,3%.
