Abstract

The relocation of the capital city is a strategic decision that can have significant impacts on the government's organizational structure and the management of national assets. This article aims to analyze the effects of capital relocation on the government's organizational structure and the management of national assets using a normative juridical approach and data collection through literature review. Through the analysis of various regulations, legal documents, and relevant theories, this article presents how capital relocation can affect the government's organizational structure. Additionally, the article also highlights aspects of national asset management related to capital relocation, such as the transfer of ownership and the management of infrastructure. Thus, this article contributes to the legal and administrative implications of capital relocation.

Abstract

The 1945 Constitution is the constitution and is the highest source of law for the unitary state of the Republic of Indonesia. The existence of the 1945 Constitution aims to protect and prosper the nation. Article 34 Paragraph 1 of the 1945 Constitution regulates the state's responsibility towards the poor and abandoned children, emphasizes the need for the government and society as a whole to act to ensure the welfare of children, aims to guarantee their welfare and protection, and emphasizes the importance of government and community participation in achieving the goal. Despite this, reality still shows that there are many neglected children in Indonesia, who face physical, psychological and social challenges. Neglected children are defined as children who do not have adequate protection and care, while the poor are those who live in extreme poverty without access to basic needs. While the constitution emphasizes protection and welfare for these groups, there are still many challenges in implementation. These problems are not only social in nature but also involve economic, political, cultural, educational, and legal aspects, thus requiring the active role of the government and multisectoral cooperation. This research uses documentation and literature review methods, as well as reviewing various related journals to evaluate the enforcement of the rights of the poor and abandoned children contained in article 34 paragraph 1.

Abstract

Merek merupakan tanda dan ciri-ciri yang melekat kepada barang dan jasa. Sebagai suatu bagian dari kekayaan intelektual, pemilik dari merek dagang mendapatkan hak eksklusif untuk melindungi merek dagangnya. Pelindungan yang diberikan terhadap merek dagang perlu dan layak untuk diimbangi dengan penggunaan asas itikad yang baik didalamnya. Pemerintah telah melindungi merek sebagai bagian dari kekayaan intelektual berdasarkan Undang-Undang Nomor 20 Tahun 2016, meskipun tantangan tetap ada seperti adanya tindak perundungan merek dagang. Perundungan merek dagang sudah cukup umum terjadi di Indonesia, namun belum ada pengaturan yang jelas untuk memberikan pelindungan kepada pegiat usaha dalam menghindari terjadinya tindak perundungan merek dagang. Metode penelitian yang digunakan adalah menggunakan pendekatan secara yuridis normatif dengan penggunaan studi dokumen atau bahan pustaka yang menggunakan data sekunder yang berupa bahan hukum primer, bahan hukum sekunder, dan bahan hukum tersier. Hasil penelitian menunjukkan bahwa berlakunya Undang-Undang Merek di Indonesia belum cukup melindungi pemilik merek dagang dari adanya praktik perundungan merek dagang, baik untuk pengusaha besar maupun terutama UMKM. Selain itu, hukum positif yang berlaku di Indonesia masih perlu mengatur secara lebih jelas terkait tindak perundungan merek dagang, dimulai dari kriteria dan indikator yang rasional serta implementasi asas itikad baik dalam pelindungan merek dagang.

Abstract

A legal system is a collection of rules that regulate society or government within a particular country. Each country has its own legal system to govern its administration, including Indonesia. Comparative civil law is an effort to study and analyze the differences and similarities in civil law systems across various countries. By comparing laws, we can understand the worldview and legal systems of other nations. The research method used in this study is the juridical-normative method, employing a statute approach and a comparative approach. The legal systems of Indonesia and the United States have different approaches to regulating contract law. Despite the differences in specific regulations, both legal systems aim to provide a clear and fair framework for the formation and enforcement of contracts. General principles such as freedom of contract, propriety, and legal certainty serve as the foundation of each legal system.

Abstract

This research was conducted to analyze how the law protects PKWT workers who are laid off before their contracts end, using a normative legal approach and qualitative research methods. The research results show that legal protection for PKWT workers for unilateral layoffs before the contract period ends is regulated in Law Number 13 of 2003 concerning Employment and Government Regulation Number 35 of 2021 concerning Specific Time Work Agreements, Outsourcing, Working Time and Rest Time, and Work termination. PKWT workers who are laid off unilaterally when the contract period has not yet expired, the company MUST provide compensation money to the PKWT worker as much as the remaining contract period in the contract agreement. Or giving severance pay/compensation if the PKWT worker has extended his contract with the company, but in the middle of the new contract being implemented the company lays off the worker. PKWT workers who are laid off unilaterally can take legal action to obtain their rights. Legal remedies that can be taken are through Bipartite, Conciliation or mediation, and the Industrial Relations Court.

Abstract

Security Management is a systematic process for managing and protecting organizational assets from various threats, both internal and external. TikTok Shop is a marketplace that is integrated with the TikTok social media platform, which has experienced rapid growth in the number of users and transactions. However, data security and consumer privacy are still key issues that have a significant influence on consumer behavior. This research aims to analyze how big a role security management plays in consumer behavior among users of the TikTok Shop marketplace based on the values contained in Pancasila. This research uses a qualitative method which is carried out by conducting a literature review of scientific articles, journals and books. The research results show that Pancasila has an important role, which refers to security management having an important role in shaping consumer perceptions and trust in TikTok Shop. The dimensions of data security and privacy, as well as ease of access to security information, are the main factors influencing consumer behavior. There are Pancasila values that play a role in Security Management and influence consumer behavior, such as; Security and Protection, Justice and Welfare, Order and Discipline, as well as Cooperation and Unity. By integrating Pancasila values in creating a better environment for TikTok Shop users. Increasing the transparency of security information and easy access to privacy information can increase consumers' positive perceptions of the platform.

Abstract

Korean culture has spread throughout the world, including Indonesia, which is one of the countries with the highest K-Pop fans. The rise of K-Pop fans in Indonesia presents music concerts as a place to bring fans together with their idols. K-Pop concerts held in a country are generally arranged by the promoter. However, sometimes promoters are negligent or deliberately commit criminal acts of fraud that harm fans who have bought concert tickets to watch their idols. The promoter's responsibility to fans must be carried out according to existing regulations. This research is aimed at finding out and analyzing criminal acts of fraud committed by the promoter of the K-Pop concert We All Are One who is a foreign citizen, as well as the responsibilities of a promoter towards his consumers.

Abstract

The state law and it’s application in cases of sexual abuse against women and children are covered in this publication. The aim of this research is to determine the methods used to prevent and combat sexual violence as well as the way in which the supremacy legal system is implemented in these situations. A review of the relevant literature and data analysis from a variety of sources are the methods of analysis employed. The findings demonstrate that the rule of law, through legislation, rules, and efficient execution of the law, has a significant benefit in application of the law to situations of sexual violence. Public awareness and education are also crucial components in the fight against sexual harassment. The research’s implications include the necessity of cooperation between the community, law enforcement, and the legal system in order to avoid and uphold the law against sexual harassment cases and ensure that everyone lives in a safe and equitable environment.

Abstract

Plurality in Indonesia is not a new problem, but something that has existed for a long time. Indonesia was built from a nation-state structure that cannot avoid the inevitability of diversity. History has written its reality through the form of Indonesian independence as a result of working together from the pluralistic strength of this nation. This research is a library research (Library Research) which aims to analyze the form of harmonization of plurality within the frame of Islamic law in Indonesia and the implementation of plurality within the frame of Islamic law in Indonesia. In this research, the authors used a normative approach, namely an approach with the aim of finding plurality in Indonesia, so that it is hoped that they can analyze the form of harmonization and implementation of plurality within the framework of Islamic law in Indonesia. Based on the research results, the form of harmonization of plurality within the framework of Islamic law is emphasized in QS. al-Hujurat/33. Islam does not deny plurality in society, because plurality itself is considered something that is God's law. The plurality of religions that have existed for a long time in Indonesia should be accepted by all religious adherents if we want to create a harmonious, harmonious and peaceful nation even though theology is different. In terms of implementation, it can be seen from the presence of religious tolerance in Indonesia. Recognition of religious, ethnic and racial diversity in Islamic law will create an inclusive and fair foundation for all Indonesian citizens. If the understanding and implementation of plurality within the framework of Islamic law is successfully achieved, then society will experience progress towards harmony and justice.

Abstract

The BLT Program is a government effort to reduce poverty levels and improve social welfare by providing financial assistance to economically disadvantaged and vulnerable families. This study aims to assess the effectiveness of implementing the BLT Program in achieving these objectives, as well as to explore the correlation between this policy and Indonesia's legal framework in the context of achieving Sustainable Development Goal (SDG) No. 16, which pertains to peace, justice, and institutional strengthening. The method used is a literature review with a descriptive analytical approach, examining secondary data from various reliable sources. Findings from this research indicate that while BLT helps alleviate the burden on impoverished communities, there are challenges in its implementation, including delays in distribution and inaccuracies in target determination. To optimize the benefits of BLT, improvements in distribution mechanisms, inter-agency coordination, and stricter monitoring are necessary.
