Abstract

The principle of non-discrimination constitutes a fundamental pillar of the international trading system governed by the World Trade Organization (WTO), aiming to ensure fair and open competition among its members. Nevertheless, the application of this principle faces challenges when states employ State Trading Enterprises (STEs) as policy instruments in strategic sectors, including energy. This study seeks to analyze the regulation of State Trading Enterprises within the WTO framework, particularly concerning the obligation to comply with the non-discrimination principle, and to examine the potential inconsistency of energy trade policies implemented by PT Pertamina (Persero) with this principle. This research adopts a normative legal research method, utilizing statutory and conceptual approaches through an examination of WTO provisions, especially Article XVII of the General Agreement on Tariffs and Trade 1994, along with international trade law doctrines. The findings indicate that the existence of State Trading Enterprises is recognized under the WTO system; however, their trading activities remain subject to the obligation to act in a non-discriminatory manner and based on commercial considerations. While state assignments to Pertamina are primarily intended to safeguard national energy security, such policies may give rise to potential implications for the WTO non-discrimination principle if not implemented transparently and objectively. Accordingly, a balance between national interests and international obligations is essential to ensure compliance with the multilateral trading regime.

Abstract

This study examines Indonesia’s anti-dumping policy as an effort to protect domestic industries from unfair trade practices that significantly harm developing countries. The issue analyzed concerns the effectiveness of the Indonesian Anti-Dumping Committee (KADI) in conducting investigations and enforcing policies in accordance with WTO regulations. The research employs a normative legal approach through an analysis of legislation and principles of international trade. The findings show that Indonesia possesses an adequate legal framework, yet its implementation remains limited due to coordination challenges, investigative capacity constraints, and pressure from developed countries that often use anti-dumping instruments as tools of protectionism. The study concludes that strengthening KADI’s role, ensuring transparency in investigations, and enhancing governmental support are necessary. It is recommended to improve industrial capacity, harmonize regulations, and reinforce trade diplomacy.

Abstract

This research examines how the powers of the United Nations Security Council influence the independence of the International Criminal Court and how redesigning these powers can strengthen the integrity of the ICC as an international criminal justice institution. The core problem of the study lies in the tension between the ICC’s universal legal mandate and the Security Council’s referral and deferral mechanisms, which are often shaped by the political interests of major powers. The objective of the research is to analyze the impact of Security Council authority on ICC independence and to formulate a redesign model that is more objective and accountable. The study employs a normative juridical approach by analyzing the Rome Statute, the UN Charter, academic literature, and international legal documents. The findings conclude that reforms to the referral mechanism, deferral authority, and the use of the veto are necessary for the ICC to operate more independently without political pressure at the global level.

Abstract

The digitalization of the tourism industry through Online Travel Agent (OTA) platforms has led to the widespread use of non-refundable standard clauses in hotel bookings, in which consumer payments cannot be returned in the event of cancellation. These clauses raise legal concerns because they are unilateral in nature and potentially violate the principle of contractual balance. This normative (doctrinal) legal research aims to analyze the pattern of applying non-refundable clauses that are considered detrimental to consumers and to assess their compliance with the principles of transparency and clear information as regulated in Law Number 8 of 1999 on Consumer Protection (UUPK). The results and discussion show that non-refundable clauses are often applied rigidly and absolutely, even in cases of cancellations caused by system errors or force majeure, which substantively reduces consumer rights and potentially conflicts with Article 18 of the UUPK. In addition, the presentation of non-refundable information that is not prominent or is vague on digital platforms leads to consumer consent that is not based on full awareness, violating consumers’ rights to accurate, clear, and honest information (Articles 4 and 7 of the UUPK). It is concluded that the validity of such clauses highly depends on the transparency of information and the good faith of business actors. There is a need for regulatory reinforcement and industry standards that guarantee consumers’ rights to obtain fair refunds under certain conditions.

Abstract

Technological development has transformed many aspects of human life and provided innovations that significantly improve efficiency and convenience. However, the rapid digitalization of society has increased the vulnerability of personal data to cyberattacks and unauthorized access. In Indonesia, public concern over data security escalated following a series of massive data breaches in August 2022, allegedly carried out by an anonymous hacker known as Bjorka. One of the most alarming incidents was the leakage of sensitive data belonging to the Indonesian National Police, revealing critical weaknesses in national cybersecurity systems.This case triggered public distrust and highlighted the urgent need for stronger data protection mechanisms at the state level. Although the government enacted Law Number 27 of 2025 on Personal Data Protection as a legal framework for safeguarding citizens' information, enforcement and implementation remain major challenges. This study aims to analyze the cybersecurity vulnerabilities exposed by the Polri data breach and evaluate Indonesia’s readiness to respond to increasingly complex cyber threats. The research emphasizes the importance of strengthening cybersecurity infrastructure, improving digital literacy, and enhancing regulatory oversight to build a secure, transparent, and trustworthy digital ecosystem.

Abstract

The imbalance of power between majority and minority shareholders in Indonesian private companies creates significant opportunities for majority shareholders to exercise their rights in a manner detrimental to minority interests. Various jurisdictions have addressed this issue through substantive mechanisms such as the oppression remedy, exemplified by Singapore’s Section 216 of the Companies Act, which employs a standard of commercial fairness to determine whether majority conduct though formally compliant constitutes oppressive or unfairly prejudicial treatment. However, Indonesia has not adopted a similar doctrine; minority protection remains procedural under Law No. 40/2007, which does not directly regulate majority oppression. This study employs doctrinal legal research using conceptual, comparative, and statutory approaches to examine forms of majority shareholder abuse and evaluate the adequacy of existing protections. The findings show that Indonesia’s mechanisms remain limited to correcting formal violations, whereas Singapore provides substantive and flexible remedies, including buy-out orders, through broad judicial discretion. The study concludes that Indonesia must strengthen its substantive legal framework to offer more effective protection for minority shareholders.

Abstract

Kemunculan media sosial sebagai ruang ekonomi baru membuat pekerjaan sebagai content creator semakin diminati, terutama di TikTok yang menawarkan peluang kerja sama promosi atau endorsement. Fenomena ini memunculkan pertanyaan mengenai bentuk transaksi jasa tersebut ketika dilihat dari perspektif Hukum Ekonomi Syariah, terutama terkait penerapan akad ijarah dan kemungkinan adanya unsur gharar dalam proses kerja sama. Penelitian ini dilakukan untuk memahami bagaimana mekanisme endorsement dijalankan oleh dua content creator, yaitu Arya Zikri Maulana Latif dan Makhyatul Fikriya, serta menilai apakah praktik tersebut sesuai dengan prinsip muamalah. Fokus penelitian diarahkan pada cara mereka menerima kerja sama, bentuk kesepakatan yang terjadi, dan bagaimana pembayaran diatur. Metode penelitian yang digunakan adalah kualitatif deskriptif melalui wawancara, pengumpulan dokumen, dan telaah literatur. Analisis dilakukan melalui proses pengelompokan data, pemaknaan temuan, dan penarikan kesimpulan. Hasil penelitian menunjukkan bahwa kerja sama endorsement yang dilakukan kedua informan pada dasarnya memenuhi unsur dasar akad ijarah, seperti adanya jasa yang jelas, kesepakatan antara pihak, dan penentuan upah. Meskipun demikian, mekanisme Arya yang lebih informal masih menyisakan potensi ketidakjelasan, sedangkan sistem kerja sama Makhyatul yang melibatkan admin dan perjanjian tertulis cenderung lebih aman dari sisi syariah. Secara umum, praktik endorsement keduanya dapat dikategorikan sejalan dengan prinsip Hukum Ekonomi Syariah.

Abstract

This study aims to examine the legal considerations applied by the Sidoarjo District Court, the Surabaya High Court, and the Supreme Court in resolving a land sale and purchase dispute between H. Suudhi and PT Jatarupa Prakarsa Jaya, as well as to analyze the impact of Supreme Court Decision No. 1557 K/Pdt/2019 on legal certainty in land sale and purchase agreements. This research employs a normative juridical method with statutory and case approaches. The findings indicate that the Supreme Court declared PT Jatarupa Prakarsa Jaya to be in default (wanprestasi) for failing to fulfill its obligations as stated in the Sale and purchase Binding Agreement (PPJB). The decision emphasizes that a PPJB executed legally before a notary possesses binding legal force and provides protection to parties acting in good faith, even though it does not yet result in a formal transfer of ownership as in a Sale and Purchase Deed (AJB). The implications of this ruling reinforce the application of the pacta sunt servanda principle and strengthen legal certainty in land sale and purchase practices in Indonesia.

Abstract

This study analyzes how fair competition obligations within the WTO framework affect the position and protection of SMEs in developing countries. Although the WTO adopts the principle of non-discrimination to create equal competition, structural constraints faced by SMEs, such as limited capital, technology, and access to information, result in equality that is merely formal rather than substantive. International trade instruments such as the SCM Agreement, anti-dumping measures, non-tariff barriers, and the weak effectiveness of Special and Differential Treatment restrict the policy space of developing countries to protect their SMEs. This study also formulates a model for strengthening policies through affirmative approaches, including asymmetric competition law enforcement, subsidy reformulation, trade facilitation, and the integration of SMEs into global value chains and the digital economy. The findings demonstrate that comprehensive domestic and international regulatory reforms are necessary to ensure that fair competition truly creates substantive justice for SMEs.

Abstract

International trade is a vital element for global economic growth, but on the other hand, it opens up opportunities for unfair trade practices such as dumping that can harm domestic industries. To address this, the World Trade Organization (WTO) established the Anti-Dumping Agreement (ADA) as a guideline for implementing anti-dumping policies among member countries. This agreement regulates the basic principles, investigation procedures, and mechanisms for imposing anti-dumping duties to maintain healthy competition and fairness between countries. Indonesia, as a WTO member, has ratified these provisions through Law Number 7 of 1994 and implemented them in various national regulations such as Law Number 7 of 2014 concerning Trade, Government Regulation Number 34 of 2011, and Minister of Trade Regulation Number 75 of 2022, which regulates the role of the Indonesian Anti-Dumping Committee (KADI). Although Indonesia has a clear legal basis and implementation mechanism, the effectiveness of anti-dumping policies still faces challenges such as limited resources, the complexity of the investigation process, and the increasing practice of circumvention dumping. Therefore, it is necessary to strengthen institutional capacity, procedural transparency, and cross-sector coordination so that anti-dumping policies in Indonesia can be implemented effectively, fairly, and in line with the principles of international trade within the WTO framework.
